IR-1 / CR-1 Spouse Visa Process & ProceduresReal or Fake Checklist??

Okay, it wasn't fake. They're just utterly stupid. *sigh* I have to RESEND it again. At least we're EP but still.... Do you have any idea how long it takes for a case complete after RFE?

Well who knows, maybe they have some new hires that can't seem to get their brain around things? The NVC seems to be making more mistakes lately.

I've noticed...I hope it was just a reminder!

IR-1 / CR-1 Spouse Visa Process & ProceduresReal or Fake Checklist??

Likely they're telling you that you have to provide those at the interview.  At least with the photographs it should say something about they don't accept scanned photos.

As for the police record, I would double check on that!

Hmm, figured that. It kind of sucks, I have to wait to call because I can't get through their line right now.

Haha, I even provided the envelope it came in with the police's address and stuff. I'm not sure what's wrong with it. It looks fine in the pdf, it's right after the birth certificate's translation... If anything I thought they'd say something about the birth certificate being in French.

IR-1 / CR-1 Spouse Visa Process & ProceduresReal or Fake Checklist??

I will be calling NVC later tonight but do you think it's fake?

They said I didn't provide the Police Record or Photographs(passport style) when I did. It was in the pdf I sent them. I just checked it and it was there.... Either it's fake or they're daft..

Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresJust recieved case complete but have a medical exam question

The record my wife had for her prior immunizations were on a hand written card. She had some done back when she was in school. To get up to date on the immunizations, she went to her local physician to get them done. She took the handwritten card with her and the paper from the Montreal consulate listing all the immunizations they require. The local doctor then checked which ones she had already done from her handwritten card and gave her the ones she didn't have. The doctor then updated the handwritten card. My wife then took this handwritten card to the medical which served as proof for being up to date with the immunizations.

You can get all the immunizations you need from the panel physician as well but I've heard that's expensive. The shots my wife had to get were a couple hundred dollars and were done at a local pharmacy. She did have to wait a week between shots too. So I would recommend getting your immunizations done before going for the medical to save time and maybe money.

Thank you! We talked with his doctor but it turns out he had all his shots a CLSC. So we got a complete print out of his immunizations there. It seems like all he'll need is a dTap and flu shot.

We called the exam center in Montreal to check, he only ever had one MMR shot...They said it was fine but from what I've read and the shots I've had, you have to have one MMR shot around 15 months of age and then again before you start 1st grade. Two MMR shots to complete the series...

Has anyone had any experience with the MMR shots? Was it fine with only one shot?

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresJust recieved case complete but have a medical exam question

I'm not an expert on this topic but I don't think your husband will have any issues as far as for his back pain issue. I think the main point of the medical is to determine if the person has, like you said, transmitable disease like TB that could pose a threat to others. I would recommend that your husband take a letter with him to the medical explaining his back pain issues, how it was caused, treatment plan for it, etc. Maybe also have a letter from your husband's physician explaining all this. Probably not necessary, but it won't hurt to have in case they ask about it. But overall I don't think you have anything to worry about as far as "failing" the medical.

Just to add, my wife has a thyroid condition but she didn't have any issues at the medical.

Good luck!

I think they are only interested in contagious diseases (though I think HIV/AIDS is an exception now) and whether the beneficiary has a mental illness that makes them a danger to themselves or other people.

Thank you! I'll get some paperwork on it just in case.

It also accured to me that his immunization records are all hand written and not in order so I'm not exactly sure if they're all up-to-date.... Where would we get the shots done to update them? At his doctors or at the medical exam? I couldn't find anything on it when I checked. I'm pretty sure he just needs the flu shot(ick- wish they didn't) and the one for tetanus.

IR-1 / CR-1 Spouse Visa Process & ProceduresJust recieved case complete but have a medical exam question

Hi,

So we finally recieved a case complete! However, a couple of weeks ago my husband found work at a restaurant but ended up having an accident due to the kitchen having wet floors with no protective rugs. The doctor said it's a lumbar strain but two weeks later and he still has problems standing for more than 10 minutes. We're going in for a consultation on Monday and he may need to go to a physical therapist for x-rays/therapy.

He can't currently work due to the pain but he says it's getting better. I read that the strains can take months to heal properly.

Will his back injury cause problems at the medical exam and with our approval? He also has minor scoliosis, could this have any effect on our case?

I thought the whole medical exam was just to check for transmitable deseases...please tell me if I'm wrong!

Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview at consulate already scheduled but USCIS in "initial Review" again....?

I had the same thing happen to me after I changed my address on their website. I wouldn't worry about it. My husband has his interview scheduled in November also so I don't think it means anything. You have your NOA2 hard copy as proof of approval and that's all you need.

I hope so!

Yes, we finally recieved it in August. They sent it to our old address in Vancouver in May, even when I told them a month in advance that we were moving and notified them after we moved. NVC had to forward it to our new/current address in Monteal.

