I can help with this because i requested an expedite for my wife at the NVC and it was approved.

You can go ahead and fill out the DS-260 when it becomes available at the CEAC website. You

will submit the DS-260 online but also make a copy of your DS-260 and carry it with you to your

interview along with a filled out copy of the DS-230 just in case you need it.

please help me, who among you here got approve there expedite in nvc? i was so confused if i will fill up the ds260 because my papers got approved in nvc and it says that i will send all the papers in embassy manila.. do i have to fill up the form ds260? or i will bring a ds230 to my interview? my interview is on january 6 already.. please help me!!

In April 2013 we visited my hometown, San Diego, and were legally married in the U.S. She was there with me on the 90 day visa waiver program. After that we returned to our home in Japan and registered the U.S. marriage certificate there as well.

 

Anyway, now we actually want to move to San Diego and I'm looking to hire a lawyer to help us through the visa applicaiton process. I know that it's something that we could do on our own, but because of the nature of the bureaucracy involved, I'd rather just pay someone who has a lot of experience doing it than risk making some mistake that could potentially get us hung up.

 

I was wondering if anyone on the forum had had any positive experiences with a trustworthy immigration lawyer or firm that helped them. Any advice or suggestions would really help! Thank you!

I advise you to write the uscis and ask for the old petition to be withdrawn because if you dont

it may cause problems for you during the interview process because it's still showing up in there

system.

I just emailed the visa unit in Moscow, and they sent me this back:

your old petition has to be canceled by your ex fiancé before any other petitions can be approved.

I filed a k-1 back in 2010 but my fiancé backed out and I called the uscis and they gave me an address

and told me to write a letter of cancelation withdrawing my petition so that's what I did. I am now married

to a different Filipina and filed a CR1 petition. I sent her my letter that I received from the uscis saying they

withdrew my previous petition back in 2010 so she could take it wit her to her interview.

Hope you could help us.
Year 2009 i was petitioned by my ex fiance. He abandoned me on 2010 after doing medical and never went for embassy interview, never seen each other since then.
Year 2011 my present fiance filed another k1 and did interview on march 2012. The CO said they need to return those 2 petitions since i have two active petitions.
March 2013, we got email from uscis that my latest petition with my present fiance already expired and may choose to file a new k1. So we filed a new petition (now 2nd petition with my present) last May 2013 and got approval this November and waiting for interview at the embassy on march 2014.

We are praying it will be okay this time.
But i still have questions like:
Does the first petition automatically terminated? I just know it was returned first by the embassy to uscis.
What do u think guys?

I was told right from the start by an immigration lawyer not to

file a K1 because he knew by the source of my income that I

would need a co-sponsor and that the Philippines doesn't accept

a co-sponsor for the K1 because it is an non immigrant visa.

 

He told me to get married and file a spouse visa which is the CR1

That is an immigrant visa which makes them your relative so you

have the right to petition for them. With a CR1 visa since they are

your relative by marriage the Philippines will accept a co-sponsor

for the CR1. That is what I was told by an immigration lawyer so

that's what I did. We are still waiting on approval.

I live in Alabama my wife is in the Philippines and we are 8 months into waiting

for her I-130 to be approved. We have checked once a month on the USCIS

website and it still says under initial review another words our papers are not

moving at all. I wote to my congressman and received a letter saying that they

were in the Atlanta field office and it could take up to a year or sometimes longer.

I read on the USCIS website that you can do an infopass but you have to go to

the office where your papers are. I was wondering if anyone here knows how

to contact the Atlanta field office so I can get directions on how to get there so

I can do an info pass to see whats going on with my wifes papers.

 

Any help will be appreciated

will not accept appointmens made from a computer abroad I know because

the us citizen will have to be the one who makes the appointment online.

I was going to let my wife schedule one for me but it wouldn't let her into

I'm a Jan.22nd filer 2013 and was just approved Nov.4th it took

9.5 months for us to be approved with the USCIS. That's not

counting the NVC. If I were you all I would look for a year before

the whole thing is approved. We are still in waiting mode at the

NVC.

