IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about the documents for an interview.
If they are asking for the transcripts, why not get them? I've never had trouble ordering transcripts before. Or if you think it's an unreasonable request, then by all means call the consulate.

No, the transcript only states that the numbers of credits I got from other institutions. I was expecting that it states all the classes I took from other colleges :(

IR-1 / CR-1 Spouse Visa Process & ProceduresVisits to the US
Some border guards seem confused as to the implications of an approved petition, and rather than seeing it as evidence that you are doing the right thing, think it means you can't enter the U.S. I don't think this is a common problem, but it has happened.

In addition, I have heard that additional border crossings can trigger more security checks, but again, many people don't seem to encounter this.

So as usual, just be aware that she may be denied entry, and I guess whether you are concerned about the possibility (which is apparently not large) of additional delays for security checks.

IR-1 / CR-1 Spouse Visa Process & ProceduresAPPROVED NOA2
My bad, I really need to stop posting for awhile, I can't keep track of what forum I'm in :) I really thought this was a K3 approval, never mind my advice!

What is next,

First NVC will assign you a case number and in about 1-2 weeks after assigning the case number. Call NVC is two weeks and enter your WAC number in. It will tell you if your case has been recieved. Then they will generate DS 3032 and AOS Fee Bill. Send those only after NVC will generate those above. You can have your spouse email the choice of agent to save time.

I hope this helps.

IR-1 / CR-1 Spouse Visa Process & ProceduresYAY!! APPROVED!!
Thanks for the congratulations!

Bosnia - I've personally never heard of anyone filing the I824 at the same time as the I130. In the past it was unnecessary b/c USCIS would automatically send approved I130's to NVC. I'm not sure - but we are in pretty much the exact same situation, approved I130, but not I129F, hopefully they will just send our approved petitions to NVC asap :) Congrats on your approval too!

Congratulations!!!!!

we have send I-824 together with I-130. We have originally filed those forms for DCF, but we did not have time to wait for appointment at the cosulat, so my husband took those forms with him in USA. So we have send I-824 together with I-130. Will we have to fill it again? I am not sure will they ask the same form again. Anyone done something like this???

On December 6, 2006, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

SO SO Happy :) Now I just need to figure out this I824 thing - I really hope it doesn't add a significant amount of time. I'm thinking about just sending it in right away, rather than waiting to see if they decide to send it to NVC.

Hope everyone else gets good new soon!!

If you already have an approved I130 and are pursuing that, you will enter the U.S. as a permanent resident after your interview in Montreal and will not have to deal with the I485 or AOS.

If you enter on a K3, then you would have to either AOS or return to Montreal for the consular processing of the I130.

That's good to know, thanks Lorelle. I'm not particulary excited about having to file an I-824 (if I do have to) - but I would rather know I had to do it than just be left wondering.

Riblet

To my knowledge there has been posts of members that have received the NOA2 with wording that if they wished the approved I-130 to be transferred to NVC that they would need to file the I-824.

Our Mao, that's exactly why we're pursuing the CR1. If we did happen to get a K3 faster, my husband was going to come down, apply for EAD, and then go back to Canada and keep working up there until he could work down here. At this point, even if K3 gets approved, that + applying for EAD would take about the same as getting a green card, and green card is obviously much better :)

It seems that you definitely can pursue both still, you just have to file the I824 to continue pursuing the CR/IR1.

I definitely don't think the I129F would be considered abandoned - I haven't seen anything that would give that impression.

It's not that there is a risk to only being on the K3 track, it's just that in my case, I would rather pursue the CR1 at this point.

I called because now that my I130 is approved, I don't want to wait around to find out if it will be sent to the NVC.

I was expecting a lot of nonsense, but the agent I spoke with really impressed me, although of course he could still be wrong :)

Anyway, he said that the approval notice should indicate whether the approved petition is being forwarded to the NVC or being retained (he knew about the new policy). I hope this is true, my concern was that the approval notice would be the standard form they've been mailing out for ages, and that there would be no way to really know immediately whether it was being forwarded or retained. I guess we'll see, but it makes me feel a bit better. Otherwise I was thinking about just filing the I824 as soon as I received the NOA2 just in case. I really don't want any more delays!

