First, I want to extend my deepest prayers to those still awaiting the joy for which they rightfully deserve.

I can not express the overwhelming emotions I feel. My Baby called me yelling... WE'RE APPROVED!!! I somehow always knew but I wanted to officially her it from her lips. SWEET!!! I'm going to give my family and friends a call, get something to eat, sit back and take it all in... This is like winning a big game... It's really cool but we won't the championship. Maramig Salamat for all of you well wishes. I am deeply touched. May God continue to bless us with his grace and mercy.

Cheers!!!

US Embassy and Consulate DiscussionManila Embassy Interview

as of 11 Nov 06

Phil-Am K1 Information…

(K1 Introduction) - If you are just starting your K1 visa journey, please check out this information provided by the Department of State (DOS) on the K1 visa experience (CLICK HERE). I found this information very insightful when I first started. Please note that the “How to Apply for a Social Security Number Card” section is incorrect because K1 visa beneficiaries can only apply for a SSN card upon arriving into the United States.

(Case Status) - Once you have filed your case and recieved your case number, please register on the U.S. Citizenship and Immigration Services (USCIS) website using the Case Status Online Tool to receive emailed updates concerning your case (CLICK HERE)

(1). The National Visa Center (NVC) number is within my signature. NVC assigns your case number once your case is approved (NOA2). They also may perform a preliminary background check from what I’ve read then forwards your package/case to the Manila Embassy. This process usually takes anywhere from 14 – 30 days.

(2). The Manila Embassy (USE) Packet 4, the phone number, a visa interview testimony, along with a sample Appoitment Letter are is within my signature block. NOTE: Packet 4 is acquired from the Manila Embassy website which gives directions on what documents are required by the beneficiary for the visa interview. If you call the Manila Embassy and dial 0 for the operator, ask for the Immigrant Visa Unit. The average interview appointment is assigned approximately 100 – 150 days from the receipt of your package from the NVC. Beneficiaries are now sent an letter of receipt from the USE once their physical files are received. However, this is NOT Packet 3 because the Manila Embassy ONLY issues Packet 4, and the letter of receipt is not always sent to the beneficiaries. Please also check out this instructional visa interview information (CLICK HERE) (Thx Sillygirl)

(3).The Department of State (DOS) number is within my signature. After your case is approved (NOA2) and reaches the Manila Embassy, you may call DOS instead on the Manila Embassy to obtain status of your case and make inquiries concerning your interview date. NOTE: DOS has no direct participation in the K1 process.

(4). The Visa Interview Appointments website is within my signature. This is where you can check to see if a visa interview has been scheduled for your case. It is presumed that the website is now the substitution for the visa appointment worksheet/list the Manila Embassy used in the past.

(5). St. Luke’s Extension Clinic (SLEC) information is within my signature. SLEC is where the beneficiary goes to take the medical exam and vaccination. The process takes two days. Day 1 is the medical exam and Day 2 is the vaccination.

(6). The DELBROS website is within my signature. DELBROS is the company responsible for delivering the beneficiary’s Visa and POE information. The DELBROS delivery fee is paid subsequent to the beneficiary’s visa interview at the Manila Embassy. Per the Manila Embassy website, the current delivery fee/time is as follows:

* Metro Manila Areas, 135 Philippine Pesos, Delivered one (1) to three (3) business days after release of visaed passport to the courier
* Provincial Key Cities (ex. Cebu City, Davao City, etc.) 165 Philippine Pesos; Delivered three (3) to five (5) business days after release of visaed passport to the courier
* Outside Provincial Key Cities, (ex. Capiz, Leyte, Bukidnon, etc.), Cost depends on area/location, Delivered five (5) to seven (7) business days after release of visaed passport to the courier

NOTE: Per the DELBROS staff, the Manila Embassy can take as much as three (3) business days to release the visa and POE package, which is NOT included in the deliver times above.

(7). CFO Guidance and Counseling Seminars are held in Manila and Cebu, with the corresponding links within my signature. The beneficiary may attend whichever location is more convenient. "Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs... " For more info (CLICK HERE). NOTE: As far as I know, this requirement is not stated within the K1 packet. However, the beneficiary can NOT travel without receiving the Guidance and Counseling Certificate and subsequent CFO stamp on the visa. Please check out this instructional information on the CFO experience (CLICK HERE) (Thx Sillygirl)

(8). The I-94 Arrival / Departure Form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s arrival and departure portions at the Port of Entry (POE) when entering the States. You will need this for the Adjustment of Status process. NOTE: Even though it’s simple, I have supplied this so you will know what it looks like and what is required to be filled out.

Cheers!!!

