m&n - I know it's hard not to get cynical going through this process - but I'm not sure they're quite that evil :) And if people don't file the I129F then the I824 won't be needed, as the I130 is only retained if there is an approved I129F petition (from what I've seen)... so basically if they keep doing the I130's faster they won't get money for the I129F or the I824.

Exactly, how are you supposed to opt out of it when the customer service reps don't even know what it is you are choosing to opt out of?!?!

I think it is just a policy to ensure that revenue keeps pouring in.....maybe, since now I130 applications are being processed faster.....people won't even bother petitioning for the K-3.....perhaps they lost money because of this....maybe fewer people filed for K-3's......and so, to recover the money they lost they added the clause of ...... well, if you want your immigrant petition to eventually get to NVC..... just dish out another $200.....unfortuately, those paying.....paying both by money and lost time.....are those that filed for the K-3 and paid it's fee as well......

The policy itself makes sense, since most people who get an approved I129F will enter on the K3 and adjust status.

What really isn't fair is that the new policy was backdated and the I130 form was not edited, so even though the press release says you can opt out of the presumption, it seems very difficult (or impossible for those of us who have already filed).

From what I've seen, the very first thing before worrying about it, is to check with the consulate regarding whether you will even be permitted to be there for interview - apparently many consulates won't let the spouse in for the interview.

Apart from that, many people seem to feel like it will make them more comfortable, and with this stressful process that can only be a good thing. Finally, there is a (probably small) chance that there will be a question that one spouse knows the answer to that the other doesn't, and you may be able to provide the response immediately.

All in all, it seems like whatever will work best for you is what you should do :)

The DS-230 finally came and I am thinking ahead a bit. I was wondering if it would be good to attend the interview with my husband or not when the time comes? Keep in mind that I don't know for sure if I can be in there with him but I was wondering if it is an advantage to have your spouse there during the interview? Any suggestions, thoughts, etc would be appreciated. Thanks!

Congrats, that's great news :) You've had a long wait!

I called the automated # yesterday and they said the case was completed. Then today I talked with a nice lady at NVC and she said the case was actually completed 1-19-07, now she said they just put all the case together and send to the embassy within the week...........finally the wait is coming to an end!!!!

I would talk to you lawyer and see if he/she is willing to do any of them - the choice of agent especially can save a few weeks and is the very first thing that happens.

Whether or not you file a I129F at this point is really a matter of personal choice. If you main priority is to get your wife here the fastest, without regard to some additional cost and whether or not she will be able to work immediately when she gets here... then certainly file the I129F. It would be smart to decide soon though, the longer the I130 is pending, the less sense it makes it try the I129F.

Well, hopefully I can cheer you up a bit :)

I received my U.S. citizenship on 9/26 of last year. I called them 3 days later to upgrade. I was given a reference number also (that sounds ridiculous about her saying they aren't supposed to give them out!!). I believe I was told to call 30 days later - I referenced the number and was told that it would be sent as a second request. There was activity on my file in the next day, and I received a letter a week or so later confirming my call. Oh, and the second time they did tell me to call back in 45 days if nothing had happened. My case was approved about 6 weeks after that. Hopefully your request will work this second time :)

September may or may not be wishful thinking, depending on which consulate you are going through and whether you decide to file a I129F.

Your wife will still need to choose an agent at the NVC, having a lawyer does not allow you to skip a step unfortunately - but, if you follow James' shortcuts, as I did, you can email the choice of agent on the same day the form is generated, and this can save a good amount of time.

Amarceau, Maybe if you change JG's just include a note that it was changed by choice, since the originally given date gives a more accurate impression of the waiting time. :)

amarceau, care to change my interview date? It's now Dec 14th. We inquired about a change via email and the consulate gave us the new date. It was with mixed emotions that this happened, but we're thankful God made the decision for us and we don't have to second guess which option was better.

I checked the site several times. It still says (on my computer screen, anyway) that Vermont is processing I-130s for spouses for December 24, 2006. I reloaded the page. What URL are you looking at? I went to WWW.USCIS.GOV and clicked processing dates, then chose the Vermont Service Center and scrolled down to look at I130s. What URL are you looking at and how are you getting there?



lol - I was starting to wonder if I was crazy -- but after I closed out of all my internet explorer windows, and THEN went back to uscis.gov -- the dates had updated! very bizarre.

Good morning all,

I have tried to find an answer to this but am still uncertain.

I am currently a PR, and have filed a I-130 for my husband.

I have my citizenship interview on July 12 - and hopefully will be naturalized next month.

What is the best way to update the I-130 to show that it has been filed by a citizen? I found one website with a fax number and form to submit to the CSC - but haven't seen this anywhere else.

My current plan is to call the 1-800 number on the day I take the oath to tell them, and mail a copy of my certificate to the CSC.

I am in almost the exact same boat -- my citizenship ceremony will be on the 22nd. I read on the uscis website that you should call the INS 1-800 number and inform them that you are now a citizen. I'm hoping that they will tell me exactly how to address the copy of the naturalization certificate I need to send in.

I'm also planning on sending in the K3 application that day -- even though we are broke I figure the extra expense is worth it if it gets us back together even a month or two faster.

