A cover letter is optional, but can be helpful. It does not have to mention a K3 at all - that would be confusing - just state that you are filing a I130. I believe there is an example in the guides - and no it does not have to be notarized.

I personally have never heard of this happening. If he can't see anything wrong with the petitions I would suggest either hiring an attorney or making an infopass appointment to see if they will point out the problem.

Probably some of you know what it means. My husband is a n US citizen and he was applying for K-3 and K-4 for me and my daugher (we are in Russia) in March. We got NOA-1 for I-130 in May, so he sent I-129 papers immediately. A few weeks ago my husband called me saying that both packages from California and Missoury returned because "they couldn't verify spouse's address". Does anybody know what it means and why they came back? As I know they usually send a note asking to send them some additional papers or verifications, but none who has already gone through the whole process has ever heard of the return of papers.
Any ideas?

Answer to (1) your priority date will be when your petition was upgraded, not when it was filed.

Answer to (2), it's not really easy to say, take a look at the Immigration Timelines to get an indication of how long they are taking for Pakistan right now.

(3) You can continue to pursue your K3 until you actually get an interview for the IR/CR1, as they can be approved at the same time, but the IR/CR1 still requires processing at the NVC before being transferred to the Consulate.

(4) Next expect to wait :) Just read the guides, and you'll have a better idea of the process after approval.

Well, to all experienced people in this forum. I filed I-130 when I had Green card but recently I became US citizen. My questions are:

1) I did sent out papers to USCIS to they can upgrade my I-130, my priority date will be the day USCIS will recieve upgrade request or time I initially filed I-130?
2) I did filed I-129F (k3) to chicago and recently recieved letter stating they have transfer my I-129F to vermont for faster processing. Usually how long its take to get approval on I-129F (k3)?
3) What if I-130 approved before I-129F then what should I do?
4) What should I expect next after doing all above steps?

Your help is required, thank u in advance.

I stand by my answer of N/A - the question does not apply to me because my husband and I have never lived together therefore, not applicable. But I don't see how either answer could make a difference.

There is also the question regarding where the beneficiary intends to live, which should of indicates that he/she intends to live with the U.S. spouse.

wow this is an interesting question and answer. I origionaly had thought that this aould be an N/A anwswer....but the answer of not yet living together really makes sense. Can we get "the" correct answer to this question? I have not yet completed i130 forms yet. thank you very much fellow vjers!!

Can I write that he got from 10th july to 20 th july or from 15th april to 23th april or from 15th april to 10th july?

You do not need a fiance visa - but it is my impression that that visa is currently being processed faster than any of the others.

That being said - it is legal to get married in the U.S., but he may have trouble convincing the Border guards that he will be leaving again. He is not allowed to come to marry you with the intent to stay and process the papers in the U.S.

But you don't have to do both, if you get a K1, then he can Adjust status after the wedding.

Neither of us are too keen on having to wait for a fiance visa, then a spousal visa.
Can we just get married when he flys back out here and immediately apply for a K3?

That's exactly what I did. The only problem I've had (so far) is that it took them a month to upgrade the I130, but now they seem to be active on it. Maybe someone who's made it the entire way through the process will be able to share more.

In addition to the above poster, mine actually went the proper place (Missouri) and then it was transferred "for faster processing." Somehow it made me feel better that they definitely knew it was a spouse visa b/c they sent it to Missouri.

A few of us have had the Chicago staff send I129Fs for K3 visas to regional Service Centers. This seems to have started about Oct 18 - 2- this year.

As far as I can tell this is not normal . Mine got sent to Vermont. Normally only K1 petitions should be forwarded to the regional service centers if they were incorrectly sent to Chicago.

K3's used to be sent to Missouri, I believe. The few of us that have been affected by this are hoping its a "load sharing agreement" instead of a newbie staff member's goof up at Chicago.

I tried calling into someone at the national customer service numbers and they had no real info to give me other than to say that I should make an appointment at my local state office using Infopass (details of that procedure are at the BSIC homepage)

I'm not sure specifically about the TN, but unless it has some specific restrictions I think that since you are in the U.S. you need to Adjust Status by filing a I485.

You are so so lucky!!!! Omigosh :) It's just an incredibly luck coincidence, they are not related. I can only hope mine gets approved really soon too - mine was transferred to California on October 4.

Eventhough both have been approved, it is still possible that the interview for the K3 will be a month or more before the IR/CR1. Just keep pursuing both of them until you get an interview! Good luck!!

I have received emails from them (even multiples) but it's totally inconsistent. So I'm pretty sure it's not a spam blocker, just crazy USCIS :)

Agree their e-mail system is a crazy. I wonder if some spam filters might be stopping e-mails because of the duplicate transmittals.

Mine was transferred Oct. 4th, but I never received confirmation that it had been received - that doesn't really concern me, the email system is so crazy. Has anyone actually received a physical letter confirming receipt in California? I got the letter notifying me that it was being transferred, but not that it was actually received. Hopefully they're too busy working on it to send me one :)

From the posts I'm reading, it sounds as if the Chicago Service Center is collecting bunches of I-129Fs and sending them to other service centers at the same time. I guess I was lucky. My I-129F was received in California only 4 days after the e-mail notifying me that it was being transferred.

