IR-1 / CR-1 Spouse Visa Process & ProceduresIMBRA apply towards I129F when I130 filed?
it seems to be affecting them, none have been approved since march 06th. the info aussiwench linked to ages ago also mentions K1 AND K3.

no k-3 were recalled, but they all appear to have stalled.

what this means in regard to RFE's and such is anyones guess. a new form should be out at some point which both the K-1 and K-3 use, the i-129f was seen in draft form, so hopefully it will be out at some point soon!

the k-3 will take many months to process anyway, so dont know if it would be done before you get your CR-1 anyway :(

do not refile, just wait. its taking longer for the NOA1 at the moment, 5-6 weeks for some. yep thats a while, but who knows what mess could be caused by refiling.

also, you can be in the US when you apply, so you could knock of some of the early waiting time by going over and applying and then using up the rest of whatever time your allowed (90 days on the visa waiver prog). you would have to come back if your interview was scheduled before the end of your time though, but that would be very lucky :D

I know personally I would hold off for a week or so, but thats just me... especially now this new draft form has turned up. but its impossible to say as no one really knows whats going on still, or how long its gonna be to fix...

well it would all be up to the person you deal with at your point of entry.

I would personally say its probably not likely that they could go back so soon after leaving. I was in the US in march for 2 weeks and im heading back again at the end of june for 2 weeks and im a bit cautious of the questioning i will get.

the very basics, she would need a return ticket and many advise as much evidence to ties back home. ie job and lease/mortgage but even then, its the one person you face at the airport who decides.

If she isnt allowed entry, she wont ever be able to use the waiver program again.

i went through DFW in march 05 without a prob and then again in march 06 without a problem. I said i was visiting friends and they asked how long i had known them and where we became friends. nothing too crazy and Ive been asked more at SFO over 6 years of trips before :)

also going back at the end of june for 10 days, not taking any extra info (contract employed anyway) and im not too worried about it. I was only there for 2 weeks back in march, i expect a little questioning but nothing too crazy. the people i see who were barred went for the full 90 days and then came back and tried to do the same thing very quickly.

edit: try not to be too worried, they could pick up on it! just try and relax, your not doing anything wrong and chances are you will get through fine :)

i mailed my I-129F on 6/2/06 and used the old I-129F form. I didn't know there's a new one. Is that gonna be a problem or should I go ahead and fill-out the new form and send it to them?


you should just get sent an RFE for the missing IMBRA stuff :) wouldnt personally suggest sending in the new one as it might confuse their little brains :P but this is just person opinion of course :)

got a NOA1 yet?

its similar in texas, but its only 30 days. ive read one attorneys website who says you can go out of state to remarry, but if the divorce is appealed, the marriage could be nulled.

if you wanted to do the no hassle easy route, put in the application for the fiance visa now while shes in the country. that way you can run off some of the waiting time together as long as she leaves the US before her visa runs out, then when she returns to her home she can complete the process and come back all legal and above board when her fiance visa is approved.

sadly you dont have to break the rules to be denied entry, when you sign the I-94W on the plane you pass all decision to the person on the gate and thats that.

Im in the US now, i had a 10 day trip 15 months ago, then another 10 day trip 3 months ago. On this visit i was grilled for ages, asked all sorts of questions. I only had a 10 day return ticket and i say im visiting friends, yet still the officer grilled me. Why was i back so soon, why was i here last, how much money do i have, am i getting married (i didnt even mention a gf so where did this come from!!), when will i be coming back, why was i here on my last visit. and on and on and on.

was crazy. I was let in though, but for a while i wasnt so sure.

all depends on who you get, but be prepared as you dont have to be doing anything wrong to get in trouble.

hi all,
Well we will be finally putting in for our K-1 this weekend. Im going through the guides for it all and ive come a little stuck at the proof of ongoing relationship. Im the non USC and im currently here on the VWP till september and most of the previous photo and evidence is back home in england.