Just wanted to share in case this information is useful to anyone. I would be interested to hear if anyone actually does receive a notice that their approved petition is being retained.

IR-1 / CR-1 Spouse Visa Process & ProceduresJames' Shortcut
The September expiration date has nothing to do with whether it is valid for use by the public, it refers to internal administrative review of forms. So not to worry, the forms on the USCIS website are the most recent.

Soulm,

I need your advice. :help:

I see that you have submitted your I-864 forms after October.

May I ask what I-864 version did you use?

This the only I-864 that I found: http://www.uscis.gov.../form/I-864.pdf
I-864 - Affidavit of Support

And it expires on Sept. 30, 2006.
Is this the same form that you used?
If not, what I-864 version should I use. I would like to try Jamie's shortcuts in submitting the I-864 and I-864A.?

Thanks so much!

same here, we used james shortcut w/ no problem and things flew thru nvc even faster than we had anticipated. i did use the heaviest plain white paper i could find just so it wouldn't be so flimsy. good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Child - What doc's required
Did your ex sign the amended agreement? And was it filed with the court? I would think (although I don't know) that you would need a certified copy that it has actually been filed with the court.

My daughter DS-230 is coming down the pipeline and I am curious if anyone knows what documentation will be required to support that I have the right to take her with me.

I have a seperation agreement which states that I share joint custody, however, she resides with me except for twice a year. This document is notarized by my lawyer. I also have an amending document which outlines that I have the right to take my daughter to the US permanently. It however is only witnessed by his/my lawyer.

Is this sufficient or does the amended agreement require notorization?

Thanks in advance for input!

I know that those who enter on K1 or K3 and Adjust Status just have to have the shots done before the Adjustment of Status (interview time I think)... that's why I'm more confused about the IR/CR1 route, as your husband would enter with a Green Card, and not adjust status. IR-1 / CR-1 Spouse Visa Process & ProceduresVaccinations to be taken
It makes me wonder if this doctor is hoping to get additional money by performing the vaccinations - the doctor should already know what vaccinations are required, it's standard. I've seen many people get their vaccinations done before the exam, as long as you have proof that you've had them done, then the civil surgeon should accept that.

My husband has had all his shots, but doesn't have proof, so he's just going to have the titre done beforehand to show that he has had them done.

IR-1 / CR-1 Spouse Visa Process & ProceduresTax Transcripts for I-864
I was just reading the instructions again (for the I864) and it doesn't look like you need tax transcripts for that either. It states:

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

I know they revised the requirements relatively recently, so there is a lot of confusing information out there. But looks like the current I864 doesn't require tax transcripts :)

Also, for self-employed:

"If you checked box 22(b ) (self-employed), you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business),Schedule D (Capital Gains), Schedule E (SupplementalIncome or Loss) or Schedule F (Profit or Loss from Farming). You must include each and every Form 1040 Schedule, if any, that you filed with your Federal tax return."

All of this is on page 8 of the instructions.

Hope this helps someone!

N/A would be correct if there are no other persons mentioned in 14 or 19 because then that question would not apply to you.

My understanding also is that Fed Ex does not deliver to P.O. Boxes - and U.S. Priority mail is very affordable and fast. USPS also has Express Mail which is guaranteed overnight, and delivers to P.O. boxes :)

Good luck with the rest of the process, hope I'll be at the same stage soon!

If they are not convinced your relationship is genuine, or she has some sort of waiver issue, those would be grounds for denial. But it sounds like she has plenty to show evidence of a relationship, hopefully everything will be fine.

Good luck & hopefully you will be together soon!

