CanadaTaxes Question

So I (petitioner) resided in Canada with my husband as a student this whole past year while we waited for him(beneficiary) to be approved for PR. I didn't make any income(illegal to work under my permit). We're going to POE next week and I was thinking on how we were going to file taxes. Has any one had any experience with this?

 

He was a student this past year as well, he worked part time at the beginning of the year but was laid off in Feburary and had to claim EI, his employer(s) refused to give him his income(t4?) form to file income this past year - they got in trouble. I doubt they'll give it to us for this coming tax season. After EI was up, he finally managed to find another crappy job to hold us over until we could move but they fired him after he hurt his back working there. So it's my understanding, he files taxes in Canada and then....how does the filing for US work? I doubt we'll be able to find jobs in the US in December(end of tax year) as in my town it's the firing season - everyone gets laid off and companies cut back.

 

So say he claims on his Canadian tax roughly 10k. We file this as soon as possible when tax season starts, right? After that we file married-jointly and state what? I had no income (father is co-sponsor), do we just put the income he made and file by hand with a copy of his canadian tax forms or?? It's my understanding they cannot tax us if the money has already been taxed.

 

P.S. do you know if I need to include any left over federal student loan $$? I know a get a tax break from having paid interest on it but I don't see how I'd get a tax break for $0 income haha.

Paying bills in your own name, renting, etc.. all builds credit in Canada, abet at a smaller rate than a credit card or loan would.   Your credit in Canada does not follow you to the USA and vice versa.  Basically this form says that you are a tax paying member of the USA.  The SSN gives you social security (it's the exact same as a SIN in Canada... needed to work and pay taxes) but doesn't help build your credit at all.   If he doesn't have much of a credit rating in Canada it's mostly because he hasn't had a lot of bills, hasn't rented or owned a home or had credit cards.  Student loans can help start building people's credit in Canada at least.  I know my went to collections in Canada but I eventually worked out a deal and paid them off so they ended up reflecting better on my credit vs negatively.  

 

Because I opened this account without an SSN is why I needed to send them the W9 form.  If you guys don't have a US account yet, you probably don't need to worry about it.

It's strange, everyone I've talked to said he literally cannot build credit before being 21 in Canada....If that's not true then he must have decent credit by now since we've rented, had credit cards, school loans, tons of other bills, etc. since being in Canada.

CanadaW-9 form

I was told by RBC today, when I applied for a credit card, to submit to them a w9 so that the IRS can start my credit rating.  Just thought other people should know this and check with their banks to see if they need to submit a w9 with their SSN.  I couldn't even get a phone contract... /facepalm

 

RBC did approve me based off of my Canadian credit.  It was pretty awesome that I don't have to start completely from the bottom. 

 

Thanks for the heads up! I thought credit went with the SSN though, there's a form we need to fill in order for my husband to be able to start building his US credit? Or is this so banks can see his US credit in Canada?

 

From what he and his bank adviser told me, he doesn't have any credit in Canada because of his age...though I think it should have started since his birthday earlier this year. Then again, we don't do much that involves credit ratings haha.

CanadaProving domicile when not living in the U.S.
My husband and I are not completely at this stage yet but I do have a question.(I'm the petitioner)

I can submit a "lease" that we've made with my parents, it's an open ended arrival with open ended leave, up to 2 years and is in NE.
However my husband and I are thinking about going to OR instead, so we can continue our education and actually hold jobs.
Would this be seen as conflicting information? My permanent residence is in NE, I'm on a study permit in Canada so anywhere I go up here is legally only a temporary address. We don't want to actually have to move there unless we have to since there's nothing there for us in terms of living our lives/dreams.

Would our lease with my parents, job application/hunt in NE and OR, Apartment search in OR, quotes for plane/moving, my valid NE driver's lic and voter registration, USA college/university acceptance letter/transfer request &/or class registration, fafsa(lists of schools sent for- in US) be good enough?

Maybe I'm over thinking things?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsBeen with NVC for about a month, recieved email from USCIS...

Our petition was approved and sent to NVC last month. We had mover the 21st and I sent a change of address to USCIS but they never did anything. Now, a month and a half later(from send the letter) I received an email from USCIS stating : "On June 28, 2013, your address was changed relating to the I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN that you filed. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance."

We contacted them so long ago and were told we couldn't change anything because we lived abroad. Now it says the case is in initial review AGAIN.

Is this going to effect our case at NVC? NVC has all our updated information....

Does it mean our case is reset and will have to be approved again?

We were just about to pay the AOS fees too..

 

Any help is appreciated,

I got my approval on September 11th and i been waiting patiently.From what i understand from what the man at uscis told me that my case was not forwarded to the nvc until last Thursday October 10th and that it would be a couple days before they get it. I'm sooo lonely without my hunny just want to get this over with.

Ok I need help because I have applied for my k-1 visa since July 27 2012 and I still have not received anything from USCIS I have been calling for 2 months and they have been telling me they are working on cases submitted July 17 2012 my case was sent to the California service center.

I have also heard it makes a difference because my husband is from Iraq so I can experience longer wait times? It has been almost 7 months and I have visited him 2 times since I applied for a k-1 visa.

Sorry to say, but if your 5 months JUST passed and you filed at CSC, there is nothing you can do. My NOA1 was July 26th. After 5 1/2 months I called and they said I couldn't put in a service request because I was "still within normal processing times." After six months passed, I called again and they said the same thing but that I should hear within 9 days and if not I could call back. So I called back after ten days (on Feb. 1) and they said that I was STILL within the normal processing times and I had to wait three MORE weeks before calling back and putting in a service request. They said that they were currently processing apps from July 17th. (To me that seems to be BS because in looking at the forums, a month prior to when I called they were telling people that same date)

Kind of like how CSC's processing time average is 5.5 months and VSC is 6.1 months yet the national average is 7.9 months? Seems to me like someone failed elementary math...

You just filed your K-1 three months ago. We will see how you feel when it has been 7 months and you haven't heard a word, not even an RFE, and you've called USCIS multiple times and one person tells you one thing about processing and another person tells you something completely different. USCIS says they are working on July 18 still, which they have supposedly been on that specific date for TWO MONTHS. They don't have time to finish the second half of July, or even OPEN some of those cases and see if anything else is needed/send an RFE, but they have time to approve cases in September?!

The only thing starting to give me slight hope again is seeing on Igor's list there have been some approvals in the last few days out of CSC, and some of those are mid-July/late July filers. Maybe they are finally back to work on the K-1 petitions.

I discussed this with my lawyer last night and he informed me that all files are scanned and digitized at the time they process your NOA1. I'm not buying that this flood has caused any real delays. CSC has been stagnant with our cases since late October and instead of providing honest answers they have gone on a misinformation campaign.


I figured they had to have an electronic copy somewhere. I filed and received my NOA1 on July 26. My fiance came to visit me in September, and they pulled him aside in customs and questioned him about his visit, the petition, etc. He didn't pay much attention to the papers they had with them, but he said it looked like some of the paperwork that we submitted for the petition.
