Help on timeline

The only thing I saw on timelines was time from NOA2 to Interview unfortunately. I guess you could subtract how many days it's been since your NOA2 from that number to get some idea.

Also, maybe people in the regional forum would have a clearer idea of this

I call NVC, and all they say is that my case was complete September 28 and that it has not yet been sent to Manila.

Manila only has so many openings. NVC operators refuse to give any hint at all of what months people were last sent on to Manila.

Anyone here have any idea how long between "case completed" and forwarding to Manila?

I tried looking at the NVC timelines. I do not understand it, I guess. There isn't a date entry for "case completed at NVC" and "case sent to Manila" there.

Hi there,

I'm not sure about the requirements for filing DCF in Spain. But if you and your wife are already together in the U.S. then it seems like filing AOS is the best option if you don't want to be separated. Unless you are willing to go back to Spain, depending on the requirements there, and wait there together for DCF.

A K3 visa is not an option at this point as your wife is in the U.S.

Most people here would be thankful to be together while their petitions were being processed, AOS is a pretty good option. I'm not sure what your wife's intentions were when she arrived in the U.S., but I believe that there might be some burden to show that she didn't misrepresent herself when she entered if she intended to stay and adjust status.

Hello All. This is my first post, so please take it easy on me.

Background: I am a US Citizen, my wife is a Spanish citizen who entered the US as a tourist (and unmarried).

My wife and I have been living together for 3+ years in Spain and the UK. We had filed for marriage in Spain earlier this year and received the formal date (and equivalent 'license'), however my work brought me back to the USA prior to that date and as a result, she and I came here and were married only last week in Florida.

Wandering through the forms and information, I was planning on doing an application based on the I-130 (I-485, I-864 & G325A), applying for her as my Alien Relative and along with a Adjustment of Status on her visa (actually it is a visa-less 3 month tourist visa) but after reading things, I am wondering if there is another way that may be quicker and/or easier (dare I say...).

I am wondering about the IR-1 and/or the DCF path, but am not sure if they apply. I dont believe that the K visa's apply in my case. Does anyone have any similar experience?

As a note, I currently do not have legal residency anywhere outside of the US, although I understand that as soon as I present the marriage documents to the Spanish Consulate here in the US, I will have immediate residency in Spain.

I'm by no means an expert, but I'm currently taking a tax law course, and just read the relevant Tax Code provisions:

Under the Head of Household definition in Section 2:

Certain married individuals living apart
For purposes of this part, an individual shall be treated as not married at the close of the taxable year if such individual is so treated under the provisions of section 7703( B ).

Section 7703:

( B ) Certain married individuals living apart
For purposes of those provisions of this title which refer to this subsection, if -
(1) an individual who is married ...
(2) such individual furnishes over one-half of the cost of maintaining such household during the taxable year, and
(3) during the last 6 months of the taxable year, such individual's spouse is not a member of such household, such individual shall not be considered as married.

Meaning that there is a possible exception, that the IRS may deem you to be not married.

But as I was saying before, it might be worth checking with an accountant - but I wouldn't make absolute statements unless you are really sure.

I do know that there is an exception for head of household, that if you have not lived together at all for the last 6 months of the tax year, then you are still permitted to file head of household. I'm not sure if there are any other requirements, but it is a potential possibility.

I've heard some people have been successful with filing married separately, and just put unknown for spouse's SSN. Although it's not the right way to do it, it's worked for some people.

I'm feeling a bit out of my league, so maybe someone else can be more helpful, or maybe it would be worth it to have a consultation with an accountant

You don't HAVE to file jointly - what you do have to do is file as Married - whether separate or jointly is up to you depending on the costs and benefits of each option.

Is this something that HAS to be done? What happens if you don't want to file your spouse. Can I just file married filing separately and if so will there be any problems for next year?

Question about A-number

Your A number and SSN are totally unrelated. Your A number is your Alien number. I'm not sure under all the circumstances that you get an A number, but it seems possible to me that if you had a student visa you would have an A number. I had one when I became a Permanent Resident.

I have a social security number since I was in the United States as an International student before. I don't know my A-number and asked my husband to look at the paperwork we have received so far. He said that I don't have an A-number since I have a SSN. To make sure, he called NVC for me, but they said they have no information about our petition since it was already transferred to the embassy. Is it true that I have no A-number? If I remember correctly, I have to fill out my A-number on some forms when I receive a packet from the embassy. right? Can I just fill out my SSN??

Why is VSC so slow?

The immigration timelines on this site give a much more realistic idea of how longs things take on average.

It looks like the average wait time between NOA1 and NOA2 for VSC is 115 days. So hopefully not another 2-4 months

And maybe you'll get someone smart on the line who can help you. It can't hurt to get extra documentation in case it's needed - but I think the decisions are already made by the time your file arrives at the embassy.

