It depends on the type of case, VSC is so far behind they're transferring some of their IR-1/CR-1 cases to CSC. I have seen a lot of K-1 petitions get processed a lot more quicker than the other petitions for those who are already married. You might want to call and check up on it if you haven't yet because from the my personal experience, I had to call for about 75 -90 % of my information/updates (still pending, receipt numbers, still pending, whether or not petitions were expedited, still pending, a bunch of well I don't have access to that info or I don't know, still pending, answering a bunch or useless questions they ask over and over and over again, and oh did I mention still pending) rather than getting the proper documents through mail, emails, and the USCIS website as they say we're suppose to get. I wish you and your fiance(e) the best of luck on your case.

Let me explain our situation. I am Italian and my wife is American. We got married in Miami in sept 08 and we filed for a visa CR1 as shown in our timeline.
We already got the NOA1 and the forms are at VSC. Our case is not visible online yet and when we called USCIS they said the case will be visible in 30/60 days!!!! and that VSC is now processing the filing of feb 08,

What exactly is the I-129 and can be applied to our specific case?

I travelled to the US yesterday from Milan (Italy) to Atlanta. We are on the CR1 process and we got the NOA1. There was not problem at the custom. I did not bring any evidence of bond to my home country. The agent just asked few question but not related to the visa process. He only asked why i was going to the US (tourist), when i was in US last time (september 08) what was my job (engineer for an US corporation)

We have been reading the guide on "how to do at NVC"
Enclosed the list of documents we need:


FROM PETITIONER (Components for I-864 AOS Package) :

? IRS Tax information - 1 year is required up to 3 years may help.

We are waiting for the NOA2 and my wife quit her job to come to stay with me in Italy for a while. For this reason we cannot provide:
- Pay stubs for current year (6 months)

What can we do? Is that a problem?

Same situation for my husband and I. He's a professional and cannot be out of work for 90 days 'waiting." We married 8/31/07 in Chicago, he flew back to Madrid. We filed CR-1 papers in October 2007, and we have just visited each other back and forth while we went through the process. His final interview is scheduled for July 9, 2008 in Madrid. Not too bad of a wait (for us).

So then to answer your questions above:
- Yes you can go and visit, since Italy is part of the Visa Waiver Program. However, bring STRONG ties to your homecountry when you cross the border into USA, because there is always a risk (very slight) of them turning you away. Things like a letter from your employer, calendar, mortgage or rent contracts, child support contracts, etc.

- Your interview will be at the American embassy in Italy

- No you don't have to both attend, but it probably shows more of a "bona fide" marriage, don't you think? I plan to be there for my husband's interview.

I agree but you'd be amazed and just how many people have great difficulty filling them out properly.

YAP! Speaks the truth, so many delays due to improper filings. But you will be fine. Take it step by step and stay on the forum, we will gladly help you. I filed the I-130 after marriage.


An attorney I know makes all of his money by handling cases that people have filed on their own - and messed up. He charges a premium, far more than he would have charged if they had came to him before messing up the file. If it isn't there mistake, he charges less. But, most of the time? It is your own damned fault. Little mistakes can hang you.

For example - moving and then filing a Naturalization Petition in less than 3 months after moving. You may as well ditch the petition and refile, it's just not worth fighting - but it can be fought. What's worse is when you move, but CIS doesn't believe you on the date you said you moved - so thinks it fell in that 3 month window . . . then you refile, and they use the first denial as basis for a second denial because they still dont' believe you have moved... So you finally get an attorney, just to find out . . . oh darn, you shouldn't have filed so soon or you should have established the dates better...

People make stupid mistakes. Attorneys make really stupid mistakes - but you can sue them for it wink.gif if you can prove it.



Thanks for the advice but i think for the I-130 and G-325 there's no need of a lawyer. The forms are pretty simple.
I don't know how ill be the following forms.

By the way if there's nothing to be written in the I-130 what do we put:
- comma "11. Name(s) of Prior Husband(s)/Wive(s)/ 12. Date(s) Marriage(s) Ended/ 17. List husband/wife and all children of your relative." none of us have been married before. So should we pute NONE?
- comma "18. Address in the United States where your relative intends to live." She's living in Miami but being originally from north we would like to go back north and live in NY. What do we have to put?

- I mean when we do not have anything to fill the blank what we write?

I am reading the guide:

"I want to marry my fiance/fiancee who is here in the US on a visa, can I marry him/her here in the U.S, and if I do, will he/she be sent back to his/her home country until the I-130 is approved??
If your fiance/fiancee is currently in the U.S legally on any type of visa other than the J-1 visa (the J-1 requires a waiver), and you are a U.S citizen, then you CAN marry him/her, and he/she will NOT be sent back to his/her home country unless the marriage took place while the spouse was under deportation or if your fiance/fiancee came to the US on a tourist visa with the intent of immigration and marriage. (This is considered immigration fraud.)

However, you must immediately file your I-130 along with forms I-485 and I-765. If your fiance/fiancee DID come to the US on a tourist visa with the intent of immigration and marriage, and you are not yet married, then he/she should return to his/her home abroad, and the K-1 visa should be filed instead of the I-130 to avoid a denial or deportation."
