I have not heard anywhere that it was going to change. It was still $70 back in December.

I am attempting to create my own AOS Fee Bill, using James "shortcuts" but don't know the current 2007 cost.
I never received mine and it was mailed a month ago.

Just an FYI, not sure if it was just my case, but I emailed the NVC last Wednesday because they had received my IV Fee Bill, but the system hadn't been updated. I received an email back yesterday saying that the DS-230 was generated January 29 -- but the phone system still hasn't updated!

Second, if it's an OMB expiration, it doesn't matter.

Why don't you just email the Choice of Agent? It really speeds things up.

It's your personal choice. Are you submitting any of the other suggested evidence? If not I would probaly send a couple of pictures, but if you are submitting any of the other evidence then I would not.

Photos are listed as any of the suggestions, and wedding pictures don't seem to fall into the category of "relevant documentation to establish that there is an ongoing marital union." But if you don't have anything else, I don't see how it can hurt.

She can actually submit the choice of agent via email, I really suggest doing this if she can. It saves alot of time. Check out the NVC Timesavers Thread pinned at the top of the NVC forum... the first several posts contain lots of great advice.

Most people suggest having the U.S. citizen be the choice of agent as this saves alot of time because mail can take so long to get other places. You can generate all of the forms that she has to fill them out and have them waiting to return by the time they are needed.

I just got an email saying my NOA2 was apporved. My wife is currently working at sea on the cruiselines but docks here every week. I am going to see her next week. Does she fill this out and sign it? Would it be better to have me in the U.S. as the agent or her as the agent in the Philippines? She will be back in the Philippines in March

I believe that in your case doing an updated I864 would be prudent, but don't submit it to NVC - they don't have your case anymore. I would have your husband bring it to Montreal. If you have time, I would file your taxes and that way you can show them the most up to date & complete info. If your income is still too low, I would also have your father update his.

I'm not positive about this, but I think I've seen people being requested to provide updated I864's when it's been a long time since they were submitted - especially now that it's a new year.

As for which version of the form to use - I would use the one on the USCIS site.

PLEASE update your timeline, everyone here relies on sharing information & it makes the timelines on the site more accurate.

When was your case complete at the NVC? I'm very curious as I'm trying to predict when my husband's interview will be.

Yes, you can travel on a 2-year(CR) or 10-year green card(IR), or a K3.

While there are restrictions on the Green Card dealing with abandoning your status, or long trips, which one should review upon receiving a Green Card, simple travel is not prohibited.

I have always heard that if the IR/CR1 and K3 are at the consulate at the same time, then the IR/CR1 takes priority and the consulate will automatically cancel the K3.

Some consulates take much longer to schedule one of the visas over the other, and some people have been able to switch their K3 interview to a CR1 interview if the consulate allows them to.

Your spouse does not have to go to two interviews, if the K3 interview occurs before the CR1 is at the consulate, then he/she can go to that, and then he/she can come to the U.S. and either file to adjust status, or return to their home country for the CR1 interview. Or maybe he/she will just have the CR1 interview if both visa applications are at the consulate at the same time.

There should be no way that the CR1 would be cancelled in favor of a K3 interview, as the CR1 is the superior visa. If you don't even want to bother with the K3 at this point, then I would just write to the consulate whenever they send you the packet for the K3, and tell them you are opting to just pursue the CR1.

You can print off the form with the fields completed and the fill in by hand the one's that did not fit. I did this, it's fine.

should i make a continuation sheet?? If so, HOW do i exactly?? Do I just print out a blank form and and complete the document and sign it...i couldnt understand the directions on the i-130 sheet

The timeline really depends on the individual consulate. But if your I130 was approved right now, it would probably take 3-4 or more months to case complete at the NVC. Then however long the wait is at your consulate... some are as few as 2 months some as long as a year.

Also it's possible that if you file the I129F now you could have an interview for the K3 by July. If you're anxious to have her come by a certain time, more than you're concerned about the additional cost of the I129F and then Adjustment of Status, go for it :)

This is not completely true. Per the IRS, you can file Head of Houshold if your have other dependents to qualify (such as a child) you.

That is not my question? My question is if I place IR1 on the documents rather than CR1 will I cause any unnecessary delays. The problem is that my wife is pregnant and I will bring her here the moment that the documents are finished. We were married June 5, 2005. I might just miss the 2 year mark.

All other documents were filed under the "conditional code".

My situation was slightly different - we just decided that we preferred to have my husband apply for his own SSN rather than have one automatically assigned b/c I've heard of delays - so we answered no to the assignment question, but the yes to disclosure pretty much because we didn't want to hide anything :)

Our case was not updated in the phone system till last night when I called the folks at NVC.
They said it was missed some how and not updated till last night. But they said our case was
Complete at NVC February 6. Whhheewwww....Finally.
Now lets hope the head aches and mishaps are done out, and Interviews on the way in the next few months.

I'm guessing they don't directly report it, but they definitely share information.

You will risk losing your U.S. residency if you take any action that could be interpreted as claiming to be a resident elsewhere (such as filing resident tax return in Canada)... so I would be very careful and decide which is more important to you.

the information you are discussing will all come much later. The first thing that must be filed, whichever route you decide to take, is form I-130.

If your priority is to be together as soon as possible and you are not concerned about delays in being able to work and additional fees for Adjustment of Status in the U.S., then you can also file a I-129F once you receive your receipt notice (NOA1) for the I-130 petition.

Please read the GUIDES on this site which discuss these two options.

Nope Rebeccajo, same cheque, we paid $380.00 but two different case numbers on the back of the cheque. The amount for the I-130 is $190.00 each. Jon again phoned USCIS and was told not to worry that there is a glitch in the system. Worry who's worrying :blink: :wacko: :angry:

Unfortunately that notice indicates that your I130 has been retained based on the new policy, and the only way to have it forwarded is to file the I824, which I have yet to see approved for anyone. They have basically made the choice for you that you will enter on K3 and adjust status in the U.S.

The I130 should only be retained if the I129F is approved before or at the same time as the I130.

USCIS now assumes that anyone who files the I129F would prefer to pursue the K3, so the odds are that your I130 will be retained.

I'm slightly confused by your post, have you been approved yet?

Yikes.... are you thinking, Riblet, that all of our I130's are now lost in limbo and our only choice is a K3? I just finished trying to understand the flow chart and James's shortcuts but does this new process means none of that will happen for me now? should I still try to see if NVC gives me a case number so I can follow the same timeline you did ie. case number followed by DS3032 and AOS fee bill or has all of this system been replaced with filling out this new I824 thingy. Help confused and scared!

Oops ..sorry to be confusing. I was a bit panicked by NY IZMIR's news. I HAVE been approved for both the I129 and the I130 at the same time from the California Service Center. I thought they were both then going to the NVC and I would follow the NVC flow chart from here on for the I130 and also follow up on the K3 to see which would happen quicker. My husband phoned to say the same notice arrived in the mail today that NY IZMER received ....saying the beneficiary was in the US and to apply for an I 824 if I needed to apply for a visa outside the US. I was wondering if that meant they have made a mistake with our petition and we cannot follow the usual I130 procedures...as you have. Do you think they have retained it in California and it's just a matter of contacting them and telling them to forward it to the NVC?
