My fiance called for the 4th time, and he started to feel bad about it. February filers were getting approval. Why can't we? :(

If she was deported, which it sounds like she was, you will need the I-212.

THE STRANGE THING IS PERSONALLY CALLED USCIS AND NVC AND THEY TOLD ME I DO NOT NEED A WAIVER I ONLY HAVE TO SHOW UP TO THE INTERVIEW AND ONE OF THE LAWYERS I TALKED WITH YESTURDAY SAID IF THERE WAS TO BE A PROBLEM WITH YOUR PETITION YOU WOULD HAVE KNOWN BY NOW THEY WILL NOT WASTE THEIR TIME AND SEND YOU A INTERVIEW KNOWING SHE ENTERED ILLEGALLY SO I DONT KNOW WAT TOO DO

I dunno.  If she went up before any immigrant court for anything - even if for 2 minutes,
then that's 'another level' of stuff .

Caught inside the USA took photos and fingerprints and deported back.but like I told u ive talked to alot of lawyers and theyve said that she dosent need a waiver because she has never been in the USA for 180 days ...

Maybe I misunderstood?

Ok my wife has a interview in Juarez MX. She is mexican citizen, i am a US Citizen ... before I started the application I-130 I forgot to put she was caught by immigration she was trying to cross the border, in 2010.I filed the application in 2011 I was approved by USCIS they RFE about our marriage I sent pictures, receipts of hotels I stayed at in MX, proof of how we communicate all phone recipts I sent all my bus tickets from Chicago to Queretaro,MX that ive went lots of times to MX and stayed for months... and the approved it after that in OCT of 2012 we had a baby I went again to mexico to register my baby and everything was successful the baby is mexican and american citizen. But now that my wife has a interview in Juarez july I dont know if she needs a waiver for entering the US the moment she enter she was caught they took fingerprints pictures after that she never tried again we have proof she stayed in Mexico.. please I need your help I am a desperate father wanting to bring my family and not being seperated it hurts looking at your baby by pictures and not being with them ..thank you

Ok my wife had a immigration interview at ciudad juarez july 31 st 2013 the officer told my wife if she had been in the US we she answerd NO then the officer told her that if she ever enterd illegally she answer YES the officer told her she needed a I 212 for Iillegal entry so after the interview we filled 212 and we payed 585 money order and send it to phoenix lockbox and today is september 11 and I havent receive no recipt or nothing I tried calling USCIS they told me to wait 30 days and I havent recive nothing wat should I do

My baby is a USC but a father is not the same as a mother my baby was born sick not Emergancy ill just ill and wat I tried to do is to For my baby to get medical aattention.she is not having her benefits as a US child and for that Sir I need my wife here to take care of her while I work im a Diesel Mechanic I have two households I have to pay gas and light and water bill I have to send for $$ for my baby medication for her therapies I and thats y I want to expedite my wwifes waiver ..

If I were you, Id get the baby all the documents he/she needs to come to the US.  I don't even know if a newborn needs a passport. Get the US citizens stuff in order, so if they approve the expedite, you can leave right  away.

I would take the information up there. You can always make a simple cover letter i.e. see attached evidence as to my request for an expedite., however, i have heard of people taking the information up to the local office in an orgainzed manner so the officer(s) know what they are looking at and usually they can assist with getting the expedite in the system or letting you know what and where to send the evidence to. If you have a doctor letter from Mexico, get it translated also.

August 1 paid waiver I212 of 585 and written hardship no evidence sent to Arizona lockbox and Arizona send to Border Patrol in Chicago and then sent to Nebraska

Wow that's a new one. A letter from the senators office.  6 months is a long time even though your In the TSC. I would call the senators office and see what that was all about. Didn't think the
senator would be involved in something like this but maybe im wrong. Like I said I would call.




The letter also said that its "a self explanatory"
The senator is already involved 2 months ago. And that letter was our latest update on the case.

Thank you so much! I see hope from what you've said. 2 weeks of another wait won't be bad at all since we survived waiting for more than 6 months already. And for another 6months for the "hit" I prayed it won't be that bad. I am still glad I heard new updates than waiting for nothing. :)

Those are harsh words for someoneo is just wanting to bring you back to reality. By now, given all the cases you've seen on here, you should be able to understand that what the immigration officer told you was wrong. Does it happen to some people? Yes. Is it the vast majority of cases? No. And if there is one thing every member on here will tell you is that it is not wise to make any plans without the visa in hand. There are simply too many variables in the process.
 
Besides, it seems like every week there is a thread from someone who is sooooo upset at TSC taking foreeeeeeever and they are soooooo in looooove and can't beeeeeear to be apart. Newsflash - we're all in love and hurting because we're apart. Some of us have been doing the LDR thing much longer than you. As Avery Cates said, people set unrealistic expectations and then take it personally when those expectations don't come true.
 
So, chill. Really. You can get approved next week, or you can receive and RFE at the 5 months period, which will keep you waiting a few more weeks for the NOA2. Anything can happen. Use the waiting time to deepen your relationship with your fiance, to get acquainted with the process post-NOA2, to start researching AOS. It's why we call it the Visa Journey, remember? Don't just focus on the destination, but enjoy the journey to get there.

Totally agree with you. It may sad to know it, but that's a fact. Not getting what we expected for, will only make us more stress. Make your relationship work, approval will come any sooner.

Going pass 6 months... called today and was inform to keep checking online updates. They have been giving me time frames each time expect this last time.

 
Their time frame...
Two weeks I should get an update plus ten days to mail, so if I haven't heard anything after 3 weeks please call back. 
 
So I am still having trouble getting pass stage 1.
