If a lawyer says that she is clear to Adjust Status - that would obviously be ideal so that you are not separated. No one here can answer that for you because we don't know all the details, and no one wants to take that risk. If the lawyer says okay, you should be good to go.

As long as your father meets the financial requirements and is a citizen or permanent resident he can be a cosponsor.

As Yodrak said, you should have a consultation with a lawyer. You need to make sure that there are no impediments to Adjustment of Status. You don't necessarily need a lawyer for the whole process, but it would be a smart move to make sure there are no complications you are unaware of at the beginning.

What you've summarized seems to be the consensus of how people think things are going to work .... but the policy wasn't 100% clear when it was released, and it doesn't seem to be being fully applied yet. Just wanna know if i'm getting this correctly.--- USCIS holds an I130 only if an I129F gets approved first over the I130. But if an I130 has been approved first over the I129F, it (I130) will automatically goes to NVC for an IV process. If i am not getting it right, i hope I could get a clear explanation--PLS! How about if both I130 and I129F get approved at the same time, what's next?

not necessarily - K1's are often, although not always, faster. But you can't apply for K1 if you have never met.

wouldn't it be quicker and easier to get married there, apply for a k-3, come home and wait? rather than apply for a fiancee visa?

I'm not sure from your timeline if you have done any processing of the I130 at the NVC. If you haven't, you are probably looking at a minimum of 3 months and more likely 4 or 5 to complete processing of the I130 and get an interview. It looks like from the timelines on this site that from the time the I129F leaves the NVC to interview date is averaging 43 days.

I'm thinking that most people in your situation would choose to do the K3, unless they couldn't afford to be unemployed for a few months in the U.S. waiting for employment authorization (which is not an issue when entering on an IR/CR1).

Unfortunately there is a problem - it is impermissible to enter the U.S. with the intent to remain.

While she may be able to come visit, this too may be difficult as she will likely have to show convincing evidence that she intends to return to Guatemala.

Your only legal options are a K3 visa, a IR/CR1 visa or DCF if Guatemala allows this.

In your signature you have the words "Approval Notice" next to today's date... does the I797C you received say Approval Notice of I130 or something of the sort? 2 months to approval really isn't that unusual, just good luck :)

The notice that was mailed out to you on October 25 seems to fit the timeline to be a NOA1 which is also on a I797C, and it should say something like Receipt Notice.

Do you know that you don't have to file for K3? And if you were going to you should have done so with your initial receipt notice. It sounds to me like you have an approval notice for your I130.

Are you a resident of Columbia? If so, Direct Consular Filing of the I130 may be the fastest option if that is available in Columbia.

As long as there are no other complications with your case - which a brief consulatation with an attorney should clear up and be well worth, then you would just file for AOS (and EAD, AP, etc if you choose). No K3.

From the quote you've cited, it doesn't look like you would have to fill out a supplement - but I'm just basing it on that. I haven't really studied the I485 too much.

Welcome. Please read the guides, it will really help you out :)

Are you planning on staying in the country to Adjust Status? It would be helpful to know what sort of student visa you entered on as some have a period in which you must leave the U.S.

If you are filing for adjustment of status (AOS), it is generally a good idea to at least have a consultation with an attorney who can make sure there are no problems with you filing. The guide for AOS explains all the forms you can fill out, including the I765 which can be submitted at the same time as the I485.

You will NOT file a I129F unless you are planning on leaving the U.S. to await your interview.

It is completely normal that your case was transferred to CSC. All K3 petitions are now processed either in California or Vermont, but we are still supposed to file them at the old addresses.

Unfortunately that is the only number to call - the waiting time to speak to someone really varies, I believe Mondays and Tuesdays are the worst. If I were you I would call and confirm that they have your correct address since you didn't get your NOA1 - I would also check with your mail carrier to make sure that your name is on the box, as that has been known to cause issues with mail from USCIS.

Basically, once you receive the K3 from the consulate, your spouse can come to the U.S. THEN the option is to A return to their country when the I-130 appointment is made at the consulate OR B apply for AOS in the U.S.

If you can afford it, it will likely be fastest to return for the I-130 rather than apply for AOS. That is what my husband will do if we are fortunate enough to get the K3 approved quickly.



Hi all,

My wife is scheduled to have her interview for K-3 Visa 20th of this month. I just got an email notification that my I-130 petition has been approved as well (I'm out of town, travelling for work these days so have not gone back home to receive the paper approval notice yet).

