Visa was denied  under act 212A5A 9FAM40.1  for not Bonafide relationship  and sent back to Nvc 

and when we got NOIR  with all consulate objections on 17th October and submitted the documents on 14 November to USCIS and case got reaffirmed on 17th December

Check every thing from your lawyer. some lawyers are  not trust worthy. in My daughter's case our Lawyer din't submit the birth certificate of my daughter to Nvc and this all came in picture when i got document status  report from the NVC .In the list a big cross mark was in front of Birth certificate after talking with the lawyer ,she checked and found that the certificate was in the file kept in her office and she was claiming  that she had sent all documents to NVC..even after that 

we got many ups and downs cos of her poor performance,now we have hired another one.

Submit as much as documents which all are enough to prove your relationship and you can get affidavits from the parents and the family members stated the reason why they din't attend the marriage but they know about your marriage and you people love each other,if you public ally announced your marriage(in news paper)so you can submit the news paper to embassy with other important documents.Best of Luck.

Hi, don't worry much.When the Ap process will finish the embassy will inform again to submit the Passport. Ap has no time limit it can be for some days to months i will advise you to check your country portal to know how long the Ap can go in your country.Prey to God. But vfs people say that embassy don't accept the documents which sent directly to their they accept only the document submitted in the vfs.I have sent the photo copy of the document through speed post and delivery status shows it has delivered to embassy i fear has it reached to the consular or not?
the one year document submission time as per 221g sheet has over and the passports are already with the embassy so i cannot go to vfs to submit the document and vfs people says when the Ap will finish embassy will contact you to submit the documents but even then i had sent the copy of the document through speed post as per 221 g sheet it was required but the court took much time to issue this document.very confused about the staus of the delivery of the document.

Basically, they've received the documents you sent in and are going to process them with the rest of your case. If they were the correct documents, they will contact you, at which point you'll send in your passports for the visas to be put into. Just relax - you should hear something soon!




EMBASSY already has our passports from 13 December 2012 , has not yet returned.

Hi friends,
my and my daughter's CR1 and CR2 visa petitions on Ap since 13 December 2012 after submitting the 221 g documents.one document was remaining to submit and i had sent it to embassy through speed post and it has already delivered to embassy and in this regard to know whether the documents reached to the consular i had sent one e-mail to vfs and they sent me this reply:

"We have received the documents submitted by you. However, your case is currently on hold under Section 221(g) of the Immigration and Nationality Act (INA) pending the officer’s review. Section 221(g) of the INA prohibits the issuance of a visa to an individual whose application is incomplete or inconclusive, or whose eligibility has not been firmly established. Please be assured that we will contact you as soon as the processing will complete".
And I have checked the status on line it shows the cases are on AP. I am confused will we get visa?Our cases are on Ap its going to be four months .

Hello All,

I am being told by the lawyer that we would need to submit original documents to the NVC.. I -130 was approved with copies of the documents. There is only one original each of Birth Certificate, Marriage Certificate and Police Clearance. I am not comfortable giving the NVC our only originals. Besides my spouse would need those for the interview. This requirement doesn't sound consistent with the rest of the process.

 Not having custody of your daughter would mean that she couldn't be given a visa but should not prevent you from getting a visa.  The procedure sees you as separate people.  It could be that your case lingered too long.   If your interview statement said your case needed further processing and your neighbor said they had never seen your husband that may make them think it is a relation for immigration purposes. 

 

In my divorce judgment sheet it is clearly mentioned that my daughter is living under my care and custody. my divorce case finalized as single party .and when embassy asked for the court order regarding the custody of my daughter i went to court and got information that no custody case can be filed if the child is already with the person who wants the custody and if  no one else is claiming the custody so a case of Guardianship was filed and i am the legal guardian of my daughter and even this case i have won as single party ex-party my ex-husband din't come in both cases so court has given me this right in his absence and it is mentioned that in the absence of the biological father the right goes to the mother. I am  an Indian citizen and my country laws will be applicable on me.

