Just to clarify I didn't say we were going to try to circumvent the warrants or anything. In fact before we even begin the application process we're going to make sure she goes down to the police station and turns herself in with a friend who has cash to bail her out. This has been something that has been looming over her head for years and I agree that it should be taken care of. I was just curious if these warrants were going to be something that was going to end up keeping us apart. In my above post I was just asking if I had read the law right in that since she was under 18 her mistakes won't be held against her.

 

I did not mean to give you guys the impression that we were going to try to do something underhanded like have her try to just sneak on over with warrants. I'm sure everyone that has gone through this process knows how nerve wracking it can be going over all of the requirements and wondering "will this make us ineligible?"

The original charges are from 7 years ago and she was 15 years old when she committed them. Alot has changed since then and would the system in place give her a second chance?

Hi there, this is my first post and I am in the beginning steps of assembling and petitioning for a K-1 Visa for my fiance.

 

My fiance is a Canadian citizen and she has a warrant for her arrest. As far as I know it was issued when she failed to appear for a follow up hearing. From what she has told me, she was arrested when she was 15 for trespassing and possession of break-in tools. She showed up for her initial hearing but failed to show up to the next scheduled one so a warrant was issued. I wanted to find out if this will effect our chances of getting a visa and how to proceed from here. She contacted a legal aid service in Canada and they advised her to turn herself in in order to take care of the warrants.

 

Would something she did when she was 15 effect our chances of being approved for a visa? How would you guys reccomend we proceed from here? Does anyone else have any similar experiences? I did my best to search for a similar topic but I was unable to find a case quite like ours.

So Ive read all the forums and i can understand most of it, ive prepared our K1 Visa Application, we've got all our paperwork and photos and proof etc etc. but now i have a question about the medical examination.

Clearly we have to lodge my visa before I take my medical examination but i was wondering . . . If once we lodge my visa application can i then organise to have my medical done in my home country of Australia, is there a time limit or lenght before i leave for America to get it done? or do I have to wait for it to be approved before i get a medical examination?

i got an RFE asking for my husbands (USCs) original birth certificate at the I864 stage as they wanted proof he is related to his father, who is living with him and is our co sponsor on the I864A.

i sent it back to them via international express mail, as it was over in australia with me (ARGH) and they received it just on friday the 16th.. SOOO fingers crossed they dont give me any more RFEs and i now can move on to case complete!

None of my boxes arrived yet. sad.gif I've packed, unpacked (when i was soooo upset by my RFE) and repacked over the 8 months of waiting, but never sending any (coz hubby was going to move from his previous condo, then was staying at the motel before and after our trip in NZ, and only found the current one after a month of moving about between motels and his dad's 2 hours away during the weekend). And I left KL a week after my interview, and by then (after interview) i didnt have any time to go to the post office at all. I have 3 younger brothers, cant depend on them to do it for me! lol. I cant remember what I got in those boxes to be honest, but im sure i spread my collection of shoes in those 5 boxes among my books and stuff. Ah well.

you poor thing, its so stressful isnt it? i was lucky enough to spend 3 months in the US over xmas, then hubby has been here in Australia on a tourist visa for 5 months, and is going back to the US in a couple of wks, so we will be apart again... and that will be the hardest part.

the embassy said we could do the initial I-130 from Australia but they will reply to his residential address in the US, and luckily his parents are scanning the mail there so when our reply comes, if it is before he gets back to the US in July.. we will know.

im scared about the being apart thing, but we were apart a year before we married last November in the US.

we can do it!