I totally disagree about the "living together" for two weeks. I think that is basically like lying on your application - would you ever tell someone, oh, I lived in country x for 2 weeks. No, you wouldn't. You would say you visited or stayed.

As for the A#, I too was confused about this, someone told me that you will always have an A#, so I put on it on the G325A.

Nationality/Citizenship would be American, but I'm sure it's not a big deal.

For the address, write her address if that's where you lived together, even if it was for 2 weeks. If you are filing for a K3, in most cases, you live apart. So they kind of expect it to be short (2 weeks, 1 month....)

I just asked, because if it is just some random person, and not anyone at the consulate then I would ignore it and not worry.

I don't actually know for sure, but if you sent everything on the checklist, I'm pretty sure you'll be fine :) If you are really worried I would suggest emailing the consulate to confirm, or just send it if that's possible.

Hi Everyone: I need your help if anyone can answer this for me. My husbands interview is set for November 16th our I-129F was approved I sent him all the necessary documents and information along in the packet. The question I have is this: The I-129F is approved I sent in the required information, my husband was told that he also needs the I-130 NOA's and packet also, I was told by USCIS today that this is not needed for the K-3 non immigrant Visa that the I-130 is for the Green card after he enters the USA then at which time we are to apply for the AOS that is when the I-130 approval is approved if the request for the I-130 package is not on the check list that was sent to him for his interview anyone please help please. Thank You

Before your wife gets a packet from Montreal, both you and she will get mailings from the NVC. Check the NVC's pages on the DoS web site to find out what takes place before the approved petition is sent to the consular section.

Hello friends!

I live in Arkansas.

In January 2006, I applied for a K-1 for my fiance who lives in Canada.

We decided to cancel our application and get married on August 5 in Canada.

So we married and I filed an I-130 for my wife who lives in Canada and it was received on September 7, 2006.

I filed an I-129F on October 16, 2006 with Chicago.

Today I received an I-130 approval and was informed that my application will be forwarded to NVC.

I thought the next thing I was to get was an I-129F approval.

Does this mean that I do not need to wait on an I-129 approval, but my wife will be getting a packet from Montreal before long?

I received the notice that it was being transferred, but never received confirmation that it was received.

I'm sure I'm being overly neurotic, but I was just wondering if I was the only one.

I know I shouldn't be letting myself get so impatient, but seeing people get approved really makes me more hopeful, and then I get disappointed when nothing happens. It is so early in the process, but we've already been apart for over a year. Oh well, it will be worth it in the end :)

As YuAndDan said, it is very difficult to give advice when we can't see the details of your applications, particularly when you applied. Regardless, if it has been less than 2 months it is still early in the wait.

There have been a few people approved very quickly, but the majority of people for K3 are 2 months or much more. Unfortunately there's not much you can do about right now :)


What is your immigration status? K-3, CR-1, AOS? Your profile is lacking that info, and it is hard to answer question with out seeing the big picture, also a timeline helps understand your case.


The I130 was last updated on 9/14. The I129 on 10/27....

Look at the top menu bar where it says Immigration Timelines, and search in there :) And there are no processing times listed for anywhere other than the Missouri center, so you can only look at the overall K3 processing times. They just started transferring K3 petitions to California and Vermont last month.



I received an email from USCIS stating that my I-129F was tranferred to the California Service Center and to check the processing times at that processing center on line. Well, I see the processing times for K-1 and K-2/I-129F-Fiance, but not for spouse?....Is it the same waiting period for fiancee as it is the spouse?


The processing times on the USCIS site are not real. Check the processing timelines section here as reported by fellow members for a better idea.


Okay.....where do I find those timelines?

I'm not entirely familiar with the J1, but I was researching it, and you should really look into the issue of the mandatory 2 year departure - it looks like you would need to apply for a waiver for that.

The online service and staff can only tell you exactly what you can already see on the online status, unfortunately.

I was just wondering if anyone have gone through voice prompt of USCIS's 800 number. After all those touches (Nov 1,2,3 and 4th) since the case has transfered to VSC on Oct 23rd, there no any updates and touches since then. I decided to call USCIS today and went through automated process. I was really hoping that my case has been approved already, instate my case is in pending and costumer service representative will not have no more information about my case..... you know what I mean! So I didn't think talking to CSR and hung up the phone. Anyone is experencing this kind of issue? Your imput will be highly appriciated.

Rickmt - the online processing dates appear to be almost meaningless, unless you are looking for a worst case scenario. The Immigration Timelines on this site are much more helpful for seeing an average processing time, although of course some take longer.

Yes ours started out in Nebraska and went to California, now it sits there because they are so back-up. If you look at their timeline they are now working on cases from May 2. 2006 not very incouraging. Ours was last touched on August 1, 2006.

Now that it is at the embassy in London, you would need to contact them by phone or email. Maybe try searching the forums, I know this info was given out recently - or check the UK Regional Forum.


Yes this is normal because NVC and the embassy are totally separate entities. The USCIS online status reflects only what the USCIS does. :)


Oh well so much for checking the case status online each morning... damn stupid really... why is it not
a connected up system.... :angry:
