I'm pretty sure that once the NVC assigns a case number, that's the one the consulate/embassy uses from what I've seen.

I want to be sure i understand the case number you all are talking about.

I was assuming the case number is the same number givin by the NVC when it arrives at the NVC.

Is a other number assigned when it is sent to the Embassy?

I'm pretty sure that there's no more online systems, although some consulates apparently show the interviews online. With that case number you should be able to contact the appropriate consulate :) Congrats, it's getting closer!

Is the next step to call the embassy. I am currently in South Africa with my wife so I have been unable to check any mail on my side, and mail moves rather slowly over here... Is the case number so I can check with the embassy over the phone or is there a way I can track what is going on over the internet?

Congratulations on the approval, that's wonderful news :)

I'm guessing the fiance/spouse thing isn't a big deal. But I haven't seen an approval, so not sure :)

As for the note on your NOA2 for your I130, that is part of the new USCIS procedure. If you have an approved I129F they presume that your spouse will Adjsut Status in the U.S., so they don't send it to the NVC for processing.

I received the approval letter today. I had applied for an I-129F for my husband who is in Turkey.
On the NOA1, receipt letter, it states:

Case Type: I-129F - Petition for Fiance(e)/Spouse

But on the approval letter, it says:

Case Type: I-129F - Petition for Fiance(e)

Is that normal for them to drop the 'Spouse'? He is not my fiance anymore! hahah



Also, I also received the approval letter for his I-130 Petition, but something in the letter confuses me.
It states:

The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status.

I looked over my copy of the petition, nowhere does it indicate that he is in the USA but that he is living in Turkey.
Why would they say that? Is it because he will be receiving the K-3 visa, come to USA, and finish the immigration process in the USA
so his petition won't need to be sent to the embassy in Turkey? That he won't need to complete the process as if he was waiting the
whole process out while overseas?

I am a little confused. Please help!

The ideal situation would be to adjust status - but I know the best advice is generally to at least consult with an attorney to make sure that there aren't any barriers to you doing that.

My understanding is generally that it's okay if you enter and then decide to stay, because you didn't have immigrant intent when you entered. I guess it would be helpful to know if you lied at the border, because that would probably make it alot harder to adjust status.

I know it sucks, but believe me - NONE of us want to be separated form our spouses. My husband and I have been living apart for well over a year now, and it looks like it will be close to two years before we are finally together.

If you search the boards, I'm sure you will find someone recommending a free or cheap consulation with a lawyer.

Hey everyone, I am somewhat like the "Screwed up bigtime" dude, except not as screwed up....That thread stopped making sense to me so I decided I was worthy of a new thread....

So I am Canadian, and met and married my husband while he was going to school there. So, 1) we were married in Canada. Then, I easily slipped through the border with him, already knowing that we had avoided something important, but everyone in our family was telling us to do something different in regards to the immigration process. We were dumb and didn't do research ourselves, we just listened to his father. so 2) we are now living in an apartment here in the USofA. I have done NOTHING in regards to this immigration process but am desperate to do it legally and to be able to work in this country. I feel helpless and hopeless, not able to bring any money into our household...craigslist jobs aren't good enough, I have a degree and I want to use it. Anyways, unlike "Screwed up big time", I have been in the country for less than 6 months which I think is the tourist visa cut-off...so I have not overstayed in the country or worked in the country. But I don't want to be seperated from my husband, what do you suggest we do? What is our first step, everything seems so complicated, but the longer we procrastinate the bigger the Visa monster grows....

Actually, K3 CAN apply for work authorization before AOS. They are different from K1 :) And I heard from Yodrak that if you do it that way you will get a longer work authorization, so it sounds better to me :)

You can apply for your Social Security Card immediately at your local Social Security Administration office.

You can file a I765 for work authorization now, or when you Adjust Status to become a permanent resident. The advice here is that it is better to file the I765 for employment authorization before filing for Adjustment of Status (AOS), as the authorization will last longer.

I wouldn't go back to Canada unless your lawyer thinks it's necessary - if you do be prepared to be separated for at least 6 months. Or look into having your wife move to Canada, but I don't think that's much faster.

I'm pretty sure some people on here have talked about free or low cost consultations with attorneys, so you might want to look into that.

Also just think about how much more money you will have once you can legally work! I'm sure it's costing you a lot more, financially and emotionally, to be unable to work right now.

It would probably be worth at least a consultation with a lawyer, but if he/she doesn't see any serious complications then the best plan would likely be to Adjust Status without leaving the U.S. It happens alot, and at least it doesn't appear that you intended to come in and stay.

yes sir,... I plan to get married in March 2007 (go back to China and get married - have her sign the G-325A and give passport pictures).. then when I come back I will start to apply I-130 (and later I-129F) in start of April 2007... so hopefully she can come April 2008.. nothing is set in stone.. it may take longer or shorter.. but estimated time..

It just means they have your case... do you not know what pending means? If not, it just means they aren't working on your case yet but they have it.

The official timelines are pretty much useless in predicting. A lot of us thought there was a typo in the earlier I130 dates, which the new date would seem to confirm.

USCIS is trying to keep within 6 months - so that's pretty much all it means.

The Immigration Timelines on this site are much more useful. Check out the "Where K3 Stand" thread also to get a better idea of how things are moving.

That is an error with the old form, if you use the G325A from the USCIS website, it no longer does that. Whatever you put on the first page will carryover to the next 3. Are you applying for a K3? If so, in that case you would put something like Other: K3 Petition for Spouse.

Greetings to you all. This is my first post here as I begin the "journey".

On the second page of the G325A:

"This form is submitted in connection with and application for:"

-Naturalization
-Status as a perm. resident
-Other

My question is this: There are 4 G 325A forms and on the sample forms from this site Status as a perm resident is checked on the first of the four, while Naturalization is checked on the last three forms....please advise.

Both the K3 and the K1 have derivative visas for unmarried children under the age of 21. If they are listed on the I129F application, on they are eligible for a visa when the mother's is approved. My understanding is that it is unnecessary to file an additional application, and that when the approved K1 is forwarded to the consulate the child will be processed with the parent.

As far as timing, the immigration timelines on this site seem to indicate an average time of 2-3 months for K1 approval, and then another average 5 months until interview at consulate. So 7 to 8 months would probably be a reasonable estimate, although there is no way to be certain.

Good luck with everything, and hopefully someone else will confirm my understanding as I haven't dealt with this situation personally :)

We all know that it's possible and happens all the time.

What people are trying to advise you (not to put words in anyone's mouth) is that the USCIS may be suspicious of your wife's intentions and you may be asked to show proof that she did not in fact completely finalize all of her business at home before coming to the U.S. with the intent to stay in the U.S.

It probably would make sense to at least have a consultation with an attorney to go over the details of your situation.

It seems to be normal for it to take several weeks for the approved I129F to get to NVC. You can call NVC to check if they have received it.

I am also curious regarding your filing the I824 - did your I130 NOA2 indicate that it was being retained? It would only be necessary to file the I824 if you hope to interview for the CR1 in the Phillipines.

I am going to add you to the Tracking Approved I130s thread in the I130 forum. Not many people have had to file the I824 yet, so we really don't know how long it takes.

If a lawyer says that she is clear to Adjust Status - that would obviously be ideal so that you are not separated. No one here can answer that for you because we don't know all the details, and no one wants to take that risk. If the lawyer says okay, you should be good to go.

As long as your father meets the financial requirements and is a citizen or permanent resident he can be a cosponsor.