Good luck with your interview next month. :)

If you're already at the consulate, do not bother with the USCIS website anymore.  There are some that never show up, some that stay at initial review forever, some that who knows what is happening with.  You're just stressing yourself out at this point!

Haha, thanks. I thought so!

For all of our way through USCIS we couldn't view anything about our case and none of the operators could bring up the information. I don't want to ever have to call them back if I don't have to, they were so rude when we told them we had to move and have them "change" our address! They said "it couldn't be done" and either hung up or forwarded us to an officer that could only put in a request and have us fill out some paper...that I'm pretty sure only needs to be filled out after the beneficiary has a GC. I don't remember which form it was.

Thank you guys!

-Crystal

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview at consulate already scheduled but USCIS in "initial Review" again....?

So, if you look at my signature you can see the timeline of events. Near the time USCIS approved and sent our stuff to NVC, they switched back to the "initial review" phase. Is this normal? We did move in Canada, and told them ahead of time our address and everything based on the operators insturctions. Could this cause a problem in our case? It's normal for people to move, our lease was up, we lived in Vancouver and our interview is in Montreal where the beneficiaries parents live. We had no reason to stay in Vancouver, especially with the job market.

The webstie says: "

Initial Review

On June 28, 2013, your address was changed relating to the I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN that you filed. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance."

And then, : "

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition."

We filed the I-130... would this be a problem when we have to adjust in a couple of years? I thought people were free to move as long as they give notice.

Thank you!

IR-1 / CR-1 Spouse Visa Process & ProceduresCEAC Issued Question

no no.. it's safe to get the passport!

There is a big envelope.  Inside the big envelope is the passport, which is loose, and the "do not open envelope".

Haha, oh thank you so much for all of your help! :)

No it's one envelope that has your passport and very obviously stated "do not open envelope"  but it doesn't come separately.  The passport will be loose.

Okay, I was wondering because we have to fly to Vancouver and get stuff from storage before we POE and he doesn't have any other ID. It;s not safe to retrieve the passport? Do you know if it's in a see through packet so we can just show it to security without opening? I saw another users photo, it was in a clear packet with the passport open and facing out. It's confusing. D:

keep on them!!  I think sometimes it takes men in Canada a little longer to get their visas than women.  I last saw this with BSD... I had mine next day and he was waiting a week or two.  wacko.png

I checked around 11 and it had been touched but nothing done to it.
Thank God! I just checked after sending a message to another VJer that was at the interview the 20th too and got this:

tumblr_mwof8nbkIa1rhdguto1_500.png

I was so sure they'd ask for more information, this whole process has had huge set backs the whole way. So glad it's finally over! Now, the package it comes in. It's two packages correct? One that has the passport and sealed-do-not-open envelope right? It's safe to open the outside packaging?

Thanks everyone!

Okay, we called DOS. The woman said it's in the standard AP that they do with all visas (checking everything over once more and writing up your information for the POE document ect.) She couldn't explain the status on CEAC, just said to wait for it to update again and that it should be issued soon. We'll be calling everyday just to make sure! :/

That will be best as well.  I hope you get the visa quickly!

Thank you! I messaged some other people who were at the interview today as they might have the same problem.

Here's an image of what shows on the site just to get an idea, in case anyone knows why it's like that or has it in the future:

I think that would be your best bet.  I've never heard of it saying issued but in AP before?

There was another person on the forum that I've found. Hers took 18 days to be printed. My husband wanted to get plane tickets to Vancouver to pick up our belongings from storage but we've decided not to until we have the passport and paperwork in hand. Hopefully the status will change tomorrow or DOS can help.

IR-1 / CR-1 Spouse Visa Process & ProceduresCEAC Issued Question

I know I'm being paranoid and that all people go through AP but is the wording on this normal? From what I've found, it should say it's been printed when it says issued...Please correct me if I'm wrong.

Issued
Immigrant Visa Case Number: MTL2013xxxxxx MTL Case Creation Date: 14-Jun-2013 Status Updated Date: 20-Nov-2013

Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. As the officer told you in the interview, if further information is needed, you will be contacted. If your visa application is approved when administrative processing is finished, you will receive notification to collect the passport with the visa from the Loomis branch you selected when you booked your appointment.

The officer didn't say anything about administrative processing, just said we were approved and that it should take 2 weeks to receive the passport and POE letter back....then again I've heard the CEAC isn't too reliable either.

Thank you!

Not sure if anyone is filling it out anymore but...

