K-3 Spouse Visa Process & ProceduresWhere is new I-129F?


Thanks GOD, today i recieved NOA1 for I-130.
Now, given all the rumors about IMBRA, should I not file I-129F for her?
If I should then where is the new form? Or should I use the old one?
If I use the old one, or those who used the old form I-129F, will USCIS return it to us to ask questions about background check?
Please clear up this confusion for me. Those who filed I-129F for K3 after March 6th, 2006 please give me some suggestios.
I am waiting.

The USCIS requested OMB Approval of the new I-129F Form by June 9... that's tomorrow... Can you wait one more day?


I was going to wait to file the I-129f, but this morning I have looked at the expiration date on the current form and it is for the 30th of June. I don't have time to wait that long so I am going to just go with it and send ours in on Monday. If they post the new one on the site between now and then, then I will do it over and send that one in on Monday instead, but I won't be holding my breath that they will update it. Knowing my luck lol, they will update it the day AFTER I post it. My father always said I was the walking definition of Murphy's Law lol

Hiya...I posted the I-129f , but now I am a bit worried about sending it the way that I did. I had it sent for delivery confirmation/signed for. The question is...because it is sent to a post office box, how the hell is it going to be signed for??? Won't this delay them getting it at all??

Having a bit of argument with my hubby about whether or not 2" x 2" pics would be acepted by USCIS if printed out from home PC.....Has anybody done this before...and if so what was the voirdict from USCIS? Did you get an RFE for different pics or not?

Thats what i used, 2X2 from my computer, they looked like passport pics :yes:

Did you actually use the pics from your computer yet?? I am curious because when I got my passport to come to England back in 2004, I used photos from Wal-Mart because they do passport photos. I sent in my passport application and it got denied on account of the photos. I then went to the postoffice who in my area is where you go to fill out your passport application, they told me there that the government are very picky about the photos that get sent and that most passport applications get refused when they are done at Wal-Mart, Walgreens, Eckerds, etc..I didn't want to use the post office the first time because the pics cost 15 dollars at the time. I honestly wouldn't risk sending in pics that are not generated by the post office or by any other agency that does the actual passport application. It cost me a) the price of the original pics plus the price of the new pics =$22.00 b.) the price of the first passport application and the price of the second application for which I had to pay 80$extra to have it expedited on accnt of the fact that I was leaving in 3 weeks=350$....moral of the story??? Don't muck about when it comes to the US government and needing anything important from them. Use proper photos..why risk it even if you got away with it the first time or the second time???

If someone is from a country that is on the VWP, then you may enter the US whilst the K-3 is being processed. But seeing as to how your SO has been denied entry before and thus losing his ability to use the VWP, I would think that him applying for a b-2 visa would be a waste of money. I am sure that somewhere he would have to state that he is applying for a k-3 visa which would more than likely send off some alarm bells. What was he denied entry for do you know off hand? That may be something that can be looked into and fixed.

K-3 Spouse Visa Process & ProceduresK3 Visa and leaving the country


Ive read the guide for the K3 visa and it states that my fiance has to leave the country for us to file the i-130. Does this apply to those who are not legally able to reside in the US? Here is our situation:

I am a US citizen and My Fiance is on an F1 Visa, she recently graduated so she is on OPT right now. So she is legally able to live and work in America for 1 year. We are planning to get married by the end of this year. Her visa expires in July 2007.

I really dont understand why she has to leave the US, or am I missing something? Also is she able to work and travel while waiting for approval of the i-130? Perhaps im in the completely wrong forum and this K3 visa does not apply to her! I will be calling USINS after the holidays to ask questions, but this recently came to us so we are kinda worried about it now. I would like some clarification on this if possible.

