K-1 Fiance(e) Visa Case Filing and Progress ReportsAny February 2012 filers?

Well fellow Feb filers finally after 7 months one day we got approved. Its hard to believe its here. Thanks to all who pulled for us. Now the next hurdle, Warsaw Embassy changed the rules and someone must go to Poland and pay in cash at a Polish bank the visa fee to get a interview date. Tanya is trying to find someone who goes Belarus-Poland often that will help with this. If not she has to get a visa to enter Poland which takes about 3 weeks then a 12 hour train ride over night and 12 hours back. Then a new visa to reenter Poland for the interview. Its a lot of expense for something other counties can pay online. Our American Government at its best

Ron, I am so happy for you and Tanya. Just remember and tell her often, the hardest part is now behind you both.........Gary

K-1 Fiance(e) Visa Case Filing and Progress ReportsAny February 2012 filers?

Well, a new day a different story. I reached the 200 club 5 days ago and still no word from Vermont. I called last Thursday and was told they were working on 6 Feb (my date 27 Feb) and I should call back when they are past working on my date. "you are still in your timeline". So I called back Friday and they told me they were working on 27 Feb and to call back on Monday. I thought I would give them an extra day and called this morning. I was told they were working on 27 Feb and should call back later in the week. I demanded to speak to 2 level supervisor, the lady said it could be a couple of hours wait. I told her no problem I am retired and can and will wait. A recording came on and said I should be waited on in 2-3 minutes. Guess what I was! A nice guy agreed with me it was out of time limits and he would file a service request and I would hear back within 10 days. He took all my info and email address. So hopefully he was serious and something will happen. I have seen nor heard of any movement on us Feb filers in the last week. I hope other people are getting approved. Good luck to all Ron

Sorry to hear that Ron. It really seems they are working on March petitions and just don't want to answer why so many Febuary petitions have not been "touched". I really feel bad for everyone waiting this long to hear something and already telling myself and Tamara it may take 7 months or longer for us too. Oh well, what doesn't kill us.....lol. Give me a call when you hear something.

K-1 Fiance(e) Visa Process & ProceduresI-129F questions

You have a couple of options Gary, but both depend on your fiancé having a computer. The easiest is to have your fiancé email you her information in Cyrillic and copy/paste then print it out. The other is to let her fill it out, scan it and email it to you.

I hope this helps!!

Actually I already have her information in Cyrillic but never considered copy and paste haha. She is going to have to send me her passport type pictures, g325 and letter of intent with signature so maybe I could just let her download it, print it then send it via mail.....thank you very much......gary

K-1 Fiance(e) Visa Process & ProceduresI-129F questions

I do not know the answer to your first question.

For the G-325A, just one each for you and your fiancee. Make sure they have original signatures and are not copies. The same with the letters of intent.

They are all sent to the Dallas Lockbox address listed in the I-129F form instructions.

Thank you..I was pretty sure of the answers but wanted to make sure. I will read on and hope to get help with the first answer and maybe ask in the Russian regional section.

K-1 Fiance(e) Visa Process & ProceduresI-129F questions
I have a few questions about the filing of the initial petiton. I have read the guide lines several times and still cant seem to find an answer. One question is in regard to Question 16.."If your fiancees native alphabet uses other than Roman letters, write his or her name and address abroad in the native alphabet." If I don't know the Russian alphabet and can't write in cyrillic what are my options?

The second question is about the G-325. Do I just need mine and hers to send or 4 copies each?

Lastly..Do all initial petitions for I-129F get sent to Dallas or does where I live determine this? It seems I have read both a few times but maybe I am confusing different parts of the process. Any help would be greatly appreciated....gary

My fiance was born in Belarus which at the time of her birth was not a country. It was the USSR. Would she still list Belarus as her country of birth or the former USSR? This is in regards to G-325A question about place of birth. Thanks in advance.

K-1 Fiance(e) Visa Process & Proceduresblue or black ink?

Does this final judgement of dissolution have the state or county raised seal on it? If not, I don't believe what you have is the actual "divorce decree", that is required, it may just be the final ruling of the court. I have the final ruling of the court that sounds like what you described, but I also have the divorce decree issued by the state with the raised seal on it, that's what USCIS will want to see.

NO raised seal, just the judges' signature stamp with the date. I was told that this "final ruling" was all that I would recieve. Guess I better call the county clerks office. edited....I was just told that in my county what I recieved at the courthouse the day of my divorce was all I would get but I could purchase another with the jugges' actual signature. Guess I will go do that just in case to avoid a RFE

Thanks a lot for the explanation. I have a week or so before I get her documents in the mail so I do have time to redo a few things just to be safe. I will also call the county court house Monday and see if there is much hassle getting the judges signature.

K-1 Fiance(e) Visa Process & Proceduresblue or black ink?