Reading this post had me worried because in Nov.2010  I filed a fiancé petition

but things didn't work out and I called the USCIS to ask how to withdraw the petition.

They told me to write a letter of withdrawal to a certain address so that's what I did

and I received a letter back from the USCIS saying my petition had been withdrawn.

 

In march 2011 I met the love of my life in the Philippines and in Dec.2012 we were married

Jan 2013 I filed a CR1 for my wife and we were approved Nov.4th and now it's on to the NVC.

My wife asked me if I had canceled my old fiancé petition of the other girl and I said yes I had

canceled it. She asked me did I receive a cancellation letter and I couldn't remember but luckily

I found my old NOA1 from my fiancé petition and in the envelope behind the NOA1 was my cancellation

letter. I also went to the USCIS website and put in the receipt number of that NOA1 and it said it had

been withdrawn in Jan. 2011. That was the 1st time I had checked it by the USCIS website since cancelling

it. I will be sending my old NOA1 and the cancelation notice to my wife for her interview just in case they ask

questions about it she has proof that I canceled it.

I have seen a few articles on AP, and they are pretty informative - thanks. HOWEVER, I have yet to find a situation like mine (although I hear it is quite common??). My Fiance and I have been together for almost 3 years. She had a previous relationship about 4 years ago with a guy who she was engaged with and filed a K1 visa petition. They never went beyond filing it and getting an initial approval (NOA1) and no interview or travel to US. They broke up because of his cheating and treatment towards her before the process was completed. Matter of fact they only met once in person. They haven't had contact since - at all. She cannot even remember his middle name, exact age, or where he is now - no contact whatsoever. I know...weird...but it is what it is and it was a while ago.

 

Meanwhile, we have completed the whole process for the K1 (USCIS, NVC, and this morning failed the Embassy Interview). Every form that we filled out, we put all of the correct info. Every spot that asked about previous rela's we put his name and that they filed before together (again, this relationship was almost 4 years ago...2010ish). They denied her this morning and gave her a 221g form for Admin Processing.

 

We have PLENTY of proof for our rela the past 3 yrs (she brought about 15lbs of paperwork with her this morning to the Embassy), and I have visited her multiple times in the Philippines, most recently Jan 2013. I will also be going there in December (few weeks) to visit. We had our plane tickets to the US already on the 14th of Dec, with plans to get married in Vegas already booked for 21 Dec. Not to mention both our families had plans already to be a part of that celebration...wasted now.

 

I don't see why an approved I-129f is valid for only 4 months, yet an incompleted and outdated K1 petition is still valid and causing issues for almost 4 years now?! From what I understand I need to file a request for waiver or something?? I plan on calling the USCIS tonight, as well as DoS. If I'm not satisfied, I will be calling a lawyer but they charge $300 for a phone consultation - so that's my last ditch effort. I will not sit and wait for this Admin thing to take it's course. I want to know what I can do to make this happen. Any help or advice will be GREATLY appreciated!!!

-Severe Financial loss to an individual or company

-Extreme emergent or humanitarian situation

-Military Readiness or other national interest situation

-USCIS error or other compelling interest of uscis

Wow!  I filed my i130's for my Filipina wife and her daughter in July.  Around the 28th.  Got the i130 back for my wife fairly quickly, but they had the wrong birthdate (off by one day that I put wrong on the application).  So I called them and they supposedly corrected it.  Never received any notice that they did actually correct the problem.  THEN I noticed they mispelled my street name (which WAS correct on my application.  So I called back the beginning of August and this time they made me wait on hold almost 45 minutes to speak to a tier 2 officer.  I guess Vermont service center is processing the i130's.  The lady seemed competent.  But when I asked her about if they had correct my my wifes Bday, she said no.  She didn't see it.  Then I noticed another mistake they have made....they used my wifes maiden name as her daughters last name, when in actuality she has her fathers last name on her birth cert and the i130 I filled out for her daughter.  They gave me the MSC# for my wifes daughters i130 and they said they'd be sending it.  I've never gotten it yet.  But I did get a notice saying that the type of service that was requested when I called on 8/15/13 was to correct my street name that they screwed up.  It doesn't reflect that my wifes Bday has been changed to the right date.  And at the bottom, it says, we will notify you "IF" we were able to change the address.  What the heck?  So I still have to wait and see "IF" they can actually change my address street name that they messed up?

