well, based on what the consulate said, it doesn't sound like they need the NOA2 for the I130 ---

and realistically it doesn't make any sense at all that the I130 NOA2 would be needed for a K3 interview, because the K3 was specifically invented to bring spouses to the U.S. while they were waiting for the I130 to be approved.

I hope this makes you feel better, but other than that I don't know what else to say.

I honestly think that knowing I have to go through Montreal's waiting line is the most disheartening thing to me right now. I'm seriously considering begging to be transferred to Vancouver if we are ever approved, but then of course the Vancouver people will probably be annoyed with people transferring and take their own sweet time :wacko:

Hi there :) If you check out the Canada forum, we have a Montreal timeline going. It seems that they have been averaging about 4 months from NOA2 to interview date, with the interview letter arriving about one month before the interview.

First of all I 'd like to thank everyone who regularly posts to this forum. Although this is my first post I have followed this and the expats forum for some time now, and the info provided has been invaluable.

I submitted my K3 checklist to the Montreal Consulate in Canada over 5 weeks ago, but I haven't received an interview date yet. I'm wondering if this is normal, or should I be contacting the consulate to ensure everything is okay. The on-line case status shows the file was updated Nov 18th, but there has been nothing since. I'm mainly concerned because I make a living on contract jobs and I recently had to pass on one because I didn't want to abandon the work in the middle of the job to return for an as-of-yet unknown interview. It makes planning quite difficult. I debated about contacting the consulate but I'd hate to be seen as pestering them if this delay is normal. The last thing I want to do is make them mad when I am finally getting close to a visa.

I'm sorry, I'm just a bit confused. You just got your package 3 from Montreal, and you have a January interview scheduled already? by 3/1/07 do you mean March - which makes the rest of your post very confusing, or January? Please just clarify what is happening.

I've been watching Montreal scheduling for a couple of months now, and they usually vary between 2 - 4 months, that's another reason I'm confused. Hopefully we can help you if you are a little more clear :) Congrats on finally getting approved!

We could use some good ideas. After 7 long months our I-129 was approved, then moved through NCS. We just got packet 3 from the Montreal Consulate (12/08/2006) and got an actual rather than a hypothetical verbal one. Since my fiance is from China, it is next to impossible to get the official birth certificate and police records that is being requested - let alone in a couple weeks. Since she has to be in the US by 3/1/07 for our Visa, it seems we need to have all the DS230 and completed checklist sent back to the consulate before the end of the year.

Does anyone have any experience of what we can do? :help:

Even though it's a non-immigrant visa the idea is that you are going to the U.S. and will stay and adjust status. So it's okay to have immigrant intent. :)

Soo.. I guess I'm about 3/4 of the way through K-3 processing, I just got the package from the consulate in my home country (N.Z). Super excited but there is this one form that has me stumped. One of the required forms to send back is the DS-156 (a Non-immigrant visa app) which asks questions such as 'How long do you intend to stay in the U.S?' and 'What is the purpose of your trip?' ... how do I answer these questions on a non immigrant form when it is part of the K3 process ?

Very confused :(

very odd - you are right, it's not there anymore! I wonder if this is another change they are making without announcing it until a month later. Maybe they are going to just use the I864 for everyone? I haven't heard anything about this.

You know, I just realized, I've heard of consulates sending out packets via DHL... not NVC, sorry about the mixup.

anybody knows how will uscis/nvc or embassy send packets to our spouse, i mean do they send it thru regular post office, UPS, Fed-Ex, DHL etc...

is it a registered mail.?

any chance it might get lost?

i grew up in the philippines and i believe our mailing system is not that good.
also everytime i send letters from the states to the philippines, most of them got lost.

Is it possible you've read about interviews for Adjustment of Status or Removing Conditions? Such evidence is required at those interviews, because those couples are already living together in the U.S.

It can't hurt to have evidence at your interview that shows you have a valid marriage, but evidence which can only come from living together can't be expected :) Good luck!

Only because I am appying for a K3 visa and I assume this is the correct forum. I read some posts that this was required and on the Juarez Consulate website and it said for marriage it was needed. I read some posts from interviews in Juarez and they said they did not ask for this information but I want to make sure for the interview that I have anything they might ask for. I am just trying to be prepared.

For the K-3 a marriage certificate. All the other items you are mentioning will be needed for your I-485.

THe I-130 I sent did not request this information. I used the latest one from the USCIS website in December.

This is a new requirement, and unfortunately it's causing a lot of stress!!

The consensus seems to be to provide the evidence you can (particularly the affidavits from people who know both of you) ... the immigration laws prevent us from living together in the U.S. so it's unreasonable to expect us to provide evidence that comes along with living together such as merged finances. Some of the suggestions make more sense if the I130 is being submitted in conjunction with an I485.

I own my own home and all my utilities are in my name also, should I have her added to all my utility accounts and anything else I can before she arrives here or is that even possible?

I'm kind of worried right now.

Michael's interview is in my last week of law school, and I don't have a passport.

So, even if I really tried to buy a ticket and explain to my professor's why I will be missing a day in the very last week, I'm not sure if I would be able to get a passport in time to fly up.

