its really disheartening to see people with priority dates and approval dates that are 3 weeks later than yours already have case complete and interview dates! I still have not received any invoices from the nvc and cannot pay any fees yet even though its been 25 days and 20 business days since my case number was first assigned at the nvc. I've called nvc everyday and all they tell me is that there is no reason for alarm and my case is running a normal timeline. Today when i called nvc i asked to talk to a supervisor so i was able to talk to a supervisor named Anna, she was less than helpful and every time i tried to speak she cut me off and kept saying "its on schedule sir", "its on schedule sir" it really pissed me off how rude she was. Has anyone ever had to wait this long to be able to pay their fees and start their case????????//


There has definitely been some kind of strange bottleneck at NVC in the last 3 months or so that is affecting a lot of people entering the NVC phase...though some others, somehow (prolly luck), avoided it. I suspect some kind of internal re-organization is going on there, but have no way of proving that theory since NVC hasn't commented on anything like that.

All I can say is hang in there...and keep calling. I'm sure you'll break thru soon.

It looks like I answered this question wrong on my petition, but we didn't get any RFEs or questions about it during the interview. I stated right up front, in an evolution of relationship letter, that we 'lived together' in a hotel for 2 months while I was in my wife's country for our wedding and answered 'yes' to that question on the I-130. Also, one of my affidavits was from the owner of the hotel, stating that she personally observed the bone-fides of our relationship.

So I'm not really sure if we just got lucky or if that was OK with them. I'm just telling our story here in the hopes it will help.

Timeline mentions package 3 and 4 and I did a search of the forums, but am more confused about whether they even apply to our visa category. Are the consulate specific, visa specific or should everybody get one no matter what consulate they are dealing with? If we are supposed to get these, do they mail them or e-mail them?

Our I-130 was approved today, barely 3.5 months after NOA1. Blazing speed!

My wife has obligations that require her to remain in Malaysia until January or possibly February of 2012. The entrance paperwork will be good for 6 months and we'd like a month or two leeway, so we're hoping to get the magic envelope in October, November, or December of 2011.

If we submit our AOS and DS-230 packets promptly it's possible that things could move too quickly, resulting in an interview before October.

I see two options:

1. Keep going as fast as we can, but request an extension on the validity of the entrance paperwork. Is there a standard way to request this? Is it usually granted? When would we request it?

2. Wait a couple months before continuing the paperwork. Is this safe? Do we need to inform USCIS that we're still proceeding, we just need a couple months time?

Any input is appreciated.


You're fine...I was in the same boat but for different reasons.

You can sit on the I-864 and DS-230 paperwork for up to a year after it arrives at NVC before the NVC would start taking action on a 'dead case'. You can go ahead and pay the fees and send the DS-3032 though. NVC will simply send you a reminder message that they are waiting on your forms.

First, thanks for passing this information along. It certainly helps us. That's pretty much how I think this issue has to play out. You can't provide the NVC with something that cannot be obtained. There are other countries to don't provide any type of clearances either and the NVC has to deal with that somehow in those cases. Bottom line is that there is nothing we can do about it and as long as we provide the documentary proof that such a clearance is NOT available, then that should be sufficient.

A phone operator at the NVC said they no longer send out the letter naming the alien and listing the needed documents. Hong Kong requires this letter along with other documents to send the police clearance. The operator told me that they now do their own check for Hong Kong and we were no longer required to obtain it. I'm here to ask for confirmation of this or not from any recent Imigrants. I'm not sure if the operators always have good info.

If that is true, it is a very recent change that has happened since July, when my wife went thru the process. It would be much easier for you, since NVC or the Embassy would be taking care of it. It was NOT a convenient process to apply for that clearance from HK from the provinces in the Philippines. In fact, I'm not sure how we would have done if my wife didn't have a niece working in HK at the time. I have my doubts as to the accuracy of what you were told, though...the NVC 1st tier operators are notoriously inaccurate.

I was in the same boat 18 months ago. My wife is Filipino and worked in Singapore several years before we got married. I can't tell you how it is now, since we went thru this in May thru July of 2011, but NVC checked the box saying it wasn't obtainable when our NVC package was approved. Since we knew we couldn't get it, we didn't even try and USEM didn't ask for it.

These days, I'm not sure how this is going. I've read a lot of posts about people going to crazy lengths to these clearances, but how do you obtain that which cannot be obtained?

If Singapore is actually giving these out to foreign workers now, they should do the decent thing and say so clearly. Otherwise, the US State Department needs to get real and accept that these are not available.

