I discussed this with my lawyer last night and he informed me that all files are scanned and digitized at the time they process your NOA1. I'm not buying that this flood has caused any real delays. CSC has been stagnant with our cases since late October and instead of providing honest answers they have gone on a misinformation campaign.


I figured they had to have an electronic copy somewhere. I filed and received my NOA1 on July 26. My fiance came to visit me in September, and they pulled him aside in customs and questioned him about his visit, the petition, etc. He didn't pay much attention to the papers they had with them, but he said it looked like some of the paperwork that we submitted for the petition.

I spoke with my congressional unit and no files in CA were destroyed. That information was not correct. The building was closed for two days. None of the I-129F’s were affected. There were some I-130 (Spousal/Child) petitions that got wet – but again, not destroyed. They did lose some computer hardware but they are still up and running.

My liaison stated that you are eligible for processing based on your submittal date. He is going to pull your file and process it. I know that you are very anxious to have your fiancé here in the US. My liaison will call me when it is complete.

Hi, I was forwarded here and hope someone can help!
I'm currently filling out the I-130 for my husband(Canadian) and found a problem in answering some of the questions.
I'm a US citizen currently living with my husband in Canada, I'm on a study permit so we will eventually have to go back to the US however we decided it would be best for us to move back this year if possible due to unforeseen financial circumstances. My father has agreed to be a co-sponsor, as I'm a student and cannot easily/legally work in Canada.

Here's our problem: My husband and I plan to move to Portland, OR to live, work, and continue our education at some point. However, I won't be able to officially get a job until we move there and attend some interviews. This is the same problem with apartments, we can apply for them but we most likely won't get a lease unless the manager meets us in person. My parents have agreed to let us stay with them in Nebraska as needed, their address is my permanent address in the US. Since the Montreal consulate is picky about domicile, would it be best for my husband and I to move back to Nebraska for a couple of months before moving to Portland?
Are PR's allowed to move around freely, without scrutiny, in the US after being admitted?
We need to continue our education part-time but the only place that we can afford that offers our majors is in Portland...we can delay a semester(3-4 months) but not longer than that - I'll forget all the Japanese I learned!

Also, in B.2 of the I-130 I should put my address abroad, correct? We need to move back to the US as soon as possible.
On C.18 should I put N/A and list we are going to Portland or my parents?
If there's no problem with us moving to Portland a month or so after moving to my parents house in NE, I'll put my parents address for C.18.

The documents I have/can have for establishing domicile are:
Apartment inquiries(this could be apartment applications near the time of interview)
Job applications/contacts
Moving Quotes
School applications(college)
Admission records

CanadaI-130 Approved~ What now?

Hi,

 

Due to financial problems my husband and I moved May 21st to Quebec...We sent an AR-11 with a letter yesterday to change our address from our old BC address. Today, I signed on and could finally view the status of our case only to find: "On May 23, 2013, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice."

 

I called and talked with an officer at USCIS and he said there was nothing that could be done to have the notice sent to us in Quebec. We even tried mail forwarding but the post-office in BC denied us the service. We have no friends or family that could get the letter and sent it to us... What do we do now? Will we recieve an email that gives us the information for NVC? We are opted in for email reciepts but they didn't send us one for the approval.

 

If I have to contact NVC, what do I need to ask them?

 

I'm really confused as to what we need to do now, so any help is appreciated.

Wow, okay. My husband called and finally got the story straight. So...How do I go about this...

