K-1 Fiance(e) Visa Case Filing and Progress ReportsTwo RFEs??

I just got NOA2 yesterday, been waiting over 9 months so I had to refresh my memory on what I need to do next.  Here is a great checklist to follow: http://www.visajourn...content/k1guide

The forum is great to get real life experiences, especially related to the embassy in your fiancee's country.

Thank you!  Wow that is a long wait. I'm glad you finally got your approval though and best wishes for the two of you :)

K-1 Fiance(e) Visa Case Filing and Progress ReportsTwo RFEs??

When the system is working right, everyone gets two notification, and unfortunately, they say the same thing.  Why USCIS couldn't be more specific on the wording such as "We will be mailing an RFE" for the first notice is beyond me.  It confuses so many, just do an "RFE" search and you'll see that your question has been asked every few days on the forum.  The topic should be pinned on this forum.

Hope your hard copy arrives soon, the wait can be agonizing.

These forums are so helpful. I just got home and on to my PC (my original post was typed in a panic on my phone, ha) so I've been looking through the site and found that 2 emails is standard. I hadn't read or heard about it before though. It doesn't make sense at all that they send two identical emails, but oh well! I agree, it should be pinned to save a lot of confusion.

I have endless questions about what we need to do after we receive the NOA2... specifically about what exactly my fiance needs to send to me. I thought I finally had it cracked but browsing the forums seems to throw up more and more things. I'm trying to put together a simplified step-by-step checklist so we don't miss anything out, but it seems the more I look, the more confused I get. Haha. But anyway! Thanks for your reply, it is much appreciated :)

K-1 Fiance(e) Visa Case Filing and Progress ReportsTwo RFEs??

Our case status says the same as the email I received today - that an RFE was mailed today. I hope they actually mailed it this time and that we're not going to get another email in a week saying the same thing! This is so frustrating! Thank you for replying smile.png

K-1 Fiance(e) Visa Case Filing and Progress ReportsTwo RFEs??

usually the second message is the day the RFE is actually mailed the first one is a message saying you will get an RFE

Ah I see.. it's just with both emails being identical saying that an RFE has been mailed.. it sounds like they were mailing two separately and got me confused. Thanks :)

K-1 Fiance(e) Visa Case Filing and Progress ReportsTwo RFEs??

On May 10th, I received an email saying the USCIS had mailed us an RFE. Today I received the same email, only saying it had been mailed today (the 14th). Does this mean we are getting two RFE's? Why didn't they send them at the same time? Has anyone else had this? I wasn't too concerned about receiving the RFE as I know it can just be something as simple as a missing signature.. but now I'm just confused and worried.

K-1 Fiance(e) Visa Case Filing and Progress ReportsConfuse about our RFE change of date!!!! :(

I know, the wait is so frustrating. Someone kindly informed me that usually the first email is just to say we'd be getting the RFE, and the second is to say they'd actually mailed it. It doesn't make sense to me though as both emails were identical, just with different dates. Why tell us they  mailed it twice? That's what confused me.

K-1 Fiance(e) Visa Case Filing and Progress ReportsConfuse about our RFE change of date!!!! :(

Hi, I'm having the same problem and just posted a topic about it, sorry I didn't see this one! I'm really worried and confused too.... We got an RFE on the 10th, now it says the 14th...

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow much does an RFE delay your case?

The best thing to do with an RFE is to reply promptly, so as not to incur any more delays.

From your timeline:

"Based on timeline data, your I129f may be adjudicated between July 25, 2013 and August 12, 2013* (RFEs at the California Service Center typically add an extra 14 days, which has been added to the estimated processing time)."

Good luck.

Thank you :) We just have to wait and find out what it is they need, but as soon as we know we'll be getting it sorted and sent.

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow much does an RFE delay your case?

Okay. Well that's set my mind at ease a little, at least it should hopefully just be a short delay.. I'm so curious to know exactly what they are requesting, as I thought we had everything they needed and we checked, double checked and triple checked the package as you do. Ah well, hopefully it's just the photo. Thanks so much for your replies! Good luck to both of you on your journeys.

