Sim, first WELCOME to VJ!!! I hope that you will be able to find your answers here and feel at home. Secondly, remember this, if you file before you get married, then you are filing for the K-1 visa. After it gets approved, you then have 90 days from the time your fiance steps off the plane into America and gets her visa stamped to get married. After that, your new bride will be able to stay with you in the country while you do AOS for her. Thirdly, if you opt to get married BEFORE you apply, then you would be applying for the K-3 and or the CR-1 visa. BOth are different. THe K-3 visa is meant to bring spouses over quicker then you can do AOS..meaning they will be entering on a nonimmigrant visa. If you opt to go for the CR-1, which is the grand daddy of all visas, you and your wife will be apart for longer BUT...once approved, your wife will be able to legally work and all of that.

So...what have we learned? K-1===can be together during the whole AOS process. K-3/ and CR-1===you will be apart for some time. (generally you are apart longer while waiting for the CR-1). Hope this helps!!!

Now, I have seen this question brought up numerous times and the answers are never the same. Some say it is ok but there are still some risks, and some say not to do it at all. From what I have gathered from other VJers that have travelled to the States while petition is in process is that yes you can, but make sure you have a return ticket in hand, and proof of where you live back in UK or country you are coming from (even if it is a signed and notarised note from your hubby's parents saying that he does live with them), a letter from his employer etc. Now, from what I have read is that because some countries have passports that are on the VWP, then it is easier to come into the States without any hassles. Also, I am under the impression that it would be harder for a K-1 applicant to come to the States while case pending because it is easier for them to just get married(meaning in the States you don't need to show proof of visa that allows you to get married when you go and actually do it. Unlike the UK where you have to show the registars office now your visit for marriage visa just to make your announcement and then get married). If you are already married and you come into the States while case is pending, I have read that someone brought along copies of their petitions for proof that they are in the process. To me, that would show that a person doesn't have intent to come into the country and just stay illegally if you get what I am saying.

Bottom line, it is upto you whether or not you want to try it. I have read a lot of success stories in doing so. More so than bad ones. Not saying that is still couldn't go wrong for you. Personally, I think that your husband would be ok with doing it. But that is only my opinion not fact.

This is heresay -- but I have heard that you can substitute a K3 interview date with a CR1 date (heard it from a friend of a friend etc.) You could have them both ride and then call the embassy to find out if you can switch?

I agree with Laura's response. If the two reach London near the same time, London will cancel the K-3 automatically. So you have a couple of choices, if you see the two are going to complete within a couple of months of one another, you can choose to cancel the K-3 & wait out the CR-1 or you can interview for the K-3, and return later to London for your CR-1. Either way you will avoid AOS. Good luck on your journey.

Please don't go on hearsay. Go on what is to be true. Like Tim and Bethanie said, if the two reach London near the same time, London will cancel the K-3 AUTOMATICALLY! That happens with ANY consulate. The CR-1 is the grand daddy of all visas. You will not be able to subsitute a K-3 interview with a CR-1 interview.

I know alot of people on here who have had there I-130 approved keep saying there going to wait to see in regards to if there going to continue with the K3 or in fact cancel there I-129 and just go the CR1 route.
My question is what exactly is it your waiting to see, If through waiting for my I-129 to be approved my I-130 has already been transfered to London embassy then surely it would make sense to cancel my I-129 application right?

I would appreciate it if someone could just explain it to me please!

Hiya Cape! Do you know if our case has been transferred from NVC to the consulate oversees yet??? As far as I am aware, the CR-1 sits longer at the NVC than the K-3 does. I believe it can take 2-3 months sittin there. That is why ppl opt to wait and see how the rest goes before they decide. Also, if you get over to the states on the K-3, you can still opt to follow through with the CR-1, it would just be a matter of flying back over to the UK for your interview. THat is what Ian is going to do if he gets to the states on the K-3. He will wait for the CR-1 interview. It will save the time of waiting for the AOS which can be a PITA!!!

K-3 Spouse Visa Process & ProceduresThinking of filing for K-3 instead of K-1

Hi there! Currently I have filed for the K-1 visa and like most people are still waiting for an approval. We were hoping to have it by the time my son was born but this hasn't happened.