This is my first post here. I spent the few days reading and I feel I need some clarification. I have applied for my spouse an I-130this year around March 2006 using LPR .I will become a US citizen on Sept 18th 2006 and planning to upgrade my wife petition to USC Immediate . My spouse is outside USA currently Residing in India.

Im Need ing your expert Guidelines for upgrading my I 130 petition for my wife, I wanted to Fedex all documents on same day i take oath. Its been 16 months without my sweets ....its been really hard and wanted this to end soon.

I also wanted to File for I 129F just in case if I 130 takes up more time.I have seen some positive signs around the forum that I 130 getting approved earlier and faster.

the key is that the K-3 is a NON-immigrant visa, it just allows your spouse to come to the country temporarily until you can get them immigrant status. It would be nice if there was just one quick & easy way :)


Yeah...my logic wants to argue that once she enters on the K-3 she will be a permanent resident thus her residence will be in the US, so, she should be able to take her IR-1 here. Hehe...I obviously have not edured to really learn the whole AOS process.

Almost all of the advice given so far applies in exactly the same way to visiting (either you or your fiancee - to Canada or the U.S.). There is no guarantee but as long as you have evidence of your continued residence in your own country you will probably be okay.

I personally refused to cross the border with my husband for over a year b/c we had a lot more trouble when we did so, but in August he came down with me for a vacation - he brought a letter from his employer that he had to be back at work on a specific day. We were questioned for several minutes, but then the border guard said we were doing exactly what we were supposed to and let us in. Hope this helps.


A two-part question then...

I'm visiting my fiancee (and her family) this Christmas. When the Canadian agents at the airport ask me what the nature of my trip is ("business or pleasure?") and I tell them "pleasure" and they ask more about it, do I divulge I'm going to see my fiancee? Would that keep me out of Canada? :unsure:

On the second half of the trip, my fiancee and I are headed down to the U.S. to be with my family. I shouldn't have a problem getting through customs; however, when they ask my fiancee the same questions the Canadian customs agents asked me, what should she say? If she says she's visiting her fiance's family, would that keep her out of the United States? :o

I don't want to lie when crossing the border. Neither does my fiancee. However, we also don't want to be barred from seeing each other or have our vacation plans ruined this winter. So what do we do?

From everything I have ever seen or heard & been told by USCIS officials - it is NOT illegal to enter the U.S. to marry a citizen -- the problem is intent to stay - and that of course is what you will have a very difficult time showing.

You must be able to show a great deal of convincing evidence to convince the border guard that she actually will leave the U.S. after the wedding.

From my impression on these boards - and not personal experience, as you can see from my timeline - people seem to call the relevant embassy/consulate for info without much hassle or repercutions -- as long as you aren't callig every day, it seems very reasonable to me to call them at this point. Hi, my wife and I are going through the CR1 route which we started back in September. We sent off the Affidavit of support a few months back, got it returned for errors and sent it back to them after fixing them about 3 weeks ago. I've been told that I need to start e-mailing the US embassy asking if they've received my case etc as soon as possible, but as I don' t really want to keep emailing them before they even get the case I was wondering if there was a rule of thumb as to how long to wait?

My wife is from the US and I'm from the UK so it will be the London Embassy it gets sent to. Am I waiting on them to send her some notification to say it's been sent on with various details like a case number or something or will we not receive anything like that? We start the K-3 method and that got transfered to London really fast but as the I-130 got approved a few weeks after the I-29F we decided to go the CR-1 method instead so we could get the majority of the paperwork out of the way whilst I was still working. Kind of regretting it now as we've been apart so long :(

Any advice would be most appreciated.

But at least it's not a huge difference - and believe me I feel that 2 weeks is significant, and if I could somehow get my husband here 2 weeks faster I would do almost anything - but at least you are very very close! good luck & I hope the rest of the process goes smoothly!!


When I first called to check on the status of our case it said in tow to four weeks, know its chainged to four to six weeks, why is this???????

Also - I wanted to make a slight correction -- you don't HAVE to return for the CR1 if you come to the U.S. on the K3... you have the option of staying and Adjusting Status to get your Green Card. At least things are moving for you :)

You'll need a police report for each interview. (Not sure if UKers send one in to the NVC for the CR-1, Canadians do.) And ask your Dr for an extra copy of the medical report. The one in Vancouver gave me two for the price of one, and told me to keep the x-ray for the CR-1 interview in Montreal. :)

He was at the embassy in Frankfurt for an hour and a half, they didn't ask him any questions about our relationship, didn't want to look at our photos, phone records or anything. The counsul just went over the paperwork, had him swear and oath and said everything is ok, go to the doctor.

All that anxiety and there was nothing to it.

I would absolutely without question wait until after November 5. The less hassle of immigration forms and fees and bureaucracy the better!! Unless he is urgently needed here, I would wait.

If he does wait of course he should make really sure that they process him with the proper status when he arrives!

The hubster should be getting his visa tomorrow, the mailman left a note that he has mail, he's pretty sure it has tob e the visa. Our 2nd anniversary is on November 5th. The debate is, should he come in next week as a CR1 and we'll have to do the AOS in 2 years (less 3 months) or should we hold off until after our anniversary so that he can enter as an IR1 so we don't have to bother with the AOS. That is, assuming I am understanding things correctly.

I'd appreciate any advice, what would you do? Thanks, as always, your help is much appreciated. :)