My wife has her interview tomorrow in Islamabad. She is taking the following items for our marriage evidence;

- Marriage Certificate
- Wedding Video
- Wedding Photo Album
- Phone Bills
- Gift Receipts
- Calling Cards

I also have a Co-Sponsor as well and our income meet the requirements.

Is there still a reason why the consulate can still deny her visa? Thanks.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfusion about Fee Bill
If the Petitioner is the Agent, then the Petitioner will receive the IV fee bill.

The beneficiary pays the IV bill?

I thought that the choice of agent form was so the beneficiary chooses who gets the mail. If the beneficiary chose her husband/petitioner in the USA, as her choice of agent, he will ge the IV bill, right?

Petitioner usually pays it, right? I don't know....... just what I thought. For my husband to come up with $380 in US money.... I dont know about the conversions from where u are.....

IR-1 / CR-1 Spouse Visa Process & ProceduresConfusion about Fee Bill
Petitioner is required to pay the Affidavit of Support fee which is $70.

Beneficiary is required to pay the Immigrant Visa Fee, which is $380 I believe.

So if your husband received something saying everything was paid, it was only everything he had to pay. You are still required to pay the Immigrant Visa fee.

I'm guessing this is what is causing the confusion. Have you looked at the NVC flowchart?

IR-1 / CR-1 Spouse Visa Process & ProceduresK3 switch to CR-1
Well Yodrak - what would you consider the first step in applying for the CR/IR1? My understanding is that you must first file the I130, and as that's the first step in the process, I guess in the way I speak I would say that was applying for it. Sorry if I wasn't clear enough, or is there some other way to initiate the application process for the CR/IR1?

riblet,

How do you figure that? He can't apply for the visa until the I-130 petition has been approved, and there is no indication in his profile or his posts that the petition has been approved.

Luckily for you, you have already applied for the CR1 visa

IR-1 / CR-1 Spouse Visa Process & ProceduresK3 switch to CR-1
I'm still slightly confused about the Affidavit of Support - I know the emphasis is on recent income, but I can't remember if that is just the most recent tax year or even more recent. Check out the I864EZ form and I864 on the USCIS site to make sure.

For police certificate, for Immigrant visa has to be 1 year or more, and for K visa has to be 6 months or more as far as I recall. I know I've seen this recently.

I'm avoiding studying for law school exams right now, so I'm quite happy to be distracted :)

By the way, do you know how to check the status of your petitions online? I wasn't sure from the way you were discussing things if you did or not.
ribletFemaleCanada2006-12-11 22:18:00
IR-1 / CR-1 Spouse Visa Process & ProceduresK3 switch to CR-1
Luckily for you, you have already applied for the CR1 visa :)

In order to file for the K3, you must first file the I130, which is the petition for the CR/IR1. Many many people pursue both, and just pick whichever goes faster. You don't really have to do anything, but just watch both. Although, there is a new policy in which the USCIS may presume that you are going to come in on the K3 and Adjust status, if that is the case, when your I130 is approved they will retain it, but you can ask to have it forwarded to the NVC, which should then send it on to London.

Generally the CR1 takes a few months or so longer, but you are work authorized upon entering the U.S.

Hope this clears up some of your questions, feel free to ask if you have anymore, or if I've been confusing.

Hi Everyone,

We have filed our K3 visa application but thanks to the help provided on one of the other topic boards we found out that this probably wasn't the best option for us and our lawyer neglected to tell us.
We where married in British Columbia earlier this year and our lawyer neglected to tell us that I would have to fly to BC for my interview at the consulate instead of being able to do it in London where I now live.
Has anyone else filed a K3 visa and then had to switch it to a CR-1 visa during the process because of the above reason? If you have could you share with me how you would go about doing this from London? I understand from reading this site you have the option to switch to the CR-1 visa during the process. Could you also tell me how long the process will take whilst in the UK for the CR-1 visa? Does it take considerably more time than a K3 being filed in Canada ?

Any guidance would be very much appreciated.

Thanks

ToTheUSA