I am getting ready to send in my I-129F but have a few questions. According to the USCIS site it states to use black ink or type but doesn't really specify which color to use for signatures. I have done mine in black but after reading the RFE thread I am now thinking about redoing them and signing in blue ink. Any suggestions?

One other issue. I have my original divorce final judgement of dissolution of marriage but it was stamped with the judges name and date. Will I get a RFE if I send that or should I just try to get another with an actual signature. Thanks in advance....Gary

K-1 Fiance(e) Visa Process & ProceduresK-1 Acceptance Letter Delay

Yes... you will receive a hardcopy which is the NOA1.

You can check the Case Status when you have your number. Don't be surprised if the status doesn't change from Initial Review as this often happens and cases have gone right through to completion and the status is never updated. Its good to keep an eye on what is going on with other cases with similar dates on VJ so you have an idea of where you stand.

There seem to be a lot of delays at initial stages of this process recently, but now you're on your way. Best of luck !

Thanks!!

K-1 Fiance(e) Visa Process & ProceduresI-129 question..how to find info about ex-wifes info

Does anyone know how to obtain a previous spouse's A# and exact info on previous immigration status.. The I-129 is asking for her A#.. Unfortunately for me, my ex is unwilling to give it to me.. We have been divorced now for 10 years, she is a citizen, and I know my obligation of support is over, I have our divorce papers...If i cant find this info, will they deny my application.. Anyone with experience or knowledge please respond.. Thanks

I'm pretty sure they care more about you than her. Just put N/A and make sure you can prove that you are legally divorced and able to get married.

K-1 Fiance(e) Visa Process & Proceduresmailing or street address for fiance?

I am starting the K1 process and my fiance has a street address where she actually lives (but there is no mail service there), and then another address where she actually receives her mail at.

Thoughts on which to put or how to handle this on the I-134 for her serction, and when she fills out the G-325a? Will they actually be using the addresses listed there to mail her stuff eventually or are they just for her background check? Thanks in advance for any insight on this.

I would put her actual address on the form and add an attachment with her mailing address and explain the difference.

K-1 Fiance(e) Visa Process & Proceduresonly 3 items can't be done electronically for I-129 right?

First off I about paid to have a visa service help me until I found this site (and read numerous stories of how bad many of them were). I am now starting the K1 process with my fiance so this is the second of what will most likely be many noob questions on this process. Right now it looks like I can do almost everything on my end (or do with her electonically on the internet) to get the initial I-129F package filed, except for 3 things.

Looking at the excellent guide here: http://www.visajourn...content/k1guide , it appears there are 3 items where I either physically need her signature or an item from her (passport picture). Since anything going through her country's snail mail takes awhile I wanted to start gathering these items now:

5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1.
9. G-325A filled out by the foreign fiance(e) signed and dated (see example).
10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

Does this sound right that these are the only physical things I will need mailed from her for the initial I-129F filing? A signature for 5 and 10, and a passport photo for 9 (and optionally any supporting docs she wants to send)? She was never married or divorced nor has she changed her name, so I dont need those items from her. Thanks in advance.

That should be all. I actually downloaded the g325a and filled it out with her info then emailed her the form. All she had to do was print and sign. Same with the letter of intent. The only real thing she needs to do is get the passport type pictures and snail mail all 3 items together. Hope that helps.

K-1 Fiance(e) Visa Process & Proceduresanyone ever get RFE'd because of a "scan" instead of a "photocopy"

There's no chance being taken. A scan and print is exactly what a photocopy is. The difference here was the scanner and printer were in different locations. There's no way to tell the difference between a printed scan and a photocopy because there is no difference to tell. A color photocopy is still a photocopy is still a printed scan.

I agree. I think I misunderstood his original question but I stand by MY choice to either "copy" or "scan and print" MY passport in color because the time/date stamps were easier to read.

K-1 Fiance(e) Visa Process & Proceduresanyone ever get RFE'd because of a "scan" instead of a "photocopy"

The instructions don't say they require color. Photocopying is also a more established process. I mean they've most likely been accepting black and white photocopies for the last few decades. I was mainly wondering in my original question on the validity of my personal scanner and printer where you can obviously tell I used a home printer, vs a professional one.

You are correct. It doesn't really matter where you have them copied, but when I went to Staples to have my passport copied, the entry and exit stamps were much easier to see and read when I used color. I didn't want to take a chance because of a few extra dollars.

K-1 Fiance(e) Visa Process & Proceduresanyone ever get RFE'd because of a "scan" instead of a "photocopy"

I know it sounds like a silly distinction but I'm wondering if anyone has every got RFE'd for anything because they scanned and printed, for example their passport, vs doing an actual photocopy. I realize they are totally the same, but a photocopy is much sharper usually but in black and while, while my printer and scanner, are good, but medium quality, but in color which makes the passport stamps stand out more. A couple forum searches here seem to indicate it inst a huge problem but they were older posts, so was wondering if this has been a issue with USCIS viewing them any differently lately.

