I totally agree with  deep 2009.I am an  indian, belongs from skin religion ,my second marriage was attended by only 4 ,5 people my blood relation people only.

Yes, keep all money transfer receipts and include them to proof your on going relationship. I have submitted all money transfer receipts starting from year 2009 to 2012 in my CR1 VISA Petition .yes, you can submit them with the phone records but clearly mention on the cover page " money transfer receipts" and other cover page "phone records".

K-1 Fiance(e) Visa Process & ProceduresPICTURES FOR INTERVIEW

My fiancee and I do not have any pictures together. We never thought about it when we were together and our decision to file a K1 was made after he went back to India. We have a child together and I am going to send him her birth certificate, even though he isn't on it b/c he was in India when she was born. She does have his last name, an American custom to lower any confusion. We have tons of emails back and forth, and we're going to try to get our phone records even though they are prepaid phones. Does anyone know about getting records for a prepaid phone? Will pictures of our daughter (looks just like him :D ) and her birth certificate be enough?

Any input would be greatly appreciated. Thanks guys!!


Hi, as I know you can get last 6 months call details in prepaid phone and only out going no incoming get last six months details and then get month by month .And for pics, YES, pictures of you two together are very important and you should consider to make a trip and snap many pictures as its a strong evidence to prove a relationship and also try to gather other proofs which all will be beneficial in your case.

My fiancee has address example-

But on papers 129-f, G325A it is filled as- X House No. 2

 

Fiancee sent me the cards for last few years from address X House No. 1

 

Does this means i do not provide cards to prove proof of relationship or provide scanned copies of cards without envelopes?

 

P.S. card envelopes have fiance address.

 what is important it is to submit  cards with envelope which has  postal stamp and address   but as you mentioned , address problem if you have mentioned the  address of house no.1 its ok. if not so written explanation that the fiancee was living before on this address and submit the cards  it  will be fine. .according to me ,Primary and secondary proofs  all should be submitted which  can prove   relationship if you  have any problem ,submit written explanation if not so gather other strong evidences which will be enough to prove your relationship.GOOD LUCK.

Depends on how hard the country is your trying to deal with. Some countrys require you to front-load and send a huge package of proof.

Thank you all for your advice. The consulate sent me the following email after my constant phone calls and emails. We have decided to get married. What do i need to do so that my application for the marriage visa to get approved. Its such a drag and i feel that all this was so unfair. My fiance was nervous and intimidated during the interview and now our lives are on hold. Here's the letter from the consulate:

Case Reason: Hold case/221 G & Refusals/214B
Public Response: Based on the information provided by Ms. XXXXXX at the time of her interview, she was determined to be ineligible for a fiancé visa as she could not present sufficient evidence of a credible relationship with the petitioner. Therefore, Ms. XXXXXXX’s petition was returned to the National Visa Center (NVC) Once NVC receives the petition, it will return the petition to the approving office of the United States Citizenship and Immigration Service (USCIS). K-petitions (I-129F), unless they are revalidated by the consular officer, are only valid for four months from the date of USCIS action. When USCIS receives an expired I-129F, they will not look into the basis for the return, but will allow it to remain expired and will not reaffirm or reopen the petition. Please direct all future inquiries regarding this case to the approving USCIS office: www.uscis.gov



Hi, i can understand you both have struggled much to get visa and it pains much when all efforts fail.One thing i have noticed that your visa case denied cos of your fiance could not present sufficient evidence of a credible relationship
So, go ahead get married and gather as much as evidences which all will prove your relationship genuine.Marriage party, gathering of people, register your marriage, ,boarding passes of visits, affidavits from both the parents and families, Give advertisement of your marriage in news paper if possible with pictures,and many more proofs you can gather and strike back again with CR1 visa.Its well said Patience pains but pays and my advise to you is instead of worrying sit together and make proper plans for your marriage and don't leave any stone to turn down.GOOD LUCK.

Thank you for your advice. I spoke with a lawyer who has given me three options.
1 wait for the reply and fight it. Can take anywhere from 6 to 12 months. And could still be denied
2 file another k1 app and start it all over again
3 withdraw the k1 and get married and file which he mentioned was the best option.
However I'll call the consulate again tonight and try to get precise reasons why the visa was denied

My advise to you is withdraw your K1 (if you see that you are not getting enough response from embassy),Get married and strike back again for Cr1 visa with lots of proofs and evidences.
But try until they send YOU correct information that why they have denied your K1.
I am also struggling for Cr1 and Cr2 visa and my husband is also in Texas

Hi Friend, Don't loose heart try again and again until you get success. vfs has given your e-mail a case no.(vfs gives every e-mail a case no.) and its your e-mail which has been escalated and is still in the process of being reviewed. it means the embassy will read your e-mail of request and vfs people will only reply when they will get any reply from the embassy.and you will get different case no. with each e-mail which you will send to Vfs.

