VSC received our I824 on 01/04, and it is still pending as of today. We are going to do the K3 just in case. My I-824 was touched today for the first time. Maybe we'll get news soon. IR-1 / CR-1 Spouse Visa Process & Procedures	Tracking Recently Approved I130 Petitions	From the pattern I've seen, it doesn't seem to matter what you answer to Question 22...although if I was applying now I would answer "I am NOT going to adjust status, and I want an IR/CR1 visa through the consulate in Montreal" The key seems to be whether there is an approved K3 - which makes sense - otherwise I'd have a retained I130 and no K3 either, and I would not be happy! Let me clarify, looks like they are retaining regardless of whether you answered question 22 *if* you have filed an I-129 as well (or maybe only if it is also approved at the same time).	riblet	Female	Canada	2007-01-22 22:22:00

If not I wouldn't assume it's been retained yet...it normally takes about 2 weeks, and can take more than a month, for the NVC to receive the approved petition. If your I130 NOA2 does not specifically say that the petition is being retained, then it really shouldn't be retained if the USCIS follows its own policy. So no need to file an I824. IR-1 / CR-1 Spouse Visa Process & Procedures	Tracking Recently Approved I130 Petitions	M&N - from what we have seen, the NOA2 for the I130 has specifically stated that the petition was being retained and if the NOA2 did not state that it hasn't been. Please fill in your timeline, it really helps you and everyone else! Have you received your NOA2 yet? Good luck with everything. For those people who are indicated as having a RETAINED I-130 on riblets table..... did your NOA2 specifically indicate that the I130 will be retained?....did it use that exact word or are you assuming that it was because an I129 was approved simultaneously? I'm confused as to whether or not I have to send in the I824. Both my I129 & I130 were approved on December 14, 2006. The I129 was forwarded to the NVC but God only knows when the NVC will receive my I130. I call everyday and have emailed a couple of times.....I haven't received any replies to the emails and when I inquired over the phone about the new policy of retaining the I130's according to the press release, the customer service reps had absolutely NO IDEA what I was talking about.....it is soooooooooooooooooooooooooooooooooooooooooooooooo ridiculous & frustrating. IR-1 / CR-1 Spouse Visa Process & Procedures	Tracking Recently Approved I130 Petitions	It shouldn't apply to you knowledge Just to people who have also filed for K3. Basically, it looks like if you have an approved I129F and then your I130 gets approved, they are going to hold your approved I130 and not send it to the NVC because they assume you will enter the U.S. on the K3 and adjust status rather than having the CR/IR1 processed at the consulate. If you want them to send it on to NVC after they retain it you have to file a I824 and pay $200. It's still not a 100% clear if just filing for K3 is enough, or if the K3 has to be approved. Good luck with the rest of everything I hope you get an approval very soon - when you do, check in on the Montreal Timeline to Interveiw thread if you haven't already! IR-1 / CR-1 Spouse Visa Process & Procedures	Tracking Recently Approved I130 Petitions	That seems to be the standard language on all of the petitions - as if it's our fault Just because they choose to presume that our spouses will adjust status. That's exactly the same as what everyone else who's been retained that I've heard of has received. Retained as per the NOA2 received in mail today. Interesting if you track your petition after approval at USCIS. The K3 for stopped any further touches after NOA2 date, but the I-130 was touched repeatedly...this may be them putting the file in storage? On an interesting note...the NOA2 for the I-130 for me states, "The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status"?!?!?!?!?! Is this something that you received too ADK0290? I am wondering is this is a USCIS mistake (I made no such indication on the I-130) or is this statement in relation to the I-129F? The letter does go on to state that I can file an I-824 if I so desire to have it forwarded to the foreign embassy. Basically, this confuses the heck out of me. Not a huge deal as long as it does not screw with my K3 in any way, or else I just may have to file that I-824. Anyone with input on this strange statement? IR-1 / CR-1 Spouse Visa Process & Procedures	Tracking Recently Approved I130 Petitions	Hi Dip Sticks, sorry you haven't heard anything good yet It's not absolutely clear what the criteria are at this point, it seems like what would make the most sense is that they would only retain an approved I130 if there is already an approved I129F. But it's possible that they might just decide that anyone who has filed K3 wants to file Adjustment of Status and not pursue the I130 at the consulate if they aren't super explicit on their I130. I REALLY hope not. It's especially frustrating because it's not like I can go back and update my I130 to tell them that I definitely want it to go the NVC. Anyway, if they decide to retain an approved I130, supposedly the NOA2 is supposed to tell you that. Then you can file the I824 asking to have it forwarded, or if by that point you have an approved K3 you can choose to Adjust status instead. I guess they just saw so many I130s going to the NVC and coming back b/c people were adjusting status, but I think it makes no sense to create this new policy without changing the form. Apparently making new forms or editing forms is a Huge deal for them, since we all still have to use the fiance(e) form for spouses. Okay, now you've got me ranting... IR-1 / CR-1 Spouse Visa Process & Procedures	Tracking Recently Approved I130 Petitions	I thought that I would start a new thread since many of us have both I129F and I130, and aren't sure how or when the USCIS will be applying its new policy. I suppose petitions approved after 10/23 only would make sense, as that's when the policy was implemented. Hopefully this will help us see what the USCIS is doing, and whether we can actually rely on what our NOA2's say. And whether or not we need to file the I824. Once people start having to file the I824, maybe we can include that too to see how long that takes. Should I also include whether each person has an approved I129F? I'll add more people later, since I'm working off of the I130 timeline, and not everyone's signature indicates whether they are pursuing both. Hi everyone, I was just looking over the docs my husband sent to the NVC last month and read in the letter they sent about the I-864: [i]"the case number must be written in the upper right hand corner of ALL documents. Failure to wite the applicants number on all documents will cause a delay in processing."[/i] My husband did not do this!! Has anyone not written the case number and had no delays? I am worried now as I want an appointment in Sydney before July because "Due to the Asia-Pacific Economic Cooperation (APEC) forum, the consular section at the U.S. Consulate General in Sydney will need to substantially reduce routine visa, immigration, passport, and notarial services from mid-July to mid-September 2007, with closure for all routine services anticipated during the end of August and first week of September.
