IR-1 / CR-1 Spouse Visa Process & ProceduresSponsor

My mother is the sponsor for our petition since I have been in school for the past 3 years. My father and mother file jointly with their tax returns. My problem is that on the I-864, it is telling to list the adjusted gross income as found on their 1044....however, this amount reflects dad's income as well.  On mom's w2- she made about $56,000 before taxes.  This amount was added to dad's to arrive at the adjusted gross income for the two.  What should I do? Should I put dad down as an I-864A person or should I just put mom's income before taxes on the line for the adjusted gross income?  Also, will Immigration people correct any mistakes we make? or will they make us do it over?

Thanks in advance....

IR-1 / CR-1 Spouse Visa Process & ProceduresClarification on Sponsorship

A. I don't have a birth certificate for my grandfather who is willing to sign a I-864A so that I can list his income.  Will not having this bar him from being allowed? I did not read anywhere where this was necessary on the forms for an I864a.

B. My mother will joint sponsor.  There is a check box that asks if she is the only joint sponsor.  Would my grandfather who signed an I-864A be considered a joint sponsor? Or would my mom still be the only joint sponsor if he was accepted?

Also, I plan on sending the paper work for whichever scenario they want to classify us as.  Meaning, I will submit paperwork for my grandfather with an I-864a w/out birth certificate and then tell them that if that is not sufficient, then use mom as the joint sponsor.

And, I am confused about when the joint sponsor paperwork is asked for.  If I send it in with my I864 at the same time, knowing I will need a joint sponsor, will they process it then? Or, I have read where they ask for this documents from my wife in the Philippines to bring to the interview?  If that is the case, then there would be no sense in sending in the I-864 of my mothers at this time.

K-1 Fiance(e) Visa Process & ProceduresVisitation Requirment
Hello,

I'm wondering if anyone can answer the following---I am in the process of getting a divorce. It is a matter of waiting for the paperwork to go through and this could be a few more months in the future. It has been over a year since my ex-wife and I separated. I know that it is required of me to visit my fiance at least 1x before the K1 will be accepted. I know that I can't file the K1 until I am legally allowed to marry, but can I fulfill the visitation requirement while waiting for the divorce to finalize?

To show---

I visit fiancee January 2-Feb. 1 2013
My divorce becomes final March 1- 2013

I submit paperwork March 2, 2013 using pictures from Jan-Feb. 2013 as proof...

Would this be acceptable?

Any help is greatly appreciated...

K-1 Fiance(e) Visa Process & ProceduresDenied Visa
Please help me understand this...I just graduated from grad school and I will be able to find work easily. The problem is that I have not had an income since starting grad school. I have read that using a co-sponsor (I-864A) in Phils is very hit or miss. A few people state that co-sponsors will never be accepted in Manila. I realize that it is up to the individual processing the form as to whether acceptance is granted (as well as who is in charge of the Embassy who may dictate policy to subordinates).

The people-
Me- US citizen-recent graduate w/ teaching degree in special education (very high demand in USA, expect a job no later than end of Feb.) Have grandfather (82) who earns 7x the 125% requirement, whom I live with and who would sign an I-864A
Her- Phil citizen w/ medical technologist degree who has worked throughout Arabia most of her working career, currently she studying to take the exam for Med. Technologists license accepted in USA as well as TOEFL. She speaks English really well.

So my questions begin...

Let's say I get a job tomorrow, but my tax statement for 2012 shows 0 income, is there anyway to get a document from IRS showing my income that is not a yearly tax return? Are there other ways like pay stubs etc, that could be accepted in Manila?

What if I apply now, can I append the application as more information comes to me? Since it takes almost a year for things to get processed, this seems like a possible way of filing with an I-864A? Meaning I submit pay stubs once I met the 125% requirement and this is appended to the original application.

Should we just wait this entire year (which saddens me) and then apply once I have a W-2 showing adequate income?

thanks in advance...Dave

IR-1 / CR-1 Spouse Visa Process & ProceduresIs there nothing we can do?

We filed on May 13, 2013 and were transferred in Dec. to Nebraska as well.  Of course we received the same 60 day letter and the 60 days will be up on February 20th.  I have not been holding my breath that we will hear anything prior to then and had speculated that if/when we need to call after the 60 days that we would get a response as you have indicated....basically tough luck, ya we lied, we can say whatever we want and you still are going to have to wait!!!!!

So frustrating!  I am prepared and my husband is prepared to call his Congress woman and Senator on day 61!  Patience is being asked for far too long!