It's a pretty long journey this whole thing and at times, it really, really sucks but if you do all the research and reading you'll be fine. I found what worked for me was to read the Government jargon and such, and then research information here and then come to a conclusion based on all that for myself and what we were doing. it's a lot of stuff to read and it's a long process but really? it's not that difficult if you read everything and follow the instructions and well, have some patience.

thanks for that. i work for the Government and have in the past and i still dont understand alot of the jargon used! UGH. its so hard sometimes to even understand the simplest of things.. but i will get there eventually.

at the time of sending the I-130 i knew i was supposed to send the I-129f seperately, but the only thing i didnt understand was the difference between the K3 and the CR-1 and how the heck they know which way you want to go!

now i get it.. finally! biggrin.gif

Simple you don't file an I-129F, and let the I-130 process normally.


i just filed my I-130 paperwork and followed all instructions on this website, HOWEVER i actually put in an I-129F form at the back (which i now know i shouldnt have done!!)

does this mean i will get an RFE and if so, do i just say i dont want that I-129f form in there now and to continue with the I-130? or will they just not even worry about the I-129F as it wasnt supposed to be in the package?
Let it process, and deal with any RFE that you may get.

If they let is slide and run them together and approve both I-129F and I-130 together, simply keep the I-130 moving through NVC by promptly responding to NVC's letters (I-864, DS-230, documents, etc..) in most cases if this is done in a timely fassion the CR-1 case makes it to the consulate before K-3 interview.

If your consulate uses P-3, P-4 for K-Visas, simply delay responding to P-3, to allow CR-1 to catch up, or you can simply reschedule K-3 interview to allow CR-1 to catch up.

There are many things that can be done at the consulate stage of the process to get the CR-1 visa instead of K-3.


oh okay cool. thanks for that.. you seem like you know what you are talking about! i envy you haha. even after reading it all i didnt understand where all the forms end up.. but that explains it better.

i hope they do what you are saying and ignore the I-129f or somehow approve both or whatever.. as long as it doesnt delay things!

i feel so confused. i HAVE done a fair bit of reading up on this, but there is so much mess in between GOOD information on various sites and i get worried when i see someone doing something different to me.

i hope i dont get an RFE. i sent my I-130 off and it had all the right info, but i stupidly put in an I-129F form at the back of it, and now i fear they will be confused and send it back. will they just mail us and ask why it is in there or something? i hope so.

YOu ask all the same questions I was baffled about too!

They know because you file an I-130 and the subsequent items with that... once approved it'll follow the course for the CR-1. In our cover letter for the USCIS, I also stated we were filing an I-130 in order to eventually obtain the CR-1 visa. I figured it wouldn't hurt to be absolutely clear as to what we were doing.

Ask away, this place is great for all questions great or small and all little fears and worries and joys regarding this process. IT's been amazing otherwise I'd have been lost on a few steps. Still not done yet, ourselves so... more questions coming for us too.

K-3 can apply for EAD BEFORE they adjust status, and can use the resulting EAD card to work befor AOS. The EAD card can take 90 days or longer to get.

You need to study up a-bit. CR-1 gets a 2 year CONDITIONAL green card id married less than 2 years when the card is issued, if married more than 2 years when green-card is issued teh card will be a 10 year un-conditional card.

A person with a 2 year conditional card is NOT adjusting status when removing conditions, they are Removing conditions, they are LPR before and after removing conditions.

wow thats good news, i might start filling ours out now too. my hubby is here in australia with me right now, but he is back in his home town in the US in mid july so i might fill out our forms while we are still together and get him to sign things and then we will be prepared!! biggrin.gif

i only sent my i-130 last week to Chicago, however i want to stay ahead of the process so to speak, and was wondering, do i just go ahead and get my police clearance now while i am waiting for a reply?

i want to make sure i am doing everything that needs to be done ahead of time, where possible.

i know it must be hard thinking of your first anniversary possibly apart, but think about how much you will appreciate each other and life once you are back together.

i did that exact thing. i entered on VWP and then married in the US then left before my 90 days were up. then my hubby visited me in australia on a tourist visa and now he is going back to the US where he is a citizen and i have just applied for the I-130 for the CR-1 visa.

i dont know how long it takes... good luck!

I am the beneficiary and I am actually going to be filling out the forms and have more knowledge of all of this, so my spouse, the sponsor, is going to just sign what I send him, and send or email me details each time we get a notice of action.

In this case, do we need to fill out the DS-3032? From what I can see, it is only for those who's USC spouse (sponsor) is filling out all the forms for the beneficiary as well.
