So to clarify - I would put in the date of your most recent (last) trip, and then for additional visits, put "see attached".

So you are filling out the form online - I looked at it, and if you have many visits I would put in "See Attached." On the form it generates, on page 1 it puts (see page 3) for additional visits - and when they look at page 3, they will see you note to "see attached." I don't see how else you can do it, unless someone else has experience with this :)

I think YuAndDan made his own point where he said "any with immigration intent". As we all know, K1 and K3 do not have immigrant intent, they are nonimmigrant :)

You can call the NVC, it is a 24 hour a day automated system, and operators available sometimes. I believe for K3 visas you must actually talk to an operator - the number is On (603) 334-0700. I think the operators are there from 7am to midnight EST - so it's not too hard to a get a hold of them.

I would agree that there wouldn't be an absolute ban on visiting, but you might have a hard time convincing the officer at the POE that you were actually going to go back.

And I'm not sure what the crime of "fighting" is, but maybe it won't require a waiver -- have you guys researched the waiver issue? I thought that waivers were generally required for people who wouldn't even be able to come visit the U.S., let alone move to the U.S., because of their issue in the first place. But I really don't know much about waivers.

I hope his interview goes smoothly and all the worrying will be for nothing :)

If you definitely just want to purse the K3, don't pay anything more to the NVC :) The IR/CR1 interviews are only done in Montreal. As you are going through Vancouver, it seems likely that you would be done much faster on the K3.

I have a feeling that if you pay the $380 immigration bill to the NVC, they may not apply that towards your AOS. I really don't know though, but I believe at this point you can notify the NVC that you plan on Adjusting status, and don't want to continue processing with them.

have the ability to have multiple entry/in and out of the USA
until I AOS

My plan is to be moved to the US legally by the end of March.

not really interested in travelling from Vancouver to Montreal
this whole thing is costly enough...LOL!

I hope I am going about this the correct way!

The packet 3 from Vancouver would be for your K3.

The Choice of Agent & I864 are for the CR/IR1.

So basically it makes sense to interview for the K3, then you have a choice. Do you want to continue to pursue the I130 and go to Montreal in about 4 - 6 months for an interview for green card. OR just adjust status in the U.S. and stop pursuing the I130.

If your husband has submitted the Affidavit of Support fee to the NVC, then he can call to see if they have sent out the I864.

And if you do go to the U.S. on the K3, you won't be able to work for about 3 months until you get your EAD.

I hope I'm not being too confusing - I'm not sure how much you know about the 2 processes :) Feel free to ask for clarification if you need it!

That's true, I was thinking it was strange that her husband received a letter. Actually, I just looked at your timeline cdancer, and you've been approved for both petitions. Did you realize that both processes are still going on? Have you received the choice of agent form from the NVC?

Whoa.

The K3 Visa involves first the I-130 CR/IR-1 Immigrant Visa petition that requires the I-864. That is a seperate and paralell process to the K-3 Visa.

Its possible your I-130 CR/IR-1 Visa petition has been approved and is being processed at the NVC.

In this case, your not talking K3 anymore.

The September date refers to an OMB expiration, which is some sort of review of forms, it doesn't have anything to do with people using forms - it used to really confuse me :)

The Affidavit of Support for K3's is the I134 not the I864 if I recall correctly. I'm not sure when it gets submitted - at the interview I think. I'm sure someone else will help you out :)

The main answer to your question is fax in your checklist! You are just supposed to schedule the medical, then return the checklist, not wait until the medical is done. That doesn't necessarily mean he could have had both the same day, they are totally separate, but the longer you wait to return the checklist, the longer it will be until the interview.

Was reading this posting and it raised questions for me. My fiance is in Vancouver now, has his medical appt. scheduled for Wednesday. He thought that he had to do that first, then fax the checklist in to the consulate before he could set up his interview. Are we doing this all wrong??? Could he have gotten his medical and interview set up for the same date?

I know I read a post earlier about someone arriving at 6am, and there were only 2 other people there at that point. So hopefully it will work out.

I have heard about people having something missing, getting it to the consulate, and not having any problem... but it would make me nervous. But hopefully it won't be a big deal :)

Is there anyway you could call the clinic and explain your situation and asked to be scheduled a day or two earlier? From what I recall of my exam in Vancouver, it took a long time, and there were a ton of people. I believe that they tell everyone 7am, so that's not really a guaranteed time. I also think it would be much better to be able to bring all your documents to your interview with you, just to avoid any complications.

I hope it all works out, you must be excited it's so soon now :)

I'm pretty sure my husband will be in a similar situation. But I've never heard of a waiver for this situation (not that that doesn't mean there isn't such a thing).