 

I looked at the links you posted.  And thanks by the way.  So according to the time frames I see up there, for the Philippines it looks like 212 days from i130 application to NOA2 delivery.  Then another 120 days to the interview?  So thats a total of 11 months?  Really?  Am I figuring that out correctly?

 

I was wondering if there is any way we can have the process expedited at every step of the way.  And is there a process for that?  What are considered valid reasons to expedite?  Could I say financial hardship that I have to basically run two households and support her, her daughter, her mom and sister who also has a daughter.  None of them work.  And it's putting a "decent" burden on my income, but it's doable.  But.....it would sure make things easier if I could get my wife and her daughter here, because I'm just wasting money for them over there when I've got everything they need here.  I had to basically build them a house and get them out of the squatters area.

 

I appreciate any help.  Thank you.

We've been told that our papers is in atlanta office and I've been reading a lot of negative feedbacks about this local office how slow they approve application. Our next course of action is to write his Senator but i guess all they can do is to inquire about the status of the papers coz according to his congressman office you can only request to expedite the process if your husband is in the military. There not much that they can do however theres no harm in trying other options.

For u i saw u r huby wrote a letter to a congressman we also did th n we got a responce frm thm aftr 1 mnths n our petition was in NBC aftr tht routed to Reno field office so hoping tht u r petition is in NBC thn it was transferred to u r local field office

My husband and I are still waiting for our NOA-2 we received our NOA-1 on  01/22/2013, my husband wrote a letter to his congressman last month since his worried that our papers is still under initial review for 6 months. He received a letter from the Congressman Office but all they did is to inquire about the status of our petition and no additional information they just informed him about things that he already knew which our papers is under review. We contacted our immigration lawyer and he informed us that the processing at this time is quiet slow and theres nothing to worry about. Does it really takes this long for a cr1 visa to be approved?

You will need to file an I-864 this the income portion but it will come after you find

out the status of your I-130. When you file the I-864 you will also need to send with

it 3 years of your income tax returns. Mine were 2010,2011,2012 along with your

1099 for each year showing the interest made for that year. You will also need

an employer letter on their letter head stating how long you have been with them

and also what your income is. you will also need to send 4 to 5 check stubs and

a copy of your birth certificate. I may have missed something but what I have told

you I know to be true because I have an immigration lawyer.

of last years files. All I have received is my NOA1 and that's it nothing else I have read

post of 1-130 filers who have just been waiting 4 to 5 months you are just getting started

because its a long wait because I contacted my Congressman and they inquired about it

for me and I got a letter back that said due to the USCIS work load wait time for approval

of an I-130 could take up to a year. So for all of you filers that have been waiting only 4 to 5

months you still have a long wait ahead of you. Im in the start of my 8th month and still no

I am also a U.S. citizen I am waiting for my wives I-130 approval you should have

received a notice of action. NOA1 about a week after you submitted the petition to

the USCIS with a receipt number. The MSC number your talking about is your receipt

number. MSC stands for Missouri Service Center which is now the National Benefit

Center. Your papers will stay there until they are transferred to your local field office

that is where they will make a decision on your petition and you will receive an NOA2

letting you know what the final decision is which is Approval/Denial letter.

 

About knowing when your petition will be approved it all depends on how fast your

local field office works on the petitions they receive. But rule of thumb is 7 to 9 months

for approval but it could take longer depending on the work load of that office.

 

My wife is from the Philippines and I am a January 22 2013 filer our papers

still say under initial review which is still the first step. We are still waiting for

our NOA2 almost 8 months into our process.
