K-1 Fiance(e) Visa Process & ProceduresOriginal Signatures Required on the G-325A and Letter of Intent?
Hello all,

A lawyer prepared our K1 visa application. The lawyer printed the G-315A and filled it out for my fiancee' (The form was confusing for her). In the signature of applicant box the lawyer signed her name and wrote "For (Fiancee's name)".

Also, for the letter of intent. I typed out a version and my fiancee' scanned, signed, scanned, and emailed back. Is that going to be a problem that it is a scanned copy of the signed document?

I'm wondering if I should just go ahead and have my fiancee sign everything and mail it to me for snail mail in case for an RFE. Does anyone think this will cause a problem. If there is an RFE how long does it delay your application?

K-1 Fiance(e) Visa Process & ProceduresForgot to include 4 G-325A forms, what do I do?
I did the same thing. MAiled only 1 for each of us. Just waiting to see if we get an RFE. I do have them ready to send in though if they request.

K-1 Fiance(e) Visa Process & ProceduresRFE via e-mail
Hello All,

If you don't receive anything in the mail is there a way to confirm that you don't have an RFE or to inquire if you do have one?

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!
RFE prompt will get you a person...Be VERY VERY VERY polite but assertive. You just want to pay the fee for your application and apologize for neglecting it.

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!

Thanks for the quick responses... Does someone have the phone number I can call???

I hope these bastards don't reject the doggone application. Is it too much to ask for someone to send and email or even call me and say, hey you forgot the check, send to address etc etc...???

There has got to be a a better way...

My advice is to call NOW! Follow RFE prompts and get ahold of someone. Explain that you failed to enclose the check and that you really want to get it resolved and not refile. You probably will be at the losing end but it's worth a try.

K-1 Fiance(e) Visa Process & ProceduresVisa Waiver Program

Bush signed the law, but in order for it to work, Brazil will have to enroll in the program, and wait to be approved for it, it will also have to change it's reciprocity law and stop requiring visas from americans.

Don't count on the VWP program for Brazil anytime soon, my guess it will take at least a year for it all to come to reality, if it does come, since the law Bush signed is for country with 10% or less of denied visa applications in the consulates (the bigger the number of illegals, the more they deny) and Brazil has currently 13% of denials.

Also, it's visa fraud to enter US with intentions to marry and stay if you already know it beforehand and are aware of the laws.

Did it say anything about Argentina?

K-1 Fiance(e) Visa Process & ProceduresRFE Check

Thanks!

I understand 100% that I could get a RFE anyways, I just want to make sure I am not missing something. Something that someone else might have done as well when they filed. :)

I submitted photos of when I went to Argentina in June 2006. That is winter there as opposed to summer here. I guess if I was in shorts and sunglasses on the beach it would arouse suspicion for example hehe.

K-1 Fiance(e) Visa Process & ProceduresRFE Check

Thanks for the tips!

Anyone else have any comments?

Passport stamps and photos should be mostly enough as long as the coincide with the dates you claim to have spent together. I don't have any receipts of spending money there, only the passport stamps, photographs, and copies of the boarding passes. I am hoping no RFE.

Why not enter on the visa waiver program and just wait it out together? Return as necesary to not violate the VWP rules.

K-1 Fiance(e) Visa Process & ProceduresShould I hire a lawyer to do the paperwork?

Most people here do it on their own. But its really your choice. If you don't have any complications, taking the time to understand the process and doing it yourself is most rewarding.

If you do decide to use a lawyer. Do your research. Immigration lawyers tend to be more familiar with work visas. You want to find someone who has handled K-1 visas or family visas. Rates vary, but it can be anywhere from $500 to $3000, depending how much they do for you and where they are based. That would be in addition to the regular paperwork fees.

If you do hire a lawyer...INSIST that you review the document fully before they submit it. Check for typos! My lawyer asked me to sign the application and my social security number was a mistype on all forms!!! Make sure you have a copy of the packet too. I paid 800 dollars for the services.

K-1 Fiance(e) Visa Process & Proceduresregarding processing times

In looking at processing times for the different service centers, it's showing 118 days for the CSC center, for example. Is this 118 days from the date that you filed, or is this 118 days from the approval date listed on the NOA 1? Also, looking at processing times for 129-F listed by the USCIS, it looks like they are still processing claims from mid-January!? What is the meaning of that?