Sheriff Uling

NOTE: The red text indicates the recent updates/chages. Please let me know if there are any suggestions. I have also correlated the numbers above to my signature below.

I was worried that until now I have not receive a letter of receipt from USE I just learn from Uling's info that not all benefiaciaries have it. I think I am one of those. I'll just wait for packet 4. I only got the receipt date of my papers when I inquired at their call center.

Uling I'll be happy to hear from you soon saying your fiancee has a visa approved. I am one who visit your signature a lot .. and got a lot of tips. Good luck to you and to YYB on your interview this coming Monday and Tuesday. :)

PhilippinesFiancee had abortion years ago

First of all she doesnt have to declare that she had an abortion. thats intensly private and frankly none of their business. She can simply say she was in hospital/had an operation for gynae reasons. They wont ask any more. There was nothing illegal and you both shouldnt worry. Its not up to the consular officer to make a moral judgement call anyway. They are concerned with 3 main things; a) that your relationship is genuine b) that there is nothing criminal in your past and c) that there are no infections , sexual or otherwise that may prevent you from being admitted.

They dont check medical records. the medical is just to determine whether the applicant has disease or alcohol/drug issues. there is no reason to ever have to declare an abortion. They wont ask about it. It would be wrong of them to do so.

Hi. I'm reading this thread with hope of finding some information about my current situation. I read your response and would like to seek the best advice if you can. I was requested to undergo a Psych Eval due to the scars on my wrist. I denied the true reason with the first doctor (Physical Examiner) because truthfully, I panic and was not expecting that it will be questioned or even seen (very small scars). And so, I went to my scheduled Psych Evaluation and told the doctor the same story but he refused to accept it because the scars dont match my story. I knew it was wrong to lie and chose to just come clean with it. Besides, it was way back in High School and dumb cry for attention from my mom but I was not hospitalized for it those we're very shallow cuts. However, given the circumstance, I wouldn't change it because it made me a better person. The doctor then calmed after me telling the truth and he said "Don't you just feel better when you tell the truth?" And I know, I acknowledged my mistake and told him that I did not mean to insult or disrespect anyone and I was just afraid. I was not ordered any other tests but I'm still afraid this will affect my interview (which is coming very soon). I dont intend to lie at my interview and will just tell the truth about what happened and acknowledge that what I did was wrong. I also believe that nothing is worst that lying so do you think I have a chance to redeem myself and get an approval? If not, what could my fiance and do? Would it help if he comes here, resched and go to my interview with me?

Homicide, murder, manslaughter, rape, abusive sexual contact, sexual exploitation, incest, torture, trafficking, peonage, holding hostage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint, false imprisonment or an attempt to commit any of these crimes, or

Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

If that is the question, how did he answer it? Looks like a big giant red flag to me!

If this is the question and you had already submitted the completed form then let your fiance call the embassy to ask for the status of your visa.

We were also asked to submit part C of I-129F because when my husband submitted the I-129F form, he did not notice that the answers he put on each small box did not print. They were all blank. It was because we didn't have the updated version of Acrobat.

It was good that the Consul only required us to submit Part C. She only wanted to see the Yes check box with the signature of my husband. Anyway, I submitted the requested document 3 days after my interview and got my visa 3 working days after the submission.

Goodluck.

Oooppss...Want to edit my previous post.

Of course my husband was never convicted of any crime, so the consul only want to see that the NO checkbox is answered. wink.gif
I wanted to ask her that time if she could just check it herself.. tongue.gif

Since Rina started this forum to most of us of the same case status, I just wanted to THANK YOU ALL as of yesterday after talking to NVC (live) and also confirmed it with their recording this evening, my wife's case has just been COMPLETED!!! PRAISE THE LORD and EVERYONE who kept us in their prayers, encouraging us and teaching us the proper way in completing the forms, etc. This forum has been awesome and really been informative and very helpful for the most part. On behalf of my wife and I, we would like once again to Thank You EVERYONE as each of you has been so helpful! Rina and other's, we shall continue to pray for you guys' case to be completed as well. I know that my wife's journey is still not over but I thank the Lord for His grace and will to where we are now at this point.

Again, thank you EVERYONE and I hope to see more completed cases before this month is up!!

Sis rina.

I really feel sad about what had happened. I hope its gonna be fixed soon. If its possible to request that your case be reviewed immediately as soon as they received your RFE response. They are liable for what had happened, thus they should take immediate action on your case. I almost had tears when i read your post about your RFE. But i think, it would be better to leave those things in the hands of God.