Regarding a g-25A mistake! help!

Is it possible to strike out the N/A, and still fit in the address?

I know I was hesitant about using white-out, and actually had my husband redo the forms because he made like 6 mistakes! I was a bit peeved

My understanding is that these forms aren't a huge deal, but maybe someone else can relay whether they've used white-out. My main concern with filling in that box was to show that he wasn't living in the U.S., although that should be obvious from the form anyway. It's a stupid form.

AOS versus Consular Processing

If you are concerned about AR, it seems to make sense to do AOS. At least that way you can be together. And 7-8 months doesn't really seem that bad - is there some reason for hurrying? You will be here, and able to work once you get an EAD.

Extended absence from the US on CR-1

I believe an absence of longer than 6 months can disrupt the period required to naturalize, unless this has changed. My understanding of the following excerpt is that if you leave for more than 6 months, even if you haven't abandoned your permanent residence, the 5 or 3 years or residence required to naturalize would start at zero again. But someone please clarify if they know better! Thanks.

PART 316--GENERAL REQUIREMENTS FOR NATURALIZATION

c) Disruption of continuity of residence--(1) Absence from the
United States--(i) For continuous periods of between six (6) months and
one (1) year. Absences from the United States for continuous periods of
between six (6) months and one (1) year during the periods for which
continuous residence is required under Sec. 316.2 (a)(3) and (a)(6)
shall disrupt the continuity of such residence for purposes of this part
unless the applicant can establish otherwise to the satisfaction of the
Service. This finding remains valid even if the applicant did not apply
for or otherwise request a nonresident classification for tax purposes,
did not document an abandonment of lawful permanent resident status, and
is still considered a lawful permanent resident under immigration laws.
The types of documentation which may establish that the applicant did
not disrupt the continuity of his or her residence in the United States
during an extended absence include, but are not limited to, evidence
that during the absence:
(A) The applicant did not terminate his or her employment in the
United States;
( B ) The applicant's immediate family remained in the United States;
( C) The applicant retained full access to his or her United States
abode; or
(D) The applicant did not obtain employment while abroad.

I also found this explanation on westlaw (I have access b/c I'm a law student):

SO, it looks like you could be deemed to have abandoned PR status as far as naturalization goes, but would not actually lose your PR status. This may be way more than you wanted to know, sorry

Medical & Police Reports in Canada

I'm fairly certain that the medical is good for one year. That being said, some doctors won't do it until you have the letter to demonstrate that you need the medical. Also, if you end up Adjusting Status in the U.S. after getting a K3 you can use the same medical if it isn't more than a year old, so it would probably be best to wait - there isn't a benefit that I can see to doing it this early in the process.

The police certificate is good for 6 months or 1 year. I can't remember which.

All in all, it is probably best to wait until you have an approved petition - you will have plenty of time between NOA2 and the interview.

I-864

I believe the I134 is used for non-immigrant visas (such as K3 and K1).

I believe the I864 is generally acceptable for 6 months. I'm still not familiar enough with the NVC process to remember where you are in it, and when the I864 is required, so hopefully someone else can clarify

Yes, the NVC does schedule the appointment.

Apparently Montreal reserves a certain number of appointments each month for IR/CR1 visa interviews, and NVC only schedules the appointments once a month on or around the 15th. So if you want to check if you have an appointment for the following month, you should be able to call the NVC on the 16th or 17th of the month before.

I'm really hoping that our DS230 will be generated on Tuesday of next week, and I will submit it same day (I just received it from Michael today). So we are hoping for early March case complete... although I've recently heard they've changed the standard 2-4 weeks to 4-6 weeks due to backlog from the holidays.

Ok, since my question is Montreal Interview related, I figure I'll post it here as well. I submitted the DS-230 to the NVC on Jan 29. They have received it now. Assuming that they take two weeks to a month to process both the I-864 and the DS-230, I should have my case completed probably end of February.

Here is my question: Is it true that the NVC assigns me an interview date, and NOT the Montreal consulate? Does anyone in a similar situation (case complete, waiting for interview date per NVC) know? Also, 'assuming' that the NVC assigns us with the Montreal interview date, how do they co-relate as far as interview scheduling is concerned with the Montreal consulate? Do they simultaneously log into a 'system' and start blocking up dates for cases? Can anyone provide some insight?

All I have to say is WOW

lol, you must have been bored... and you must have some serious statistics skills

Because I'm completely bored this evening . . . I decided to try to work up some of the data we've all collected. I did a histogram of the 12 cases (excluded DCF) for the K-Visas for the time period (in days) between Packet 3 and the Interview. Here is the graph. The data aren't really normally distributed, but it's fun to try to make these predictions, anyway!