My fiance has been in the country almost 6 months and will have to leave soon and won't be able to come visit me and the baby. We are thinking of filing for the K-3 and getting married so he doesn't have to leave me and the baby.

We really could use some advice on how to go about this, or if anyone else has cancelled a K-1 and wen't for a k-3 how they did this and how the process went for them.

Any advice is welcomed, we both want nothing but to keep our family together.

In all honesty, I think that you should just continue to wait out for the K-1. You are so close to getting an approval, then it won't be to long after that you get your interview. I would say a month possibly 2 months time if that, that your fiance will have their visa. If you get married now, you will have to cancel the K-1, then start the whole process over again which will lead to a longer wait and more seperation time. At least with the K-1, you will be able to do AOS together!!! Think of it that way. I wish you luck with whatever you choose to do.

We are filing an I-129F once we get our NOA1 from the I-130, and we plan to let both processes run to completion. He will enter the US on the K-3 so we can be together (provided it does indeed come through first!), and then go back for the CR-1 interview to avoid the pains associated with the AOS process. My questions above are meant to help us make some decisions for the future, such as whether I will accompany him for the CR-1 interview. We have to get a rough budget together for the year that lies ahead, both for time off my job and for $$ needed, since we are arranging for me to fly to the UK every two months until he can join me here in the States. Alas, big bucks take big planning!

So anyway, my original questions stand. Sorry I didn't give enough information.

Hiya Jen! Right, you are in the same boat as Ian and I with the only difference being that I am here in the UK with him and am staying with him until he gets his visa whichever comes first. If he gets the K-3 first, then he too will be flying back the UK for his CR-1 interview. Now, to answer the medical question, I believe that since he will have had one already for the K-3, that one should still hold up for the CR-1. If not, I am almost positive that having one in the States will be ok, but you have to make sure that it is a doctor that is approved for the immigration. I do believe that the medical exam for the London US embassy is near by to where you have the interview so perhaps he could look at killing two birds with one stone if he can't have the medical in the States. As for the latter part of your question in regards to how long it takes after the interview, I do believe it is all down to the post and how you have it sent to you. I would give at least a weeks time for your hubby to have his visa delivered to him. You can always change the date of the return ticket if you get the right one. I do believe there will be a fee to do such, but is minimal compared to having to pay for a whole new ticket.

I keep hoping that I am one of those ones that is lucky enough to get an email when approved because being here in the UK with my hubby, I have to wait until my gf back at home forwards all the mail. Yeah, I called USCIS today, and got the same ole same ole. The only thing different is that they did ask me if we had a change of address which I thought was odd, but then when I rang my gf back at home to see if she got something, I told her what they asked me and she said it sounds as if they have possibly sent something in the mail. If they had, why not update the online status? I have been reading ppl are getting their approvals thru the mail but never got an email. So...here is to wishful thinking EH??? LOL

I had sent my 1-129 F to Chicago on 25th May and today I got an email that the case has been approved.
I hope this is not a fraud coz I had lost my faith in this process. I truly pray that everybody else gets there approval ASAP.I was so happy when i was watching other people getting approved and it was a big hope for me that they are moving.

K-3 Spouse Visa Process & ProceduresConfused on what to do - serious change of plans

Hello fellow transients,

So he proposed in March and I of course accepted. We spent many long hours on the phone deciding when and where to get married and who will move half way around the world. We decided to marry in August in San Diego (where I live). He would return to the UK, we would apply for a UK spousal visa and I would move to London (where he lives) when approved.

Well.... he arrived in July (on a 90-day visitor visa) and once he was here we had many more hours of discussion and we decided it was best for him to move here. So we are getting married on Saturday. He has a return ticket for September 6. What next??? Ideally we would like for him to return on the 6th for just a few weeks to move out of his flat, close appropriate accounts, etc. and come back here.

So... after some research I see these as our options, but want some input as to what potential problems are with both.