Yeah I had a question about that too. Also, follow me on this one. If you go to immigration timelines, K1 visas, and change it to 3 months. Why does it say average time between NOA1 and NOA2 is 80 days? If you scroll down to the service centers all of them are 90-110 days? Which one is accurate?

K-1 Fiance(e) Visa Process & ProceduresCan you be denied K1 at interview if USC isn't employed?
Hello all,

Let's suppose I were to leave my job and be in between jobs at the time of our interview (which hopefully will be November sometime). My parents are willing to sign an additional support document. Can the embassy deny our suspend our K1 visa if I am not employed?

K-1 Fiance(e) Visa Process & ProceduresNOA2...now what to expect?
Hello all,

Yes I've read the guides.

We just got our NOA2 on October 8th. I'm just curious what to expect next. How do I get the information after this to fill in our timeline (NVC left date and arrive date etc). Does it go pretty quickly through NVC to the embassy?

Does our case number change now? How do I get this information.

wasn't there something that you didn't believe that he filed the I-129 bc you thought the case-number was a fake?

ohwell, i guess you guys are just dealing with things differently.

Amen....I've seen her post alot of stuff like this. Then she goes away for a while and comes back again.

K-1 Fiance(e) Visa Process & ProceduresNo Vaccination Records
So she can still come here without her vaccination record and we can get them all tested or redone here?

K-1 Fiance(e) Visa Process & ProceduresNo Vaccination Records
Hey all,

We got our NOA2 and my fiancee is looking for her vaccination records. Sadly, she isn't able to locate them (although we will keep trying). Her records from her former doctor are also probably lost as well (he isn't practicing anymore and the practice is gone).

What happens if she doesn't have a record of her vaccinations for the medical interview? Should she redo her vaccinations before the interview? Once we are married she will be on my insurance and she can get them here too if we wish.

I read it's not required for the medical exam but from what I hear from others they want this at the medical exam. Anyone else have experience in something like this?

Thanks,

Charlie

Can you elaborate a bit more about working with an immigration officer at the local office? Have you been making infopass appointments for help filling out the paperwork? If not, how else do you have an immigration officer working with you?

Yes I made an appointment with a immigration officer at the local office. The immigration officer I spoke with was very nice and she helped me alot as well as gave me her personal extension so that I can call her directly with questions. So she has became a huge help.

K-1 Fiance(e) Visa Process & ProceduresNeed Advice
Hello everyone, First I should say I really love the site and it comes in handy for me and my finsaee. I would like to tell you all a little about our story and see if anyone has any advice on what I should do. Me and my finsaee met online July 2008, We quickly fell in love and planned our first meeting in Morocco. I went to Morocco and we had a GREAT time together we had our engagement party on Oct, 4, 2008. I then came back to the USA and started the process of the K-1 visa with a lawyer, the lawyer was suppose to be a friend but turns out he has really goofed up our case. I had my first Appointment with Immigration in Feb. 2009 It went well and I had to gather more information and return it to them as well as fill out some papers there. We thought everything was going well we were getting some updates from the lawyer but nothing from Immigration other than the Appointment notice. Anyway to make a very long story short I decided to go back to Morocco to stay with my Finsaee until we got the visa I was blessed with a job from my employeer and I could do it online allowing us to have some money and stay together which was like a dream come true for both of us. So I returned to Morocco in Feb, 09 and in May I get word from my (so called lawyer) that there is some documents that he needed from me and I had to come back to the USA unplanned and unexpected. So it was a major let down for both of us. So I returned back in the USA in May, 09 and have since been on a roller coster of situations and in the end I fired the lawyer and took over the process directly with the immigration officer at the local office. Thank God now everything seems to be going ok I gave all the nessessary documents to the immigration officer and the case was sent July,09 to the Main offices and now we are waiting on our NOA. This is our first time doing such a case and I was wondering if anyone out there had any advice or anything similar happening to anyone. HELP!!!... I was also wondering about any fees that I may have to pay? Since I am doing everything alone now and without a lawyer I feel like I am in the dark about alot of things. So anyone please HELP!!! I am pregnant and we are expecting our baby in Jan, 2010 and I really want my finsaee here with me for the birth of our baby! So if anyone has any advice or could help in anyway please let us know. Thanks so much.... Amina Boussague
