I am the beneficiary and I am actually going to be filling out the forms and have more knowledge of all of this, so my spouse, the sponsor, is going to just sign what I send him, and send or email me details each time we get a notice of action.

In this case, do we need to fill out the DS-3032? From what I can see, it is only for those who's USC spouse (sponsor) is filling out all the forms for the beneficiary as well.

as a new member to the forum, i am finding my way and i apologise if i have started threads that were already started etc.. but sometimes it is hard to do a search when you dont know the correct acronyms for various procedures yet. now i am a bit more clued up on it, i will try not to start irrelevent or double threads... someone else already picked me up on this today and i really appreciate your post about this as i dont feel so bullied when it is something that is brought up to help new people to the boards like myself, rather than drive us away.

i am a pretty clued in person, and will learn my way on my own if need be, but its so nice to have the help of those further along.

i will remember the rules and try to abide by them..

i think that was explained by the sounds of it. they thought submitting in English would be better.

You know, you never know with NVC. My guess is that since the dates aren't going to match there could be a problem. May I ask why you didn't submit the original, when the instructions say they want originals?

brnidokiegurl I did not get any of our documents back sad.gif I was under the understanding that the originals would be returned to the petitioner but that was not the case with mine. I paid for each original and felt like my whole past was in that envelope. UGH! And that envelope that they give the recipient to bring with them to the USA (some say it contains your originals) they just took it from my husband and that was the end of it. I was dissoppointed


you poor thing that's terrible...

I'm going to make sure I request an extra marriage certificate before I send mine off... I don't want to risk losing mine!!!

i am doing the CR-1, i too was confused between that and the K3 but now i know what is best for us.

i am expecting to be apart from the hubby for a long while, but hoping it will be as swift as possible from my end at least. i want to make sure ahead of time i am full of information and knowledge to get things moving from my end!!

approval can take anywhere up to a year before they have to make a decision or else it expires.
(ours took exactly a year)
then the case is sent to NVC once it is approved and there you have to pay a $70 fee for the AOS form i-864 which is completed by the petitioner and along with those you send in your financial docs. inclusive of taxes, bank statements, etc etc If you as the primary sponsor fall below the 125%above poverty category you need a co sponsor and their documents as well. the beneficiary has to complete the DS3032 (you mentioned in your other post) stating who they wish to choose as an agent for further correspondance. preferably a person residing in the US. This could be the petitioner as well as a 3rd person.
(we chose my father who is living in the US and added my hubby, my fathers, and my email addy and we all got all emails)
Then the Beneficiary pays a $400 fee for the IV (immigrant visa) and completes the DS230 part I and II forms and sends in a copy of their valid passport, 2 photos, police certificates for any country they have lived in for over 6 months after turning 16, marriage certificate, and any divorce ones if applicable...
Once NVC has all the complete documents they complete the case and schedule and interview.
Once they have an interview date they send out an interview letter via email and you are to wait for the interview.

Hi All!

I have only just sent in my I-130 last week to Chicago, and although I have read and read enough on here and the wikis and the Embassy websites to last a lifetime, I really am looking for stories on people who have done it, or are further along than me.

I know there are people who are further along, who have their NOA1 and then those who have their NOA2 as well.

I know I can see timelines on here too, but can anyone give me a brief overview of what happened after the I-130 stage, when it comes back, do they send you paperwork and instructions on what to do next? Do you then send the next lot of paperwork somewhere else and then you get a NOA2 and then the spouse which is not the USC gets an interview?

I really am after something in dummy terms, in simple 1. 2. 3. 4. kind of terms. I know it is not that easy, but all going well... what happens next when I get a letter about the I-130 being approved?

Usually we get things certified at a police station or by a justice of the peace.. Is there a rule around this?

i sent plane ticket stub photocopies of when i went to the US and when hubby visited Australia.

i also sent about 6 photos of us together and one of our wedding day and our rings.

i sent a letter from his parents as an AOS.

i lastly sent in a letter from the bank of our joint bank account in Australia where he stayed with me for 5 months. i still use this as a daily bank account and he uses it if he needs money from it.

my package was precise and neat and quite small. i didn't feel the need to send in heaps of info as i am confident in our union and our information given.

i got a NOA1 within a week of the I-130 being sent in. yaaay!

i think 20 is good if it works for you! especially seeing as you dont have much else in the way of info.

i had a thought, do you have receipts for wedding rings or anything? or your invites, if you did have a traditional kind of wedding? they would help.

