K-3 Spouse Visa Process & ProceduresConsulate Interview Approved!
QUOTE (mamalou @ Feb 12 2009, 11:52 AM) <{POST_SNAPBACK}>
Thanks God he is so good to me. our interview go smooth and the Consul assign to us was nice lady, she approve us without even asking a Co-sponsor, considering that my husband's in come does not meet Poverty income requirements, but the thing is that he is currently & continuously working (I arrange his 2008 pay stubs from Jan to the current date, in separate sheet of paper I did make a breakdown). I guess its a plus factor that my husband is single, no kids plus when the consul ask me whats my job I said I have been through a lot of work before I was once working in an office, become self employed, I also tell that i have a home business. So maybe she think that I can be a potential rather than become a public charge. Lastly, i ask her ''Mam when can I get our visa, She said don't worry everything is fine except to just furnish me with your NBI Clearance in your previous family name (late husband family name i used before) She said once you submit it your visa will fallow. told her '' you know Mam my husband is so lonely waiting for me since we been apart for over 1 yr now, She smile & said Yes I understand your situation but don't worry, smiling at me & my daughter. Alam nu mga guys un pre screener na assign sa booth #25 was so mataray to me. Pero I keep quite nlang. But anyways thanks for everybody wishing me well in my interview.
Good Luck to everybody who are patiently waiting I wish your speedy approval. Your time will come soon. kicking.gif star_smile.gif kicking.gif

K-3 Spouse Visa Process & ProceduresWhich is reliable & cheaper, buy ticket online or to travel agencies here in Manila
While waiting outside the USEM Manila we were given flyers from travel agencies selling tickets & I see its a lot cheaper than tickets sold online. what do you think are they reliable? i will suggest this to my husband because he's going to buy me ticket soon, but if i find it cheaper here then i just purchase here to save "sayang din un". This is my first time to travel outside PH. Any suggestion?

K-3 Spouse Visa Process & ProceduresHas anyone gotten married in the Philippines?
QUOTE (Prettyredmaple @ Jan 16 2009, 07:25 AM) <{POST_SNAPBACK}>
I just want to be prepared for any documentation I need to show I am legally able to marry a filipina in her own country. I have notarized copies of my divorce including the court docket. Of course I will have my passport, driver's licence and probably birth certificate.

In addition, what must I bring to file for the marriage licenced in her town in the province?

If you are a US citizen want to marry here in the Philippines? first you go to the USEMbassy Manila have your documents ready like Divorce decree + Birth Cert+ passport & U can get ''Legal Capacity'' doc from there pay 30usd. Next step is to go the Municipality or City Hall where your Fiancee lived go to the Civil Registry Dept. submit the Legal Capacity (have it photocopied for future use)+ you & your Fiancee BC + Divorce decree & get a Marriage License payment is less than 100 pesos, (don't talk to any fixer in applying for a Marriage License they will charge you big amount because you are a foreigner)you will be given 10 days to wait, while waiting you can arrange the wedding, also there is seminar for both of you to attend( Marriage Counseling), then after 10 days you can already claim the Marriage License & You can now Get married in the Church or in a Civil Ceremony. this is a step by step guide for you based on my experienced. Ok, Good Luck.

K-3 Spouse Visa Process & ProceduresNo visa yet til now
Done with interview Feb 12,2009 Consul ask my NBI clearance (in my ex married name) I am just wondering why until NO Visa yet receive after I submitted additional Document last Feb 19, I called USEM 301-2000 Feb 24 but the lady discouraged me to call, she said "why not your USC husband call us instead of you, then she told me next time you call our Call Center(she wanted me to call this number with 53/min charge) Since then i haven't call again. Is this a protocol that our USC husband's are the ones to call them? Considering we pay the visa fee, then they don't want to entertain inquiries? Anyone's opinion is highly appreciated. Thanks
hayssss, I hope I can receive my visa soon.

Hi, Once again I have questions to ask from u guys, I come here in the US with K3 V last Mar 7,2009, My daughter is a k4 she is coming here in the US on the 3rd week of April. My question is: Can she travel to California as her Aunt is inviting her to stay there & eventually Apply her SSN & EAD ? or AOS (if this is possible) We have different State. I have read someone post in china forum with same situation with mine that she apply her daughter an AOS & they were approve both considering that her daughter already turn 18 yo few months before they get married, will it be possible to me also, my daughters bday was Nov 02, 2007 we get married jan 22,2008? i dont have exact idea, others told me it can be possible & others tell me it could not be possible. Help me pls enlighten. Thanks, waiting for ur advises.

