You don't need a lawyer to do a I-129. That is the easy part. The Consulate is the tough part. We had some interesting goings-on with these folks but eventually it panned out. Make as many trips as you can in the meantime and enjoy a country not many people see. Learn her culture. Save all your boarding passes and itineraries for each time you go and submit as evidence when she goes for the interview. Take pictures as well, especially with her parents. Oh yeah.......MAKE COPIES of everything! Tell her to as well. I am dealing lost papers now.

The next how ever many months are going to be frustrating and sometimes will piss you off like no other, but you can get through it. The guide section here is very helpful and enough folks have been there to help you out.

If your child is born overseas, make sure you do a Consular Report of Birth Abroad. It will get the little one a passport, SSN and his American citizenship. It is very easy to do and if you go to the Consulate with her and the child it makes it go faster, 4 hours for us. You will be "interviewed" by the staff but it is nothing super detailed, but be able to spout off all your travellings. They were interested in all the stuff I did for the Army for some reason.

If the child is born out of legal wedlock, VN guvmint will not permit an English name nor will your name be anywhere on the birth certificate. Just get Zen with that, you can fix later.

Do a Consulate Report of Birth Abroad for the child. It's relatively easy and straight forward. Then you can submit as part of the evidence pile. You may get a demand for DNA testing but that is simple as well. Just be ready to jump through the rings. There are always rings.

Tourist visas are hard to come by. My wife applied twice and was sent packing twice. The "ties to home" is hard to prove when she has very definite ties to you. Devote your energy and resources to bringing her and your daughter to you.

I retired in 2005 and did not submit any military records for the I 129 process. But...


I did a CRBA at HCM for our son and had to list everywhere I lived for more than one month to include deployments to all the fun places Uncle Sugar has to offer.


When we did Linh's AOS I made copies of her ID card as part of the evidence pile.

We started in March 09 and had our CRBA done in a couple weeks. I was there for it and got grilled by the VN staff. I had a lot of travel and long periods overseas with the army to explain. The American guy was ok. Follow the instructions on the Consulate website. Be prepared to have a DNA requirement thrown down on you. It was a little pricey for us and the convenience factor was not really there, but be patient and it will work.

Linh had an interview same month as well but did not get her visa right away, we had to submit some other stuff (DNA) but was finally granted in june.

Not doubting your post Jim, our sons US passport does not have a exit stamp in it for some reason and he does not have a VN passport. Maybe an anomally?