1. Apply for AOS and concurrently apply for Advance Parole to travel. Then wait for approval to travel before he leaves to tie up all the loose ends. The problem I see with this is that we may be denied since he came on a visitor visa with intent to marry (however, there was no intent to stay). Also, we don't know how long it would take for the approval of the parole to travel and he can't leave his flat, etc. unattended for too long.

2. Let him go in September and apply for K-3. Then wait for approval for him to move here. The problem with this is the time it might take. Based on the timelines on this site, we see how this can take as much as 6 months or more and we hate the thought of being apart for that much time.

So specifically, if we go the AOS route, how likely do you think we will be approved and how soon do you think he would be able to travel home? And if we go the K-3 route, can he travel here while the application is pending?

Any experience or advice would be GREATLY appreciated. He just keeps saying it will all work out, but I'm stressing a bit because I feel like I've waited 34 years to be with this man and now that he's here I don't want to be separated any longer than necessary. :)

Right, if you get married without him having a K-1 visa...he will have to go back to the UK and wait while you file for the K-3 visa. There has been a hold up with all K visas due to IMBRA, and no one here can give you a definate time frame right now. As for your 1st question about doing AOS. You cannot do AOS if you get married while he is there on a regular tourist visa..the VWP. You could try it, but I can almost guarantee that he would be denied because you would have to prove that you didn't have the intent of him staying there, but like you have already stated, you had intent on getting married which I would think would look just as bad. The only way you could file for AOS without any questions is if he had originally came in on the K-1 visa or the K-3. If I were you, I would file for the K-1 visa, that way the wait time that you would have for that in getting it, your fiance could be taking care of his loose ends as you put it, and he can fly over, you two could get married, and then file AOS...the whole while he can stay with you. Other option is to have him come over, get married, file for K-3 but he would have to leave and wait in the UK for his approval. That could take about 6 months if not longer...depends on each individual case as to how long it takes.

PS..your fiance is right when he says that it will all work out! Don't stress out already when you haven't even begun the process. PLease keep a clear head and really think it through when you decide which option to go for. IMO, you are best to apply for the K-1 then adjust status that way. This will give your fiance time to get things sorted over here in the UK. There are a lot of great ppl here on this forum that will help you the best they can. I will not lie to you, this process is not the easiest, but if you start it off already stressed, it isn't going to do you any good. Just relax....talk it over with your fella...

It's raining today, and I did not want to go out to pick up the mail! BUT, I AM SO GLAD THAT I DID!!!! :dance: :dance: :dance:
To my surprise, I received the K-3 Approval in the mail today. :dancing: :dancing: :dancing: I had checked the USCIS website on last night, but it had not been updated since 8/4/06. However, on that same day, I had received three emails from them of receipt of my IMBRA RFE response, but no mention of an approval. I checked the I-797 approval date, and it is was approved on 8/4/06. Don't understand their procedures!! :unsure: What the heck! I'm glad I received the approval!! :dancing: :dancing: :joy: :thumbs:

I pray that everyone else will receive a speedy approval as I did!!! :thumbs:

OMG I cant believe it.......As i went to sleep last night i prayed for all of us (as usual) well this morning my prayers were answered!
Even though i am the benerficary, my husband is bad at checking his email. I had the email updates under my name.
This morning i wake up to 3 emails in my inbox telling me we were approved yesterday. I yell through to my mum and as she came in i burst out crying. Its such a relief, I feel like the wait of the world has been lifted off my shoulders.

I had a feeling this was our week, especially after seeing Rob & Melinda was approved yesterday as they got there NOA1 2 days before us.

Its only 4.48am in the US, do i call my husband or let him sleep????

But if I had been told what I would be facing this year just so Luis and I could be together, I wouldn't hesitate to go through with it. Don't forget ...for those of you telling him it is ok to stay and that he can apply for AOS, he has already stated that he was denied a prior visa application. This will affect his process.To the OP Again, get a lawyer and a good one but do it soon. And like tim and bethanie stated, don't overstay!!!! Not to add salt to open wounds here, but you really should have looked into this properly before getting married. I can't see anyone at USCIS making any comments that would make anyone believe that they would be able to stay in the country. They are going to advise you to leave then apply for any type of visa. Please don't take that the wrong way, but it is the truth. Like they say, you make your bed...now you are going to have to lie in it. Goodluck with what you do..

