I am USC and I had filed I -130 for my overseas spouse on 1 Feb 2006, after six months, I have not had NOA-2 yet.So last month on July 29, I called USCIS and they made a service request and they told me within 30 days, I should receive something about my case.After past 30 days I did not receive anything,

Today when i called them again(as u see date for VSC is 23 Feb2006 for I-130)for my case. The lady was nice and she was putting request again, but her computer said that they sent something in mail yesterday.

I am curious , what that would be??hoping not the same ####### saying please wait until 30 days pass of your processing date.anyone any idea plz??

I don't want to give you any false hopes here, but I called them on the 24th of August to see what was going on with our K-3 and was told that something was mailed out. FOr some reason, I don't think that they are allowed to tell us what it is just in case we don't get it in the post. I am not sure. But I was told the same thing to call back in 30 days if I hadn't heard anything. They also told me that with the RFE's, they have 30 days to give approvals from the returned date of the RFE if you know what I mean.. Low and behold, I was touched on the 24th, and on the 28th of August, my gf called me from the states to let me know that she had received our NOA2. Keep your chin up...things will start moving again.

We have been lucky enough to be approved for both petitions and our I-129F case is on its way to London. As my husband and I miss each other so much we obviously want to be together asap and looks like this will be happening pretty soon.
My question is instead of AOS when I get to the US, we are thinking that it will just be easier for me to come back to the UK when my interview is scheduled.
However obviously I do not want to be coming back as soon as I get there, so if we hold off with mailing the forms back does the I-130 approval run out?

This makes sense? Basically if i delay sending back the AOS bill etc for about a month will the approval ever become void?


Hiya Gemma..right...I would have to say that the Approval does run out just like the I-129f runs out. If you notice on the approval, there is a valid from date and to date. Ours is valid from August 24 until Dec 24 2006. I would think that that would be the same. I wouldn't worry about it tho IMO. Think about it, the K-3 is moving pretty quick, you should be getting package 3 soon, and the interview shouldn't be too far off from that. Let's say you got the approval for the I-130 this month. Remember, it sits longer at NVC. Like 2-3 months. Then, the USC gets sent forms that have to be filled out by you and him, then gets sent to the consulate in London. Ian and I are going to just go with the K-3 then he will fly back for the I-130 interview. This will give him a chance to see the family again and will give him the big immigrant visa. I wouldn't worry too much at this time about it. Just think about the K-3 and what is ahead for that.

Sorry, didn't see that you got your approval already for the I-130. I still wouldn't worry. Just let them both play out. It will still be siiting longer at NVC.

Seeing as to how our case was not touched since July 28th, I decided to give a ring to the USCIS. I was then told that you have ot wait 180 days from the date they recieve the transferred case to even call and inquire about it. Just a friendly reminder ;)~

Hiya Bombay...yeah we are ready for the K-3 and hopefully even with the Embassy LOSING our returned packet3, we won't be slowed down to much. Ian will fly back for the CR-1 interview eventually when that comes to the Embassy. WHat you have to remember is, the I-130 petition stays at NVC for a few months before it is even sent to the Embassy over here in the UK. So I think it is safe to say that the K-3 will be done by then. ;)~ Thanks for the well wishes everyone!!!!

Hey Laura, great to hear from you girl.

The cost difference really is the airfair. As you haven't started the NVC process it may be preferable to adjust status from the K-3 as you are still looking at 2-3 months at NVC, whatever time it takes to be forwarded to the consulate, and the time it takes for an interview to be scheduled. So all up you are still looking at approx 5-6 months until a CR-1 interview. On the otherside, from all I have read, adjusting status can be a right pain in the butt.

Thanks guys! So I guess my next question would be this, if we contiune with ajustment of status, how long would it take for ian to get his employment papers?? That is the real concern here as I am not yet working (but actively looking).?! Thanks so much guys for the help.