You have to apply for the K-1 visa. The K-3/CR-1 is for people that are already married. I think though, that because she is already here on a F1 visa, she may not have to apply for a K-1 visa, I believe that you may be able to get married. Not sure on that so don't take my word for gold. But I am giving you some ideas to look into. Also, I am sure some of the more knowledgeable VJers will be on and will be able to correct me if I am wrong. Until then, do some research on the K-1 visa. Best of luck! :thumbs:

Timesnap~ you and I have the same timeline just about. I filed my 129f a bit later than you but still. I still haven't been touched on the I-130. WEEEEEEEEEP!!!! Also, how the hell do you put your timeline on the bottom like you do and everyone else does??? I can't seem to figure it out. Computers are definately not my thing!!

I went to check my case status, and lo and behold...I saw that there had been an update. THANK FOOK FOR THAT!!! I could see everyone else with the same time line as me getting their RFE's except for me. There is a God afterall...lol..Perhaps now things will start moving along for the K-1 and K-3 visa apps.

What happens if the I-129F gets approve and the I-130 still in process, will my husband be able to wait here in the US for the I-130 or will we have to star the process all over again in order for him to get a residency card????
I have read that some people go back to there country to have interview, however if he is able to leave Cuba with the K3, we don’t want to take any chances and have him go back, could he wait here for the residence card??

Hiya De & Al...your husband will be able to come to America on the K-3 visa and wait for the I-130. He will have to fly back for the I-130 interview in Cuba. That is what my husband and I intend on doing if the I-130 doesn't get approved before the K-3. Hope this answers your question..

On the 7th of July, I checked the online status of the I-129f and found that we were sent our RFE. The date of the update was the 7th of July and said on the 6th the RFE was sent out. Ok...well I checked the online status on the 9th to show my husband and the date was changed to the 8th of July as being last updated. Then I just checked again to see if there were any updates yet for the I-130 and noticed that the date for the last update on the I-129f was again changed to the 10th of July. What does this all mean???? Does this mean that our case keeps getting touched on these dates??? If so, why would they keep touching it when I have been mailed out an RFE????

Oh yeah...when I check it...it still says the same thing. So the dates change but not what it says. Still says that they sent out the RFE ..if that helps any

Seperated_Lovers,

The Priority Date is the queue date (place in line) for when a visa application will become available to the beneficiary of the petition. There are annual quotas for many classifications of immigrant visas, and there are more applicants than available visas.

However, there is no quota for Immediate Relatives, visas for Immediate Relatives are available immediately. Therefore no waiting in line, therefore no Priority Date.

My hubby and I are going to concentrate more on the CR-1 than the K-3 visa. If the K-3 happens to kick in before the big one...then we will go with that. I have noticed that the update date on my online status has changed several times for the K-3 but we used the old form and have just been sent our RFE. I am a bit curious as to why they keep changing the dates but oh well. Not gonna get my undies in a bunch over it whatever happens happens..

Here It seems that I got doomed even more and that is " I got 2nd IMBRA RFE and i sent it back in no time and after an hour i got the first ever email from USCIS that they have transfered my case to California Service Center" . Now for God sake, tell me , what that means ? :help:
Does it mean that my case is screwed even deeper ? I am becoming schizophrenic and I dont have health insurance. Mental problems are costly to treat and i dont know what to do other than " Forced Patience"

LMFAO...today must be moving day then for all of us lol. I just started a thread stating the my I-130 case has been sent from Vermont to California...I know what you mean about getting the first email off of them. I never even got an email stating I was getting the RFE...My I-129f case has been touched about 6 or 7 times and that was before I even got the RFE!!! and AFter I got it!!! But the I-130 was dormant..until now...I am with ya...just breathe in ...breathe out..breathe in...breathe out....lol

How ironic, the day after I call USCIS to inquire about the status of my returned RFE's, today I get not one, not two, BUT THREE EMAILS confirming that they received them. HOW GREAT IS THAT??? lol I was getting so down because everyone kept saying they got their approvals shortly after they got their notices of being received....woooooohoooooooooooooo....

Did you mail the RFEs from the UK? Or did you send them to your friend in the States first so she could resend them and have them postmarked from there? I'm not sure if this would make a difference, but ...