You need to contact a good immigration attorney for personal advice.

But you should know that it's your wife (the petitioner), who starts the K3 process for you (the benificiary). She fills out most forms, not you. Once she has proved she's eligible, and her petition is approved, then you have permission to apply for a visa. That could be several months down the road. Generally, the foreign spouse goes back to their country to wait.

What is your status in the States now? Do you have any kind of visa? I believe that if you entered legally and married on the spur of the moment, you may be eligible to apply for AOS (Adjustment of Status). You would not be allowed to leave until (and if) it was granted. And you'd be on the hook to prove you did not have immigrant intent when you entered. Might be difficult given your history.



To your first part, i don't want to return to the uk, and i thought by her filing the forms i was able to stay here until they clear so to speak.

My current status.. I came on the VWP and got married and basically don't want to leave her now coz ofcourse we have just got married... I don't know what to do :(

Thats the other really difficult thing, if i wasn't advised by the embassy to get a b1/b2 visa i'd never of gone for the interview, i went and got refused!! after they advised me to go for it. Now i have that hanging over me and i'm scared now were married that will haunt us and things won't get approved.. What does a guy have to do to stay with his wife??? its insane

How long have you been over already? You could do AOS and stay but there is a big risk with doing so. Generally, the USC petitions for the pending immigrant (yourself). If she applies for the K-3, it would bring you back over quicker potentially...the downside to that it that you dont have the immediate immigrant visa and will have to apply for social security number and the right to work whild doing the AOS,she can apply for the CR-1 which takes longer to get you over BUT, it is the grand daddy of all visas and will allow you to work etc.

my thoughts to you is that you get a good lawyer because you have one flaw...you have already been denied for a visa. Make sure you do your homework when you hire a lawyer because there are some out there that dont work on immigration all the time. Also, you need to let reality set in and realise that you will potentially be apart for months. You need to realise that that is the unfortunate fact about the whole immigration process. Unless your wife can do like what I did, and go stay with you in the UK while you both wait for your approval. She would have to keep some sort of domocile and make sure she has an address to put down on the forms in the US...I have all of mine sent to my friends house who said that Ian and I can stay with while we look for our own home. She just forwards me all the mail sent from immigration.

Take your time, and breathe in..breathe out....this is going to be a long ride...but you obviously love your wife and she is worth it...

Hiya everyone! Right, I was reading a thread in here yesterday about someone calling the USCIS and asking for an immigration officer. Well, I did that. I did get to speak to one and this is the outcome. I have found out that once they get the returned RFE's, they have 30 days from the receipt to give some kind of letter or notice. In a round about way, she told me that our approval should be given by the 30th of August since our receipt date is the 1st. If we don't hear back within 30 days of that date, then we are to call back. I hope this information helps any of you who are also waiting.

Ian and I are currently in Newcastle for the bank holiday weekend but are getting good wireless connection. I will post if we get any approval today or tomorrow. GOODLUCK everyone!!!

We are in Newcaslte right now and Ian is busy dealing in a big poker tourney so he has no clue. The DS-3032 (choice of agent) is for the I-130 process at NVC, not for the I-129F. There are no forms to sumbit at NVC for the K-3 process.

Congrats Laura! From here, your petition will be forwarded to London. We set up my husband's interview by calling with our NVC case number. Within a week or so, my hubby received the packet 3 and returned it. For this, he will need to obtain a UK police certificate (40 days processing) and his vaccination records. In addition, he will have to know the dates of prior residence and employment dating from what seemed like conception. I may be missing something here that others can help you with.

On your end, for London, you will need to fill out an I-134 with all supporting documents and send your husband copies of all your paperwork thus far. As far as I know, it is very rare for an interview and a medical to be done on the same day. Good luck and godspeed!

Hiya! RIght, Ian and I just received the NOA2 from my friend in America. I was looking at it and there is a number next to Ian's name that starts with an "A". Can anyone tell me what that is please?? It starts with A then has 9 numbers after it. Thanks in advance!!

