I heard from others that for C1 visa they will send the SSN automatically to home address in USA, after arrival, so no need to apply again. But I am not positive about this info, cuz we did K1 visa. VSC is not processing I-130's as fast as they were at the end of 2005 where it was not unusual to see 30-60 day approvals. Things change and it doesn't necessarily mean they are backlogged, they are possibly right now giving priorty to other petition types. It will swing around again...it usually does. If you received a notice stating 30-60 days then that has definately been ammended to a longer time frame as can be seen by the processing dates. Those dates that you say where approvals should of been granted already, are a guideline and at any time that can change. VSC is only now processing I-130's with receipt dates of December 03 which is what you should go by....not the notices that have said 30-60 days.

I know it is frustrating waiting and I hope you hear something soon.

If anyone has problem with VERMONT SERVICE CENTER about processing I-130 Cases. Please do the following three things

  • Please call your state senators and Congressman for help. Please describe your situation and how this center mishandling your case.
  • Please call Dept. of Homeland Security at 202-282-8000 and ask them to transfer to Office of Inspector General. Make a formal complaint about mishandling I-130 cases for US Citizen and Residents.
  • Please call WASHINGTON POST at 202-334-7572 and talk to PAM CONSTABLE. She is a immigration reporter for Washington post and she will write an atricle about this cases. Please get as many people you can find in this same situation.

Me and my fiance had the same problem when filling out our G-325A. I downloaded an updated version of Adobe and all the + signs went away. But my fiance just hand wrote the information that was showing up with a + sign. Hopefully that will be okay, I guess we will find out! But I think its okay to hand write some of the information as long as its neat and legible!

At the moment, I'm a 15 year old Australian girl engaged to a 20 year old US citizen. I'll be turning 16 on the 13th of April, and I'm wondering how I can go about getting a visa to be able to live with him. When I turn 16, I'll be legal in my country, and also in his state. To get married we'll need consent from my parents, which is no problem, as they've already agreed. I know it sounds controversial, but I'm really worried about which visa path I take, because I don't want to screw anything up for myself and not be able to come over to the US.

Also, my father said he called the American consulate here and said that since I have no work experience and no skills, I don't have a much of a chance of attaining any visa. I'm actually curious to know if this is true or if he's lying to me. Sorry to be so dramatic, I'm just kind of in a pickle here. Advice/suggestions very welcome!

Additionally, if anyone knows about the total fees they've had to pay and how long it took them, that kind of information would be really great too.

Work experience and education are not considered in family imigration visa such as the K-1. They are considered for other types of visas.

You need to be considered legally able to marry. Even though 16 is the legal age in some places for marriage, you might run into issues with that. Waiting another two years until your 18 before starting this process might be a good idea. There may come questions about the legitamcy of the relationship since you are still not considered an adult. It wont be very fun to wait 6 months or more for the interview and pay all the fees only to get denied because of your age.

You need to have met each other within the two years prior to filing the I-129F form. You will need to provide proof of the meeting. Anything from photos, to reciepts to boarding passes will help.

Your fiance (or willing co-sponsor) will need to be also prove that he/she makes 125% of the poverty guidlines. Or has enough assets to meet that level for 3-5 years.

Fees total about $1000+ over the whole process, but not all of it has to be paid at once. It is proposed that the fees will increase in 2008. Inital filing is $170. Visa interview and medical could cost $200+ depending if vaccinations are needed. AOS after you get stateside is $500-$800 depending if you decide to file for AP and EAD as well. later on, you will have to pay a fee for removal of condtions, but thats two years after the AOS.

When you go to your K-1 interview, take the child's birth certificate, and have them correct her birthdate. Just explain what happened with you transposing the two numbers.

It isn't that big of a deal at this point. It will become a bigger deal at the K-2 interview stage, so it is a good idea to correct it now and then you won't have any problems later when the K-2 interview comes along.