My question is, what should we do? Should we go ahead with the k3 visa interview appointment or need to do something different now that I-130 has been approved as well? Does it matter either way?

We checked no for my husband although he was denied entry from Canada. My understanding of that question is that it is relating to actual formal proceedings, rather than a simple denial. A denial doesn't mean that you did anything wrong, just the official didn't feel he/she could allow allow you to enter the U.S. at that time.

There is a question that will be asked later, either on the DS156 or DS230, I can't remember which, that specifically asks whether you've ever been denied.

Sometimes they lose things... if I was you I would send in a copy of the marriage certificate, so if that's what they want, then there will be no delay. And I would also schedule an INFOPASS appointment to try to clarify if there was anything else -- are you sure it would take weeks? When I tried before it was only a week. I had to go to Cincinatti for fingerprinting before and it didn't seem too busy, but I might just have been lucky :)

Folks i Finally received the RFE in the mail today but i'm a bit confused as to what the are asking for. At the top it states to respond to the items checked but none of the items is actually checked by them leaaving me a bit confuse as to which one they are requesting. How ever under marriage certificate although it is not checked they have filled in my full name (maiden) and my husbands full name so i think that is what they need. All the other options are blank has any one encountered this before? Shuld i just send them the marriage certificate although i'm very sure i send it the last time. I called Customer service and they were not able to tell me which info was requested and suggested i do an infopass but that will take weeks. Any suggestions. thanx folks

From what I understand, it is up to the consulate/embassy to cancel the K3 if they have an approved 1-130. There is no reason for you to cancel your K3. Whichever arrives at the consulate first will be processed first, unless the K3 and I130 arrive around the same time, and then the consulate will just cancel the K3.

This is what I think happens from what I've read, but I'm sure additional opinions will be more helpful.

You can still follow through with both. You can use your K-3 and later return to Brazil for your interview for CR-1.

You can file your I-130 as a permanent resident, then upgrade the petition when you become a citizen.

You can't file the 1-129F until you are a citizen - but you need the NOA1 from the I-130 to file for the I-129F --- so if you've already filed, it might give you a 2-4 week shortening in time on the K3 b/c you can file on the day you become a citizen rather than waiting to get the I-130 NOA1 after your oath ceremony.

Why do you prefer the K3? If the I-130 comes first, it's generally preferred - your wife will have a green card when she enters the country. Also, my understanding is that once the approved I-130 arrives at the consulate they will cancel the K3 if it arrrives later.

on the USCIS.gov website, if you go to Case Status & Processing Timelines, you'll see the option to register on the left.

Once you've received your receipt notice you can register online -- apparently if you get your cancelled check the case number may be on the back, but you should receive the receipt notice pretty quickly anyway.

But - I've been registered online, sometimes they update it, sometimes they don't. Some people get emails, some people don't. You will get a letter when you are approved, so that's really the way you'll know :)

Amarceau -- I have never seen the requirement of the birth certificate of the foreign spouse, where did you find this? It just made me really nervous b/c I just filed my I-129F on Monday!

All you need to include with the K3 is your marriage certificate. You do not need to supply pictures as proof of your relationship. Here's a checklist of what you need to send with the K3

Required Supporting Documents for the I-129F Petition

From the U.S. Citizen:
• A Clear Copy of the I-130 I-797 Filing Receipt
• Copy of Birth Certificate for U.S. Citizen.
• Copy of Marriage Certificate:
• Copy of Complete Final Divorce Decree from all Previous Marriages - U.S. Citizen.
• 2 USCIS color photographs of U.S. Citizen.

I believe you can file the I-130 and I-129F from Greece - but hopefully someone else can confirm this.

You are correct that once he has his Green Card he must reside in the U.S. He can leave the U.S. for a maximum of 6 months (unless he applies for an extension) but even so he must maintain intent and evidence of residence in the U.S.

I've read thru different posts and FAQ's and I want to make sure I have it straight.

I am a USC married to a Greek residing in Greece with a 5 year residence permit. As it is, my husband does not hold a visa to visit the states (Greece is not part of the VWP). We do wish to immigrate back to the U.S. in about 2 years time but in the meantime we would like to visit my friends/family/home.

Do I have the following straight?

A K-3 is a NON-immigrant visa that is valid for 2(?) years. It is a multiple entry visa as long as the visa is still valid. Once we decide to immigrate, he enters again on his valid K-3 visa and we file I-485 for Adjustment of Status and he receives his GC..?.?