This is a real hardship and I wish the best to all of you stuck in this limbo.

No, they did not ask for any additional documents, as all our documents were accounted for. Also, they kept her passport. On the letter it roughly stated the following:

" You have been found inelegibal to receive a visa under the followign section of the Immigration & Nationality Act paragraph marked with x." And marked with "x" was section 221(g).


The fact that they kept the passport is a good sign.

221(g) is a fairly routine interview result. They either want something from you or just waiting on something (maybe a background check) to complete. For instance, my wife got one (which we were expecting) because they were waiting on the Hong Kong police to send a police certificate and it hadn't arrived at the time of the interview.

Anyway, you'll know exactly what the situation is when you can clearly read the form.

You're not buying love...that boat sailed when you got hitched.  She's already got you and everything you own, so it's a moot point.  You're supporting your wife...just like any normal husband would do.  I did the same thing for my wife while she was still waiting to get her visa and used that as evidence of financial co-mingling.  I'm rather sure that's expected my USCIS, unless she's somehow financially well off.

Yeah, I agree...maybe 'front loaded' was a bad choice of words. I've read several posts here that had really 'light' packages (6 wedding pics, a couple of affidavits and some phone logs) that made it thru. OTOH, I've seen some that sounded pretty substantial (receipts, chat logs, etc, along with the aforementioned) that caught RFEs. Really hard to tell how much is 'enough'. But I hope scanning in receipts and organizing things on word docs will keep the package slim, trim and organized yet provide 'enough' to avoid any RFEs.

1. i made scans, printed them out via word, each 'thing' was numbered, and cross-referenced in an evolution of relationship letter.

2. no idea if it's acceptable, others have done it without problems, though. I made a photo book, 20 pages (so really 40 pages), was 20 pages of wedding photos, i think, then 20 pages of other photos of us with her family.

Hi Folks,

First, thank God for this site! I don't how people got thru this process before there was something like this.

Ok, I'm a long time lurker who's working on the I-130 package for a CR-1 visa. I've read most of this forum over the past months, but I still have a few quick questions about putting a I-130 package together. I've decided to somewhat 'frontload' the I-130 to show a bona-fide relationship. So these are really more about organizing the package than the contents:

1) How did you handle receipts and boarding passes? Did you just stuff them in a separate envelope labeled receipts or did you scan and import them into a word doc? Not sure how to keep those organized in the package. I'm also unclear if they need originals at this point...though I assume they will during the consular interview.

2) Have tons (literally hundreds) of pics of our meeting, our wedding and our honeymoon. I know I just need 10 or so from each...does anybody know if it's OK to import these into a word doc...I tested and they look very clear. Anyone know if this method is acceptable?

I don't know how anybody else does it...but I'll tell you my story so you have an example about how and why it is done:

I've been single my entire life and have lived a very frugal lifestyle. I had accumulated significant savings when the company I was consulting for (I'm a software engineer) filed for bankruptcy. I had been so busy all my life, moving from city to city while chasing contracts, that I realized that I had to do something about my love life or I was going to die alone.

So, after my last contract vanished in January 2009, I decided to change my priorities and spend all of my time searching for my soul mate. I got very lucky and found the perfect woman for me. I courted her from May 2008 to July 2009, when I met her in her country. I proposed and she accepted. We were married in February 2010.

Now, I never looked for a job after my last contract expired. Since I had saved my money for several years, I could easily afford the 2 trips to see her (I never took unemployment as I never intended to find a job until I was married)...1 to get engaged and the second to marry her (and we had a really nice wedding too, but weddings in her country are about 1/5th the price of comparable weddings in the US).

I always planned to bring her over based on my assets, since I've been an independent consultant for years and have no W-2s or employment letters. My cash assets had just fallen below the 3 X Poverty level last month. Well, I got a gift 2 weeks ago...the company I last contracted for emerged from bankruptcy and asked me to come back as a contractor (very good hourly rate). So now, I will go back above the minimum asset level within a month.

It can be done, under the right circumstances. I think there are a lot of people like me too.

IMO, I would not sweat over the affidavits from friends, etc. They won't carry that much weight. The thinking is: "why would someone send a bad reference?"

If your other evidence is thin, then affidavits may be helpful.