I also have been thinking that i might not be included in November interview coz its the last quarter of the year. Processing are getting slower. crying.gif

Hello sis. I am rather numb now about the whole situation, simply because I chose to at this time. I guess, in simplest word to describe my emotions right now "I'm extremely exhausted". It does not matter how careful we may be or how well prepared you are with organizing your paperwork, something get screwed up somehow. What can I really do to make things better? Nothing really. It's a waiting game as usual. I have faith in God then, the more I have right now. innocent.gif

There were more of us who have been placed in RFE, for whatever reasons NVC have, it's unfair for most of us. Our struggle and effort to be with our loved ones does not stop at NVC, we still have the consulate, etc. to deal with. My disappointment was more because of the need to be with my husband and my young son, whom I left back in May when I last visited thinking they will be home for Christmas.

It was confirmed that there are no more spots for November interview at USEM, another sad news for most of us. You know how it is with the Philippines as soon as the "BER" months enter, it just gets slower as the turtle when it comes to completing a task or work. crying.gif

Not only that NVC does confuse me, now I am more frustrated than ever. ranting33va.gif

Now, it has been confirmed that they can not locate the documents I already submitted them, thus they have sent me a missing information checklist in the mail. I had the chance to speak to my husband and requested to send me again the same documents. I honestly can not blame him if he was annoyed when I talked to him earlier today, since I can clearly sense that he was also frustrated by the outcome of the case and the negligence of NVC. It is indeed not easy to obtain these documents, given that the weather in the Philippines lately has not been cooperative, and not to mention the waiting time for requesting these documents from these government agencies.

Talking to NVC today, I knew I had to be calm and open-minded. On the other hand, I just hoped that they understand where I am coming from. I had to carefully explain to them that at this unfortunate circumstances, they had to be liable for misplacing the document. I had to request from them, and made them understand too that given that situation, they had to accept re-submission of my DS230 exact photocopy in 2 ways: (1) via email or (2) via Express Mail. I will give them the benefit of the doubt, at this time, since they have agreed for me to send it electronically. Hopefully, they will address this issue in a timely manner.

I am heartbroken at this time, looking at other's timelines both from present and last year's, that our family will missed out another holidays. The US Embassy in Manila, unfortunately, are no longer accepting any approved cases for this month for November interview. Thus, we'll be lucky if my husband will get a late December interview or early January interview. The latter seems to be more likely to happen.

As always, I'll keep you all posted.... as the saga continues.

I dont think NVC lost those documents. When you open an envelope, everything is there.Attached. With Case #. Sis RIna wont miss a thing coz i think she's very organized.

Sis rina,

I feel sad when i read your post that you've got an RFE. I know what you feel now. All we want is to be with our loveones this christmas. is it too much to ask? sad.gif

I bet they're just delaying our cases. Aurea is right, their reason for RFE is so mababaw. Applying for those documents in PI takes a long time. mad.gif Yeah go send them you photocopies of what u sent them before. GRRRR to them. Too bad i didn't photocopied mine. haaaayyy..

hi sis,

What's wrong with NVC? I think they are just trying to delay some of the cases especially in the philippines. Even if there's no reason for RFE, they gave someone an RFE. I dont think they lost it. mad.gif mad.gif NVC's reasons of RFE's are so mababaw. mad.gif

As some of you may know, I have been waiting for NVC to provide me status of my DS230. Finally, today I heard what other people would not want to hear..."found a missing information" which translates to RFE, and a letter was sent on October 2nd. My initial reaction? Lots of questions like "For what?" and "Why?"

I knew I had to talk to them, besides I gave them a break to review it, so then I called the number and waited for a live operator. I was expecting for a question or two we may have missed, but NO that was not the case. Everything was good on my husband's DS230, we got them all right. I can't believe what I heard when they said they are missing my husband's biographic data page of his passport and police certificate. ohmy.gif

Here's what I have sent them with the original DS230 packet:
  • Barcode Coversheet
  • DS230- Forms Part I and Part II
  • NSO Original, Birth Certificate
  • NSO Original, Marriage Certificate
  • Marriage Termination Documentation
  • >> NSO Original, Annotated Marriage Certificate
  • >> Certified True Copies from Regional Trial Court
  • Photocopy, Valid Passport Biographic Data Page
  • Original, NBI Clearance Certificate
  • Original, Police Clearance Certificate
So, if I have all these documents on my DS230 packet, why would they say I am missing it?

I have made an exact copy of the packet I sent them originally, and since I have been careful with what I sent them (double checked every page, reviewed them and followed every checklist they required), I will be sending them a letter today via Express Mail, and I will attached the copies I made of my original packet to show them that unfortunately they dropped the ball on this. I did not cause the missing information, they those documents and they better find it. Let's see what they say this time when I call them back on Monday mad.gif

In my own exprience, it is not based on when the case was completed nor on a first come first served basis. its the other way around....