Don't fret about a lack of touching or updates. Sometimes these don't show up on your case status until after you've received an email or snail mail that they received something. Hang in there.

Hiya hun! TO answer your question, because we have a place to go to when we go over to the states, we were able to start the immigration process here. Thus far we haven't had any problems.

Now, I have just called USCIS and they told me that it can take upto 60 days from them receiving the RFE to enter it in their system. Correct me here if I am wrong, but I read elsewhere that it was suppose to be 30 days?! Am I wrong on this??? I seriously hope that things are going to slow down again, not after getting my spirits up for being touched so much on the I-130 petition. WEEP!!

Ok, se we mailed back BOTH of our RFE's, and still NO update on the USCIS website in regards to even getting them. Now I am a bit concerned over this as most of you know, I am able to stay with Ian in the UK, therefore we are doing the paperwork from over here and my bestfriend back at home is forwarding everything to us. I called her on Saturday the 29th, and she said that the only thing she got was the letter stating that the I-130 was transferred to California which ironically, we ended up getting that day in the post.

Now I understand that you have to wait 30 days before you call, but I also know that there are crafty ways of getting answers from them..lol I know because I have done it before lol. I need some advice on what to do here. It wouldn't be so bad if I were in the States and was sending it from there because it is easier to track. Over here in the UK, yes you can post via registered/signed for, but the thing is, once it leaves the UK, you can no longer track it. There is no confirmation of them actually getting it.

Any thoughts or suggestions?

Okay, here is what happened to me so far:

06/10/06 sent I-130 pakage to CA service center
06/23/06 They sent me my NOA1 but to an incorrect address (not my mistake) I didn't know this happend
07/12/06 called 1-800 help line and told me to send a package directly to the center ...
07/13/06 USPS next day sent the pkg.
07/31/06 Called 1-800 help line and talked to an officer who told me that the WAC# on my canceled check was the recipe number and just print out the online status statement and put that in the K-3 package and send that bad boy out. She also informed me that some of those phone service operators actually operate from home as contractors. Wow, that is wild. She went on to tell me that those contractors can't call up our cases from their home only the officers at the call centers can do that. Another wow..

Now I am back on track; breathing easier since knowing all this and sending my I-129F package out tomorrow. Whew!

Waiting is easy but when something goes wrong, that is what bites.... haha

Jen, I commend you for wanting to speak with a lawyer, but before you do, let me just suggest a few things. First, click on the link that I have put in here for you. Look at the guides for the K-3 and the CR-1 visas. Then, download the forms for both visas or at least open them up and look at them. Read them thoroughly so you can get familiar with the forms and the process. Secondly, when you look for a lawyer, don't go with just any lawyer that says that they can file for you. Look for a lawyer that specializes in Immigration and only DOES Immigration. Even then, that is still not a guarantee that they won't try to sucker you in by making you think that you will need a lawyer..remember, they want your money and it can be very expensive to hire one for Immigration as it is not an everyday thing. Hence charging you more if you understand what I am saying. My hubby and I contacted 3 different lawyers and they all wanted to charge at least 10 grand. 2 out of three of those lawyers I might add only dealt with Immigration.

Now, remember, you have found a wonderful site to come for help. There are always plenty of helpful ppl aboard that will try to answer your questions as best they can or will at least direct you to someone who is more knowledgable. I would say talk to Aussiewench or Yodrak. Or MDYOUNG, or JerseyGirl. Those are just a few to mention but there are loads more that are full of helpful information and or suggestions. Honestly, I am glad that my hubby and I did not choose to hire a lawyer as the paperwork is pretty much straight forward.

Also, forgot to add, when you do talk to a lawyer, becareful with them trying to tell you that they can cut the wait for the visa by more than half. As most of us on here know that that is major BULLSHITE! I had 2 of the lawyers tell me that. There is no way to make it go faster unless you have just cause to have your case expidited and even then there is no guarantee. Hope this helps you.

