HI,

The online case status for my I-129F is still showing "NAO2", however we have since received a notice
from the NVC in receipt of the I-129F and forwarding to the London embassy.

Is this normal operation for the MSCxxxx online case to no longer be updated?

I hope that's what that means, because that's what I did. But it didn't seem to make sense in the context of the rest of the news release. I thought they might mean something more than that, but I hope you're right. Anyway, I'll stop worrying about it now :)


I wonder what they mean by "unless the petitioner clearly indicates on Form I-130 that the beneficiary will use the consular process".

That really isn't much help for those of us that have already filed. Grr.

What they are saying is that one must clearly answer the second part of Q22 on the I-130 by listing the consulate they will be seeking a visa from.

I realize that in it's own way the USCIS is trying to make things more efficient, but I'm frustrated to have to do an extra step, as I've always intended that my husband would go back to Canada for the consular CR-1 interview - I really hope the new form doesn't have a fee, although I'm guessing it will :( I'm going to look into it later.

I've been up all night and too sleepy to take it all in, but the new procedures with the filing of the I-824, Application for Action on an Approved Application or Petition look like they could be interesting. Will have to absorb it later after some shut eye.

Actually, all K3 petitions are sent to the Chicago lockbox NOT to a local service center. This is in the instructions provided with the forms.

Also, to answer your question, some service centers are faster sometimes, sometimes not. Luckily you don't have to worry about it because you have no choice of where you send it, you have to send it to the required center.

You first put together the I-130 package and send it to your service center, it is listed in the instructions included with the I-130.

For you it is Texas Service Center

When you get your NOA1 for the I-130, you then prepare your I-129F package, and again send it to: Texas Service Center

For the I130 the instructions do not require a G325A for any child, just for spouse. It's in the instructions that come with the form.

For a child over 16 yr. old. G325A is not required? Somehow I got impression that for a child under 14 a G325A isn't required.

Ah, from your post I understood the baby was born after naturalization. I'm not entirely sure about what step you will have to take next to get the baby here with the mother, but regarding the G325A, my understanding is that form is only required for persons over the age of 14.

Okay, I just checked the I130 instructions, and there is no G325A required unless you are petitioning for a spouse. For a child, you need:

"A child and you are the father: Submit a copy of thechild's birth certificate showing both parents' names andyour marriage certificate."

I'm thinking that you need to file a I130 for your child. My understanding is that there must be one I130 per immigrant, and you can't use one for two people. Hopefully someone else has more experience with this.

I forgot to mention that the baby was born before I got naturalized. Does the Child Citizenship Act still apply here? I might be contradicting myself here about this issue. I went back and read about the Child Citizenship Act (http://travel.state....o/info_457.html) and I don't think my baby would be eligible, considering that she will be coming in the US on a non-immigrant visa. Maybe after the I-130 passes, it could be applied.

This brings back the question about the G-325A for the baby, on whether we need to fill one up for the baby or not.

I needed to add spaces to keep the editor from making an active link within the text.

I HATE the new website. I have not been able to log in through the old link since yesterday, I have to go to the new homepage and enter my case number on the bottom right. VERY annoying.

My main problem with the new site is that it will tell you how to do something, but has almost no links to take you there.

she did not receive a NOA from the USCIS, instead she received delivery confirmation from the post office,

It's not that unusual to wait a few weeks for a NOA1 - do you have a cancelled check? If so, you should be able to get the case number off of the back of the check.

And FYI for other people reading this post, you can waive the signature requirement - you still get confirmation that it was delivered if you feel okay about not getting a name. That's what I did anyway.

Can an EWI person adjust thier status while being in the U.S. also this person has an approved I-130 application that was filed back on 27 April 01. i thought that once you have an approval i-130, an EWI was covered under 245(I). Any help and thoughts are welcome.

MSC is your USCIS case number, you will have a new NVC case number - hopefully someone will pop on and tell you how to find out what it is :)


You can start calling NVC about a week after approvals to see when they receive. The k3 will get shipped out to embassy while nvc will generate AOS bill and Fee to you on the k1.

NVC can also confirm when the embassy receives the approved petition as well. I beleive I did receive a letter from nvc but it was nearly a month after and I had already called to confirm.

Since your k3 approved at the same time, it will beat the k1 to the embassy. You have a decision to make on whether to hedge your bet and pay the IV bill and AOS fee to the NVC or persue the k3 to get your spouse here. Those fees are non-refundable.

Delbros is a bit later, after your spouse completes medical and interview you are directed to pay a delbros fee for delivery of your approved visa.

NVC - For immigrant visa inquiries, call the National Visa Center at 603-334-0700, provide your case number to get update on your case.


When making a call to NVC, there is no options for case number start with MSCXXXXXXXXXX. Do all K-3 folks get case number start with MSC?

"Two weeks after you receive the NOA2 you can contact the NVC to see if they have received your approved I-129F. You can contact them at 603 334-0700. Their homepage is here. Welcome to the US Department of State! "

You might want to take a look at the flowchart to get an idea of the rest of the process too :)

And I checked elsewhere online, it looks like there is no toll-free number.

It sounds like you are prepared. I was originally going to pursue both K3 and CR1 till the end, no matter the cost, but at this point it really looks like there would be no point pursuing the K3 (for us that is). Good luck with your wife's interview!!

I really hope you're right, that would make me very happy :) I guess I saw one person who took a really long time, but there doesn't seem to be any rhyme or reason as to why things like that happen. It would be nice if there were more IR/CR1's through Montreal recently to get a better idea.

Couldn't get much help for the current situation however I can see some historical cases who went through Montreal embassy - but I don't think there is a back log that makes it too slow. Typical max. wait is 2 months for IR1/CR1 interviews.

Have you checked out the Canada forum lately? Montreal has been Really slow for quite awhile as far as I've seen, but I haven't seen so many IR/CR1s though.

Congratulations on the date. I am going to try this week to see if I hear something favourable. I am sensing Montreal embassy will not be that busy as I got no responses from anyone going through Montreal at this point - I know this forum has a fraction of people attending but in relative terms I think Montreal must not be that busy this time of the year.

My understanding is that for the K1, NVC does not do any processing but merely forwards it to the appropriate consulate. It sounds like you were reading what happens at the NVC for the CR/IR1 visa.

I looked over the FAQ's and I'm a little confused on how the process goes after you get the NOA2. Somethings I've read on the state department web site say I have to fill out an application for an immigrant visa and pay 380 dollars, but I thought that the K1 was considered a non immigrant visa.It also says they need photo copies of her passport.For the choice of agent form does my fiancee fill it out with me as the agent? That guidlines on the NVC forum seem to be for I130 applications, do I follow those or is my path different? Thanks for all the help so far, I couldn't have done this myself without you guys.

The shortcuts apply only to the I130.

K1's generally pass through the NVC very very quickly, so there is no need to do anything to speed it up.

You can call the NVC (the number is in the pinned "NVC Timesavers" thread at the top of this forum). They will be able to tell you if your I129F has arrived and when it leaves for the appropriate embassy. Please note - you will have to try to speak to an operator because I129F's are not dealt with in the automated voice system. Be prepared for a long hold time, I've heard that calling at 11:30 pm eastern works best, but after 2 days of calling I got through around 2pm eastern.