Thoughts? Thanks in advance.

Why take the chance? You can get your entire passport color copied for a few dollars.

Sounds like 2 different stories. The OP stated she came to the states in 08/10 and never got married but the other story involves a man that did get married and his problems started before 08/10. Both are sad.

K-1 Fiance(e) Visa Process & ProceduresNVC question

I guess that you could wait and see if all is processed correctly by the NVC and interviewing consulate/embassy..... However, should you need to speak with the State Dept. folks about the status of your approved petition, you will need your case number. We followed the advice given in the site's Guide section K-1 flowchart. We did get a letter from the NVC a month or so after our file was sent to consulate, a sort of cross-reference letter. It contained the USCIS receipt number and the corresponding DoS casefile number. Though, there are some folks that have reported that they never received the NVC letter. It is generally recommended that folks contact the NVC and obtain their casefile number.

Good luck on your visa journey.

P.S. What visa are you petitioning for? K-1 or F-1?

K-1 and thanks for the reply.

K-1 Fiance(e) Visa Process & ProceduresNVC question
I asked this question in another thread but didn't get an answer. Maybe someone can answer it here.....does the petitioner have to contact the NVC and embassy to make sure they received the petition or can the benificiary just wait to hear from the embassy? Does getting the case number prior actually speed things up?
southernmanMaleBelarus2012-09-14 08:49:00
K-1 Fiance(e) Visa Process & ProceduresHow do I know ??

Here’s specific information about your Embassy and what documents you need:

http://www.visajourn...gdom&cty=London

I would keep calling the NVC and say you’re checking to see if your petition has been received from USCIS yet. Once they receive it, they will give you a case #. They will also mail you a letter. Once you get that case #, you can email the Embassy a few days later to see if they received your petition that the NVC forwarded to them. That’s what I did, but I’m not sure how the UK works. It worked for Jamaica:-)

I don't mean to hijack the tread but out of curiosity, does the petitioner have to contact the NVC and embassy to make sure they received the petition or can the benificiary just wait to hear from the embassy? Does getting the case number prior actually speed things up?

Hi !

I sent the I 129F on May 1, 2012 and I received the NOA1 one week later. It was sent to the Vermont Processing center.

Since then, I haven't received any information or updates on my case. Is that normal? Should I be concerned?

Thanks!

Don't expect anything before mid November.

K-1 Fiance(e) Visa Process & ProceduresLetter of Intent to marry!!!

Hello :)

I am looking for this kind of question.. good thing someone asked... When you mentioned ink signed, Can I sign it and then scan it and send it to my fiance via email, and then he will just print it and submit it together with the I-129F... Will that be ok?

Thanks :)

It'a possible you could get away with it but they want original letters with real signatures not copys for this. Best if you actually sign it then send via snail mail.

Hi,
Am in the process of sending in my i129f application for my fiancee, my question is do I send in the I134(affadavit for support) and the evidences along with my I129f petition, or do I wait until a later time to send it.

K-1 Fiance(e) Visa Process & ProceduresPaper size of I-129F packet

Hey (again), everyone.

My I-129F is basically ready to be sent off, but after getting the packet of my fiance's stuff, I realized that all of his paperwork was on a different sized paper (A4 from the UK). It's approximately one inch longer than US legal and I was wondering if I should submit it as is, or "trim" the ends off of the A4 pages (there's no content on the excess space).

Suggestions?

Thanks, all.

As is. I had the same problem when my fiancee sent me a few papers. They don't care what size the paper is as long as it's the correct info.

K-1 Fiance(e) Visa Process & ProceduresPoland

I just went through this process in February. Someone has to go to Warsaw and go to the main post office and pay. They will need her embassy case number.  They will recieve a reciept number that it has been paid. The next day you can call the embassy with the reciept number and scedule an interview for the next day if the fiancee is from Belarus. I am not sure about Polish citizens. If the fiancee is approved they can recieve their visa the day after the interview. The process takes 4 days unless you have someone in Warsaw to take care of the first step for you. Feel free to PM me if you have any other questions.

I have a question to you people who already done with NoA2 and to those who is not. I send 8 pictures of us but it is not dated digitaly. I singed, wrote our names, location and sing the date on the back of each picture, with a hand writing. Will it be counted as datedfor USCIS?

Your pictures will be fine if both of your names are on them along with a date and location. Digital dates are not requiered.

If you sent what they asked for then you should be fine. Just in case have some of those things ready to send if you get a RFE and have some evidence of an ongoing relationship ready for the interview process. I wouldn't worry too much.