Has anyone else had their spouse go alone? Do you think this will be a problem?

At first I thought it would be okay, but I'm starting to panic a bit.

I would definitiely recommend scheduling an Infopass appointment - I had my interview and then didn't hear anything for almost 60 days. I scheduled an appointment, and 2 days later my oath letter went out! I don't know if there was any connection, but it's totally possible that a flag went up on my file and the officer who had it was reminded of it. Anyway, you can't lose anything by trying.

This sounds like a fairly complex situation, but here is my input for what it's worth.

Your husband does not have to apply for citizenship immediately at the 3 year mark. So as long as he doesn't violate the basic green card requirements (i.e. leaving more than 6 months, intent, paying taxes, etc.) Once things have settled down he could apply once he reaches the point of having been in the country for half of the previous three years.

I myself didn't apply until I had been a PR for 7 years because I was away for school and didn't meet the 1/2 residency requirement until that time.

Hope this helps. But definitely be aware of all the other requirements, it would be awful to accidentally lose the Green Card. And be prepared for a lot of hassles when travelling - from my experience the border guards seem to disapprove of green card holders going somewhere outside the U.S. for work or school. Good luck!

I've never heard of a waiver for this kind of purpose.

The employment and paying taxes doesn't matter so much (what if it were your elderly mother in law, for example--she could be a Permanent Resident without ever working) but the physical presence is very cut and dried.

If he doesn't want to delay his naturalization, my only suggestion is to meet with a lawyer who does a lot of natz work and talk out a strategy. Maintaining PR status is very individualized (that's your first hurdle) and there may be other twists to the natz eligibility that we're not aware of.

I handed in my Green Card at the Oath Ceremony, and received my Naturalization Certificate the same day, so I was never document-less.

I changed my SSN relatively quickly after the citizenship ceremony, but only because my name changed (I held of changing my name after the wedding, b/c it seemed simpler.) I would update my SSN first, but realistically I don't think it matters, you keep the same number.

That's a good point, maybe I'll just get them done again and then again for a passport when (if I pass) needed. I know they need all the info again, it's just a pain in the ###, considering I swore I photocopied and kept everything from my I-751 I did a few months ago, but can't find anywhere. I did find all the ####### I sent for my AOS years back, unfortunatly that no longer helps.

So do they keep your GC or do you keep it? I'm curious because inbetween getting a US passport I may need it to travel. Also do you get your SSN updated before you apply for a passport? Since you just happend to have gone through this recently ha ha...

At my interview they just wanted my green card for ID. I didn't need to provide more photos, but then they didn't say they might need them. I know they use the photos directly on the naturalization certificate. I know it can be annoying, but I guess it's basically $8 versus the risk that they might have lost your photos and need more and there would be a delay.

I'm sure they are not looking to torment you, but I beleive generally people naturalizing based on marriage are required to bring evidence to the interview. It's just bureaucracy, nothing personal :) It won't be the interview that lasts 2 hours, it just depends how long they take to get to you. Good luck, it will be great to be finished with them :)

I think the number one thing is to continue to file taxes as a resident. And to not claim anywhere you go to be a resident somewhere else - so that fact that you will be on a visitor visa is a good thing. Hopefully as long as you are gone for less than 6 months you won't have any trouble.

I'm by no means an expert in this area, maybe someone else can contribute. I guess when I was referring to ties, I just mean that in case they question the fact that you did not abandon status, that you would have evidence that you only planned on being gone for a short time and intended to return. And don't worry, you don't sound ignorant :) We're all here to learn.

I don't think they could deny you on that basis, unless you give them any reason to suspect that you have abandoned your residency. Which shouldn't be a problem if you keep all your ties in the U.S. and have a valid reason for going.

Also, my understanding is that the physical presence requirement extends to the date of the oath ceremony, so you need to make sure that you will have been in the U.S. for 30 of the last 60 months at the time of your oath ceremony. At your interview they ask if you have left the country at all, and then you have to provide that info again at the oath ceremony (or at least I did!)

I would definitely get a lawyer. How do you have a social security number if you came here as a tourist? It sounds like in addition to your very long overstay, there is the issue that you have been working illegally. Sounds complicated, and I would definitely get legal advice.

It's really just a personal choice - and it's usually easier to give a good impression during a brief interaction if you put some effort into your appearance. But I don't think they will turn you away or anything. I don't remember people being especially dressed up when I went, I actually can't remember what I wore...but I probably wore something a step up from jeans.

Ok with my interview comming up in a few weeks (hoping they don't deschedual it), I have a simple question to those that have already gone through with it. How did you dress?

Reason is, I read on another board someone suggested to dress up for the Naturalization interview. Now I hadn't ever dressed up for any INS things before (including the one for my green card), so I'm just curious what people on here wore. Jeans? Dresses? Dress pants? Bermuda shorts? etc. And if you waited before getting your interview, what were others that were waiting for their naturalization interview dressed up like as well? I'm just trying to get an idea, I don't want to over dress or under dress, and the less dressy the better...