Hi everyone! It's been a while since I have been online due to Ian and I finally making it over from the UK to NY. As soon as I have time, I will sit down and properly write up a report of how things have been and what we are doing. For right now, I need a few questions answered please. Right now, Ian and I are debating whether we should follow through with the CR-1 and have Ian fly back for the interview, or if we should start his change of status on the K-3 visa. We are close to Buffalo and were told before that we could go there and file for the change of status but when we drove up there, we found out that they are no longer accepting the applications and we now have to go through Chicago, which of course takes longer. Our question is this, the big visa has been approved on this side, now we are just waiting to send in the 70 dollar fee before they can go any further. What would cost more? Doing the AOS, or following through with the CR-1. Can anyone please help us with this? I thought that the AOS would cost more money and take longer. WHat are the opinions of the group here???

Hiya livewire. Right, what country did you get married in? It will be a whole new process, and you have to notify the USCIS office that you originally filed with, the change of plans. Also, it is my understanding that the foreign spouse will not be able to live in the US until approved for the K-3 visa. So in other words, you are in the same boat as the rest of us I am afraid unless like you are like myself where you can stay with your spouse in his or her own country until the K-3 is approved. If you try and stay in the States, it will be much harder for you I believe. I am sure that someone with more knowledge on this sort of thing will respond soon enough. But I do know that I am correct in saying that the foreign spouse will not be able to stay in the States once the K-3 application has been filed. Hope that helps somewhat.

Right, I was in the same boat as you. But unfortunately, it isn't that easy to just get married in the UK anymore. You will have to go back to the states and get a visitor for marriage visa. I had to do that in order to get married myself. The registars office wont even touch you until you have that visa stamped in your passport. Once you come back from the states with that visa, you then have to wait an additional 7 days to take up residence and you will have to provide proof of that as well. Once the 7 days is up, you may then go and make your announcement with the registars office, then you will have to wait an additional 15 days before you can get married. I hope this helps. I forgot to add, you may go online from the UK and apply for your visa and then make an appointment to turn in all documentation that will be needed. You will need proof of financial support, any divorce decrees, bank statments. You will not be able to stay in the UK and wait for the visa. You must be in the US. The reason being, the customs in the UK need to see that and stamp it with entry date. Also, when you make your appointment at the British EMbassy in the states, it would be better if you goto say California or Washington I believe because they have appointments right away where as NY office you have to wait until they open up the dates for each month. I had to wait a month before I could even make my appointment.

Hi everyone

Hope someone can help me (and my friend) out!

Basically my friend (British) has met the man of her dreams (American). Now that she has graduated from University she wishes to go to the USA under the visa waiver program and stay with him for the maximum 90 days, before returning home. Then approximately 6 weeks later she intends to go back in again on the visa waiver program and stay for the maximum 90 days before returning home once again.

Is there any issue with repeatedly entering under the visa waiver program for the maximum period? I've tried researching this myself but to no avail!

I would be very careful, that is what I would tell your friend. I being the USC, did that coming to the UK. I came here last May, was suppose to stay until August, then ended up staying past that. My 6 months was up last November (6 months is what the USC is allotted when you come to the UK), and we ended up going to Spain for a week then coming back. I was told by customs that they would give me another stamp and let me go through, but if I did it again without a visa (other than the vwp), then they more than likely won't let me through again. I had to come back to NY to get my visitor for marriage visa back in March so I am good until Sept.

I am not saying that your friend won't get through, but I am not saying she will either. It is a risk no matter what. Is there a way where she can apply for a visa that would allow her to work or anything?

After all that worry about the visa not arriving in time for the flight, IT ARRIVED THIS MORNING!!!!!

Along with the mysterious brown envilope. The visa is sooo pretty lots of different colours.


Side note: i payed £22.50 to get the visa faster and before 8 oclock, it arrived 4 days later. My friend payed £9.50 and got it yesterday!!

Thanks again for your continuing support for the last 9 months. I can not believ its finally over and on Tuesday ill be with my baby for good, about time!!!!

I sent my k1 on june 5 and it was received at Vermon on june 7th...........i have not recieved a NOA1....would it be aproblem if my fiancee visits me for 2 weeks.........she's thinking of coming next week.