We sent them the record on July 17th, they received it, looked at it, and then RFE'd us for a missing police record August 8th. When I called to confirm it August 9th they told me they never received anything and would have a supervisor look at it. We sent another copy, in response to the checklist right after the call. The next week I called and was told to email a expedite and supervisor review with the document in it. A month later on September 6th we received another RFE, this time telling us that the document was wrong but not specifying what was wrong on it. I called that night and in response they said that they never received an RCMP police record check, that the file was not a pdf and to send it again. I demanded to be told what was wrong with it but was refused detailed stating they never received it-it was corrupt. Later that night my husband(beneficiary) called back(3 times) to get more information, he was told they did not have it, that the file was corrupt but to call back on Monday for a supervisor to look at it(just before mid-night so none were available). On Monday, today- September 9th, he called starting at 9am. The first call told him to call back because the supervisors were in a meeting. An hour later he called back, the person told him they had the record but wouldn't let him talk to a supervisor, said they were busy and hung up. The next person, he asked to be transferred right away - they refused and hung up. The next person asked for his stuff(higher ranked) and found that they had the document and were looking right at it the whole time. Every time we called, they saw the document and told us it never existed. They transferred him to a supervisor, Betsy - she's so nice! - but none were available in the department we needed. She looked at it and said the translation was wrong - as I'd suspected the whole time, it had to of been the only thing- if there was any sort of problem with it to begin with. The way that the Longueuil Police translates their police record checks makes it so they search a database that doesn't exist, even though it's really the CPIC databank. The supervisor marked it and put it in queue but told him to get one from another place while we wait for the expedite review. We went and explained everything at the place I listed above (recommended in the wiki) and the guy filled out a over-night request. We'll have a properly translated document in hand by 11am tomorrow.($65)

 

**ALSO, we had problems with the expedite request and sent more than one email due to what I figured was server block because there was no Auto-responses. Last week, we received an email stating our expedite is under review at the consulate - for an email that didn't have an auto-response. Today...I don't know if they're that unorganized or what but we received another expedite review for the ONE and ONLY email that we did get an auto-response on. I doubt it can mess up our case anymore but it's indicative of how unstructured NVC really is. Out of the four expedite request(3 seeming failed to have been received) we got two requests through. That means if people need an expedite request and they get denied, they could just send another because it won't be handled by the same people... Right?? Any thoughts on this? I thought it was really weird.

 

So...

This whole time, practically 2 months, was wasted because the lied to us from the very beginning. If they had admitted to having a police record and just told us the translation was messed up we would have received a case complete the 6th instead of a second RFE. That, and they can't simply call a foreign number and verify the database searched without having a fit, that detail is the most ridiculous.

I was not able to get a CPIC certificate from the city (Montreal), or SQ police, I had to use this service when I was in Montreal... so, maybe just verify that what you got says "CPIC" - see Police Records here: http://travel.state....5.html?cid=9013

They verified it was good. The issue is, NVC won't tell us what is wrong. They deny having the document and then they say it's not a pdf when it is. We can't even know if anything is wrong because they refuse to even acknowledge the documents existence. Hence the calling tomorrow and getting the document for another place as a backup.

It's a "certified criminal record check" from the local RCMP, we followed the directions on the state.gov and RCMP websites to get it. All agencies we have contacted verified it and told us others have used the same thing with little problems. The problem is at NVC for now.

Ha, I know! That's the thing, the whole IV documents were in ONE pdf file. The police record was on page 13 of the pdf they already open, looked at, and accepted everything from. Page 13 is not corrupt, it's perfectly clear. Files don't just get damaged on one page. This is what I keep telling them... They already looked at it and have it. They just refuse to accept that it's in the original pdf file sent in July. Either way, the new checklist pdf I made and sent them last month was only 3 to 4 pages long(cover letters and an added scan of the envelope from RCMP so they know it's from them), they should have been able to find it in that but apparently they couldn't.

I'm not sure, I'll ask my husband later if he has their name and stuff.

Have you tried the Commisionaires instead for the police check?

 

What's that? 

My husband called at around midnight last night and finally got them to admit they received it but they denied it being a pdf file. Which means the person who downloaded it from their mail client is incompetent and broke his version of the file. OR their adobe reader software needs updated, OR their computers ALL need updated- either way it's a pdf. I saved it as a pdf, it says pdf, I uploaded it as a pdf, my mail service says it's a pdf, when I download from them it's a pdf. A pdf is a pdf unless they break the file by putting "name of file .any other extension" when they download it.

