However, there is one more technicality I am unsure, but curious about. We hope that, financially, what my fiance will have by the time of the interview will be enough. We'll also have a signed and overall ready co-sponsor Affidavit, but we'd like to not turn it in with the rest of the documents at the Embassy, but instead to give it to the CO in case they asked for more proof (documents, whatevers) during the interview. Is this even possible? Or is it better to hand in both Affidavits? Would they just ignore (and therefore return) the one signed by the co-sponsor if the petitioner's was sufficient?

The problem might be the fact that my fiance won't have tax returns for any year other than 2008. He makes enough money now, and has been in 2008, overall. Before that, he was in college and didn't file taxes.


Badgerella, I read somewhere about a girl who had two sets of fin-l dox too, her fiance's and their co-sponsors. When she was called to submit the documents before the interview to one of the consulate workers, she gave her fiance's financial papers and said that they also had a co-sponsor, however she was told that she would only need to present them if the CO asked during the interview. And I believe he never did.

Thanks! His mom WAS actually gonna black out her SSN. I figured it wouldn't be that big a deal, since they won't have time to run it thru any kind of check at the embassy.
I'll keep trying to straighten out the rest of stuff too. I can't believe, in the very end, we hit such a stumble. Immigration red-tape, I hate you! devil.gif

If only his mom would get that letter from her employer you'd be all set & safe. Would his mom be more willing if you sent her a copy of what it needs to say? Maybe she's not sure what to ask for so she doesn't want to do it?
I don't know that I'd submit your fiance's info since his employment is only 2 months so far, and he won't be able to send any tax transcripts along. Seems very risky to me.

Hello everybody!
I always thought that the hardest part would be to survive the NOA2 wait, but here we are, have the Interview date set, and it does not get easier.
Here is the financial aspect of our situation. My fiance, the American citizen, has been in school 2005-2007. Therefore, his income has been sketchy. So his mom has volunteered to be our co-sponsor. Now, it took her a while to make this decision, especially after I sent them the list of what they may ask for at the embassy. Her main concern was sending all her detailed info across the globe, it may getting stolen, identity theft, well, you get it.
Now, finally my fiance tells me she has everything ready. At a closer look, it turns out that "everything" includes tax transcripts for 2007, bank statement and affidavit. I asked about the letter of employment, to show that not ony she had a steady income in the past, but she still got it, right? And was told "it's an overkill".
And my fiance, who now makes about 22K, but he's only been at this job for 2 months is sending me his affidavit, his bank statement and recent pay stubs. Turns out he did not file taxes in 2007 as he did not work - only studied full time. So I asked to also sent me a diploma, or a certificate or smth from his school to prove that. And he might get a letter of employment himself, but he says that no one does those where he works .
Please, tell me how screwed are we? We've been arguing over this a lot lately, and he says that it is just too much to send ALL that I asked for. But it's not like I just decided to ask them for all those dox, just for fun.... Oh boy, am I worried?

Hey guys!
I just received the financial documents from my fiance and his mom (she's our co-sponsor). Well, his affidavit looks fine, but hers has no bar codes. We used the new form from the USCIS site, and I guess her printer didn't print out the bar codes. Do you think that would be a problem? Do they actually scan them or smth at the embassy? I already asked my fiancee to have her fill it out once again and print it out on his printer and sign and email to me ( no time for snail mail left), so I WILL have the copy. But I'm still worried.

I've been caught out in this area too, and it was because of my naivety.  I'll give a bit of background which will support JE57's quote below.  I am employed as a contractor for a US company/division/office/employer.  My employer hasn't been asked for this (yet) but has evidence that she tried to recruit within the states but there were no suitable candidates.  She has kept this evidence because that is the only reason a US employer should be hiring foreign work.  This applies to contracted work where the employee is living and paid in the foreign currency, or if a work visa is requested for the employee to work in the states.  

 

Now, I did look up the rules on working in the states for free on an esta and training was mentioned.  My role in my job is to write and maintain training packages, and my boss travels to facilitate the training.  I was in the states visiting my spouse and my boss was caught up with a family matter so asked if I would travel to facilitate a 1 week training course which I wrote.  I agree'd since she wasn't paying me anything other than the standard wage as part of my contract, I didn't see the issue as if I'd been in the UK at the time I could have conducted the training session remotely (skype/webex etc).  What I didn't take into account was that training was referring to attending training.  But I delivered a training course, not attended one.   