Hi Anh map...I do understand your logic. It's just that affidavits are one of the few things I can provide that the I-130 instructions explicitly ask for. My wife lives in a foreign country...I met her online, saw her in person for 10 days, then spent 58 days, in her country, preparing for and completing our marriage. But we have no house that we've shared...no common bank account, because both of our countries make it practically impossible to do those things until we are together...which won't happen until she is here.

I have sent her wire transfers and money transfers to her bank account...but our accounts are not co-mingled directly and, as I said earlier...unless I immigrate to her country or she immigrates here, there is no chance of a joint bank account.

I guess that is why I'm so focused on the affidavits. We have tons of secondary evidence (photos, phone logs, chats, e-mails, etc, ad-nauseum) and that may be enough...but those things aren't listed explicitly in the I-130 instructions.

USCIS has never asked wedding pics, photos of our gathering etc. and I have never sent them. But, I have seen for others, those are requested. So, it is case by case, based on how the the immigration officer is convinced in one's case.

Everybody's case is unique. We sent only the copies of everything including Affidavits from third parties while submitting I-130. We didn't have any RFE. However, at NVC stage, we provided all the originals (except beneficiary's passport) and got everything back after the Consulate interview. NVC will forward ALL originals to the Consulate. But I don't think USCIS will forward originals to NVC after I-130 approval. In their instructions, it says USCIS may keep the originals in their record, if you send the originals. It will be pain to contact them to collect the originals back. But, I think there is an option to request the originals back if you contact them.

Again, copies are enough. But if you have more than one originals of the same event (eg: marriage), you may send one of them.

Everybody get's a different roll of the dice. I guess I'll sleep on in. I plan to send this package out, come rain or shine, next week. It's all just a roll of the dice though. If you win, then you did it right and if you lose, you did it wrong. That's pretty much how this process feels. Besides the obvious mistakes, there is just no way to know until you get the results.

We included the notarised copies of the affidavits with the English translations (originals we are going to bring to the interview!). For organizing the package we used the plastic folder where we put all our evedence in sections to separated plastic files (like this: Link). The total weight of the package was about 6 lbs! And we made it well through both the USCIS and NVC. :-) The best of wishes!

I'll send them plenty, but my wife still has a lot in reserve for the interview. I really want one of those interviews that last about 5 minutes and consists of small talk, a few basic questions, then "You're Approved". We, anyway, you are very close to the end now! What OBX told is correct. You will need originals in NVC stage. So, if you have multiple originals of the same, it is ok.

Otherwise, IMO I wouldn't recommend to send the originals to the USCIS unless they requested. USCIS may not send back the originals, IMO.

Thanks Loto...I just dread the RFE. It's a heavy price to pay (up to 2 months). What do you think of my idea about sending originals plus a copy of each affidavit? They should "theoretically" submit the entire package to NVC, minus what they need for their own records. I'm just thinking that if I meet their filing requirements by sends a copy along as well, those affidavits might just make it all the way to the consular interview.

Hahahaha, no kidding. It's like dealing with a mutant hybrid of the IRS, the local DMV and The Ministry of Silly Walks. At some point I just have to send this thing in. I've changed so many things on my I-130 back and forth now based on peoples reported experiences (and I thank all of them for it), that I've probably killed a forest reprinting my package with the changes I've made...only to read that somebody had success with doing the exact opposite way I just changed my form to read. It's not our fault...this stuff is vague and often counter intuitive to lay people like us. It's maddening. I'm within a few days of just saying "to hell with it, I'm sending what I have".

I-130 instructions state:

If these instructions state that a copy of a document may be filed with this petition, submit a copy. If you choose to send the original, USCIS may keep that original for our records. If USCIS requires the original, it will be requested.


We did send the originals of our affidavits, however, and never did receive them back. Luckily we did not need them at any other stage in the process.

That bolded part basically sounds like an RFE. If they decide they need the originals, they will send you an RFE to request them. But an RFE is up to an 8 week penalty in processing. More reason to send the originals and keep copies, I think. But, now that I think about it...if I send originals and one copy each, maybe they'll keep the copies for their files and send the originals along. Either way, I've got copies, both alone and as part of the total package copies I'll be making.

Thank you all. Looks like a 50/50 split on whether to send original or copies of affidavits, though the guidelines do seem to indicate that all supporting docs can be copies.

1. Unfortunately I sent my original affidavits, thinking that the notary seal had to be original :angry: , but I believe supporting evidence only have to be copies. See the Guide for CR-1/IR-1 here: CR-1/IR-1 Guide

2. No staples. Use binder clips or ACCO fastners. I also put tabs at the BOTTOM and labeled each section (tabs of course were on blank page separators).