They(supervisor) agreed to go through every email we sent them and look at them one by one for the file- which isn't hard since I know which ones have the pdf for the checklist. We have to call them on Monday and walk them through how to open a pdf file created in Adobe Acrobat. In the mean time I'm sending them another copy of it and getting an extra from:

I called and the guy said they don't have it on record/never recieved it but how can an RFE say it's not correct when they say it's missing.... It says "RCMP registry of Criminal Convictions" as it's sighted source. We already contacted the police station and CPIC last month and they said it was good and the same thing. Our expedite is still at the consulate- it took a month just for them to send it there. This will be the millionth time I gave it to them, we even provided it in the expedite request. On Monday, when my husband is back in town from work we're going to get another record from CPIC's place....

Yes, it's in English. The only thing I can think of is that it says "Service de Police" at the top on the insignia...

CanadaProblems with Canadian Police Record Check

Last month we received an RFE for a "missing" police certificate, that had already been provided in approved DS-260 documents. Now, a month of wait and I get another RFE for "10 - Canada Police Certificate - The police certificate that you have submitted does not fulfill
the necessary requirements". We got it from the local Longueuil, QC police station. It's in date and everything is correct, I'm on the phone - waiting- right now. But #######? Now we have to wait another month for their ###### up??? I don't see what's wrong with it. Everything is correct and others have used the same form.

We're going to his family doctor on Monday and are going to ask for his immunization history, I'm pretty sure if you're over 18 and you followed all of your immunizations when you were a kid all you would mostly likely need is an updated dTap and influenza shot. Make sure to check your past immunization records to be sure though as many shot requirements have changed in the past decades.

I will find the post and post it here. There was more than one person saying they got approved in jamaican when they used it as part of there income.

It does not make any since for them to use the form I864 for the k 1 and then not allow child support when it is clearly state in the instruction that you can use it. I already emailed kingston to verify that but from the other post i was reading from different places and people said they got there visa after showing child support as part of  their income i'm not worried . But like i said it clearly state you can use it in the instructions. Why wouldn't they use it if the instructions says it can be used. Doesnt make since to me.

JA does not accept child support as income, they state it is too inconsistent. They will request a co-sponsor.

I-134 is used for K-1. Co-sponsors use the same form.

JA is funny acting when it comes to income. They look at last year's income, so make sure you filed your taxes, and have either a copy of your taxes or tax transcript for the past two years. JA does not count unemployment or child support as income. You do not need to include assets if you make enough income.

Also, if you are self-employed make sure you have everything to prove you meet the income guidelines. They look at certain info on your taxes to see if after your tax deductions, you meet income guidelines.

If JA says you have to have a co-sponsor, they will deny your petition under 221g, if you do not have one.

Thank you for the response! We have not made a phone call this week. But we did call NVC last week. I just panic when i read that email from NVC and thought it got lost too. So i guess, its pretty normal these days that USCIS dont send it right away to NVC.

Well i phoned them, on a different number than above, went through the non-immigrant route and managed to blag details and helpful info. Led me going to the website to pay my courier and visa fee already, despite no instructions to yet, as its valid for 1 year, and have done so obviously. Tried phoning again after doing this to see if it auto put me for an interview and if i could change it, but with no luck. 

During my second call though Errin rang DoS in America, and they said packet 3 had all been logged and packet 4 was due to be sent out. Her exact words were that ''packet 4 was being issued but not updated as sent out yet'' Not bad really as im completely fobbing my way through this and getting way ahead of myself with what I'm doing. Those who dare...... wink.png

 

 

If you have a reason to expedite, a snail mail request with paper documentation (of the pregnancy and complications) by a doctor would be a good idea. Also check your insurance to see how long it takes her to be covered and that the prexisting condition is okay. The cost of delivery in the US can easily run over $10k and with complications or need for neonatal ICU it is going to cost a lot, even with insurance. Whereas in the UK, there is NHS.

 

Well NN, not quite as simple as that, she unfortunately is still in Illinois and I am here.....so there will be no NHS. However her job covers her and family full medical, and she has an over the top plan on top of that too. So we're good.....i just need to get back!