Of course I can easily sort out the proving we have met by popping into the back yard with the camera :D but things like older photos, older boarding passes etc. i cant get till september and i really wanted to take off some of the wait while im here.

Ok, ill say what I do have. I would have both passports with this current immigration stamp and another back from march. her passport with her first visit to the UK back 18 months ago. Ive also got online itemised phone bill going back to nov 2005 with the hours of phone calls. I dont have any of the older photos of us together as they are on my PC back home, but i have a couple of printed out pics i took of her in london, but not the two of us.

EDIT: Ive just found some backups on my webspace of the 2 of us from london 18 months ago and one from my trip to the US last year

is this enough??

i know the feeling :( i had to wait over a year for the divorce to all go through, my partner had to kiss his ### to make sure he finally did the uncontested divorce as we had no money for lawyers...

worst year of my life, but it was all finally over 2 weeks ago and we are going to put in for the K-1 this weekend.

just try and stick it out as there would be nothing worse than being denied :(

hi all,
Well i should be finally posting off the application tomorrow and i just have a couple of really dumb questions to fellow brits about what to put for citizenship/nationality on the g325a form and the country question on the I-129f. See my brain is mush, is my nationality citizenship english or united kingdom? im more confused as on the vwp you must put UK or they get peeved.

also, my country or residence on the I-129F is england right? its not been technically removed or anything!


anyway, if a fellow brit could tell me what they put, it would put my mind at ease :D

hey :) we are finally going to be putting in for our K-1 this weekend through texas as well, so ill be keeping an eye on how things go for you, wish you all the best!

sadly (well expectedly I suppose) the NOA1 now seem to be taking a lot longer, although im hoping this is due to them speeding through the IMBRA backlog for the poor folk caught up in it all...

Im in the US for another 6 weeks, the thought of going home is filling me with dread, but i dont have to think about it for a while!!

well my partner sent off the package to the texas service centre at lunch today, so its finally gone in! took a bit longer to put in partly due to the problem of finding someone to take passport photos after she got off work in the evening. we eventually found walgreens, only to find the pics they took of me had a weird black bar across the top, so another delay to ge those redone.

then the printer decided it didnt want to work! so that was fun :D

anyway, to cut through it all, it was finally posted!!!

i know its not a big deal, but ive been waiting through a long divorce just to put the darn thing in :)


i have 5 more weeks in the US to knock off the whole process, then my partner comes to the UK in Jan for 8 short days and then hopefully it will only be a few more months after that till its all done!!

anyway, i had to tell you folks as I know you understand :P

NOA1s are taking upwards of 15-20 days to recieve, especially for transfers. Just hang in there. If it gets past 30 days and still not NOA1 or a checked cashed, then I'd start making some calls.

yep i agree, im personally planning on anything upto and around a month for the NOA1. Im guessing, but they are trying to clear all the IMBRA before putting newer ones into the system so we are getting a delay. could be totally wrong mind :D

still, dont panic for a bit, many are waiting 3+ weeks for theirs but it turns up in the end :)

im allowing at least a month for the NOA1 after reading the last few weeks worth of new posts to TSC. it sucks, but thats the way this game goes. at least its finally on its way and the process has started.

we were originally going to get married but put that off and did the k-1 due to the extra time the CR-1 NOA1 was taking before you could even send in for the K-3. glad we did now :D

well we had the great news this weekend that my partner is a few weeks pregnant!

Im sure i have seen similar posts to mine before, but being pregnant is not grounds for having the case sped up is it?

i didnt think it was, but if anyone has any info either way, it would be appreciated as obviously my partner is pretty sad at the idea of going through X months on her own.

hopefully though ill be approved in time to come over for the last few months and to see the little monkey pop out into the world :D

yeah its not easy for any of us stuck in the nightmare that is the visa application process.

I dont think you have much to worry about if you feel bad about feeling bad, the really unpleasant folk are the ones who dont feel like that ;)

just try and take comfort in whatever you can, i know thats almost impossible at times :( but this is hopefully a one time thing and ever day that passes is a day closer to finally being together :)