Trace, I called up the USCIS and they told me that you have to wait not 30 days, but 60 days for them to receive it then put it in the system. Ironically, the very next day, the online status showed that they received and I also received three emails from them saying that they got it!!! Hope you get it soon. I would just call them again. Find out what in sam hell is going on!! :thumbs:

If you are sending to the Lees Summit in MO which is a PO BOX addy, there was a thread and for the life of me I can't remember where, but someone pointed out that sending it delivery confirmation will actually slow it down a bit because when a postman goes to deliver, there isn't someone standing there at the PO BOX waiting. Therefore, the post will be taken to the post office and a notice will be left in the box. Then you have to wait for someone to go and pick it up. Sorry if that seems so dim but only want you to be aware of how it works. I have sent my first RFE back with confirmation delivery and have yet to hear back either. WHen I read the other thread, I just winged it and sent it via regular mail. So here is keeping our fingers crossed. lol

I am simply becoming very frustrated with this thing.

Please understand one thing clearly, if you apply after marriage, then your wife must show proofs of your marriage. That will include your pictures together at the marriage ceremony, thereafter and your email, phone records, etc.



See that's just it...that is the problem I am facing.

We planned on having the marriage ceremony after the visa for her to come to the states was issued.
That way I would fly out there have the wedding ceremony and fly back with her afterwards. Wedding ceremony pictures will not be available until then. The culture out there is a little different. I will be married legally, however, the wedding ceremony will not come until later.

Is there something else I can do?

Do you have any pictures of you together at all?? What else do you have that would show proof of relationship? You will need all you can get so you can send to her for her interview. Phone bills, emails, snail mail, and gift receipts that you may have...engagement ring receipt etc...boarding passes from when you have been together..any of that will be a great help.

LJ...yes I have all of those...

I have a bunch of pictures from our engagement ceremony where we are both placing weddign bands on each other's fingers, I have a lot of phone bills. I have my flight itinerary as well as the Syrian stamp on my US Passport to indicate I was in the country at the time of our engagement. I have the wedding band receipts.

Furthermore, once I send her the G-325a forms for her to fill out. I will have the DHL receipts and paperwork.

I will also have Western Union receipts from wiring money over to her..


Its just i think there is some confusion going on. The only option I have is a K3... I cannot persue a K1 because, by law, we are married through a marriage certificate. She is not my fiance...she is my wife. Even though we still have not had the formal wedding ceremony, we are married.

AHHHHHHHHHH ok...sorry about the confusion then. Ok, first thing is first..you need to relax ok? You can file for the K-3 and or the CR-1. You can use everything you have mentioned as proof of your relationship. If you are looking to get her over sooner, file for the K-3. Since you have to file the I-130 petition (which is for the CR-1) in order to file the I-129f for the K-3, you can always opt out of the K-3 at a later date. So lets say you apply for the K-3....it gets approved and your wife flies over to you, then your wife gets notice of CR-1 interview, she can fly back to her own country and go back for that and will be able to get work asap and not have to go through the time and hassle of AOS. Plus, I believe it saves money. Its upto you. Good luck with your journey.

Sim, first WELCOME to VJ!!! I hope that you will be able to find your answers here and feel at home. Secondly, remember this, if you file before you get married, then you are filing for the K-1 visa. After it gets approved, you then have 90 days from the time your fiance steps off the plane into America and gets her visa stamped to get married. After that, your new bride will be able to stay with you in the country while you do AOS for her. Thirdly, if you opt to get married BEFORE you apply, then you would be applying for the K-3 and or the CR-1 visa. BOth are different. THe K-3 visa is meant to bring spouses over quicker then you can do AOS..meaning they will be entering on a nonimmigrant visa. If you opt to go for the CR-1, which is the grand daddy of all visas, you and your wife will be apart for longer BUT...once approved, your wife will be able to legally work and all of that.

So...what have we learned? K-1===can be together during the whole AOS process. K-3/ and CR-1===you will be apart for some time. (generally you are apart longer while waiting for the CR-1). Hope this helps!!!
