It's okay if you have your email you'll be fine. But on the DS261 choice of agent my cousin did it yesterday they were asking for the Email of the applicant what she did was she put both same email on the petitioner and beneficiary.

DS-261 Question

I got my case number and invoice number yesterday and tonight I was trying to fill out the DS-261 form but every time I try to log in, this message shows "Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please contact the National Visa Center if you believe that you have received this message in error." Do we have to wait a couple of days before I can fill out my DS-261?

How did you get your case and invoice number? Did you get it over the phone? I got mine over the phone I'm still waiting for the paper copy I was told when I try to go online to pay the AOS and do the DS261( Choice of Agent ) It won't be available right away.. I also get that error message they said give them 3-4days before going online.

You can fill it out as far as I know, as long as its already available and accessible at the CEAC site. What paperwork are they talking about?

The Affidavit of support paper works. I called 2nd time the lady that I spoke to said it's fine dunno who to listen to anymore weird answers one is yes and second one no.

Ds261 Online Application

I got my case number over the phone February 2 I checked on their online website CEAC.state.gov last week but it's not letting me access my file buy today I wad surprised it let me go to my file and they already had my input in their system. I called NVC if I should start filling out my Ds261 since it's ready but I haven't received the paper work they said not to because it may cause serious delay. Is that true?

If you sent the original to USCIS, huge error; USCIS on,y requires photocopies. You are either going to have to jump through hoops to get the original back or have a new one issued.

I called them today they told me to file G884 form. I guess that's a good news for me I just hope I get it back.

WHY would you send the only naturalization certificate you have? Color copy is enough, or even copy of your US passport.

I have colored copies but I thought they need original I sent it anyway... My mom did the same when she filed for my dad I thought it was okay. I called them Nvc adviced me to email them and request to have it back.

From your timeline, it looks like you've just gone to NVC. I think you get your originals back at the interview. They still need them at NVC stage.

Police Clearance(NBI)

I asked my husband to send me his NBI last April 2013 when I filed for his I-130 . I am in the NVC process did my AOS and hoping not to get RFE I was getting ready for DS260 I know i have ti submit the NBI with that if I send that NBI and it will expire April 2014 will that be a problem with NVC? Let's say I am able to send my Ds260 by the end of February?

since it's already 2013 tax filing should I give them my Annual income year 2013? I won't be filing my 2013 tax not until March.

W2 & 1040 taxes

I scanned and copied my most current W2 and 1040 forms as part of my I864 evidence and then my last two tax transcripts (2012 and 2011). I haven't heard anything back...and hopefully I don't until it's case complete!

Whichever of the two between sister and aunt is the higher wage earner would also complete an I-864 as a joint sponsor.

What if she didn't file taxes? her mom and dad claimed her? does she still need to fill out i864?

NO. This question has already been answered. For some, the "total income" from a tax return transcript and the number on line 22 of the 1040 will actually be the same as the number on the W2. However, the number they are looking for is "total income", so line 22 of the 1040 or "total income" from the transcript is the right answer. REALLY.

For example, your W2 COULD say you earned enough to qualify but you took a big loss on your side business, stock loss, sale of property or depreciation that reduced the "total income" to a number that would NOT qualify. Give them the total income number or simply never move forward an inch in your immigration process.

No they are not the same.

Use the number on the tax return that was filled, not the w-2 form that an employer provides.

You need to report the 1040 income on that item:

if you filed a 1040 (or 1040A), then use total income, and if you filed a 1040EZ, then use adjusted gross income.

I just receive a checklist from Nvc it says

__________ income indicated on the I-864EZ Part 19 does not correspond to that shown on the most recent tax return and W-2(s).

I just copied what's on my W2?? am I doing something wrong?? does it have to be what's on my 1040? I gave my w2's for 2010,2011 & 2012.

They advised me that since my case is complete I have to send a new copy of filled out I864EZ to my husband for his interview. Has anyone have this issue before?

CEAC Status Updated Date Changed

I noticed on my children's case, the date changed when they shipped the package. Their interview was May 5th too, my daughter's date stayed 5/5/2014, got her visa delivered by May 8th. My son's changed to May 6, his visa is out for delivery today (PI time) May 9th.

What does it mean when the CEAC website status date changed?
My husband had his interview May 5, 2014 @ USEM and he was Approved...
I checked the Ceac website and the status updated date changed
from MAY 6, 2014 to MAY 8, 2014? Does that mean they are working on his Visa? We wanted to get his plane ticket but were still waiting for his Visa to arrive.

I called customer service yesterday and talked to a Tier 2 officer. She said there was no activity on my case. She opened an inquiry which she said was similar to e-request; and i got approved today.

Not if you, the petitioner, are not residing in the USA, because the visa is for family re-unification and if you don;t establish domicile in the USA nbefore or at the same time she is entering, the visa will not be allowed. The other problem with that plan is that once she uses the visa, she gets a greencard and that is a legal permanent resident card, ie she is supposed to live inside the USA for most of any given year.

You can file now and then stall at NVC stage by taking your time sending back documents etc, or by requesting a later interview date. Once you have an approx date when you will return, get the medical and interview done and she will have 6 months to use the visa once issued. The problem is there is an unknown- people from your part of the world often get AP (additional security checks after interview), which can last for anything from a few weeks to months or, arely, more than a year.

Hello Everyone!

I am not sure if it is the right forum to post, but I am posting here anyways. Even though I just opened an account, I have visited this site a few times.

I am planning to get married in May and then come back to the U.S. and file for IR-1/CR-1. However, I may leave for a job assignment out of the country. I am not sure about the exact during of the job. It could be anything from a year to two.

If the petition is approved here in the U.S. and forwarded to the embassy, what happens if I am already out of the country? Will the embassy reject the case? I would like to get everything done so that she can come back with me to the U.S. if my contract unexpectedly gets terminated due to any reasons such as change in economy, etc. Please help!