Look the links related to K3/K4 at:
http://www.visajourn...m/faq/k1faq.htm

In general K-4 visa holder can apply “Adjustment of Status (AOS)” any time after approval of I-130.
Work permit (file I-765) available while cases (Form I-130 or Form I-485) are still pending. First get EAD and then apply SSN.

To qualify for K-4 visa, must be:
the unmarried child of K-3 applicant and less than 21 years old.

K-4 status will be automatically terminated 30 days following marriage of a child in K-4 status (prior to enter in US or AOS) or 21st birthday.

QUOTE (payxibka @ Mar 23 2009, 08:41 PM) <{POST_SNAPBACK}>
travel within the USA is allowed

She can travel to CA from home country.
Also K-4 visa holder can travel within USA and outside USA without any restriction as long visa is valid (no advance parole needed).

The above is all correct but misses two critical points. The K4 visa holder needs an approved I-130 to adjust status and the US Citizen cannot file an I-130 for step-child unless the marriage occured before the child's 18th birthday.

From the I-130 instructions.

What Documents Do You Need to Prove Family Relationship?

8. Stepparent/Stepchild: If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday, copies of documents showing that any prior marriages were legally terminated and a copy of the stepchild's birth certificate.

The child can enter the US as many times as they wish and travel within the US until they turn 21. Then they lose their legal status with no way to adjust it to permanent resident. What some do is obtain student visas. Some eventually marry a USC and adjust. The others go home or become illegals.

THANKS guys for the input but I have fallow up questions, Can my daughter be allowed to apply for EAD & SSN there in Calif? (as I understand she cant be applied for AOS anymore as Push qouted) while I am here in other State. She wanted to work if possible. Thanks again.

I wouldn't wait for my I-129F to get approved because VSC is at standstill with those petitions and you can't be sure that they whether they are going to approve it or not.I would pursue CR/1 because it's a superior visa and NVC time is much shorter now.I noticed that we have similar timelines and that we also got touched on the same day.My file was touched yesterday also but no sign of an approval yet.I hope that there is no RFE coming!Good luck at NVC!

It seems we have the same case. Yesterday May 7, our 1-130 was touched!! Looking forward to our NOA2.

Ok, here's my answer smile.gif

If you don't have any property uder your name, then you should not list any.

As long as your co-sponsor meets the income requiremente you should be fine.

IMO, listing your car does not make any difference if your co-sponsor meets the income.

You can read some tips for the I-134 here.

Thanks Eric/theresa!!!! ur answers to my query is great and it helps, thanks to this site also

US Embassy and Consulate Discussion1-134 question, guide me pls
Hey, I'm preparing for my 1-134 AOS, I'm just confused under question #7 i own real property valued at: ????? do i have to put amount? since i am living with my 90 yo mother's house, my other siblings have their own houses too. I been single with no kids for many yrs 'til i meet my wife in the Phil, we just get married recently and i don't have my own house, i don't have life insurance, but i have bank deposits that im trying to save my money every payday. What should i answer since i am thinking that it is a plus factor when we the petitioner have our own property.I'm worried this thing may jeopardize granting a visa to my wife. Another thing is that i do not meet the minimum poverty guidelines so i have to get co-sponsor which is my sister who is financially stable. Thanks to her I am relieved. My other question is: Q- #7 ...I have other personal property? reasonable value??? Can i put my car and the amount? last Q #8 The ff persons are dependent upon me............ Since i have no dependent here in US should i put the name of my wife? I need u to guide me pls. Thanks for any reply mitch&malou

US Embassy and Consulate DiscussionWhat form should my fiancee's co-sponsor use is it 1-864 or 1-134?
QUOTE (ZeeNusah @ May 13 2008, 09:01 AM) <{POST_SNAPBACK}>
For the K visas you need the I-134. I-864 is used for AOS after entry to the US.

Are you married or not? Your timeline says you filed both the I-130 and I-129F but you refer to the petitioner as your fiance.

If he does not meet the income requirements then he needs to find a cosponsor who meets the requirements. Does one sister meet the requirements? I'm not sure how it works if you are using 2 cosponsors.

Thanks for your response, his co-sponsors (sisters) both meet more than the income requirement in Poverty guidelines. Does he need them both ?or just 1 is enough? I am referring to K-3 visa if approve ahead of 1-130 what form should a co-sponsor has to fillout. Thanks Waiting for your response again.

