CanadaAnyone who has a K3 timeline and is going through a US Consulate in Canda:
Montreal is the only one that does IR/CR1 - Vancouver and Montreal both do K3's.

Me and my husband have decided to file an I 129F. I feel hopeful that this route will be faster, plus Vancouver will be easier and closer to get to. I am just asking anyone who has a K3 timeline on their signature to leave a response. Instead of me randomly looking and clicking on peoples names, I though this may be easier. Thank you!!!



Others will comment but I have read that MTL is the only consulate that does K-3's...

For once I am very thankful that I am in law school - almost 3 weeks to visit Michael :) We already exchanged Christmas presents because we couldn't wait!

Hope everyone else has a happy holiday, whatever and wherever they celebrate!

I'll still be on VJ though since Michael has to work, and that gives me time in the day to get online :)

I don't think it would be a bad thing, and maybe would go a little bit towards showing how serious you are. The only thing that came to my mind was that while I think it's different in each state, that usually the license is good for a limited time (like 30 days) so you would only be able to try it if you got it when you already knew when your interview was.

But I really can't see how it could work against you :) Enjoy your visit!

The rule is not to, and I seem to recall someone in my family having to open gifts at the border once. It's really a calculated risk though, I'm personally not wrapping anything.

The duty to disclose would depend on what you were asked... the rule of thumb is generally to not volunteer more than asked, while never being untruthful or evasive.

My husband has had some trouble, but proof of things such as a job, and a lease or deed are a big help.

As for the actual approval timeline - it's hard to say, things are changing all the time. Based on history for Canadians, you are probably looking at 3 - 4 months until you get to the consulate stage - then it really depends on which consulate your K3 is processed through. Which depends on where you live - it would either be Vancouver or Montreal. Vancouver seems to be taking about 6 - 8 weeks (last time I checked) and Montreal is averaging closer to 3 - 4 months. Several people who had a West coast address they can receive mail at have successfully transferred to Vancouver to take advantage of the faster processing.

This leads me to another few questions then.

If we were to marry in Canada and then I tried to visit my new spouse in the US, would I have to disclose that when crossing the border?

Generally how long after does it take for a Canadian to have a K3 approved?

My understanding of your situation was that you wanted to work for 2 more years - and if you do the K1 you would have to be in the U.S. for an average of 3 months before getting Advance Parole, and therefore would have to be away from work. That's what my advice was based on.

With the K3, you can come and go from the U.S. as you please. It is valid for 2 years, so you would want to Adjust Status or get an IR1 within two years of activating the K3. K3 doesn't take much longer to process on average than a K1.

The other poster did misquote me a bit - I said Adjust Status OR Advance Parole - AP would be the route which would on average allow you to leave after 3 months.

Also - these timelines are always general estimates - just so you are aware that everything might take a lot longer - or faster than you expect.

Hi & Welcome :)

If you get a K1, when you enter the U.S. you cannot leave again until you get your Adjustment of Status or Advance Parole Document. Unless you have an emergency, you wouldn't be able to leave for probably 3 months.

It might be a better option for you to get married, then apply for an I130. That would likely take about 9 months from the time you get your marriage certificate. Once your I130 is approved (which occurs in Montreal), you then have a period of time before you actually have to activate it - which if I recall correctly is 6 months. Once you enter the U.S., then you have to be concerned about showing intent to remain in the U.S. - so still working in Canada at that point could be difficult to do. But - you can delay the I130 process if you like to get to 2 years.

Also, you could apply for the I130 and K3. The K3 is generally faster, and once you have it it will be much easier to visit your girl friend. Otherwise, if you are married to a U.S. citizen you can expect a fair bit of questioning at the border each time, and will have to be prepared to show evidence that you will be returning to Canada.

And you will need your marriage certificate to file. I've heard of some people taking the signed license directly to the clerk or whomever is the registrar of marriages for the locality and being able to get their official certificate the same day if the judge lets them bring it themselves. When you enter the U.S. on a K1 you are legally authorized to work until your I94 expires (which should be about 90 days from entry). The problem is that unless you enter at JFK and get a temporary work authorization stamp you won't have an proof that your are authorized to work. Employers are supposed to require documentation of proof that you are legally authorized to work - if they don't and they hire you, then you won't be breaking any laws, but the employer will be violating the legal requirements they are supposed to meet.

As soon as you have your official marriage certificate you can file for Adjustment of Status, EAD, and AP. (While you can apply for EAD first it will only last the original 90 days of your I94 if you don't file consecutively with AOS).

So basically it is a matter of whether the employer is willing to let you start without proof of work authorization or if you manage to get a temporary EAD by entering via JFK. If not, you are looking at time to get the marriage certificate (which varies) + average 90 days to get an EAD from the time you file.

As I've been writing this - I'm not 100% sure you need the marriage certificate to file AOS, I'm pretty sure, but I'll check.

You can technically apply for EAD when you enter on K1, but it will only last to the extent of your I94 (which is basically 90 days) - so the odds are that you will pay for an EAD which will only last for a couple of weeks if you are lucky. I've seen people do it because they didn't understand they had to wait until they filed AOS to get a longer EAD.

If you ask me it is no point getting the EAD stamp! Employers won't hire without a social security card. That means a one month wait for social security card(2 weeks until social security visit, 2 weeks in the mail). To find a job and start working will take a month. Therefore you will have one month of employment and then you will have to quit until the actual EAD is processed. It is something to think about!


I'm not sure I'm understanding the logic at the end here - how could you start working before you have EAD to begin with? In my case, I have a job prospect before I have even left Canada. I'm in a position that I will have to tell my employer I would love to work for you but I will not be available for 90 days until EAD is processed. Or are you saying just to take the chance and work without the EAD?

from my understanding unless you get the EAD stamp at the POE you have to wait to apply for one when you do the AOS, which might take a few months to get approval...

You can apply for the SSN right away, and you have until 2 weeks before his I94 expires to do so. If you don't do it in that time period you will have to wait until he gets an EAD or Adjusts Status. Be prepared that some SSA offices are confused on whether a K1 can actually get a SSN. If you search for posts by MDYOUNG, he posted the actual SSA regulation which permits this.

Not everyone files the I765, it's not mandatory. That being said, by filing the I765 he should get an EAD in about 3 months and be able to work. Some people get their AOS processed quickly and the I765 ends up being a waste, but some people's AOS takes a long time, so it's a personal decision. Also, if you are going to file the I765, you should wait and file it at the same time you file AOS because it will be valid for 1 year. If you try to file before filing AOS, the EAD will only be valid for the time period of his initial I94.

Unfortunately about the temporary EAD, they're only given to K1's and only if JFK is the POE, which is hard to do coming from most Canadian airports where you go through American customs at the airport before you depart.

I've seen people discussing this and the consensus seemed to be that for your first EAD it is best to not file online.

If you file online as K1 it is likely that the EAD will be linked to your K1 status rather than AOS, and will expire shortly after you receive it.

Apparently using for renewal EAD's if necessary is okay.

Just reading through the Electronic Filing rules for I-765 on the USCIS website. Apparently according to the website K-3'ers cannot apply online for their EAD, but K-1'ers can.