Oh i know this tim and beth i was just curious to see what would have been faster thats all, seems to be some conflicting views from both the forums. I guess either way it takes a bloody long time!

I don't mean to be rude here, but why even waste time asking if you are already married??? You should think about what questions you post on here because this site is meant to help ppl, and if you ask a question that is irrelevant to your needs or a question that you already know the answer too, then it kind of wastes our times on here. YEY! Congrats Laura......yup get on to DHL and you can find it. I could only find London when i entered correspondence, so if you cant find it straight away dont worry!
The really cool thing is both of the packets that were sent to London on Thursday are already there!!!!!!!
Hopefully that means by next weekend we will have packet 3! :D

OOOOOO ONE CAN ONLY HOPE EH???? Do you know if the USC gets anything to fill out or no??? THis bit is so confusing to me lol. I hope that the answer to that is no seeing as to how I am with Ian in the UK....that would just suck if once AGAIN I had to wait to get it as my gf from home forwards it grrrrrrrrrr...lol.

As to you Lina.....I will call on Tuesday as I have off to see if I can make the appointment now that I have the case number. Keep your fingers crossed that that will do. I was told that we had to wait until we had packet 3. I would hate to make the appointment and not have packet 3 yet when it came time for the interview..

I just called NVC and we have our case number....AND....it was sent today. OMFG OMFG OMFG!!!!! I can't believe it. I am so excited....this is just absolutely brilliant!!! Can we track it online or no???? Gosh I am so excited. lol.

They assigned our case number the same day, Chris was told it would take 2-4 weeks till they sent it to London. I made him called back again today as i knew the trend was within a week and it was sent yesterday, so you guys should be right behind us!

I will pm you shortly with our phone numbers...that would be absolutely wonderful. Linababe is due for her medical and interview soon too. That would just be brill if all us met up. I am soooooo happy. lol...

I made my husband call the NVC just now as I saw it was usual for them to only take about a week for London cases. He just called and they sent it yesterday! Were so excited as it really feels close now.

I know the next step is packet 3.....can i fill any of these forms out before they send it to me to save some time?

OOOOOOOO that so gives me hope because we got our approval only a few days after you. Isn't it all so exciting???? OMGOSH...I can't contain myself. Wouldn't it be lovely if Ian had the same interview date??? OOOOOO...we should so meet up lol..Here's keeping our fingers crossed!!

Right, So I have booked an appointment for Ian's medical but have some snags I think. Is it possible for him to go to the medical WITHOUT package 3 as he has not received it yet. Also, the doctors here seem to have misplaced his vaccination record. I know someone told me once before what kind of shot it is that he could get that could save him the money from getting all of those vaccinations again...can someone please refresh my memory???? I think it was something that can tell which shots u have had and which ones you need to get. Thanks in advance guys.... :D

Does anyone know how to get the DHL tracking number from the NVC. Last week an operator said they sent the package to the consulate via DHL but did not have DHL tracking number infomation. Thank-you very much for your help. I love this forum.

I believe all you need is the case number. Linababe knows how to do it with just that. PM her if u can. Hope u get it sorted. I can't even open the DHL page as it keeps saying that the java is not enabled..which it is grrrrrrrr...

Hiya Bombay...our case was approved on the 24th of August...sent out to Embassy the following week I believe and just found out that it was recieved at Embassy on the 5th of Sept. Now I don't know if the 5th was the date that they finally put it into the system or not...but hope that helps hun...

I have extended my stay here and have a two year visa...limited leave to remain. After two years I can become a legal citizen here, but that wont be necessary. But, I am working here. WIll that make a difference??

Congrats Bombay!!! Just so you know, I was told too that our case had just been transferred to the Embassy on the 5th of Sept. as well...Guess what?! That was wrong....that was the day that the Embassy put it into their system as being received!!! Sept. 11th our packet 3 was mailed out. So hopefully, that will be the case for you as well...won't be long now though that you receive your packet 3...GOod Luck!!