Is your wife part of the VWP? If she isn't then I believe it would be a definate no for her coming to visit you. If she is, there is still a risk of being sent back without leaving the airport. I believe it would be riskier for a K-1 petitioner due to the fact that it is easier to just get married without waiting for the K-1 once she is in the US then it would be if you were already married and waiting for the K-3. Either way, it is a risk that can go either way. It all comes down to who she gets at customs and what kind of mood they are in. I know being American myself I have been given a hassle coming back into the country.

THis is just my opinion. The only thing I know to be fact is about the Visa Waiver Program. It is a risk you need to weigh out and see if it is important taking it when it could potentially cause problems in the future. Goodluck with whatever you decide.

I don't think that there is anyway of saving it. Also, I don't think there is a need to print it out. Being touched can be anything really it doesn't necessarily mean that they have done something to the case to move it along. Just be glad that yours has been touched lol. I am still waiting and we have about the same timeline. I still haven't even received my RFE for my K-3 while others who have sent theirs in the same time have. I wouldn't worry about it.

Just checked with NVC....they are customer friendly. She was almost holding my hand on the phone and explained that average wait time is at least 2 to 4 weeks. She has also seen cases where CSC did not transmit cases for 90 days. I hope that is not the case for us.

I don't think that you have anything to worry about. The only reason why a case would be held up for that long is if while doing a security check something came up with either your name or your fiances name. ALso, the cases that can take upto 90 days are the CR-1 cases that are the grand daddy of all visas. That is the actualy immigrant visa versus the K visas which are non immigrant visas. Don't worry. At least yours in in NVC...we are still waiting weeeeeep..

I have come to the conclusion that the NOA1 date and the RFE date make NO DIFFERENCE in approvals. I have now seen people with RFE dates of when they sent things back two weeks later than I, and I still have no approval.

Conclusion: Nothing but the wind matters at CSC and customer service is just talking when they say they base it on the RFE date now.

Total Time from Application Receipt:
Days: 129
Business Days: 94

Total Time from RFE received at CSC:
Days: 36
Business Days: 27

touches mean something. its that you dont know what the resoult of a touch is til normally 2 -3 weeks later. it means they are updating or keying in information. its a sign of life if you will. it gives people " HOPE"
in this hellish process. admit it. you were happy when you got " TOUCHED" as all of us were when we first started.

I agree with you to some point. Yes, we were all excited about getting touched...who wouldnt be?? But for some ppl to turn around and say that a touch means that you are going to be approved is wrong. A touch could literally be anything. Yes, it is nice knowing that you are getting touched because it means something is going on. But I don't believe in false hopes....be excited about a touch yes..but don't put all your eggs in one basket thinking that a touch means it is getting approved. ON our K-3 we were touched numerous times then the last day was the 24th;..a few days later we found out that the NOA2 was mailed out to us on that day..but that isnt the same for everyone...

I'm sick of reading about newer member telling newbies they been touched 2 days in a row, and soon they will be approved.

The older VJers can back me up & say touches mean they are working on your case but it in NO WAY suggests an imminent approval. Please do not get people's hopes up.

I had touches 6 days in a row & wasn't approved for 3 weeks. GaryC (& others) had the same touches & STILL is not approved. They really do mean NOTHING. Please stop telling people it means an approval.

I agree with you. I know I don't like it when I see that from members that have joined after me, still gets my hopes up. My I-130 was touched touched touched, but stopped getting touched on the 28th of July. Now we are almost in Sept. It is very disheartening to hear such rubbish then only to be let down. I rather know the facts and nothing but the facts...and true ones at that!!!

Best bit of advice tho...just ignore those false hopes. Go by what you know. I always tell ppl that a touch is when they look at your case or it gets moved, nothing more nothing less. Yes it is true that a touch "could" be something more, but until you know for sure and have that approval..don't count on it.

I finally received mine in the mail and was wondering how many others got their's already?


And a question to those who received their IMBRA RFE's back when they were doing the mass mail outs - how many of you got approvals soon after it? Do you suppose they are still expediting any petitions that used the old form? When mailing it back, did you send it certified? Before I knew it would come with a return envelope, I was planning on sending it express mail, but now I'm thinking that might slow down the processing?