i got married in a court house, so didnt have any of that, but i had a receipt for our wedding bands.

i was in a similar situation though i was able to get a joint account when my hubby visited me in australia.

i would use lots of pics, and emails and letters if you have them. i picked out the lovey dovey emails (3 or 4) from when we first fell in love, and then some from when we were excited about getting married, or meeting or whatever. also plane ticket stubs if you have them?

oh yes!! also, get a letter of support from a friend or family member? i got one from my USC hubbys parents. i just got my NOA1 back.

hmm this is a hard one.

i too would have loved to do that, just disappear, but couldnt.

i went to the US on my own (no kids) and i was on a visitor visa and i told LAX customs i was "visiting friends and tourist stuff" and i got through, and then i married my USC boyfriend, and i could have applied to stay i am guessing, but i didnt want to do the wrong thing or risk getting kicked out of the US so i came back to Australia, and now i am filing a CR-1 as his wife to go over. it will take months, but i didnt want to risk staying in the US.

i think on a visitor visa, or the visa waiver, like what i had, you COULD do it, i mean, go into the country and stay after marrying, but with a young child also? i am not sure.

you need to get advice, and i hope someone here can give you it. i feel for you, i know what it is like being in a situation like you are. i just worry if you come over as a "visitor" with your child that the customs people might know and you will get into trouble. a girlfriend of mine did it, and she was already married to a USC, and the only reason customs let her in was because she was in an interview room at LAX for 3 hours and her son had an epileptic fit!!!

Can I just say I feel really sorry for the girl who sponsored the k1 in the first place, unless that was fraud too?

I feel so sad thinking time is wasted on frauds when we are all trying honestly to be with our loved ones and being apart so long to do it the honest way.

And as for the ticket, I was actually going to go back April 2009 - but got refused for a 12 month visa... and then couldn't use the visa waiver *I'd already purchased the ticket* So since then I've been changing my ticket since waiting for the fiance visa.

The consulate that denied my visitors visa actually suggested i go for the k1 visa. We looked into it and decided we wanted to close the distance.

And I just found out I can get phone records from two years ago. *Now I feel grateful that sometimes i was lazy and didn't use a phonecard*

I'm harassing friends to write letters detailing the relationship.

Ahh I just want to be there already :(

So I went to the Sydney consulate, and fist checked in all the documents with the gentlemen at the counter.
He took everything. looked pleased and handed it back. I also saw him stamp an approved form. He said you'll have to pack warm seeing as Chicago gets really cold. And then he said oh congratulations *big smile also*.

But then when I came to the actual interveiw things were fine until the consulate asked when i'd last seen my hubby. I explained it's been since dec2008 because firstly i got denied a visitors visa and then couldn't use the visa waiver to go visit him. And then we were waiting for the fiance visa to come through so we decided to wait on that.
Vick also changed jobs during that time so he couldn't take vacation time and then later wanted to save it for the actual wedding.
I was really nervous and I think I looked it too.
She also went out of her booth to complain to the gentelmen about the approved form in the file. *#######*

I brought maybe about six photos with me, two letters and a birthday card but she didn't take it.

initially she just wanted information that we've stayed in contact between the time we've been apart.
But on the denial form she's asked for information from 2007-2010. So I'm going to hopefully dig up phone logs from that long ago with the phone companies. We have a social networking site we use to contact each other. But we both don't keep msn logs. *deep sigh*
My ticket is for 30th of may also.
This sucks. We've waited way too long. :( :( :(

The reason I mentioned the military was just from what I have seen on a few posts and whenever I call USCIS, they always ask me if I am military or not. Maybe there is nothing to it, but as I said, even if there was, I wouldnt really mind.

My expedite request is for basically the same reason, but my child is not yet born yet. However the doctors found an irregularity on the fetal stem crying.gif , so I am trying to expedite the request so her and our child can get the best medical treatment.

Since they expedited your request out of the service center, did they tell you about next steps yet? Are you call each place to expedite the next steps? I am kind of wondering after CSC if I need to keep calling at each stage to request the expedite.