I and my daughter's passports are with embassy and our cases are on AP from past three moths (administration process)AND TO GET local police clearance and passport police clearance(pcc)i need my passport so should i wait for the AP to finish or i request the vfs to get our passports back to apply for the both passport and local police clearances?
And the form I-864 AFFIDAVIT OF SUPPORT MY HUSBAND WILL FILL AND SEND IT TO ME BUT I JUST WANTS TO KNOW ONLY ONE FORM IS O.K. FOR BOTH ?OR HE HAS TO SEND TWO

I got two 221g sheets on my interview day on 16/12/2011 and according to 221g sheet i had one year time limit to submit all the asked documents after that i filed guardianship case in court on 3rd January and i was in hope that the case will finish with in the time limit but not. so on 13/12/ 2012 had submitted rest all documents with a letter stating that the court case is going on in the court and pls grant some more time with a copy of the court case petition.the visa cases both CR1 AND CR2 are on AP NOW.AND ON 5TH March 2013 the court declared me the Natural Guardian (ex- party )AND i have already sent e-mails regarding this to the vfs people and they say that we have forwarded the e-mail to the consular i am still waiting for the reply
from the embassy that how can i submit the document of guardianship to embassy,but no e-mail has yet come.
i have planned to send the copy of the document through speed post to the Embassy will they accept it or it will reach to the consular cos the one year time limit has finished and both the passports are submitted in embassy already. pls advise the best possible way to send the document to the consular.

LET ME EXPLAIN CLEARLY ABOUT MY STORY.
MY EX-Husband stays in Uganda(citizen there) i came to my parents in Delhi with my daughter in 2006 and filed for Divorce in 2009 and got divorce in 2010 as Asingle(ex party divorce)and its mentioned in my divorce judgment sheet that the child is living under the care and the custody of the mother.After that i got married with An American citizen in 2010 and he filed for CR1 AND CR2 VISAS.I was thinking that at my divorce time the magistrate has already mentioned about the custody of my child is enough cos the bio father never came in the court in divorce case.And on our interview day the consular asked me, do you have the custody of your daughter then i told him its mentioned in my divorce judgment he read it and after some times later he said we need the separate order from court.Which i didn't have that time i got 221g sheet to submit the court order regarding the custody of my daughter.I asked the lawyer he said you cannot file for custody cos the child is already living with you,and one magistrate has already mentioned it in your divorce judgment sheet that the child is living in the care and custody of the mother, and no one other is demanding the custody of your daughter, even not your ex-husband.so in this case court can award you NATURAL GUARDIAN OF YOUR CHILD(14 YEARS OLD DAUGHTER)SO i had filed a case of Guardianship on 3rd January 2012 and the case was going on and finally the court declared me the NATURAL GUARDIAN OF MY DAUGHTER ON 5/03/2013 MORE THEN ONE YEAR AND EVEN THIS CASE I HAVE WON AS SINGLE PARTY THE BIOLOGICAL FATHER DINT COME IN FRONT OF THE COURT.My case is different the biological father was not present in both of the cases(divorce and the guardianship)In his absence(he doesn't want the child and even not the child wants him) as per law ,the court has awarded me
the natural guardian.I just worry about will this declaration be enough?I have waited and fought for my daughter more then one year to win this case AND ACCORDING TO OUR INDIAN LAW THIS WAS ONLY APPLICABLE.PLS ADVISE ME I AM BIT CONFUSED.

IndiaBirth & Marriage Certificates for Senior Citizen Parents in India

Non-availability of parents’ civil marriage certificate – (I-130 Processing by USCIS)

Parents were married about 40 years ago and their marriage was not registered / recorded in government records at that time , as it was not mandatory / compulsory . Can the marriage be registered now , with the same date of marriage ( 40 years ago ) , in the office of “Registrar of Marriages” ? Will such a (belated) marriage certificate be acceptable by USCIS for (I-130) processing ? Suggestions are welcome .