IF this is the correct route . . . I file a I-130 from here -- Athens. We both fill out G-325a... and then for a K-3 I have to file a I-129F petition..? I am able to do ALL of this without leaving Greece..?


OR.

I know that if we just decided to immigrate WITHOUT visiting prior we are able to file a DCF here in Athens. Assuming we were approved, we go to the U.S. within 6 months of approval, land and he is given a stamp and a GC shows up in the mail at some point. BUT we are required to be residing in the states from that point on, correct? Not leave and return for a visit once or twice a year, correct?

I think I am after a K3?? :blink:

First of all,Thanks to VJ members for providing such a useful information regarding Immigration Visas.I just received email notification about 2minutes ago stating our I-129F has been approved and now case will be sent to NVC for further immi processing!I also received the copy of I-129F in the mail today and noticed it already has Alien(a#) assigned to my wife/beneficiary!

Can you guys assist me further?At this point, what type of docs should I start collecting to send it to beneficiary?How Long willl it take Before NVC assign a Case No to our Visa and forward it to Beneficiary's Embassy?Please Advise.

If you can afford it, it appears that the best option is generally to pursue both. K3 only stays at the NVC for a very short time and then moves to the consulate. Whereas the I-130 can be at the NVC for much longer (sometimes 6 months) and then gets sent to the consulate.

If it's a difference of a couple months its worth it to me to pay the extra fees to get Michael here sooner, and then send him back for the I-130 later. And, if the K3 and the I-130 end up at the consulate at the same time the consulate will automatically switch to the I-130. Hope this helps a bit, I'm no expert, but this is what I'm going to do. And Congrats on both approvals!!!! :)



:D :D :D Got the email today that the I130 is approved. I am very happy about this, but also a little confused if any action should be taken on this. The I129f was just approved last week and hopefully has been forwarded on to the NVC. So what is to be done right now with the I130. Does that process continue on while the K3 is being approved. Do I need to pay the fee for this IV now? Will this speed up the adjustment of status process once Sam arrives here?

Thanks for any info about this. I have looked in the help areas, but am still confused on this issue.

Dipsticks -- when my naturalization went beyond the period in which I was told I could expect to hear from them, then I scheduled an Infopass appointment, and bam, two days later my approval was mailed out. I didn't even have to go to the appointment!

If you have the time I don't think it can hurt to go in and check - especially if they are outside their own range. I think it might be enough to bring someone's attention to your application, or not, but no harm trying :) Oh - and I personally don't think there's any point calling, as far as my experience has been, the people on the 1-800 line are pretty much useless.

oh man it sucked i was tempted so bad to con on here or check the status but Adiel was right.....nothing even happened while I was gone. Not even one touch. I think our 130 is past due now the 90 days we have a receipt notice for June 15th and the 129 has a notice for july 18, should I be calling now or do I keep on waiting?

I've often heard the explanation that a very early touch means that they are applying the payment when your check is cashed. We are only a day apart on timelines, and I was touched on 10-2, and I assumed that's what it was. Good luck :)

I am glad we got a touch today, having the 129F received on the 27th...I am just a bit paranoid that they may be requesting further evidence or something of that nature. I didnt receive an e-mail to say I have been touched and when I clicked on it, there was no status change. Am I just being paranoid? What could these touches mean? If they wanted further evidence, they would email or mail us right? Thanks for any help guys!

I don't believe there is any way to know what the touches mean. Our I130 didn't recieve any touches and then today I come home and check my email and there is the approval. So obviously they were working on it, but didn't show. I wouldn't get too excited about the touches only when you get the official approval notice!! Although I know our I129f was touched once before approval and made us feel so much better that at someone was doing something with it. It is very hard waiting and not knowing what is happening with your application, I know. :)

Congratulations!! And based on the posts I've been seeing 70 days isn't out of line - a lot of people have been getting them approved in about 60 days. Good luck with the rest of the process!!

Also, it looks like you applied with the new form if you applied after June - and there is no RFE necessarily required if you use the new form.

I have no idea why my case was approved so quickly. I noticed that October's time line K-3 visa's approval times have dropped sharply. Could this be the reason why my case was approved so quickly?

I did not get a RFE for my K-3. Is that normal?

I am more confused about this process than ever. However, I am tickled silly after getting the approval notice. So, perhaps I should let sleeping dogs lie.. haha...
