My understanding is that IR2's receive a green card just like an IR1, so the answer would be that she doesn't need a work permit, she is already authorized to work and just needs to apply for her SSN.

A stepchild (ukrainian) in the US on IR-2 Visa. Can she get SS number and work permit? Is it one of those maybe yes maybe no deals or just a matter of application?

That's exactly the email I got today, and my case was complete this week :) I would say 10 days is possible - super fast but possible :) It's not that much of a stretch from 14 days including weekends like it took for mine.

I wouldn't worry too much... many people get this message when nothing is actually missing. I was expecting it, but it still made me nervous! I thought the same thing, either I somehow missed a detail on the DS230 or there was a problem with the DS230.

For some reason, NVC automatically sends out a request for the DS230 about a week or two after it's generated. When I received the mail, that's all they were requesting - the DS230. My case was complete the next day.

Of course it's possible you're actually getting an RFE, but at this point, try not to worry too much, it's actually pretty common :)

221(g) can be administrative processing (security checks) or that there is some missing evidence - but if they didn't ask for extra evidence, maybe they are doing additional security checks.

That really sucks! I wonder if it has anything to do with the new Adam Walsh law?

You can continue to pursue both, it's up to you. But my understanding is that once the consulate receives the CR1, it will automatically cancel the K3...and since you are so close to having your case complete at the NVC, it might be a waste of $100. It would make sense to look at the timelines to decide which interview is likely to come sooner.

Many people are able to buy an additional copy of the medical exam from the physician who performed it, try contacting them. It varies, but is often only $25 or $50 - much less than another exam.

We will be returning to Taiwan for my wife's CR-1 interview in 2 weeks, she got her K-3 visa in August, 2006. We finally got an e-mail from the embassy in Taiwan about using the results of my wife's K-3 medical for our CR-1. The embassy said the K-3 medical exam result can be used if they are less than a year old BUT MUST be sealed by the hospital.

I believe that for birth certificates/passports all you need is Either the birth certificate OR all pages of the passport of the U.S. citizen - you do not need this for the beneficiary.

Other than that, as I mentioned in the other post - the new I130 instructions do not mention photographs, but if you want to include that as additional evidence that's your choice :)

I called the NVC this morning and we have an interview date for April 25, 2007.

I agree with CutienPurg.

I also wanted to mention that you do not need to order tax transcripts if the sponsors have copies of last years tax returns (as most people do). A photocopy of a tax return is totally acceptable.

Also, only one year is necessary, not three. The additional two are optional.

By the time your case reaches NVC your husband and father-in-law will likely have filed their taxes already, so if they don't have copies of last year's return, they can just make a copy of this years and that should be all you need.

As I said before, I would not send 2005, but if you do you still don't have to get a transcript, because you can send a copy of that return as well.


do you mean just make a copy of the taxform itself for 2006, the one u send in to IRS? and then maybe copies of our W-2's? and then get the transcript for 2005?

If your 2006 taxes are good enough, just send a copy of that, don't bother with more.

And unless you've lost your copy of your 2005 return, you don't need a tax transcript. (If you decide you really want to send 2005, but as I said one year is fine!)

I agree with CutienPurg - you do not need a transcript, just file your taxes and submit a photocopoy of your return.

I personally think you should file your taxes, make a copy and send that.

Ive said this is several threads and I really believe 2006 are what is being considered current. Here's my thinking ....

All tax info is required to be sent to the tax payer by Jan 31. So after say mid- Feb, a person should have had ample time to file taxes. Not having filed by now is more of a choice. Plus, considering you lack income for 2004 , as long as 2006 was good , it would be to your benefit to show it.

Anyway , that's just my 2 penny opinion.......

deemabrouk: only the actual NOA2 indicates whether an I130 petition has been approved or retained, not the website. With the new "streamlining" policy, if both the I129F and the I130 are approved, only the I129F should be forwarded to the NVC and the I130 will be retained until the spouse enters the U.S. and is ready to file for AOS - OR you can file an I824 and pay an additional $200 to have the I130 forwarded to the NVC, but I have not seen anyone have one approved yet.

I double checked, and I guess they don't have an example if you are filing the I130 on its own, not with the I485. I wouldn't put permanent resident unless you are adjusting status... that being said, this form is antiquated and appears to be almost a formality at this point. As long as you fill out it completely with no blanks, have an original signature, you should be okay. I'm guessing that since a lot of people don't have VJ for reference, a lot of different things get put in that box!

If you are just submitting the I130, then it makes sense that the form is being submitted in conjunction with an I130 petition for spouse. Good luck with the rest of the forms :)

Your wife falls into the following category:

Any alien (other than an alien lawfully admitted for permanent residence) who-

(I) was unlawfully present in the United States for a period of more than 180 days but less than 1 year, voluntarily departed the United States (whether or not pursuant to section 244(e)) prior to the commencement of proceedings under section 235(B)(1) or section 240, and again seeks admission within 3 years of the date of such alien's departure or removal,


SO, when you file an I130 for her either in Finland if that is option is available to you, or in the U.S., you will also need to submit a I212 Waiver. Check out the guides:

AND - as people have said, No, she wouldn't be subject to a 10 year ban, just 3 year - but if you file the waiver you'll probably be okay.

I would definitely look at the waiver process, I'm not sure what the actual likelihood of complications would be, but I know that at least one of the forms involved asks for a list of the dates of all visits to the U.S., so you would be revealing it at that point. I personally would try to deal with it rather than avoiding the issue and having it become a bigger deal later. And obviously you can't lie about it, and you don't want to look like you're hiding it.

If they are asking for the transcripts, why not get them? I've never had trouble ordering transcripts before. Or if you think it's an unreasonable request, then by all means call the consulate.

No, the transcript only states that the numbers of credits I got from other institutions. I was expecting that it states all the classes I took from other colleges :(