I have no idea, we haven't been told much. We both received emails advising that the expedite got approved and that they were sending the application by overnight DHL to the sydney consulate. Jacob then received a leter in Iraq that was posted 2 weeks ago advising that I should receive my interview pack within a week. Well its been over 2 and still nothing. I now have a new case number though, so i've sent off an email to both my home Melbourne and Sydney consulate office to check if it has been posted yet. I cannot bear making another phone call, especially as they charge $2.15 a minute to speak to an operator, to only tell me, 'I don't know anything.'
By the way, despite having a US embassy in every state in Australia I have to pay for an airfare to fly to Sydney for the day, with an infant for my interview, what a joke! The costs are just adding up and up. We are paying for our wedding in Hawaii in April. so the bills are piling up now. Added to this, I'm trying to organise my things to be sent by ship to Hawaii as it takes 3months, and I've just found out that I can not do it without my visa. Its just one headache after another. I'm literally pulling my hair out!!! ranting33va.gif
Thant's terrible news about your child, they definatley should not refuse your request. You definatley need the best medical treatment, I know how devastating it is, you feel helpless with a sick child. Our son has been in and out of paedetricians and has been hospitalised, he's gone through so much pain with all these horrible tests. He's been screaming in pain 24/7 since he was born, he's 4 months old now and he's seriously under weight. It turns out all along that he has had food allergies, something so simple to treat. A tip as a parent, always go on your gut insticts some quacks are not always right.

I have heard both ways, but it seems to me they seem to give preferential treatment to the people in the service - Dont get me wrong, I am not complaining about that, If I was in a potentially life threating situation from my country, I think that is the least they could do. But I wonder if that is why you got a response so quickly. They promised me a responce on the 17th, but i still dont have anything.
I tried to send a faxt to the Director today with a letter, but the number I found (couple of places on VJ) didnt answer. mad.gif
i talked to someone around noon today and she was trying to be helpful, but the system was having problems. I explained my situation and she transferred me to a supervisor - who was completely useless. mad.gif I tried again this afternoon and the system was still down. The guy told me they would be open until 6:00 PM, so I ASKED - Eastern, Pacific, what - he said NATIONWIDE - So I said, OK there is a big difference betwen Eastern and Pacific time, so do I actually have until 9:00 PM - He said yes. So I was giving them time to get the damn system going, I just called again and it says to call back between 8 and 6! AHHHHHHHHHHHHHHHHH!!!!!!!!!!!!!!!. mad.gif mad.gif mad.gif mad.gif

There doesn't seem to be any kind of customer service going on down there. My poor fiance had to stay up one night and be on the phone for hours to finally get through to someone who knew what they were doing. Our visa was expidited due to medical reasons of our son, not simply because my fiance is in the military. My fiance was transferred to 7 different people, each time having to explain the situaiton over and over again. Eventually he was told there was a dedicated number for deployed military personel. He then had to stay up again the following night to call that number. Whilst I know you maybe frustrated that we got such a prompt response, but this maybe due to our son having a birth abroad certificate and US passport and is therefore a US citizen who is quite ill. I'm sure you will hear something soon.Good luck!

They should send you a reply via your email address to both of you, and then post your pack to you.
My visa was filed on the 8th of sept 08 and my fiance who is currently deployed in Iraq requested to expedite around the 11th of november, and on the 13th we both received an email advising it had been approved and my package was being posted. I should be receiving it any day now. kicking.gif We are both vey excited My fiance is currently serving a 15month deployment and is leaving on the 15th of feb. So this guarantees that I will be there when he arrives. I gave brith to our son on the 22nd of July so father & son have alot of male bonding to do..Best of luck with your expedite.

It didnt state where the medical was to go,
so I just put mine at the end and had no problem with it.
I gave them the original, I made copies for myself and one to hand in just in case.
They did keep the original though (it was that booklet you gave to the doc).

hey guys, i found this waaay up the front of this thread and wondered, do you actually need to get new copies of all this stuff for the interview in sydney for a CR1 visa? i have sent the majority of this stuff, bar the medical of course, already to USCIS and NVC.... wont they just send it all to the embassy and all i really need to take is my 3kg envelope, my passport, my medical results and my evidence?

they already have my birth cert. and marriage cert. and police cert. and all that stuff.

nice to see some new faces on here!

im just popping in to say any day now, hopefully, i will be hearing "case complete" and it will allllll be over for us.. well til interview time!

its sooo exciting really. i hope it goes smoothly.

anyway, in other news, i am off to sydney next weekend for a friends wedding in the hunter valley. it will be lovely. i wish i wasnt going alone but oh well!

i hope you are all well and as happy as can be. pretty soon we will all be with our loved ones.. biggrin.gif