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow much does an RFE delay your case?

Hey guys.. we got notified by email of an RFE heading our way in the mail... I have a feeling it may be because my passport photo doesn't meet requirements (even though I had it taken in the US! - I was reassured by the girl in Walgreens that it would be fine. Oh well). But anyway, on the email it says that a "new processing period" will begin after we send the requested documents.. Does this mean we are back to the bottom of the pile?? I know we are lucky in that we are only 5 months into our wait, compared to others who have been waiting way beyond the average processing times, but I really don't think I could bear another 5 month wait or longer :(

K-1 Fiance(e) Visa Case Filing and Progress Reportshow long should we look leave it till we call nvc

Thank you for the info smile.png,is it just our case number we have to ask them for? I'm still pinching myself that we are at this stage and can kiss goodbye to uscis

When I called I just asked if they'd received our file, they asked me for the receipt number (WAC/EAC#) and our names and dates of birth, and then they told me when they received our file, when they sent it to the embassy and gave me our LND#. They were really helpful in my experience.

K-1 Fiance(e) Visa Case Filing and Progress ReportsAfter K1 Medical London - just wait?

Hi, the embassy will arrange your interview for you, from what I can tell it usually takes 2-4 weeks after they've received your medical results. As long as you've sent in your DS2001, as well as your other forms (which I see you have!), you just need to wait for them to send you an interview letter. I'm not sure about wait times... when I called DOS a couple of weeks ago, the lady told me that July and August were booked up, yet I received my appointment on the 13th July for August 8th (I had my medical on June 28th). All you can do is wait really!

Also, the guy who took my X-Rays is great. I got a history lesson from him lol.

Good luck :)

Hello everybody! wink.png I hope everyone is doing just great today. I have an update on our case!dancin5hr.gif We got an RFE notificaion sent to us on this past Friday 7/26/13. I received the hard copy yesterday 7/30/13. It turns out I hadn't filled out the small box where it ask if I had ever been arrested/convicted of a crime.headbonk.gif I know! WHAT A DUMMY!!! So all I had to do was check the box and sign the paper they sent to me. Of course I did that right away that same day.ClockWatch2.gif Could anyone tell me if this could be a good sign that our approval is soon to come since it wasn't anything major that was missing and also how long will it take to get a response from them? The Texas Service Center is who has our application right now and I live about 20mintues from Mesquite, Texas which is where I sent my response. If this helps to give you all an idea. Your answers ans opinions are greatly appreciated!heart.gif Thank You in advance to everybody who responds!biggrin.png

Many, many people who receive RFE's get their decision pretty quickly after sending their reply. Good luck! dancin5hr.gif

Hi, it generally isn't too long before a decision is made after they receive the RFE reply, since it means your case is finally being dealt with by someone. I think mine was about a week.

K-1 Fiance(e) Visa Process & ProceduresK1 process question

Yes, the fees for the EAD (I-765) and AP (I-131) are waived when sent with the AOS (I-485) package.

That's awesome, I didn't know that. Thanks!

catie-bFemaleUnited Kingdom2013-05-17 09:15:00
K-1 Fiance(e) Visa Process & ProceduresK1 process question

Yes, once you get married, you can apply for AOS (adjustment of status) which is a conditional green card.  This process takes around a year.  At the time you file for AOS, be sure to apply for EAD (work authorization) and advance parole (AP).  Their application is free along with the AOS package and will typically be processed in two to three months.  Assuming EAD and AP are approved, you'll get a EAD/AP combo card that will allow you leave the US and return.  If you leave the US before you get this, you will not be allowed back in until you apply for another Visa.

Sorry to post a question on someone elses thread, but I thought that the EAD and AP both had fees of $300-400. Are they free to apply for if you send them along with your AOS forms?

K-1 Fiance(e) Visa Process & ProceduresANY OTHER DOCUMENT NEEDED?

