I would absolutely without question wait until after November 5. The less hassle of immigration forms and fees and bureaucracy the better!! Unless he is urgently needed here, I would wait.

If he does wait of course he should make really sure that they process him with the proper status when he arrives!

The hubster should be getting his visa tomorrow, the mailman left a note that he has mail, he's pretty sure it has tob e the visa. Our 2nd anniversary is on November 5th. The debate is, should he come in next week as a CR1 and we'll have to do the AOS in 2 years (less 3 months) or should we hold off until after our anniversary so that he can enter as an IR1 so we don't have to bother with the AOS. That is, assuming I am understanding things correctly.

I'd appreciate any advice, what would you do? Thanks, as always, your help is much appreciated. :)

there have been a couple of answers to this in your other post in the K3 forum.

Ok here is my question to everyone. If lets say one's K-3 approved and the I-130 is still pending. Can the person come to USA and without the approval for I-130 file for AOS or one has to wait for I-130 to get approved.

And lets say If a person has a K-3 visa in hand and comes back to the States and if the I-130 gets approved, can the person go for Consular processing and AOS in the US (both at same times). Just to see where ever he can get an interview first?!

If a person comes back for Consular processing for cr1-ir1 to the country and goes for Consular processing, if put on Admin processing can the person return to the US on his K-3 or do they cancel it?!

I would be much obliged for a response from anyone who has any knowledge regarding this.

As far as I understand, the medical and police certificates are good for 1 year - but it's probably best to get additional copies. Hopefully someone else can help more with this.

As far as what to do, you can interview for the K3, go to the U.S., continue the process for the CR1 and return to London for the interview (which seems like it would be faster than AOS, but depending on flights might be more expensive.

Or you can skip the K3 and just wait for the CR1.

Or you can interview for the K3, go to the U.S., and adjust status there. Biggest drawback to this option is that you won't be able to work until you get the EAD.

Many people return to their country for the CR1 interview after coming to the U.S. on the K3, but depending on your financial situation, how urgently you want to get to the U.S., it's really up to you :)

Some people are never touched and never receive email updates. For my citizenship application the only thing I got was the approval letter. I wouldn't worry :)

I filed the I-130 for my Colombian wife on August 23, 2006. I received the NOA 1 shortly thereafter. I notice that almost everyone else's application was "touched" a few days after receipt by the California Service Center. Our application was never "touched". Is that anything to worry about? Thanks!

I don't usually suggest hiring an attorney - but it sounds like you might need one. Sorry I don't have any other advice.

I was married to a US Citizen and applied for the I-130 and didn't go through the "final interview" yet.. However, we got divorced before the I-130 (green card) was approved.. The guy canceled because there were irreconcilable differences.. In the system, there is our pending case now... no denial, no approval..

last year, I met a nice guy who is also US Citizen, and we plan on getting married soon.. how will this affect our marriage and application for my new I-130 next year? It has been over 1 year since my first I-130 cancellation.. Will this affect my new I-130 application when I apply next year (2 years from cancellation)? The first one has already been cancelled last year.. Can you please give me any advice?

I'm not entirely sure in the context of having an application already at the consulate. I know when I became citizen I called the USCIS 1-800 number to upgrade, because that's what I read to do.

I would personally call the NVC and ask them what you should do.

My wife filed a petition for me when she was on green card 4 years ago. My I-130 approved in Jan 06 and She became US citizen in April 06. My case approved from NVC last month September 15th and forward to embassy in pakistan with F2A catagory and waiting for my priority date.

Can i email my wife's passport copy to NVC to upgrade my case from F2A to IR ??? Or I should contact to Embassy in Islamabad (Pakistan).

Just letting everyone know that I received the NOA 2 Approval e-mail tonight on our I-130 submission! It only took 71 days. It looks like some of these are getting approved fast by the CSC. I am trying not to celebrate too much on here because I know that there some couples that have been waiting for months. I guess we were one of the lucky ones. I can only hope that all of you that have been waiting longer will receive your approvals shortly. Thanks for everybody's help so far. I am sure we will be needing more help with some of these steps as the NVC process begins for us shortly.

In my experience (3 different petitions) - the website frequently is not accurate and doesn't update.

The last touch on my N400, was last touched 6/1/2006 and has the following message:

The status for this Receipt Number cannot be found at this time in this automated system. Please check your case receipt number to see if it is correct. If you have questions or concerns about your case status, please contact the National Customer Service Center.

Since 6/1 I've had my interview, and RFE, and my oath ceremony. No touches at all, and no available status. So as long as you have the paper, I would not worry.

From what I've heard people say, I think it can take anywhere from a few days to a few weeks for the approved I130 to reach the NVC. But I believe the notice says it can take up to 90 days.

Anyway, congrats on the approval & I hope everything goes smoothly for you!