 

Anyway, cut to my next visit to the states.  I'm taken into secondary inspection and they asked why I had travel receipts with me billed to an employer in America.  I said that they needed someone to deliver the training and because I wrote the training under my UK contract, and was still employed on my UK contract that I'd offered to do the training course.  It was explained to me that even although that is my job, I wasn't authorized to complete this work in the states.  The fact that it was face to face and an american employee wans't available, in the eyes of the government they could have gone to a temp agency and paid a USC to do a couple of weeks work.  

 

Basically, even although you were doing the work for free (for a friend) if you weren't available to help out, your friend would have most likely had to pay someone (a USC) for services.  Even if the USC offered to do it for free, it's something they can put on their resume, and it would have been their credentials on the wall (a networking opportunity perhaps).  If ongoing services are required, the USC get's this work.  

 

Anyway, I know you didn't intend to take work from a USC, I made the same naive mistake but got off with just a warning, told to be careful when it comes to employment and basically to keep myself on the right side of the immigration "law" I should refrain from working at all when in the states.  I agree your punishment was severe, they could have done a bit of scare tactics, but I think the difference between your situation and mine is I was travelling as a tourist and an opportunity to help my current employer in their locale came up, as opposed to traveling to help out a business being the intention of my visit.  

 

I wish you all the best in the future and hope you can get the situation resolved for you and your friends benefit.  

 

To the OP,  You made a mistake by working (free or not) in the USA.   Now you are suggesting that you will continue to do work in the USA by continuing to help your friend from your abode in Canada.   You're in IT so you have the ability to do work from abroad.  BUT... before you get your friend's new business in trouble be sure that the businesses that hire him as a contractor for which you will render services from abroad are not going to get in trouble for doing so.   I don't know the laws in this area but it would pay for your friend to do some research.  Perhaps even people here know if you rendering services as part of a contract agreement between a US company and your USC friend would be allowed.   And by rendering services I mean rather you get paid for it or not.   What is the point of displaying your certificates in his store if you a citizen from Canada can not legally provide services.  My point, you claim ignorance of the law which got you into this situation in the first place..  CBP has your name and your friend's name and knows your intent..  Don't allow yourself to fall afoul future laws that would embroil your friend's new business.

Depends on you Service Centre.  CSC does not, last update is approval.  TSC and NSC will update the portal IIRC.  I don't know about VSC.

Same thing happened to me. Our NOA2 stated that I was in USA and needed to file form i-824, I was in Canada and I knew that it was 100% wrong. My husband (petitioner) called USCIS and the first customer service rep had no clue, just kept saying to file the form. So he asked to talk to a supervisor and after waiting on hold for 3 hours the supervisor finally told him that our file had already been sent to the NVC.

So I would ask for a supervisor right away when calling.

My husband called USCIS, asked to speak to a Tier 2 and they said they didn't have time to discus the case and hung up on him.  

 

I called the NCV and they told me to contact USCIS.  

 

In the meantime (to avoid any unnecessary delay) we filed the I-824 today and wrote a check for the $405.  Fingers crossed the I-130 was sent to the NVC and the I-824 is subsequently closed down, but if not at least it's in the system.

Hi all, 

 

I'm new to this forum have just recently received NOA2 on our I-130.  We have an issue though, we received the I-797, Notice of Action, and it's saying I'm in the US and to apply for AOS.  I'm not in the US so it's saying to file I-824 and pay $405 for the pleasure of their mistake.  Anyone else experienced this?  What was the outcome if so?

 

In the meantime we've raised another Service Request with USCIS.

I've got a similar story to lakehouse, my I-129 actually slowed down my I-130 by a few weeks.  

 

I too got transferred late in the process, and when I got an RFE on my I-130 I had to wait 5 weeks for the physical letter, which arrived the same day as the I-129f RFE (all the wanted was a passport style photo which they already had with the I-130 petition).  Then we were caused no end of stress when they said the I-129 petition was sent to the NVC but the I-130 wouldn't as I was already in the states to to adjust status.  I wasn't already in the states, so we filed another form, costing $485 to have them correct their mistake.  

 

To top it all off, someone on this site noticed that anyone who waited a couple of months between I-130 NOA1 and filing the I-129f experienced significant delays (possibly linked to the fact that the I-129 priority date was used instead of the I-130)

 

It does not speed up the USCIS part of the process at all.  The only way it may speed up the process is if its sent seperately to the NVC, they don't administratively close it and send it on to the Embassy, you will be scheduled an interview then once the I-130 is case complete and sent to the embassy they will process the I-130 but using the early interview date you got because of the I-129f.  I believe this happens less than 1% of the time, but given that I was delayed somewhere from 4-6 weeks at USCIS stage, even if I was one of the 1% at the NVC, all it would do is bring me back on track at this point.