Moreover , the office of “Registrar of Marriages” is not willing to issue a “No Records Available” certificate for the 40 years old back period , as they say that it is not possible to check old records – which practically seems to be true ( in my opinion ) .

Hi, My advise to you is if it is possible register the marriage.
If not so go to the higher authority to get in written the "NO record available"the same thing happened with me i was not having my birth certificate so i went to get it from NDMC Delhi they said they will check the records and the records were not found and they refuse to register the birth and refuse to give me NON availability of birth certificate i went to the senior officer but she said its 2 years now we have stopped issuing "NON availability document".Even then i tried my best to get it and then i went to the NDMC head office to meet the higher officer(head of department)i spent half a day in wait to meet him and finally got chance to meet him when i told him about my problem and told him that i have all the documents to prove me then he ordered that issue the NON availability document to me and i got it with in three days.
so go and fight for it and approach the senior officer(head of the department) when they will order the lower department then they will check the records. AND if they disturb get advise from the lawyer.

dhanyaavad aanu ji! So for the proof of address, do I bring my proof of address from the US? If so, what do they accept? And also, out of interest, when did you and your husband get the affidavit/get married?

 

first of all i would like to tell you that  we went to get  this affidavit in year 2010(September) just before 4 or 5 days prior to our marriage.  On that day embassy  gave us one sheet of guidelines(based on new guidelines from the u.s. department of state the embassy is authorized to notarized a statement from the u.s. citizen party to  the marriage,in which the citizen him or hers if affirms that they are free to marry) and one  notarized affidavit .

yes, you need to take any id proof which has your current address of U.S, your passport and copy of e-mail of appointment and some other documents.and you have to be at embassy personally with all documents and your signatures will be required on the affidavit after  it , embassy will notarized it and you will get it.

 In our case ,we  had submitted  the cover letter of guidelines from embassy  with affidavit when we went to register our marriage.even when you will go to register your wedding ,your address(U.S.) proof will be needed so bring any id proof which has your address of U.S.

Send one e-mail to embassy that you want this affidavit and so and so is your  wedding  plans in India , i hope embassy will give you appointment as early as possible which will not effect your wedding plans. we did so and got this affidavit with in three days.

I and my beloved will be wed this August, thereafter we will be starting our visa journey (**cringe**). We are getting married legally under the Special Marriage Act, and I am a US citizen, so I will need a single status affidavit. I can't seem to reserve a date at the damn Delhi embassy yet and it seems unlikely I will be able to get a date which coincides with my weddings plans (the wedding starts soon after I get into the country and it's in UP, not Delhi!), I need to get my single status affidavit before I get to India instead of waiting on the bloody embassy. Is this possible? If so, where can I find a copy of it? I have heard it's on VJ. Thanks for your replies!

You have to  send e-mail to  U.S. Embassy Delhi  to request that you need this affidavit they will fix  an appointment and that day you have to be there on time with the print out of that e-mail , with your passport,  address proof and the embassy will issue this affidavit in presence of you .  In our case we got it with in three days.one day my husband sent e-mail regarding this to embassy AND  got reply that his appointment with embassy is after two days  he went to embassy and with in 20 minutes he got this affidavit.

In addition to the marriage certificate, is there any other document (or some other form of it) I can provide to establish a bona fide legal marriage? 

 

 

As per documents  all which you have mentioned are enough. But for  marriage ,marriage should be registered and have marriage registration certificate.

And affidavits from your side relatives and  from your parents also needed.

Hi, my visa( Cr1) case is on Ap from December 2012 its more than 6 months  and Delhi  embassy has my passport from past 6 months .

sometimes embassy returns the passport and when Admin. process   finish,  again ask for submit the passport no need to worry. and during Admin. process embassy do field investigation as they did in our case too immigration officer came at our home and asked questions from my mother and the neighbors too and they note down every thing on a paper, so its their way of investigation  and when Ap will finish they will contact till then check status on line  this is what all people are on Ap is doing.

IndiaCan someone please share a PCC so I know what it looks like?

As the subject says, I was wondering if someone wouldn't mind posting or emailing me a copy of a [correctly made] PCC, so I can give it to my wife to show the authorities as an example.  I know someone had done this a while back, but I can't find that thread anymore.  I really really appreciate it!

 Yes, its right that  PCC is issued by Passport offices in India and they have standard format. All you need to do is request PCC for USA and passport office knows what to print-basically two lines of letter . and a  stamp on one page of the passport, you will get two copies of the printed standard format of PCC one you can keep with you and another submit in the embassy.