I am sure more experienced members can give you more information.

I'm really liking the binder clip idea. Very simple to do, but they can easily remove them if they want to.

I don't think it is a good idea to staple anything. I would use paper clips trip instead.


I agree. I'm leaning toward binder clips now. Some of these sections in my evidence (phone logs) are too thick to staple anyway.

Second you can staple them no problem and keep the evidence organized and preferably make a notice on each stack of papers Reflecting whats in it,

For example ( Photos of our wedding ), etc, to make it easy for the officer to review your petition.

I really need to chill about putting this package together...however, couple of trivial (or maybe not) questions.

1) Do I have to include original witness affidavits attesting to the relationship or can I send copies? I'm afraid USCIS will lose them or something and then I'll just be left with copies. But if they need the originals, that's what I'll send.

2) How did you experienced folks organizing your I-130 package? I've got several sections of evidence compiled, but it seems I should staple them together in separate sections so it doesn't get all scattered when USCIS starts ruffling through it. Did you I-130 veterans use staples or paper clips to hold related stuff together? Or did you just stack it all up and put it in the big envelope loose?

Sorry, if these seem like dumb questions. I've gone over this stuff 200 times and I still keep thinking of things and finding things to fix. This stuff puts filing taxes to shame.

That's actually what I did with my wife's G-325A. She really had a hard time getting it filled out properly, so I just had her send me signed blanks along with a form she filled it and I filled it out for her, correctly formatted. I hope USCIS doesn't have a problem with that...I just transcribed the information she sent with my own handwriting into the correct format. She made lots of simple mistakes like writing in cursive (when I told her to print) and leaving gaps in dates when she was unemployed...I think I shaved about 4 months off the back and forth mailing by just filling it out for her that way. Hello, I got my Noa today for my I-130 but realized they rejected it cause I did not have street address listed in section c but she does not really have a street address. She lives in an area where the streets merge together. There is street close to the one she lives on but she lives behind it on a side street. Should I just use that? And they sent everything back to me do I need to redo the whole thing or just fix the mistake? Cause I typed it using the online feature here. So I'm not sure I should send back with corrections with pen. I also see there is a number on the side of my documents I have heard the case number is often wrote on the back of the return check. They sent it back as well and I notice there is a number there and it matches the one on my documents would that number still be good if is a case number and if not will I need to send all new papers? Or would sending the old ones speed it up? If anyone can give me info on this I would be greatful cause I want to resend right away if just the address it is quick fix but I'm worried that that was as far as they read then stoped do they look the whole thing over before they send back to me?


Hi TandM. I'm posting this not because I have answers, but because I have the same issue with my wife's home address. She lives way, way out in the rural countryside and there is no street address at all. They don't have a mailbox so they have to go into town about 30 miles away to pick up mail from the post office. Letters I've sent to get to my wife, but the address is just the family name, barangay, city and province.

Now I'm worried.

*laughs* Thanks for that. And I'm sorry, I just realized what photos you were referring to, and what photos I was referring to. I was referring to the photos being submitted as proof of bonafide marriage, not the passport photos in support of the G325A. *blushes* Sorry for being unclear!


I would just write the who/where/when on the back of each picture with a felt tip. I printed my pics (since they were all digital anyway) in a word doc and wrote the description beside each one. Had between 2 or 3 pics to a page. Cut way down on the bulk of the package. I'm submitting my package tomorrow, but I read several threads where people had no problems with that method either.

Quick question for you all:

Was going over the G325A form and noticed this little question at the bottom of the form: This form is being submitted for a.)naturalization, b.) status as permanent resident, or c.)other (specify). I know it's C, but just what should I put? IR1/CR1 visa? Immigration?

I was going to ask another dumb question, but can't remember what it was. Will edit with it if I think of it. :P Hah, I thought of it. Or if not specifically it, at least another question: For those of you who submitted pictures, did you write on the back of the photos of date and what it was, or type it up and tape it to the back, or what? Did you send them in protective sheets or loose?

OH! I remembered my original second stupid question: What are ACCO fasteners? :P

Hah, some questions I actually know the answer to.

1) Consensus is C and next to other write I-130 (assuming this it is an I-130 that is being filed).
2) You are just supposed to write the name of the person with a black felt tip pen (or similar). I put mine in small ziplock sandwich bags and clipped to the form with a paper clip.
3) Let me google that for you. :rofl: Sorry, always wanted to use that.