I'm keeping my finger's crossed that this means my petition is ready to be adjudicated and they only need the supplemental questionnaire to give me my NOA2. :star:

First...RELAX!!! LOL I can just picture you sat there going all nutz. Ian and I never even got anything in the mail in regards to our RFE being sent back and recieved. We only got an email. We never even got an email saying that we were approved for the K-3. I only found out by checking the USCIS site which I gave up long before our approval to even look at or count on being right.

I believe in my heart that your approval will be coming soon. Not by the touches, but by the time it has been since you filed. Keep the faith and things will work out the way you want them hun.

Hiya guys. When you get your NOA1 for any petition, whether it be the I-130 or I-129f, is it safe to throw out the copies or is there a chance of getting an RFE still? I am just curious because I had stated before that I didn't make copies of the second set of my I-130 that I mailed in and only kept the first set for which I messed up on. It is still in the computer and I was wondering if it was safe to delete it seeing as to how my name is different, but then I thought of well what if there is still a chance of an RFE?!

Any answer would be appreciated...but appearantly that doesn't mean anything to you. You know, reading the past few threads and seeing this bullsh#t, it really makes me think twice about coming on here. But then, I think, no I have been here for about 6 months now and for the most part I have gotten some pretty damn good advice. ESPECIALLY from Aussiewench and Yodrak! Unfortunately, if new ppl come on here and see these sort of posts, perhaps they won't feel the same kind of welcome that I recieved along with I am sure it is safe to say thousands of others. Please, can't we keep this ammicable??? It's kind of like when you have really good news then someone comes and bursts your bubble, or you are the opposite and really depressed and need some cheering up, and instead you just are made to feel worse. That is what these kind of postings do. The whole concept of this forum is being dragged through the mud. I said this on another thread and will say it again...please, if you have problems with another VJ memeber, can you please pm them? That would be the most adult and responsible thing to do. If you feel like there is a problem with the VJ site as a whole, then post something on OT or leave altogether. I don't want ppl to give me sugar coated answers either, but I know that when someone is being honest with me it is because they have been there themselves and know what they are doing.

Now...getting back to the original topic of this thread, you have to file for cr-1 or k-3. K-3 is suppose to be the quickest but appearantly things are being slowed down with the IMBRA. If you go to the guidelines tab and click, you will see all the types of filing. You should read all of them pertaining to marriage and see which one suits you. Unfortunately, there is going to be a wait and you will be seperated unless you are fortunate enough to have your spouse come stay with you for a while, during the petition process like I am with my husband now. Unfortunately, I have to leave him soon enough due to the fact that my visa is going to run out. I hope this helps.. and good luck

Ok, this thread instead of helping...has just really confused the hell out of me!! Can anyone pm me and exlain to me in lamens terms what all of this means please??!!!!!

Ian and I have been trying to find out if the check he sent has been cashed or not but we can't find out that easily because the check is a bank drawn international check. I have called the USCIC and they have told me two different things now. I mailed our I-130 out on May 10th. We have not recieved anything yet. I know it takes approximately a month to hear back, but I am worried about a check floating around. Now I read this thread and try to catch up and all it has done is confuse me even more!!!

I think I will go bang my head on the wall now. Perhaps it will knock some sense into me...either that or it will knock me out cold...

Hiya! I just called last week on the 23rd I believe, and they told me the same thing. That they were having problems with the computers and having technical problems and to expect an eight to ten week wait as well. Hopefully we will get ours soon as well as I am still in the UK with my hubby while we file..everything has to be forwarded to us before we can even send out the next petition.


Please keep my updated if you get yours please. Btw..when did you send out your I-130? Perhaps we will have the same timeline?

Sorry about that one, I think the forms are getting to me lol. Yes it asks whether you have met not how long you have known eachother. But you will have to show proof of your relationship when it comes to the interview. THanks guys for clearing that one up!

Right now I am upto my eyeballs here in paperwork and it seems as if there isn't an end!!!

Hi All,

I would like to know how long does a couple have to know each other before they were wed to be approved by the CO?



