yes its a new law, the USC has to have a vis to get married in the uk, maybe you can find the details some where!!, maybe you could go for a holiday get married while visiting as i did & stay for your 90days & file while your there??, but beaware that if you file the K3 if it gets fast approval you might end up returning sooner than your 90days so you have enough time to arrange medicals etc, also you will need a police certificate this can take 40 days to get, so maybe you can apply for it now, as its good for a year!!

ive looked in the UK visa things, she could get one in 4 working days for £50 if i read right. she had her heart set on marrying over here.

yeah i think we could consider the option of me going there and marrying, applying, staying no more than 90 days :) if i got brought home early, i would be happy, would mean it wouldnt be too long. but as ill be going through texas, i think its gonna be a long drawn out process.

yeah, i have the police forms downloaded already, i should do that, would at least tick one thing off the list ;)

Hiya...right...I am American and my fiance is British. I have been here in the UK since last May 2005. We decided to get married here in the UK and we were under the impression that we could just get married on my visitor visa as well. No you can't lol. As far as it taking 4 working days to get a visitor visa for marriage in the UK..no it doesn't take that long. What you do is you apply online, then make your appointment for the closest British Embassy office to you in America. You take all of your proof of finances, any previous divorce papers etc...and you get the visa that day! I had to fly back to NY to get mine, and the interview took aproxiamately 3 minutes then was told that I was all set and to come back in an hour to pick up my passport with my yellow visa placed in it!! Easy peasy...GOODLUCK!!!

In order for you to apply for DCF in London, the USC has to either be in the military, have indefinite remain to stay..Other than that...you can't just apply for DCF in London. Sorry. Hope it helps

The USCIS is currently in transition from having the Service Centers process petitions based on geography to a system where each Service Center handles a different type of workflow.

In the cases of I-129F's, I-130's and I-485's.. it appears that the CSC is going to handle these types of workflows...

Is that going to be a good thing though??? I don't think that it should hinder our cases and that they should go by the date they were submitted...And I got all excited when I read my timeline and saw that my rough estimate for time of ajudication was Sept. 19th for Vermont..I was happy with that..now what will it be?? DECEMBER 19th 2008?????????????

Because it seems that they're sending all of the K3 apps to California. There's another thread on here somewhere, and one person who was transferred lives in New Hampshire, I believe.

But this isn't the K-3 bit. this is the CR-1 application. So it doesn't make sense for them to send that one from Vermont to California..

Background: Sent my I-130 in on 6/30/2006 to Nebraska (since I live in Ohio). Noticed that Nebraska processing times do not include I-130's. Asked what's the deal on VJ. VJ'ers said that I-130's, that would have been processed in Nebraska, are now being transferred to California.

I sent my I-130 USPS Overnight Mail, which was signed for on 7/3/2006 in Nebraska.

2 Questions:

1. Other than my cancelled check, which has yet to be cashed, is there any other way (besides NOA1) I can know that my I-130 is INDEED at least "in" California?

2. If I-130's are being transferred to California for "efficiency", does that imply and/or does anyone have any knowledge of CSC shipping some OTHER forms to be processed to ANOTHER service center, so that CSC can more "efficiently" focus on whatever forms they are now receiving from other service centers?

Hiya...until your check is cashed and or you get the NOA1, there isn't a way to find out where your application is at this time due to the fact you don't have a receipt number and it hasen't been I believe 30 days. If I am wrong on this, I am sure someone will come along and correct me. I know that when I first posted mine, I was a bit frantic but eventually received the NOA1. Good luck with your journey and I hope you hear something soon.

Question: Where do you see the "touched" on the USCIS webiste?

I registered, but all I see is that the petition was received on July 13, 2006 at the top of the page when I click on Case Status Search.

I wondered the same thing until someone was kind enough to tell me that when your case has been touched, the date will change on the "date of last update". Do you know where I am talking about? It won't say that it has been touched...the date will change, hence your case has been "touched".

Hiya folks! As I posted the other day, I received an email stating that my case was transferred to Californian from Vermont. Fair enough. That was on the 18th. How long does it take them to transfer because I have been touched everday since the 18th. Does that mean that they already have it in California you think?? I hadn't been touched at all before the 18th other than to say that they received our petition. And that was back in June I believe...stating that they received it in May. Hmmmm...is this a good thing??? Can't help but get my hopes up..