I don't know what the violation would even be called. I know you're not supposed to overstay, but even an over stay isn't a violation leading to a ban unless you overstay for more than 6 months (meaning 6 months + 6 months for a Canadian). That's how I understand it anyway :) I'm definitely not an expert on waivers.

This was all I found on the U.S. embassy site:

"Canadian citizens are generally granted visitor status in the U.S. for up to six months at time of entry. Requests to extend a stay beyond this time must be made to the nearest office of the U.S. Citizenship and Immigration Service. Any visitor may be asked to demonstrate that they are only remaining temporarily in the United States. "

I haven't ever heard anything about a maximum time in one year. As long as you didn't make misrepresentations at the border, I don't think this would be a problem. Maybe someone else will have more insight.

My husband was denied entry last September. He was pretty freaked out by the experience, and we waited a long time until he tried again. And when he did he was VERY prepared. Since then he has come down maybe 4 times, and each time without serious problems. He was just very upfront and honest. It's funny what that one border guard said to you, (about doing the right thing) we had one say the exact same thing at first, but he said we were okay to enter the U.S. It just goes to show how much it depends on the border guard. As you can see from my signature, it hasn't interfered with our process so far.

I just remembered though, that when my sister's husband was denied entry, they made a really big deal about the fact that the next time he tried to come in he should absolutely tell them he was denied the last time, or it looks like he is being deceptive.

I don't think it can harm anything, the worst I've seen are people being turned back. I've also heard that it may trigger more security checks at some point, but I have a feeling that this is less of a concern for Canadians.

I found out the name of the form, it's I693A... who knows if they'll charge more, I can only guess yes :) It doesn't appear to be on the USCIS site.

I know what you mean about cash, it makes me nervous to carry it! If you wouldn't mind posting back after your medical, my husband will have to have his there sometime in the not too distant future.

So, I have been reading all these horror stories on the AOS forum for people who are going through hell to get their vaccination record transferred to the immigration form the the AOS portion of their journey.

With my own medical coming up, can anyone please tell me exactly what I am supposed to ask Dr. Seiden for a copy of? Will they give a copy of the whole medical? Is it just the vaccination record? Is there a specific form AND (for any of you who have used Seiden) do I have to walk with extra cash for any of this.

Cash! Can you imagine it? Ha! I can't tell you the last time I have carried more than $20 on me - you gotta love Interac and those wonderful credit cards!

Well, it would immigration fraud to go down on a visit with the intetion to stay, and no one here is going to recommend that.

K3 or K1 would both probably take 6 months, or more if there are complications and delays. Then 3 months average to get work authorization.

I130 would probably take 8 - 12 months, and you are work authorized when you enter the U.S.

They are all really close options. I guess the only benefit about applying for the CR1 is that you can pursue both K3 and CR1 and take whichever comes first. Also, if you are in the Vancouver Consulate jurisdiction, interviews there have been consistently much faster. So a K3 or K1 could possibly be as fast as 4 or 5 months if you're lucky.

For the passport photos we submitted of my husband (at the USCIS stage) I cut them... I think alot of shops that do the photos trim them when they come out, so I don't think there's anything wrong with it :)

OK I have 5 passport pictures with canadian requirements. I gave 3 form my medical and all they did is attach it to the sheets so they didnt really care about the size.

But now I just took a look at me 2 pictures left. They meet all the requirements for Background, size of the face, distance between top of the head and chin, etc, etc.

And I measured also if I would cut the bottomof the picture to make it square ( its 49mm by 70mm right now) the distance between the eyes and the bottom of the picture would be perfect still.

So any suggestions?? Cut the picture or no?

They cant deny you for following the instructions written on their own sheet can they?? :protest:

AOS will cost you more money and it is a big headache with the EAD and such.

Here's the link to the "Vancouver Waiting Room" thread, I'm pretty sure there are some K3's in there. If you pursue the K3 the interview would be in Vancouver.

Hmm, I know Montreal is the only one that does the CR1. Either way, we are at a complete standstill with the I 130. It could be 6 months alone before my I 130 gets sent to NVC, the I 824 is pending and right now they processing June. At this point, I'll be happy to go anywhere, Vancouver, Montreal.

Montreal is the only one that does IR/CR1 - Vancouver and Montreal both do K3's.

Me and my husband have decided to file an I 129F. I feel hopeful that this route will be faster, plus Vancouver will be easier and closer to get to. I am just asking anyone who has a K3 timeline on their signature to leave a response. Instead of me randomly looking and clicking on peoples names, I though this may be easier. Thank you!!!