From what you have said it is most likely some information that your neighbors provided.  Not doing anything for a year can cause a petition to be closed but they should have worded that refusal differently.  Did they give any codes about why they can't issue you a visa ?   Do you have any ex husband ? Do you "see" any male in any way that the neighbor may think you are married to someone there ?  If you are not totally sure about what happened , think very hard about the most probable reasons .  Make an explanaion of those.  When they send a NOIR you have so little time to respond you want to be ready

 

Hi thanks for advising me. i have doubt on my neighbor cos the same day she came to our home to say sorry  about what she told them------the lady immigration officer asked her  by showing my husband's photo that do you recognize him and  have you seen him here ?she said no i have not seen and i don't know who is this person and much more.

secondly , after my interview i filed one court case regarding the guardianship of my daughter and every month i was sending e-mails to inform the embassy that the court has given me this date and as i will get the document from court i will submit it .yes, due to delay from court in my daughter's guardianship case  i was failed to submit the document of my daughter  with in one year time limit but when i had submitted rest of documents i  had submitted one request letter to grant me more time to submit this document but  embassy had not sent any information about it.

my husband sent one e-mail to vfs (visa help  desk) and they replied :

"With regards to your query, we would like to inform you that, you may check the reason in the letter provided to you after the Consulate/Embassy interview by visa officer"

It means that embassy has refused to issue visa cos i failed to submit the 221g asked document regarding my daughter's guardianship with in one year time limit.?

i have not yet got any official denial letter from the embassy  just got one e-mail according to this e-mail the

  It apepars you were denied.  The interviewing officer will write up a report of the interview and it is supposed to be reviewed by the lead officer.  It is then shipped back in a pouch and sent to the original approving center.  It is then put in line for a review.  If they just disagree with the consulates finding you will get a notice that it is reaffirmed.  If they agree that something is wrong they will send you a NOIR ( notice of intend to revoke) and you will have a very limited time to respond in a way that changes their mind.  Do you have any clue what went wrong ?

 

we met----------through a matrimonial site  in 2009 after my sister told me about him.

and married in ------2010 attended   got two 221g sheets on interview day 16 December 2011

due to long court case of my daughter's guardianship i had submitted documents of 221g sheets on 13 December 2012 but i was not even succeed to submit guardianship document court took long time to finish the case  but i had submitted one request letter to extend the time but embassy din't replied. after that i tried  and sent the guardianship document  in March 2013 through speed post to embassy directly but after many e-mails till today embassy had not informed me whether they have got those documents.the embassy asked me to submit the custody document  but my daughter stays with me and no one is claiming her custody so as per law court awarded me guardianship. Do you think this is the reason of refusal cos i had failed to submit the document with in one year?

Two  officials came at our area to  and asked questions from our neighbors but one neighbor has said something wrong i feel so   do you think this can be the reason of denial.?

And i am an Indian lady and my hubby is American man(not Indian white man) is it the reason?

as i have spent 13 years in Uganda  my thinking is not like Indians i found a genuine person ,loves me and i got married  with an American man. do you think it can be  a reason?

 Many consulates hold the case especially for K1 ( to be sure they are expired )  Expect at least 2 months for it to get back, maybe 5.  Once it is back they will tell you they need to review it and their standard tiimeline is 120 days.  The rejection process is slow.

Mine is cr1 . i have not yet got any official denial letter from embassy  but one e-mail which i got on 23 April  from visa help desk it says that" after your interview and subsequent review of your case you was found  ineligible for visa  so case will send back to NVC"

and after that online status updated on 26 April that case is on Ap. one confusion is  my case is on ap or denied? and  i want to  know the rest  of the process.

Hi, my case similar like you. when i had sent documents to NVC I did not have separate custody order for my daughter it is mentioned in my divorce document that my daughter is living under the care and custody of the the mother(me)and i got divorce as ex-party.And i had sent my divorce decree with judgment sheet to NVC in year 2011 and NVC din't ask for SEPERATE custody order but when i went to attend interview with my daughter the consular asked for separate custody order I told him that its mentioned in my divorce document but all in vain , issued me 221g sheet to submit the court order regarding the custody of my minor daughter
I had filed one court case regarding this document and it took more then one year to get the document from the court. Even after this i have heard that the no objection letter from the biological father that "he has no objection that the child can migrate with mother to U.S.A." is also required to submit in the embassy if not so court permission to take the child to another country is required.This was my experience.

More tips on the interview below??

1. Speak slow, and answer questions in detail. Stick to the question and don?t veer off the subject. Respond clear, and descriptive. Should not be longer than one minute to answer, but be sure to explain yourself. 

2. If you do not know the answer to a question, do not lie. Say, "I don't know the answer to that at this time." or "I don't remember."

3. The answer to many questions will be in the papers that were sent in the petitions. Questions like, "what are your wife's parent's names". They will expect you to know the information given in your petitions. Review everything in your paperwork with your husband before his interview, and do a mock interview to see how the information may be applied.