Now that really is the million dollar question, isn't it?  I'm waiting to know that one too, but keep an eye on my timeline as I update it the minute I find out anything, mine was received 3 days before you, so that should give you a good indication.

Can I ask what people are seeing on the ceac site when AOS/IV documents are "received" and reviewed?  I asked today and was told that the site wont update for "security reasons" which seems bizarre, why have the option on the site if they won't use it.  Also, why are we inputting payment details, and lots of personal info (DS-261 and DS-260) if the site isn't secure???  

 

PS - I write "received" this way, as our AOS docs were delivered on May 22nd but the agent said they received them in the building on May 27th.

Quick question for you VJ pros.. Just wondering how long has it been taking for AOS fee to show as paid? Paid it on Tuesday evening and it's still showing as "In Process"

 

Mine took 12 hours, 10 hours for the money to leave the account and another 2 to be reflected on CEAC.

One more question, My wife (the petitioner) has never been in a paying occupation, and currently she is a Homemaker. So for I-864 part 6 which box should she tick? Should she write she is employed as a homemaker? or should she write she is Unemployed since... well hmm her birth? :P If i write unemployed what should i write in the 'since' part?

 

I'm not really sure if you should write homemaker or unemployed, but for the "since" part, you could just write the date your wife finished any schooling/education, since prior to that date she was a student, not unemployed/homemaker

Hello people.. Just a quick question. I filled DS-261 and paid $88 for AOS on 20th of May. I had already sent my I-864 form with last 2 years Income Tax returns along with my I-130 Petition Package. I also mentioned it in the checklist I attached with my I-130 petition. Do I have to send it again? or would they send me an email or something?

 

** I even attached the letter of employment (Current).

 

Were you asked to resubmit the I-130?  As far as I'm aware, after I-130 approval, you step away from that process.  You should be completing the DS-261, Paying the AOS fee then submitting the AOS form along with evidence, then paying IV fee along with documents then completing the DS-260.  I'm not aware of a situation where you have to resubmit any I-130 information.

 

That being said, from what I understand, it's beneficial (and advised) to keep a copy of every form and document to take to interview.  

 

EDIT:  having reread your question, I understand that you sent the AOS with the original I-130 petition, and not the other way round as I understood it?  If so, then yes, you will need to resubmit the AOS package.  Not only is it likely out of date, it's been filed to the wrong location in the wrong order, and won't likely include the most recent tax year.

Hi All,

I have a question. I am the beneficiary and in my birth certificate, there's a clerical error with my father's name. Correct name is Michael but it was typed as Michel. Is there a high possibility that I could get a checklist for this? I already have this changed but It will take another 2-3 months before my birth cert will be corrected.

NVC received our case last May 2 and we are still waiting for our case number. We just want to make sure that we have all the documents ready for nvc.

Hoping for someone here to shred some light regarding my concern. Thanks in advance! ?





 

 

I'm honestly not sure about getting a Checklist, but I am sure that you have to fill out parents detail on the DS-260.  Perhaps there's a way you can get some kind of notarized/official document or statement from the government, or even a photocopy of your fathers passport with a written explanation as to the spelling differences.  Maybe the best thing it to call the NVC and see what advice they can offer?

30 minutes after reading about the fact that resubmitting the DS-261 can possibly cause a delay, I too accidentally resubmitted it.  What a stupid process; I was trying to be uber organised by accessing and saving confirmation of the completed submission and instead, by clicking into the "complete" section, I re-opened it.   I'm hitting my head against a brick wall here.  I sat in the I-130 forum watching all these people who filed after us getting approvals before I even got my RFE which took weeks.  Then I have to wait 5 weeks to even be received at the NVC, I really got my hopes up when things started progressing quickly at the NVC stage.  Now I make a stupid mistake and potentially have delayed the process even more.   :oops:  :ranting:  :oops: 

 

Sorry, I know pretty much all of us are in the same boat, I'm just so frustrated that the wrong click of a button can potentially cause delays, and the inconsistencies experienced by most of the members here is totally unacceptable.  It should be first come first served, processed in order.  We all know that doesn't happen!!!

I think I'm going a little crazy, but my DS-261 and AOS bill were available before we received the notifications.  My IV fee has a "pay now" option, but no fee available (it was showing N/A before the AOS fee became available).  

 

Anyone had any luck calling NVC to have the fee enabled or is it just the usual waiting game?