If you don't like the responses you're getting on VJ, I'm sure there are other fora out there. :unsure:

Personally, I don't like reading posts from constant complainers (or being around those types of people in "real life"). I'd rather surround myself with people who take positive action when they see a problem. In this case it might be organizing a letter-writing campaign or supporting others who are going through the process. Don't just sit around and complain if you don't like the process, do something.


That is EXACTLY my point. Don't just sit there, do something. I wrote to my federal representatives, state representatives, and to the white house. I sent letters to the editor to major newspapers in my area including the New York Times and Boston Globe. I shared my perspective with a city reporter writing an article about immigration.

I don't mind responses - I just don't want things "sugar coated" on my behalf and I don't want to be told to just relax and live with the poor service and delays - I need to do something, and I'm doing everything I can.

Supporting eachother means being there for the good and bad, not just the "whoopee yahoo" when someone is approved, but validating the facts when someone is screwed over or waiting longer than anyone ought.

P.S. Also, I noticed that you had very little of a wait - that I've already waited almost twice as long as you for my NOA2 - and it is easiar to put on those rose colored glasses when the crappy stuff is happening to someone else and not you.

You should be happy for her, not slight her for it. And who says she is looking through rose coloured glasses?? Never make statements like that unless you have walked a mile in somone elses shoes. I have very personal reasons why I should be allowed to have my case expideted but guess what?? IT AINT HAPPENING...so, I charge forward and take it one day at a time. I think you need to simmer down there. If you want support here, then by all means stay, but if you want to carry on like you are in this thread, I am sure you will find that not many ppl are going to want to even open your threads let alone answer them!!! I am sure you will find lots of ppl on here like I have that don't sugar coat things and will tell you like it is. I am sure they will be along soon enough as soon as they see this. Perhaps they won't...consider yourself lucky if they don't..

I can certainly understand your comments. For us, our I-130 was filed in May, and has just been transferred on the 18th from Vermont to California. This notice was sent to me on the 18th, then I noticed on the 19th that our case was "touched" again. I am not sure what it means, nor will I sit here and try to ponder over it. As far as anyone sticking up for USCIS, I don't think it's a matter of protecting them and or their services, but rather trying to have some sort of faith in the system and keeping hope alive. It is very hard for the majority of the couples who cannot be together during this long and tedious process. Ian and I have been fortunate enough where we can be together but I can certainly relate to what it is like being apart. Please don't take this the wrong way, but take it as constructive critism if you will, your post is not very helpful in keeping the spirits up. Although, I can certainly understand where you are coming from. Please don't think that there isn't anyone on VJ who doesn't think of any of what you have said, and with that in mind, please don't think that anyone turns a blind eye either. I think it comes down to surving this ordeal and doing what you have to do to keep yourself from falling into a state of depression which I believe can happen.

The good thing is that the process for CR-1 at NVC is more hands on so you have some control over the speed your case progresses. You have checked the pinned Timesaver and James Shortcut thread havent you?

5. Usually after you're done with NVC things progress rapidly and straightforward (i.e. you get your embassy/consulate inverview on schedule)?

Depends on the consulate post as some take up to a year to schedule interviews.


6. IMBRA (aka the "International Marital Bliss Reduction Act") is "gumming up the works" and thereby slowing the processing of CR-1's and K-3's?

IMBRA applies only to those filing an I-129F petition for spouse or visa, not the I-130 for the CR-1

10. K1 visas ususally take about 4-6 months, but CR-1's and K-3's take about a year?

Again that is dependent on consulate and how long it takes to approve petitions and move through the NVC process. There is many cases of CR-1's being granted in 6-8 months and same with K-3's.

11. The recent practice of transferring the processing of certain forms to other Service Centers is MORE LIKELY to cause delays rather than speed up the process?

Not necessarily as in the past this has been a positive thing in many cases. It is also not a recent practice..it is something that has happened many times in the past. I-130's that have been transferred from VSC to CSC only recently have already been approved and we should continue to see that happening.

12. The Californina Service Center is historically slow, and the fact that CR-1 forms (i.e. I-130) is being transferred there from other SC's is supposed to be a good thing?

Also one should remember that whilst they are presently doing this reshuffle and it looks like CSC will be processing all I-130's, you can bet that other petitions not connected with fiances or married couples are being transferred out of CSC to be now processed at other CSC. The work load theoretically should be balanced.

When people say that they have been approved, it means that they have been approved over on the American side. THe application still has to goto NVC and then over to the benificiary's country, then has to go through some more paperwork, then interview. Everyone has an interview to be fully approved. Sorry if you were confused.

