Hello Michey
You have a lot going on, and you've gotten some good advice. I'll try to give you something you can work with.
 
1. Filing status. Hypnos is correct in explaining that your status is determined as of the last day of the year. If you were married on Dec. 31st, then your filing status can only be Married Filing Jointly, or Married Filing Separately. It is possible to amend your return by filing form 1040X (and CA has the state version, 540X). But you have three years from the date the return was due to amend, so don't rush it right now.
 
2. To file a tax return with your husband, he needs a tax identification number. If he is eligible for a social security number, he has to apply by filing form SS-5 at your local social security office. If he does not have his visa yet, then he is ineligible and needs an ITIN. The IRS certifies certain tax professionals as "ITIN Acceptance Agents." Find one locally and they will take care of it. Don't try to do it yourself. 
 
3. There has been a discussion of how to report foreign income but I do not know if this is an issue for you so I will leave it alone. There is not enough info in this discussion to advise you properly. Just understand that the rules regarding foreign earned income apply to US citizens and Resident Aliens. If your husband is a nonresident alien, you can choose to have him considered a resident alien for tax purposes by attaching a declaration to your tax return. Again, this is an involved procedure and you should seek advice from a local tax professional. 
 
Remember that once your husband becomes eligible for a social security number, he can no longer use the ITIN. 
 
Obviously, everything will be much easier for you if you wait until your husband is physically present in the U.S. If there is no pressing reason for you to file by April 15th, you can get 6 month extensions from both the IRS and the FTB. The IRS will want you to file a request for extension, form 4868. The FTB grants the extension automatically. Be aware that if you owe taxes, interest begins to accrue as of April 15th. The extension is for filing, not paying.

Will that be a problem with nvc? for year 2012 taxes I filed single? I am in the NVC stage and I know that I will be sending them a copy of my recent tax return.. for my 2013 taxes I'll file an extension until my husband comes here.

You do not NEED your spouse to amend your taxes.   I don't know how you amend them, I've never filed taxes in the USA.   To file MFS you simply put NRA (non-resident alien) in the SSN spot and mail the taxes vs sending them electronically.  
 
My husband applied for an extension last year because he didn't want to send them out by mail

Call the IRS and ask them how to amend your taxes, or google it. 


Will that be a problem though? cause that's what my tax preparer adviced me to do it late until my husband gets here ... but I still have to send a copy of my tax to NVC if I do the affidavit of support I will send the 2012 paper work which says I 'm single?

You are considered married for tax-filing purposes if you were married on the final day of the year, 31st December. If, on that day, you were married, then you must file either as married filing jointly or married filing separately for that tax year.

So the issue typically is you can not file Married Filing Jointly without your spouse SSN and until he gets here he likely does not have one.
 
You are able to get an ITIN. I would recommend you ask someone with Phillipines specific experience the best way to do that in the Phillipines. The ITIN is issued by the IRS but getting the necessary notarization varies country to country.
 
You should ask your tax preparer if you can file Married Filing Seperate without your spouse SSN, I have hear different answers to that.
 
And finally when you finally get the SSN you should amend your tax return for 2012 and 2013 to married filing jointly and you should get additional money back.

Has anyone have this issue before?? I am trying to file my tax this year I talked to my tax preparer cause I've always filed single before and now that I am married and my husband papers is still in the NVC process My tax preparer told me that I have to wait for my husband to get her before I can file my taxes or else I will end up

Dear All,
as my wife income can not match the poverty guidelines, so I had asked my uncle to file another form I 864 to support me for my wife low income.
NVC revised the forms and asked me to refill both forms and I am now confused how to fill the forms again.
anyone can suggest or help me to fill these TWO I864 forms for both my wife (as the petitioner )and my uncle (is he the joint sponsor or one of 2 sponsors??)
 
 although I read the instructions but I am stacked with this form for more than 2 weeks now
your help is really needed and I appreciate  your support in order to fill the 2 forms I864.

If you have both case& Invoice# you can go ahead pay AOS and this will take couple days to generate and it will appear very soon as PAID while doin that gather all requirements as needeed as soon it ready to sent out..NVC will email anyway for the next step..

I would just write the case number at the top right of each page.  Doesn't matter whether pen or pencil.  Frankly, it is unlikely to matter whether you do it or not.


So it 's case number with the words I-864 form

did you get your case number by phone when you called the nvc or by email or by post mail?


Over the phone but they still have to enter my unformation on their system so right now I am preparing my paperwork for then Affidavit of Support.

1 for the person immigrating.. 1 for you and zero for the rest... don't count your immigrating spouse twice.  



So on part 3 line 7 I put 1 Part 5 #1 I also put 1 Myself 1 and married should I put 0?

you're counting your wife twice, it says do not count any person twice, since you are petitioning your wife and she is the beneficiary you count her once, don't put anything in spouse, since she has already been counted once, that if  you are filing for anyone else than spouse or children

It's okay if you have your email you'll be fine. But on the DS261 choice of agent my cousin did it yesterday they were asking for the Email of the applicant what she did was she put both same email on the petitioner and beneficiary.