1. Country USC resides in: Canada
2. Is there a USCIS field office in this country / Is DCF still possible? No, I wish!
3. When did you file the I-130: March 2013
4. How long had you been living abroad: 6 months on visitor visa(May to Nov. 2012) and from November 2012 to current date on a study visa.
5. Do you reside in the country legally? Yes
6. What is the reason for your residence: work permit/student/tourist/ Student/tourist
7. Did you list your foreign address on all forms in I-130 package? Yes
8. Did you send I-130 package from abroad? Yes
9. Did you include evidence of your residence abroad in the I-130 package? Yes. Wrote all locations and dates where photos were taken, they were to establish our relationship. I even provided my Canadian health card, student card and a copy of my study permit as well as leases abroad.
10. Did you mention the fact you reside abroad in the cover letter or write a letter describing your current situation and the evolution of your relationship with your spouse (mentioning your residence abroad)? Yes.
11. Has your case been "auto-expedited"? How long between NOA1 and NOA2? Nope. It took 73 days to leave USCIS.

We couldn't view anything about our case online and when we moved to Quebec due to financial hardship in the last month of the USCIS approval- they refused to update our contact information saying it doesn't matter because both of us are abroad and we couldn't receive anything in the mail anyway(Always received the documents that were sent by postal mail). Had to have NVC confirm and update everything after they received it.

K-1 Fiance(e) Visa Case Filing and Progress Reportsrefusal notice . I'm not happy

I found a co sponsor that has a household of 4+1 for my fiance so its 5. Together with his wife he made $80,000 +  on his 2012 tax return with him alone he made $55,000 of that . Income guidelines for a family of 5 is 34462. This should be enough and even if they filed jointly and they look at his income only on the tax return, it shows he made $55,000 by himself. Am i correct. Also if they help me like they said . Is it only binding until i file the AOS and affidavit for support which from  what i understand would include just my income for my house . What do u guys mean when it says not legally binding.

You still need to follow the guidelines for I-134, do not look at anything for 864, it will be rejected, and your visa will be denied, as it is the wrong form.

What i'm saying is that they base their decision off the 864. I sent in the i134 and thats what i'm using

K-1 Fiance(e) Visa Case Filing and Progress Reportsrefusal notice . I'm not happy

Being direct is not the same as being rude.....rude is the catchall name when people post something that someone does not want to hear. Meanwhile, others freely castigate the embassy or consuls, as if they know far more than the very people who have been trained and have the experience and knowledge to conduct their job/responsibilities far beyond the knowledge base of any single applicant.

Perhaps many would prefer to read something like..."oh, just call your congressman and set the embassy straight..." while failing to realize that no congressman can order the embassy to do anything. Congress is in the Legislative branch of our government while the State Dept is in the Executive branch,....and no one from one branch can tell somebody in another branch of our government what to do.

Voicing displeasure or disagreement won't bring about a solution, no matter who agrees or disagrees with your complaint. Better to respond to the request of the embassy rather than try to elicit some random reply from people who have no knowledge of the rules and regulations, but have only an opinion that is not likely to be based on their vast experience in the field of immigration law.

The interviewing officer likely has interviewed hundreds if not thousands of applicants, depending on their own time in the State Dept....that amount of first hand experience and exposure to our laws greatly exceeds by leaps and bounds opinions of others who have not sat behind the interviewing window.

You know what are you a consular officer. It seem like u know everything there is to know about the steps an officer make when making a decision. Like i said if u don't have nothing nice to say, keep it moveing. Obviously if you knew everything you would not bee on visa journey like the rest of us. Have you ever thought about that. Keep your comments to ur self if there not going to at least try and help make my situation better. Pleas do not comment on my post anymore because your not a positive person , ur just someone who does not give a dam about the bullshit that comes out of there mouth.

I am so sorry to hear this.

Our embassy looks at last year's income.  I know that others informed you they are not supposed to, but they do.  If your income for 2012 does not meet, then you need a co-sponsor.

Did you have everything bundled together with a cover sheet, or did you have things separated. We just handed over the entire packet to the person. They did not return anything. the only thing they did not accept was pictures.

You can marry him, if you choose and then your 2013 income will count as you will have that tax transcript.

You are not refused, if they are requesting a co-sponsor....I would try finding someone, they are not going to be responsible when you file AOS.  Your 2013 income will be sufficient for AOS, so you will not need a co-sponsor.

I thought that if i get a co sponser i have to file with them when i do the adjustment of status.

K-1 Fiance(e) Visa Case Filing and Progress Reportsrefusal notice . I'm not happy

Hi my fiance had his interview this morning and. First off I have to say that I?m very disappointed because they gave him a paper saying I don?t qualify because I don?t make enough. I do make enough. He said you they only took the affidavit and my tax transcripts and did not take none of my financial documents or anything such as paystubs and job letters from my job which shows I gotten a raise and everything that shows that I make enough. Yes it does not state it on the tax transcripts because if I gotten a raise in 2013 it is not going to say I make that from both of my jobs. I have worked two jobs and worked very hard to meet the income guidelines just for them to say I don?t . I worked had just so I would meet the financial part of this and for them to say that I don?t qualify that is a big blow to the head when I know I make enough. And for the fact that they did not look at paystubs and asked us to bring these items. Is there something i can do. They said i need a sponsor but i don't have one. Can i marry him there then file for one him to come.