I just had a premination and decided to call the 800 number tocheck on the case, I was shock to hear that the RFE for the I129 was received..finally :dance: :dance: :dance: :dance: :dance: :dance: , bu twhat really got me was when I tried the I130 number. It said THIS PETITION WAS APPROVED ON JULY 24, 2006 :dance: :dance: :dance: :dance: :dance:, oh my god I cannot believe it, I got approved. What a load.

That is absolutely WONDERFUL and encouraging news! I sent back both of our RFE's and still have not heard one thing in regards to whether or not they even got them!! LMFAO...To the OP, lol I learned the hard way posting something in a thread and mentioning trying to get my case expidited for which I have a very valid reason to do so. But, after contacting my congressman, I was told that even though my son is very ill (and yes it is life threatening) they could not expidite my case. Since then, I have found out that my son is doing well, and have settled into the fact that I must sit back and relax and let what happens happen. I personally am ok with your letter EXCEPT the part where you mention in great detail about how you helped campaign and are now asking for HIS help. ####### for TAT? as they say? Yes that is very wrong and would probably lose a lot of his votes if he were to expidite your case due to heartache. Think about it...do you seriously think that your Congressman will help to expidite for heartache if it means losing voters??? Yes, my husband and I are together waiting out his immigration in the UK, but there was a time where we were seperated for months and months so I do know what it is like. But, you need to sit back and realise that the timelines were there for you to see BEFORE you got married and started this whole process. You knew it was going to take a while. I think if everyone were to get there cases expidited on accnt of heartache, the expidition process would be backlogged and then the K-3, and CR-1 process would pick up lol..hmmmmmmmm...anyone thinking what I am thinking??? lol. Anyhow, bottom line, there are more ppl like me who actually do have legit reasons for expidition, but are not able to get it that have to just wait...and wait some more. Yes, you can do something, keep busy in the political stand and help to change things, but don't go asking for favours...seriously, how would you feel if you asked for a favour, got turned down, then someone else came along and asked for the same favour and yet got it??? You wouldn't like it much would you???

The insctruction pages on I-130 clearly state that only a money order on personal check is accepted. Also, each service center has their guidlines,on USCIS webiste, as what kind of payments they accept. Sending personal check is recommended cuz that way you can see reciept number on back of it when the check is cashed. Good luck.


My husband and I sent a certified Bank check for both petitions and they BOTH were ACCEPTED!!!! So yes, you can send a certified bank check.

First, have you filed for anything yet? Secondly, do you have anything like say a prior deprtation, overstay or anything that will warrant the need for use of a lawyer? I would say not to hire a lawyer but that is my opinion as the forms are pretty much straightforward and no matter what a lawyer tells you, they cannot help you to get your visa any quicker...that is utter bullshite lol.

THirdly, if you file K-3 the fees are as follows....

I130 Form- 190.00 dollars
I129f Form- 170.00 dollars
150-250 for medical
100 dollars approx. for record fees
350 for AOS
Plus I do believe there is a cost for the fingerprinting and biometrics but not sure on that one.
Plus any other additional fees incurred whilst being apart ie, postage, phone calls, heartache....stress...etc.

For the I130...

I130 form 190 dollars
150-200 for medical
100 dollars for medical

Then the next fee is I believe 205 dollars which doesnt get paid until your spouse has been in the country for two years and the temporary green card is up then they apply for the permanant greencard which is good for 10 years. The form you file for that is the I175. This form is to remove conditions of residence. Like I said it is good for 10 years and must be renewed every 10 years unless the resident becomes an United States Citizen during that time which I believe you have to be in the country for 7 years to do so. I finally get to share the excitement of getting my first approval!! I was talking to my husband on Skype this morning when I received the email saying that our I-130 was approved yesterday. He and I were literally jumping up and down for joy. It's been 6 months with nothing, and to finally receive some good news was enough to bring both of us to tears.

Now...on to Phase II! :D

Your timeline says that you flew on the 7/23 (with your visa) to be with your husband! CONGRATULATIONS!

I also noticed on your timeline that you didn't do a K-3 (unless I missed it). I was just curious what your rationale was, since I am now considering that also... (I apologize because you may have previously posted the answer a dozen times)...