4. Avoid saying "I think . . .". Women do this a lot. The examiner will expect you to know not be unsure, of your answers. Alwife, avoid adding "umm", "you know" and "ahh" type fillers to your speech.

5. When applicable, don't just state, demonstrate. If the examiner asks a question that can be answered with a document or photograph(s), provide it along with your answer. 

For example, if the examiner asks, "What does your family think of your wife?", give them a picture or two with your answer; "They like her very much. Here is a picture of her with my mother at my home." 

Or, "How many attended your wedding?" Answer, "(give a number, then say) We have wifeme lovely wedding photos of our guests having fun. Here are a few that I can show you." 

6. Give American answers for dates and times. 12/24/07, not 24/12/07.

7. Dress well, but not overdressed.

8. Try to appear calm, well organized, and friendly. Nervousness raises suspicions.

9. Remain focused. If the examiner makes jokes, smile and enjoy, but do not make jokes too.

10. Make proper eye contact when conversing with the examiner, and try to control your own facial expressions assure that your face remains pleasant and cordial.

11. Be audible (means speak up) your examiner doesn't have to ask you to repeat your answers.

12. Organize your papers in a way that will allow you to retrieve them easily and quickly. Examiners appreciate order and someone who doesn't waste their time.

13. When the interview is over, always ask for the results. "What should I now tell my wife about my visa status after our interview?" Before you leave, have them explain any papers they give to you and/or any procedures they will be taking to complete your case. Try to get the examiner's name for future reference, if needed. Write it down. Remember to verify the phone number so they can contact you to pick up the VISA.!@! hurray@@!!!

14. Arrive early to the consulate, but always be prepared to wait for a time past your scheduled interview appointment time. Be careful of thieves around the consulate if you have to carry cash. Bring ID; you cannot enter without it.

Hello,

 

I filled for a IR-1 visa last february. In France, my name is written like this on my french ID and passport :

 

Firstname : my firstname - Last name : my maiden name - Spouse name - my spouse name

 

 

When we filled my I-130 and DS-230, my husband told me that the middle name was like a second firstname is the US so I put  "none" everywhere since I had no second firstname. This is how I filled :

 

Firstname : my firstname - Middle name : none - Last name : my spouse name

 

Other names used : my firstname + my maiden name

 

Now I realize that my maiden name is going to appear absolutely nowhere on my US papers... And that it might be complicated when I'll have to show my diplomas or other papers (like my french driver's licence) that only have my maiden name on them (from when I wasn't married). The names on my US papers and french papers won't match and I don't want to carry my french passport everywhere as a proof.

 

Do you think I can ask the officer to change my name and replace "none" for the middle name by my maiden name, during the interview at the embassy ?

facing same problem their visas got denied cos of the same act INA212a5a  which indicates that their marriage is solely to enter in America. i have got through the same experience and my friend(pure american) married with Indian guy  also got denied under same act and the petition of her husband  sent back to NVC why this all is happening ? any one has the answer what should we do to get positive results?

It has mentioned in  The court document of Guardianship of my daughter (which i got on 3rd march  2013 )that i am married with ---and the address of my husband got married on ------ and on the interview day consular demanded the separate custody order to get visa to U..S.A to join my husband there. and i haD submitted my marriage registration certificate in the court as a proof that we both are  married with the copy of counselor's 221g sheet in which he has demanded custody document  the marriage certificate which we got from temple.is it not enough to prove a genuine marriage?.

How can consular say that our marriage is not valid or invalid petitions?

I must say that the guardianship document i was  failed to submit on time when i submitted 221g asked documents but later i had sent twice to Delhi embassy through registered post and tracking report was "delivered"  but Vfs and embassy never replied my e-mails that they have received it .

It  has mentioned  in my daughter's guardianship court document that my husband is sending me money  through western union regularly to support me and her step daughter  for our needs and the studies of the step daughter.

Is it not enough to Prove that he sends me money cos i am his wife not that he is paying money for buying a bride?

our families will give affidavits for this issue..We don't want the documents which we both will arrange to prove  that we are genuine husband wife to go against us this is also disturbing us.pls advise us.

The  Chase  freedom visa card which i am using ,my husband is the one from whose account it has issued i can use cos i am his wife and all the transactions is clearing from my husband's account.why it is not good to use this card all the payments my husband is paying he has given me authority .is it wrong? and it will impact bad on immigration process? pls advise me.

