You can probably get a judge stamped signature from the court or google California statistics for a legal copy of your divorce. Most states use a company that prints legal certificates for about $20. I sent both without an issue.

Unfortunately my dad passed away in 2007. I'm wondering what I should put in the gap "City and Country of Residence" of my father's.

I was thinking of N/A. What do you think?  WRITE DECEASED

 

another question is if the name at the bottom of the form where it says "APPLICANT: Print...." has to be handwritten? IT CAN BE VERY NEATLY HANDWRITTEN OR TYPED.

The short answer is no, there is no need  for folders,clip and staples as long as all of the required information is there. However, I followed the guidelines here http://www.visajourn...ontent/assembly  and used acco fasteners. Yes you have to punch holes in the top. I have done this with both my k-1 petition and my wifes AOS paperwork without any problems. Just remember to make sure you send everything they ask for and a cover letter helps them find everything quickly. I simply placed the entire package in a cheap paper folder and then mailed it in a little larger envelope.

Don't hire a lawyer, you can do everything yourself and it really is very simple. This site has all the information that you will need and pleanty of good people to help you along the way.  A denied B-2 visa will have no bearing on a k-1 visa petition. 

 

As for your fiances divorce, it will not be a problem as long as he is legally divorced and able to marry BEFORE  he submits the petition. My previous divorce was finalized one week before I met my wife and proposed. It will not be a problem.

 

Each embassy is different and has different rules about the interview process.  He may or may not be allowed to be with you during the "interview" process but he can go to the embassy with you.  Fill in your timeline and whatever country you are from visit that section of VJ to ask specific questions.  Don't be afraid and good luck.

You stated you were a neo-natal nurse. If so and you have been working full time for the past few years then you will be fine. You will need the IRS tax return transcripts for the past 3 years anyway.  If you haven't worked and haven't made the min required income then you will need a co-sponsor. If you are simply just wanting to change jobs in the middle of this process then you will be fine and just make sure to send all supporting documents with your I-134 to prove your imcome.

If you did not meet thru a IMB then simply check no. Your criminal past is a different issue and not related to IMB. Whatever past you have on record then you must submit it. They don't care if your fiance knows or not at this point but they may ask her at a future interview if she is aware. Be honest and you should have no problems.

Birth certificates, divorce certificates etc. If you are not going to the interview with your fiance then I would not send originals but exact copies of everything you originally sent with the I129 petition. They will probably not need any of it but just in case something was lost along the journey it is better that your fiance has a copy with her at the interview so getting her visa is not delayed.  And don't forget the I-134 support form.

Does Kiev get a  Packet 3 and Packet 4 prior to the interview?
Our interview is in Moscow on Weds of next week, and it strikes me as odd that you said their mind is made up prior to the interview.  Because in Moscow you bring everything for the interview itself (i.e. Proof, documents, so on).  It would seem that it would be hard to render a decision in advance without all of that.

 

I'm just curious as it's one of the RUB places.

 

OP, I hope this all turns out well and that there are only miscommunications.  It sounds though, and I'm sorry for saying it, that there are some trust and maturity issues you and your fiancee face.  I hope that's something you're able to overcome.

An officer will look over your documents and proof before the face to face interview. Usually they already know if a visa will be issued prior to the "interview"

Here is what happened to me over Xmas 2009 when my flight from London to Almaty got canceled and I had to go from London to Moscow (SVO) to Almaty.

I asked the ticked agent at BA if I needed a transit visa to go thru Moscow. She assured me I would be okay, I asked if she was 100% certain and she asked a few co-workers. All said I would be fine to transit thru Moscow. I arrived in Moscow at 0530. The flight to Almaty was at 0830. When going thru passport control, they called someone who could speak English. He looked at my passport and then took all of us (there were two other Americans from Chicago going to Almaty) to a door and said to come back at 0700 to pickup our passports. We arrived at 0700 received our passports and went on our merry way. It was a bit stressful sitting in an airport without your passport wondering if you would get it back and be able to leave. I did not pay the $170 for the transit visa, but the worry was worth about $120 :lol: . So I would say you do not need to pay for the transit visa, but you will have your passport held and if your connecting flight is close in time you will miss it as they are working on Moscow time.

Thank you...this is exactly what I am afraid will happen. I think there is an international law against any country doing this but I really don't want to find out the hard way haha. I'm just going to get the transit visa and not worry about it.

feli114 is right. If you are traveling and have a layover/change of carrier, etc that is part of your original travel and you wouldn't need any other documents. If you leave the airport that's a different story.


Thanks for the replies and I hope you are correct but, Russia is a bit different than Spain. I guess I should just wait until Monday and call the Russian Embassy to make sure.

My fiance is from Belarus but will eventually have to travel to Warsaw Poland for her K-1 interview. We are trying to do anything and everything possible before that time comes. Ron, her passport will be good to use for the Schengen visa until July of next year so yes, the interview will not be a problem. She should be in the states by then but our concern is if we decide to travel to Europe before she is a US citizen, she will not be able to use the passport she has now. Renewing it is easy enough but we are unsure if doing it in the middle of this process would cause a problem with USCIS,NVS or the embassy in Warsaw seeing that she already has the old passport number on file with my petition.