My case has recently updated for both acceptance of my medical, and also the ds160/readiness form.

 

I will be emailing both available channels in order to try speed up the appointment for medical rasons, but was hoping someone had a number i could call?

 

I have called (0)20 7499-9000, but that doesnt seem to get me anywhere? Or am i missing something? The automated does ask for a 4 digit (think) extension number if i know one, but i obviously dont. Does anyone know the extension i might need or have an alternate number that i could try and do this through?

on the online readiness form. it says namE, but does it mean namE or namES?!?! I know how pedantic they can be about these type of things! I am mulling over what to put now...thinking I'll include my middle name too, as in the rest of the forms/process, it has been necessary..... it wouldn't have been hard for it to be clarified though, or a simple Given name(s)..... i swear they try and make this as hard as possible! And we're a worrying and, rightly so, paranoid, bunch!

 

As per the rushing of interview if at all possible, think i am going to try all 3 options you mentioned! It cant hurt!

 

 

And your right Sharkano, i seriously don't think they know whats going on themselves. Must be a nightmare there at the moment, processing 3 different version at the same time likely! I'd imagine the staff hate this as much as us!

Received my NOA2, aug 26th, and finally after 7 weeks, NVC got my case, and case number the same day, and it was forwarded onto the London embassy arriving last friday, the 18th of October. I had taken a chance that it would arrive after around a week from the NVC, so i also had my medical on the 18th...finished at 3pm....updated on CEAC website at 4pm that case had arrived! Nice bit of luck there :)

 

So, I've now completed my DS160 this morning, and was expecting i had to send in the DS2001 readiness form. HOWEVER, seems like I'm outdated on this now.....

 

Am i right that i actually now need to fill in an online readiness form, specifically this one.....

If so, and this is where it gets a little complicated, we have half the wedding arranged for january 6th.... and our first child due on the 15th...however due to a complicated pregnancy (incompetent cervix) she will likely deliver the 8th or 9th/day of our choosing. SO....I WAS planning on sending a cover letter with the DS 2001 including a letter from her Doctor, and cover letter, explaining why I needed a rushed appointment if possible due to the pregnancy complications/chances of early delivery.

 

As further info, i have Not waited for packet 3 etc to arrive, and have zero intention of waiting for 4 either if possible to keep things moving as fast as possible.

 

So, i suppose to sum up.....

 

How do i send in my readiness form? Is it the online one above?

And how can i try and rush an interview?

It does thank you! Sounds like i may be better asking the hotel im staying at to store them for me, likely free, and for the sake of an extra mile walk! Make it easier to get first in the queue space too if im not part of all the people at goulds biggrin.png

I got my expedite request and had my interview today, a week later! Approved btw :) 

Best thing to do is call DoS, they will know the dates etc before you ever receive any mail etc....i never received my mail through post in time...

Sorry yes, i did know the total was $1070, if im correct its 985 for the app and 85 for bio's? Don't worry though, i enjoy the ever escalating costs....you get what you pay for in life, and the wife to be is costing me a fortune so she must be a good'un :D

K1s don't pay an entry fee. You must have been reading somebody who got an IR1/CR1 spouse visa. You'll pay through the nose for your AOS application.

 

really! awesome! financially in this process first bit of good news i think I've had! I must have read it wrong as you said as I remember reading somewhere I had a $160 (think) fee to pay to NVC or somewhere!

 

Even better news as i thought the AoS was $500 to about a week ago, misread again, and its $985. Though, whats money for happiness biggrin.png

Interview on monday went swimmingly :) even with a caution and warning on my police report which i was super scared about!

 

NOW..... changed today to ISSUED...eek, haha, but i cant remember where i have to go to pay this final ''entry fee'' or whatever it is.

Urgh, well i dont know going off this and the rest of info then. My interviews at 0900 though, and i will be stood outside the embassy at around 0715. Guess we'll see what happens! Hopefully it wont be raining and more so that I get to go in ASAP! 

 

I also do NOT have my letter of confirmation of interview from them, but i do have an email from my inquiries into a speedy interview;