Does anyone know how long the CA service center takes to move an I-130 to NVC? Does anyone know what it means when I get an approval in the mail but the USCIS website is not updated with this information? I am concerned as the USCIS website previously reflected the current status. We have had a lot of these because our I-130(s) have been in process for over 3 years. This because the Manila Consular officer returned the I-130(s) to the USCIS for further review. We finally got a notice from USCIS of intent to revoke, we responded to this and the USCIS re-approved the children's petitions. Now the I-103(s) don't seem to be at the USCIS and not at the NVC and the website doesn't reflect the current I-797C Notice of Action I received. Any thoughts.... Thanks, Bob

Neither the I130 or G325a request financial information. That comes much later in the process. Sorry I'm not sure about the rest of the details as I haven't gotten there yet :)


I have been going through the forms I-130 and G-325a that we have been told to fill out. We looked at the G 235a form and its asking for hubbies assets.

Now we only have $10,000 savings at this time, but will come into another $20,000 (aus) by June.

Will having only $10,000 in savings now affect the application? Will they deny it on that?

We are getting a joint sponsor (Hubbies mate and wife who earn combined $40,000 USD per year), but we don't file the joint sponsor form till later on right?

Also its asking hubbies yearly income. Does that mean his income now, or his US income (none as he's worked here for 5yrs)

If you are only just filing the I-130 & G-325a out then you have lots of time before you file a affidavit of support, I-864 which i think is probably the form you are refering to??..........................when my husband filled out this form, he didnt put any assets all he chose to put on the form was his annual earnings, & backed that up with tax returns, he didnt put the house or anything else on there!!

Not sure about your first question, but as for mailing it fast - US Priority Mail is 2- 3 days and will send it to a PO Box - I have done this before and just waived the signature requirement.

Hi all, I need to mail in the self generated AOS Fee Bill with my payment.
The NVC already generated and mailed the original but I am using James shortcut.

I want someone who very recently got their AOS Fee Bill to look at it and tell me what the return mailing address should be.

Also, can I send a personal check drawn on my US bank or does it have to be a money order ? I thought if I used a personal check it would allow me to see when it was cashed and processed. Will sending a guaranteed money order make the NVC process any quicker than a personal check? Like maybe they have to wait for personal check to clear fully before going to next step versus guaranteed money order allowing them to move to next step immediately ?

The mailing address is listed on the shortcuts but I want to make sure that is still the accurate address and that there have not been any changes.

Please include the complete address in your reply.

Also, I know it is a P.O. Box address and FEDEX and UPS overnight do not ship to P.O. Boxes so what is the FASTEST method I can use to get it back to them ? I don't want to rely on USPS First Class Mail.

It is up to you whether to pursue the I130 or adjust status in the U.S. It will probably be at least a few months until the I130 is completed, so it might make sense to at least apply for a EAD even if you don't adjust status.

I'm not really sure about the medical exam issue though.

I'm sure someone in the Canada forum would be glad to help :)

Oh, and please fill in your timeline so the rest of us can see how long it took you.

Hey everyone, I have my appiontment for my K3 visa november 22 and i just recieved the notice that my I-130 has been approved. I have 2 questions, 1, do i have to adjust my status and get a work permit now that my I-130 has been approved or can i just wait until the I-130 process has finished and get my green card? and the 2 question has to do with the medical exam for the I-130 can i use the same medical exam results as for the K3 or do have to get another medical? Do they keep your medical exam when you get your K3 appiontment? Thanks for any help!!!

I guess maybe because they don't officially usually process the K3s, they aren't tracking them individually.

But I barely even look at the processing dates anymore - I've been a citizen for 6 weeks now, but according to the service center I filed at they are still working on files before mine. They aren't much help!

I haven't checked I30 times for Vermont, but last time I checked, Vermont seemed to be flying through I129fs! I think you're very lucky to end up at Vermont!

I believe that all I130s are now being processed in California or Vermont. It doesn't really mean antyhing for you, it happens to all the applications now. It just means California will process your application :)

I have just received the immigration visa fee bill for $380.00 from the NVC. On the second page I noticed it says "When we receive your Immigration Visa fees, we will send you the Immigration Visa Application (form DS-230 Part I) along with further instructions. Return only the original application that we send to you. Do not use downloaded computer forms". My question is why are they asking to not use computer downloaded forms? Is this new? Or should I ignore it?

Oops, Sorry, I misread your question.

Here is some info I found on the Pakistan embassy:

Packet 3 Contains: Specifying the documents needed and actions that must be taken by the beneficiary and the petitioner prior to issuance of a visa.
Issues a Packet 4? Yes
Packet 4 contents (if known): Consists of information, forms, and requests for documents.
What forms should be send back to the Consulate? Follow Instructions in Packet 3 and 4
After receipt of the approved petition, and when the filing date (priority date) of the petition is reached, NVC forwards a "Packet 3" to the beneficiary, specifying the documents needed and actions that must be taken by the beneficiary and the petitioner prior to issuance of a visa.

After the required documents have been obtained, the beneficiary should sign the reverse side of the Packet-3 letter and send it, as well as Form OF230, to the Embassy’s Consular Section.