As I understand it, the I-134, letter of intent and letters from employer and bank all have to have original signatures so it would be better to send those things through the mail.

Good luck in your interview :)

K-1 Fiance(e) Visa Process & ProceduresName wrong, age wrong. Argh!

Concerning being an issue. I would rather discuss it face to face with the person holding my folder and the last person who will touch my file before it goes to visa printing, over discussing it with a contractor in Scotland.

Agreed. Thank you! :)

K-1 Fiance(e) Visa Process & ProceduresName wrong, age wrong. Argh!

How badly is it misspelled?  Is it Chirs instead of Chris or is it Sayid instead of Laurence? You could call them to let them know or you could mention it at the interview so that your visa is printed properly.

Either way it shouldn't delay your interview but if it's enough of an error they may run another name check after the interview.

Good luck!

Ahah, it was just the "e" from the end of my middle name Jane. Sorry, I didn't see your reply before replying to Nich-Nick. So it's just a teeny tiny mistake. But enough for me to get in a flap over  laughing.gif

Thanks!

catie-bFemaleUnited Kingdom2013-06-30 04:02:00
K-1 Fiance(e) Visa Process & ProceduresName wrong, age wrong. Argh!

When was your medical? It takes a few days for them to get the blood tests back from the lab. If they still have your medical file, they can correct it before sending to the embassy, as well as mail you a corrected copy.

For the embassy, if you applied in your correct name on the DS- forms, it will likely be fine. You will be there with your birth certificate and passport in hand to show the correct spelling. Much better than calling the embassy line, which is in Scotland, and can't actually see most of your info or make changes. Meanwhile they charge £1.23/minute for the privilege of getting no help from them. You can check on it at the interview to make sure your visa will be issued with the correct spelling. A clue will be what name is on your interview letter.

The mistake was made by USCIS, unless the actual petition had a typo. Do you have a copy? Your fiancé can call the USCIS, insist on a Tier 2 person, and ask that a correction be made in the records and that they send a corrected NOA2 since it will be part of your adjustment of status documentation to send in. The embassy is part of the Dept of State and barely a kissing cousin to USCIS, so go back to USCIS to check on where the error started. The Dept of State/embassy generally won't be able to fix things at USCIS.

My medical was Friday (28th), so I'll call them first thing tomorrow morning. I was worried it'd cause a delay in my results getting to the embassy, causing a delay in an interview date being scheduled (hoping for a mid-August interview). But thinking about it, it can't take that long for the results to make it just around the corner!

I wasn't looking forward to making that call to the embassy, as I'd heard before that the only way to contact them was via that premium rate number. So if I leave the misspelling for now, and just mention it at the interview, it won't be an issue? Surely they'll realise an error was made since it's definitely spelled correctly on the rest of our paperwork. Honestly, all this panic because someone left the "e" off the end of Jane! Haha.

I'll get Bob to call up USCIS as soon as he can though, regarding the NOA2.

Thanks so much for the helpful response!

K-1 Fiance(e) Visa Process & ProceduresName wrong, age wrong. Argh!

Hi folks,

On the letter I received from the embassy after our NOA2, my middle name is spelled wrong (my fiance told me earlier that it's misspelled on the NOA2 as well). Also, on the vaccination form the doctors gave me after my medical, they made a typo and made me 254 instead of 25! (Which I stupidly only noticed after driving all the way back home from London). oops8rh.gif So I'm going to contact the embassy and the doctors on Monday morning to let them know.... but my question is, will calling them up and asking them to rectify it cause a delay in getting our interview date?

Thanks luv.gif

I am a December vermont filer. Our case was transferred to texas in may and we received rfe on 20 june. We replied to it on 30 june. Still waiting approval. :-( my question is should I start gathering my police records or should I wait for an approval?? I need police clearances from uk and canada. Please help !

It looks like your case could be approved soon :) Get your police certificates now so it's one less thing to worry about. I don't know about Canada, but my UK one took a while to arrive.