I would suggest contacting your state senator now. Go to their website, download the privacy form, fill out your case information, and fax to their office. Call to follow up and get the name/email/direct phone of the person assigned to your case. There is no reason for you two to have to wait an additional 8 months for a "joint" interview when many consulates don't even allow fiances to enter the consulate. Best of luck - don't give up.

Can you tell me how do i find this privacy form or can you help to post a link , i have never taught this would happen , i am so down right now ..

I'm so sorry about your story, heres how u can find this privacy form, look first your senator into your browser www.united states senator for ......(name of your state, where you belong) then click the link. You can send email there, once they respond to u they will give you release form or privacy form to fill out. You can call the senators office too provided in his website. Take it easy, things will be alright for u guys. Love will keep u together in due time.

OH Ok, you mean that my husband has to fill out 2 sets of F 1-134, 1 for me & 1 for my daughter? same thing with our Co-Sponsor? so there should be 4 sets? Am I correct? I just knew this, Thanks YU for the advise.
Going back to my prior statement, our co-sponsor did not fill out my daughter's name in the Item 3 '' Name of Spouse & children accompanying or fallowing to join person''

Yes, your daughter's name needs to appear there. You may simply write it in.

IM sorry but I don't get clear answers, such as:
>Were there 2 sets of I-134, one set for the K-3, and one set for the K-4? I don't believe one I-134 can be used for 2 visas.
>That's right. An I-134 is needed for each intending immigrant. I put both together with one set of supporting documentation..
>Yes, your daughter's name needs to appear there. You may simply write it in.

I am sorry I was confused: As I was saying Husband (principal sponsor) filled one set of 1-134 & have already included my daughters name in the item 3, but Co-sponsor did not write my daughter name(only my name) in the item 3 she filled one set 1-134, I want clarification based on your answers to me: Should my husband & Co-sponsor need to file another(separate) form 1-134 for my daughter(K4), I was asking if there should be 4 sets?
Sorry, but I need confirmation & Thanks

US Embassy and Consulate DiscussionDone with interview, still waiting for Visa here
Done with our interview last Feb 12, 2009 Approve but CO ask additional document of my NBI Clearance (in my previous married name), Consul told me by the time I submit the requested doc visa will fallow soon. So Feb 19 I already submitted that said document, but 'till now still waiting for our visa, I haven't receive yet any delivery advise from Air21. Last Tues I call the USEM 301-2000 & the lady told me " why not your husband call instead of you?" & she discourage me calling in that number, she said instead calling this toll free number you can call the USEM Call center. Is this a protocol when we want to know status of our visa? Anyone's opinion is highly appreciated. Kinda worried here, but can wait, I hope not too long. I'm praying this waiting will be over soon.
Good luck to us.

US Embassy and Consulate DiscussionMy Interview Experience
QUOTE (ange2964 @ Feb 18 2009, 03:04 AM) <{POST_SNAPBACK}>
Just want to share with you guys my interview experience held last February 18.

My appointment is at 7 am. I arrived at USEM around 5 am. I was exhausted that morning coz I haven't slept since the night before my interview because of various emotions (afraid, excited, happy and full of hope). 6 am came, the guard called us to enter the gate two. That is where I have shown my appointment letter, the one sent by USEM via e-mail. Then the guard checked our bag and instructed me to enter the room for K visa applicants.

I proceeded to ticketing booth wherein I was asked to submit 2 copies of DS156 with 2x2 pictures attached and my signature, 1 copy of DS 156K and 2 copies of DS 157 (one with BDO validation and the other one was an extra copy). The girl noticed, I left a field with no answer. So those who will fill up the DS forms be sure no field is left empty. Put N/A or None if necessary. When I was done filling up those empty boxes I was "again" asked to fall in line. Every move is fast so you really have to pay attention. If you got the wrong 2x2 picture, USEM will ask you to retake picture. The picture should be 2x2, with ears shown, no earings, no necklace.

Those of you who will have their interview, to avoid delay, double check all your forms and 2x2 pictures.

When all my forms are ok, the lady gave me my ticket number where it will be shown on the screen. Before calling my number, the guard instructed to sit on the blue chair and wait for my name to be called for finger scanning. It's almost an hour when I got called and fall in line. Finger Scanning was then so fast. I did not get any problem with that. There are some who took few minutes to redo the scanning. The technique there is rub all your fingers into your palm or tissue before falling in line. In that case, you have already cleaned or cleared up your finger right before you heading to the machine, this is to avoid delay again.