My husband visited me in January  this year he was with me whole month and now again he is going to come on our third wedding anniversary in September.i has added my name and got credit visa  card on  my name through which i am doing shooing every month   and  he sent me money through western union and i have money transfer receipts and i get money from the bank so all the western union transactions are recorded there and now when my husband will come i am going to add his name in bank account   here and also one fixed deposit together . i will gather more affidavits form my family and some relatives about our marriage..boarding passes and also planning to do some celebration of our third wedding anniversary  and will get pics with relatives. we are genuine husband wife and loves each other  much .and also looking for a good immigration attorney who has office in Texas ans expert in handling returned petitions under this act. pls advise me.

i am (Indian lady)married with White american man .we met  through a matrimonial site and became friends i was separated that time from my ex- husband. after  near about 6 months ) divorce  i got married  and my husband filed for crt1 visa .

in our marriage only my parents and brother sisters were there and no one from my husband's side we both married under Hindu marriage act my husband converted his religion to Hindu and next day of our marriage we registered our marriage and got registration certificate same day after registration of our marriage my husband went back to U.S.A and we went forward with immigration process and near about one year of filling i got interview date in which i got  two 221g  sheets one to submit more document related to ongoing relationship and marriage.. and another to submit custody order regarding my daughter from previous marriage which i din't have that time so i had filed court case and court case took one year three months to finalize the case  so with in the one year time limit to submit the 221 g document ,i had submitted all documents except of my daughter's custody document cos the case was not yet finished that time. after that our cases were on Admin. process and later denied under act 212a5a 9FAM 40.1N--------invalid petitions and returned back to NVC.

I had submitted our marriage registration certificate, some pics of our marriage,affidavits from my parents. call details, money transfer receipts, affidavit from my husband's brother and his step mother regarding our marriage, wedding card from both sides, e-mails, some letters and card. my husband came to meet me after two years  of our marriage he went next day of our marriage (one year passed in immigration process and next year in fighting the custody case for my daughter so every month we both will thinking that as i will get paper from court i will get green light and will join my husband so two years time passed like this when we see that it will take long then my hubby came to meet me and spent one month with me)

this is my story, pls help me to come out of this visa denial we both are very upset cos of this denial its going to be three years of our marriage,some our relatives know about our marriage, we have also published in news paper about it..

pls advise us how we can come out of denial under 212a5a 9FAM40.1N.

what all documents be enough to come out of this denial? is it easy to over come? Any body pls  suggest how to over come this refusal.

Why do Consular refer the work section INA 212(a)5(a) for denying  the cr1(immigrant visa)? and what  is all about section INA212(a)5(a) ? 

Many CR1 visas got denied under section INA212(a)5(a) what  can be the possible reasons?

I have called  passport call center no. and asked about it and this information i got it from their if a person is going to apply for Passport police clearance and if he/she will fill in form that he /she is married then first they have to add spouse name in the passport.

I have a bit of complex situation with my passport and the question is related with the passport  issuance Seva Kendra.

 

My passport  is with my family's surname ,my husband's name is not added in my passport and my petition for Cr1 has been filed with my family's surname not with my husband's surname .

I have to get Passport police clearance from Delhi ,for this i have heard that adding the husband's name in passport is compulsory for females then a person can get P.C.C.?

But my question is ----- I will send my passport for adding of my husband's name in it  and ii will get new passport /new booklet with different no.  will it create any problem? At this extent can i send my passport for endorsement of husband's name in it  I j can add my husband's name  but  can't  change  the surname  because the CR1  petition has submitted with my family's surname

Any one please who had gone through the process give us your steps .

My Cr1 visa petition got Reaffirmed by Uscis and soon the case will reach to Delhi Embassy for Second interview.

first interview  was on  December 2011  so all the documents are expired now,will we get  the list of documents  from NVC which we have to  renew and submit again?

And i had submitted police clearance certificate from another country ( was  living there from year 1997 to 2006) after 2006 i am in India ,never went back to that country till today  i want to know even this certificate of back years i will have to renew and submit again to Delhi embassy?If any one knows please advise me.

Hi all vj friends.  after reaffirmation of our cr1 petition the case has reached to Delhi embassy and i have to fix  second interview date with embassy which i have not yet done.i need some advise.

 I have not updated my passport after marriage  in 2010 it is with an  old address and doesn't have my husband's name in it we have marriage certificate and registration certificate and i have added my husband;s name in voter id card..

Is it beneficial to add spouse name in passport?

If i will not update my passport and will submit the same will it effect the visa process/will deny visa?