Good luck to all of us May filers dancin5hr.gif

Fingers crossed. Pls Keep in touch with me so we see what happen next.

My Patience is gone and im really nervous now.

Good luck for us . we Need it dancin5hr.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresIs there nothing we can do?

Hi,

we started our visa on May the 3rd.

In december we got transfered to Nebraska and in the letter was written, if we dont hear in 60 Days something we should call.

So we called, and the answer was after 1,5h waiting, they are sorry but Nebraska is behind. 2 Months.

Other People that filed at the same time. have the NOA2 we still have nothing.

WE should wait till the end of March.

Is there anything we can do? I mean end of march is not so far away, but then we wait 11 Months, for the NOA2.

Thanks for your help.

Fritzi

IR-1 / CR-1 Spouse Visa Process & ProceduresK4 - is parental consent required?

Wow, thank you for your quick reply. I thought this was the case. If he remains difficult, I suppose I'll have to go to the family courts and try for full custodianship, or somehow persuade him this is for the best!

IR-1 / CR-1 Spouse Visa Process & ProceduresK4 - is parental consent required?

I live in the UK and I've recently married a USC.

I'm applying for a K3/K4 VISA at the moment, and the father of my child, with whom I have shared parental responsibility for a long time, through mutual agreement not a court judgement, thinks he can prevent this because he will not provide consent.

Is his consent required for my daughters K4?

Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresVaccinations Waiver

Well, some vaccinations contain the cells of diseased animals, including including cows, monkeys and pigs.

The rubella vaccine virus is cultured in human cell-line cultures, and some of these cell lines originate from aborted babies.

I really don't want to get into the pro/anti vaccination argument, I accept there are many who think a position which rejects immunisations on any grounds is wrong from a general population control perspective. I'm after immigration advice here, not a discussion on my religious interpretations and choices.

IR-1 / CR-1 Spouse Visa Process & ProceduresVaccinations Waiver

Thanks for your quick reply!

Do you think this ultimately leaves me with this choice - delay my emigration while the probably futile I-601 process goes ahead, or accept the course of vaccinations against my religious beliefs?

If my visa application is deemed ineligible on medical grounds, will I be left unable to visit my husband in the US, or will I be able to enter, on my UK passport, as a visitor?

I'd been hoping for my child to join me there next summer and start school in the USA!

IR-1 / CR-1 Spouse Visa Process & ProceduresVaccinations Waiver

I recently married a USC and am applying for my visa.

I converted to Hinduism a few years back and am opposed to receiving the expected course of vaccinations on religious grounds.

Does anyone have experience of the waiver process? I believe that I have to refuse the vaccinations at the medical interview and then apply for a waiver of ineligibilities on religious grounds (Form I-601)

I'd like to know

  • if, after the medical interview, which I suppose I won't 'pass', and thus won't get my K3, this will prevent me and my child travelling to see my husband at all!
  • roughly how long the I-601 may take to be processed.
  • if anyone knows of success stories with the I-601 process on this issue

Thanks

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsJuly 2013 Interviews

Hey I'm a new user but reading up on VJ for a while now.

I called on May 22nd and heard my case was complete, followed by a checklist which also stated my case was ready to be scheduled, on may 29th I received another email saying that my case was complete.

Now I was expecting to get scheduled somewhere this week, but still nothing, while others around the 22nd received a date already...

The interview should be scheduled in Belgium. I saw in the member list some belgians where the interview was scheduled within the week...

Am I missing something here? Is there really no logic behind this?

I'm hoping to receive an email soon (is this still working?)...

Thanks,

Mike

It seems like uscis is sporadic in approving noa. This past week theres approvals from December, March, January. It really depends on the local office and the persons desk its sitting on unfortunately. Im an April 1 NOA1 and Im sure this doesnt mean I will get a noa2 in 2 weeks. If it arrives in September I will be satisfied. If it actually arrives in July I would be happy. Good luck to all

I have a question about my wife the beneficiary. We will need to submit a photocopy of her passport demographic page to NVC. We are in the process of changing her passport to a new one with her married name.
Does NVC require the new married name passport? Or is her old passport sufficient for the NVC?
We are beginning to gather all the docs to send to me for the NVC process.

Thanks

I need to ask about the documents required for NVC. We have been getting some different answers if we need to submit xerox/photocopies of documents like marriage cert, birth cert, etc? Or we need to send all originals to NVC for the IV docs?

Which one is it?