Right now I am split between the K1 and K3 visa.

We're not married yet...but we made the intentions to wed... the only thing that's hanging on me is that k1 we'd have to known each other for 2 years and saw each other face to face with in that time.

That's pretty long-

K3 visa I heard that the min.. is 8 months... but the proecess takes longer then the K1.

He doesn't want to wait a year to get married but I'm afriad if we get married say with in 2-4 months fomr now the CO may think it's fraud. :help:

I hate to break it to you, but right now the K-1 visas are even being held up due to IMBRA. I am sure someone can give you the link to the IMBRA info. As far as there being a certain amount of time that you must know eachother, I would have to say it is all down to who deals with your case and passes it on to the next phase. I haven't heard of anyone having a hard time and not getting approved because they haven't known eachother for a long time. You will have to prove that you have a valid relationship when you go for your interview which you should be able to do if you have pics and any other documents that would link you together. Phone bills, emails, written letters, gifts that may have been sent through post etc.

Hiya everyone! Hope everyone is doing well and receiving good news on their applications!! Right, Ian has his house up for sale here in the UK and we were just talking last night about when he gets his packet that he will eventually have to fill out. Now, I know it is a ways away yet, but we would like to change his address now to his dads house to save the hassle later on. Who do I contact to do this? We have only filed the I-130 petition (don't know if that matters or not). I appreciate all help. Thank you in advance.

Hi Laura

Yes that section needs to be completed. On yours, you would put your name, the date, and A # if you had one......On Ians, he puts his name, the date, and can put 'unknown' for A # if there wasnt one on the NOA1. He would of been assigned one by now (one of a few he will be assigned during this process). As for the G-325A's sent with the I-130, they may send an RFE or they may not, if this wasnt done.

Thanks Lorelle! Where would this said alien number be? I have looked at the NOA1 and do not see where an alien number would be. Do you think if I call the 800# about the I-130 they will have any info as to what I should do about that mistake?

Hiya..I know I have asked before if my spouse is suppose to sign the G-325 form so that is answered, but now I have another question. On the bottom where you sign it, I just noticed that it asks for applicants name and date and alien registration number, are we suppose to fill that in as well??? I didn't do it when I sent the I-130 petition, but I am about to send out the I-129f. What are we suppose to do? Ian doesn't have an alien registration number. As far as the forms not being filled out with the I-130, what do you suppose will happen?

As much of a mess as this IMBRA stuff is, it looks to be resolved shortly. Your best route is to wait until the new form is available and posted by USCIS. Then file for the K3 using the new I-129.


How do you know it is going to be resolved shortly?? And when is this new form for the I-129f suppose to be coming out??? I would much prefer using the new form if it means not going through the IMBRA hassle. Is there a link somewhere where I can read up on this??

I sent out my I-129f petition yesterday. As far as getting an RFE that still isn't guaranteed that K-3 petitioners will get one, but even if we do, I won't be bothered. At this rate we will probably be better off going through with the I-130/CR-1...Either way, I am not going to worry because that isn't going to get us any closer to the end. FAITH FAITH FAITH...oh and yeah...patience lol.

Thanks GOD, today i recieved NOA1 for I-130.
Now, given all the rumors about IMBRA, should I not file I-129F for her?
If I should then where is the new form? Or should I use the old one?
If I use the old one, or those who used the old form I-129F, will USCIS return it to us to ask questions about background check?
Please clear up this confusion for me. Those who filed I-129F for K3 after March 6th, 2006 please give me some suggestios.
I am waiting.

The USCIS requested OMB Approval of the new I-129F Form by June 9... that's tomorrow... Can you wait one more day?


I was going to wait to file the I-129f, but this morning I have looked at the expiration date on the current form and it is for the 30th of June. I don't have time to wait that long so I am going to just go with it and send ours in on Monday. If they post the new one on the site between now and then, then I will do it over and send that one in on Monday instead, but I won't be holding my breath that they will update it. Knowing my luck lol, they will update it the day AFTER I post it. My father always said I was the walking definition of Murphy's Law lol