Were you aware that the K-2 Visa must be obtained (not just applied for) within one year of obtaining the K-1 Visa? I'm just asking because a lot of people are confused about this point.

no we too never used a lawyer but once my husband had taken advice from lawyer for my travel coz my petition is hanging at nvc stage ,
otherwise didnt feel the use of lawyer,

If you read the guides here and follow the directions, you should be fine.

well since i live here in New York, pretty much there are many many phone cards that give you about 1 hr caling time to the dominican republic, and they are only 2 dollars, Now i have over 100 of these aved, and since i was reading the guides i saw that it stated that it wil be good to show calling receipts or etc, but i used these ards because they are affordable and convenient, should i do something, send them, copy it send or what.... thanks

I don't think Love should have barriers, but I do think it should not be taken lightly. Love and marriage requires patience and understanding and a committment to keeping each other financially stable on some level. I think the writer is committed to this, or he wouldn't be goign to school. But to have a woman sell her parents house to afford a plane ticket? That seems to me to be...well, not right. Either way...it's ok to have love take some time. Yes I want my SO here and here now, but....as he says, Honey we are not kids, we can wait the time this will take. If your relationship can not endure a year or two wait, then...how will it endure other things that normally happen, or not normally happen. The same skill set is required to push past the hard times, the lonely times.

I guess I should clarify something. Her parents own a house they are living in in another city, she is living alone in Tbilisi. In a house her parents own. It doesn't mean they are wealthy, they just needed a place for her to go to school from. (her school doesn't have Dorms like a lot of American schools do)

I'm a broke college student, I go to CC and live in my parents basement. I'm 20 years old 8-9k in debt and still going to school. I work one to two days a week because I can't work more with all the classes I have to take to maintain health insurance on my parent's bill. I met my Fiance in High School, and we dated for 3 years and during that time I managed to save up enough money to go visit her last summer, in Georgia (the country). I asked her to marry me in January of '07. I can barely afford car insurance each month to get to and from school, let alone gas, I'd be kaput if it weren't for my parents. She's living in Tbilisi, also under a roof her parents own, she'd have to sell it just to be able to afford the plane ticket here. We need to get together as soon as possible, and another 6-9 months minimum might be a death sentance to us. I'm just starting now because I had no idea how long it took and ~sighs~ I'm feeling pretty hopeless. Could someone who knows something tell me about these things direct me on where to start, tell me about someone who's had it harder to make me feel better, or just put us out of our misery and tell me to simply go there and give up hope on a safe place to raise our children and a chance to achieve our professional and personal goals?

I have couple of questions:

1. My fiancee has a birth certificate from the hospital not from the local muncipal. The birth certificate does not have her name (this is the way it is it India, child is not named immediately), only her Parents name. What else will be required?
2. She is a divorcee. She has a divorce certificate but not a marriage cert. And it may not be possible to get one now. Is there anything else she can do?

BIRTH CERTIFICATE: Original and photocopy. Each applicant must submit an original and a clear photocopy of his/her birth certificate. The certificate should include the applicant's name, date and place of birth, the names of both parents, and the seal of the issuing office, i.e. the municipal authorities. If your name is not mentioned in the birth certificate and if any details are missing in the birth certificate or if there is a discrepancy regarding your date of birth or name, submit the certificate along with secondary evidence.

Secondary evidence can be a baptismal certificate, an adoption decree, a school record, a notarized affidavit from a close relative, a neighbor or friend who was present at the time of your birth on the appropriate stamp paper, which must be sworn before a First Class Magistrate. The person making this affidavit must state how he/she knows your family and how he/she knows the facts of your birth. Secondary evidence must have your name, date and place of birth; names of both parents; and the seal of the issuing office.

If your birth was not recorded, please submit a "no record of birth registration" letter from the relevant municipality along with secondary evidence and if your birth record has been destroyed or the municipality authorities will not issue one, submit a letter from the municipality stating so along with secondary evidence. (See preceding paragraph for definition of "secondary evidence.

TERMINATION OF PREVIOUS MARRIAGE: All applicants who have divorced or whose spouses have died must provide an original and a clear photocopy of proof of the legal termination of all previous marriages (death certificate of spouse, divorce decree). Divorce between Hindus and Christians must be documented by a court order. A certificate from the Kazi or the head of the Jammat must document divorce between Muslims. If any of these documents were issued in a local language, a notarized English translation is required in addition to the original.