Next, was my number flashed on the screen. This is for the pre-screening. I was asked few question by a Filipina Lady. The questions are: who is your petitioner, what is his job, where does he work, how did you meet him, how many kdis does he have. Then, she asked my bc, nbi, I-134, ITR and W2 of my fiance and few of my picture together with my fiance. She did not asked me to submit the employees certificate and bank statement of my fiance. The wrong thing I realized is that I put all my picture in a medium size album wherein it does not fit the window. So I was not able to submit the entire album. Instead, I just pulled out some of the picture from the album and submit them to the lady behind the window. I think she only asked around less than 10 pictures out of the 43 pictures I brought.

After seeing the pictures, she asked me to go back into my sit and wait for my number to be flashed again. This time it's the consul interview.

In a matter of 10-15 minutes, I saw my number flashed on the screenand I headed to window 31. I was interviewed by a lady whose I think she is in her mid 30's. She was nice. She asked me to raised by right hand. Then, the interview started. She asked my certificate of singleness and again asked the following questions: who is your petitioner, what is his job, how did you meet him, what does he do for a living, did you know he was married before, what is the name of his ex-wife, what is the name of his kids, where does the kids stay?. To my surprise she did not asked for any e-mail, chats, or any documents to prove that we have met in person and that we are have our ongoing relationship. After her numerous questions, I've heard her saying "I can see NO problem with your documents, I would then say you are approved. Wait outside for your name to be called for the payment of your visa delivery". I sat near winder 37 and wait for my name to be called. The guy handed me the pink slip and I immediately headed to Air21 and paid the visa delivery. I think, if I can still remember the amount of delivery is P215.00. I left USEM around 10 am.

With all the above statement, I am happy to say that I passed! I would like to thank the Lord for the blessing He had given to me and guided me. I give Him all the glory and honor. Thank you dear Lord.

To all of my vj family who will going to have their interview, may God bless you. And have a smooth journey.

Did u receive your visa already?

US Embassy and Consulate Discussionpolice certificate
QUOTE (missgarcia @ Mar 3 2009, 03:54 AM) <{POST_SNAPBACK}>
I'm addressing this concern to all those who have undergone the same. I'm supposed to submit a police cert from china since i worked there for about 9 months on a Z visa. I had my interview already at the US embassy manila and was told to submit this. Problem is I can't supply this doc. My former employer refuses to sign me my employment cert because of my untimely resignation from work (because i had to pursue working on my visa papers) which unfortunately for me is being asked by local police in China as per policy. I have called, written, appealed and even called the phil consulate in beijing but was told that they can't help me..anyone here knows what the embassy can accept in place of police cert???? My fiancee and i have already written to the embassy and explained our situation but we are still waiting for feedback up to now. I went to the chinese embassy makati several times but all i got was a very abrupt the embassy does not issue police certificate. Any advise on this will be really really appreciated

PhilippinesHas anyone gotten married in the Philippines?
QUOTE (Prettyredmaple @ Jan 16 2009, 07:27 AM) <{POST_SNAPBACK}>
I just want to be prepared for any documentation I need to show I am legally able to marry a filipina in her own country. I have notarized copies of my divorce including the court docket. Of course I will have my passport, driver's licence and probably birth certificate.

In addition, what must I bring to file for the marriage licence in her town in the province?

If you are a US citizen want to marry here in the Philippines? first you go to the USEMbassy Manila have your documents ready like Divorce decree + Birth Cert+ passport & U can get ''Legal Capacity'' doc from there pay 30usd. Next step is to go the Municipality or City Hall where your Fiancee lived go to the Civil Dept. submit the Legal Capacity (have it photocopied for future use)+ you & your Fiancee BC + Divorce decree & get a Marriage License payment is less than 100 pesos, (don't talk to any fixer in applying for a Marriage License they will charge you big amount because you are a foreigner)you will be given 10 days to wait, while waiting you can arrange the wedding, also there is seminar for both of you to attend( Marriage Counseling), then after 10 days you can already claim the Marriage License & You can now Get married in the Church or in a Civil Ceremony. this is a step by step guide for you based on my experienced. Ok, Good Luck.

PhilippinesJust curious, asking
While waiting outside the USEM Manila we were given flyers from travel agencies selling tickets & I see its cheaper than buying tickets online. what do you think are they reliable? i will suggest this to my husband because he's going to buy me ticket soon, but if i find it cheaper here then i just purchase here to save "sayang din un". This is my first time to travel. Any suggestion?

Comments?

Our receipt date was Feb 29 but was not transfered to CSC . Case here still pending. Hopefully this Oct miracles will happen to all of us who are waiting patiently.