As for deciding on the CR-1. We had originally wanted to file the I-129F to cover our bases. At the time CR-1's and K-3's were in many cases on par with each other making doing the K-3 almost worthless. Once our I-130 was approved in around 42 days we decided the K-3 wasnt worth it as the CR-1 would mean no adjustment of status, would have SSN and be able to work straight up etc. If you read the AOS forum it can be a preverbial pain in the butt and can take up to a couple of years depending on your local office. We just didnt want that hassle. We did procrastinate a little too with the NVC stage and on looking back, the K-3 at the time would of only gotten me here to the US a couple of months earlier if that. Well worth the wait.

OOOOOOOO that just sounds sooooooooooo RUDE lol :blush: I can't help but to be OPTIMISTIC because I keep reading about ppl getting approved shortly after their transfers. And once again I was "TOUCHED" last night. Soooooooooo...I can't wait to see what happens tonight. I thought that I would not want to wait, but the fact that Ian's house still isn't sold, makes it easier for us to wait.

At least I know that they got it! But yet it doesn't explain why I was "touched" on the 19th, 20th, and 21st...hmph...(throws tantrum for "false touches"!!!

I-130 transferred today from Vermont to California. Received the email today. Guess I'm a late bloomer. Yes, there's a poll someplace, with roughly 3/4 all Vermonts going to CSC.

I believe that there is already a thread on this but what the hell. I got my email on the 18th of JULY saying that our I-130 was transferred over to California. Now, I don't know how long it takes to get to California, but our case has been touched on the 18th, 19th, 20th, and 21st. Don't know what all of this means, but I am taking it all as a positive sign. Good luck to you on your journey.

Just wondering about this "Gov't speak" and what it really means haha..

I am going to take a gander on this one..I believe that it means that all information was sent to the beneficiary. I may be wrong but the way it says it was sent to the person whom issued ( i am guessing whoe the visa will be issued to). I am sure someone will be along shortly and correct me if i am wrong.

Hello everyone,

Gotta share: Got back from lunch today, back to my dreary corporate cube, and decided to login to USCIS for the umpteenth time this month...BEHOLD! Touched last night, I knew, but again today...so I click on my case number and nearly fell outa my chair when I read: "This case has been approved. On August 21, 2006, an approval notice was mailed." Hubby just happen to call me, right as I was clicking my way to the website. What timing!!! So great to share with him, at that very moment.

Congrats!! We have similar timelines...hopefully we will be getting our approval soon as well!! I see your last touch was on the 28th of July just like ours...maybe that is a sign eh??? Won't bet my bottom dollar on it but worth a prayer or two..or three lol...

Hiya...my hubbys brother in law works for HSBC. All you have to do is go into HSBC while you are here, and open a US dollar accnt. THat is what my hubby is going to do. All the proceeds of the sale of his house will go in there. And it will also benefit us because all assets have to be shown in US dollars. We are in the same boat as you. I am the US citizen and I too am waiting here with him for his approval. Goodluck with your journey!!!

NADA!!! ZILCH!!! FENITO!!!! NOTHING!!!!!!!!!!!!!! Not even as much as a touch since the 28th of July. Altho our K-3 petition was touched on the 21st of August. Got me so excited I thought I was gonna wet myself!!! We have the house sold so hopefully things will pick up on the immigration for us so we can get on over to NY.

I havent been touched since the 28th of July. Been recently touched on the k-3 tho...twice woohoooooo...lol

I am USC and I had filed I -130 for my overseas spouse on 1 Feb 2006, after six months, I have not had NOA-2 yet.So last month on July 29, I called USCIS and they made a service request and they told me within 30 days, I should receive something about my case.After past 30 days I did not receive anything,

Today when i called them again(as u see date for VSC is 23 Feb2006 for I-130)for my case. The lady was nice and she was putting request again, but her computer said that they sent something in mail yesterday.

I am curious , what that would be??hoping not the same ####### saying please wait until 30 days pass of your processing date.anyone any idea plz??

I don't want to give you any false hopes here, but I called them on the 24th of August to see what was going on with our K-3 and was told that something was mailed out. FOr some reason, I don't think that they are allowed to tell us what it is just in case we don't get it in the post. I am not sure. But I was told the same thing to call back in 30 days if I hadn't heard anything. They also told me that with the RFE's, they have 30 days to give approvals from the returned date of the RFE if you know what I mean.. Low and behold, I was touched on the 24th, and on the 28th of August, my gf called me from the states to let me know that she had received our NOA2. Keep your chin up...things will start moving again.