The beneficiary, who then becomes the "Applicant," is sent a "Packet 3.5" which consists of information, forms, and requests for documents. When we receive the Packet back from the applicant (through American Express) – with prepaid return) with all the forms completed and all the required documents, we will schedule a visa interview within the next few working days.

It seems like what most people do in this case is continue to pursue both if they can afford it.

The K3 is only held at the NVC for a very short time before it is transferred to the consulate, while the IR/CR1 can be at the NVC much longer (maybe 2 - 6 months) before getting to the consulate.

Some people choose to pursue both, and then interview for the K3, and return to their country for the CR/IR1 interview. I have also heard of situations where people had a K3 interview scheduled, then the IR/CR1 reached the consulate, and they were able to switch the interview.

If the IR/CR1 reaches the consulate first, then the consulate will ignore the K3 when it arrives.

Hope this is a bit helpful, I obviously haven't reached this point yet :)

Hello everyone!

I am relatively new here and have been trying to navigate the legal and sometimes confusing logistics of the legal immigration process.

Like many of you, I was married in Colombia back in August and came back to the US to file my paper work! I filed the I-130 in September and after receiving my NOA1, I promptly filed my I-129F K-3 paper Work. I received an email on both shortly after my initial filing that both petitions had been transferred to the California processing facility.

Now, I just received emails that both the petitions were approved with in two hours of each other!

My question to those of you who have experience and knowledge of these issues are: Which do I pursue at this point? Both? or just go for the CR-1? Would the K-3 still be faster at this point?

Any thoughts, suggestions or comments are greatly appreciated!

I'm sorry I can't answer your question - but I would really strongly suggest removing your names and any reference numbers, those aren't good things to have out on the net! Sorry I can't be more help though.

On november 2nd,2006,my wife caled the embassy regarding her visa, the embassy told my wife that her visa was there, but they needed an updated NB! check first, so my wife hand carried up to the embassy,expecting to recieve her visa, but they told her just to wait again,it's now the 22 of november, and there still has been no word on her visa, we have ask me congresswoman to do a follow-up on it, in hopes of at least finding out what the hold up is.

I think it makes no sense at all to wait! What if they want something more after you send it in or there is a problem with any of your documents? Then you will have delayed a month or more in getting your interview. There is no reason to wait.

If it will make you feel better I would call. But personally, if they are going to deny a petition that you asked to be canceled, I wouldn't worry about it. As long as you have the NOA1 for the I130, and that's what your pursuing then I think your okay.

The reason you might not have received any advice is that there isn't really a certain answer to this, it's just what makes you feel better. I can't imagine how it would cause any risk to the petition you are pursuing if you choose to ignore the letter. And calling them is likely to be a waste of time since most of the operators don't seem to know what they are talking about :) But it's up to you, good luck with the I130!

That means that your K3 petition has been approved, it will now go to the NVC for 2-4 weeks and then be forwaded to the embassy.

The K3 is considered an inferior visa, as it is a non-immigrant visa, that was designed to bring the beneficiary to the U.S. faster. If the I130 arrives at the embassy after the K3 it will override the K3 and the embassy usually just cancels the K3.

the last i heard is that my I-129F has been approved... what does that mean? :D

It sounds like you have an approved I130 petition. The K3 is a nonimmigrant visa.

Once you pay the fee, the NVC will complete processing the petition and then forward it to your local consulate for an interview. If you are approved you will enter the U.S. as a Permanent Resident (possibly limited if you have been married for less than 2 years.) and will be issued a green card. Is your husband also confused about what is happening?

as far as i know... we have submitted the I-129F and the I-130... unfortunately i have no idea of any response from the visa center... my hubby first paid $70 and then i was sent this pack for the Immigrant Visa Application Processing Fee Bill which indicates that we should be paying $380 for application processing fee and security charge.... that is all the information i have for you coz most of the paper work was brought by my hubby to the states with him.... thank you. :help:

The rules have been changed very recently, but if your approved I130 was already sent to the NVC then I don't think it will affect you.

If the NVC has not received the approved petition yet, you might fall into the new requirement of having to file a petition for further action to have your I130 sent to the NVC. Sorry I can't help you, I hope for your sake it's soon - you really are so close. And I believe most embassies send out the appointment letter about a month before the interview, so hopefully you'll hear something soon!

The only thing I saw on timelines was time from NOA2 to Interview unfortunately. I guess you could subtract how many days it's been since your NOA2 from that number to get some idea.

Also, maybe people in the regional forum would have a clearer idea of this :)


I call NVC, and all they say is that my case was complete September 28 and that it has not yet been sent to Manila.

Manila only has so many openings. NVC operators refuse to give any hint at all of what months people were last sent on to Manila.

Anyone here have any idea how long between "case completed" and forwarding to Manila?

I tried looking at the NVC timelines. I do not understand it, I guess. There isn't a date entry for "case completed at NVC" and "case sent to Manila" there.
