I did not do this as is was not mentioned in the shortcuts on this site, and it didn't delay us :) I think the most important thing is the cover sheet.

Hi everyone,

I was just looking over the docs my husband sent to the NVC last month and read in the letter they sent about the I-864:

[i]"the case number must be written in the upper right hand corner of ALL documents. Failure to wite the applicants number on all documents will cause a delay in processing."[/i]

My husband did not do this!!

Has anyone not written the case number and had no delays?

I am worried now as I want an appointment in Sydney before July because "Due to the Asia-Pacific Economic Cooperation (APEC) forum, the consular section at the U.S. Consulate General in Sydney will need to substantially reduce routine visa, immigration, passport, and notarial services from mid-July to mid-September 2007, with closure for all routine services anticipated during the end of August and first week of September. In the event of the arrest, death, or serious illness of an American citizen, an emergency duty officer will be on call".

This process hasn't really stressed me out until now. VJ has been a wonderful resource for me, especially everyones timelines.

It should be the 0710 I think...and the first three letter for California are WAC. I'm pretty certain the first two are for the year. My first 4 were 0616. I'm not sure about Vermont.

I'm not sure what you mean about civil status, but I'm afraid that you are in for a long wait before you can come to the U.S.

It would not have caused problems for your husband's future citizenship application to have petitioned for you and your child. In fact, I would suggest that he apply for you both now. The waiting period for spouses and children of permanent residents is long but at this point, as far as I know, he has no other choice.

It will be 5 years from the date he received his green card (minus 90 days if I recall correctly - you'll have to confirm on the form) before he can apply to naturalize. Then likely 6 months to 1 year before he becomes a citizen, at which time he can upgrade your petitions if they haven't been processed yet.

I would really recommend consulting with an immigration attorney to see if he/she has any advice for other options.

im sorry if i made u a bit confused about our situation. i thought that i have mentioned on my post that may husband's father petitioned him (my father in-law). my husband came here in the philippines. he's father was a US citizen already and he petitioned his children and that includes my husband. we got married here in the philippines but he wasnt able to change his status until now because they think that it could affect his application for citizenship. my question is that, can he still petition us? when could he change his civil status? do u think it could affect his citizenship? i fear that he might not be able to petition us because of his civil status that he had right now. i hope it made my story a little more clearer than my previous post. thank you

I'm afraid that you are in for a long wait. If may have been possible to add you while he was stil in the process, but now that he has the card, as far as I know, the only thing your husband can do now is file a I-130 for you and your child. Unfortunately, the waiting time for spouses and children of Green Card holders to have an available visa number is years. Eventually your husband can file for citizenship and then upgrade the petition for you if it hasn't been approved yet, but it would likely be about 6 years before that would be completed.

Maybe someone else can correct me, but sorry it's not a great situation to be in :(

My understanding is that trying to submit anything additional, unless specifically requested by an RFE, is almost impossible. That being said - I don't see how it could harm you, and if it does become an issue, you would later have a copy of your addendum that you tried to submit to them.

I don't know if it's even significant enough to worry about, but if it would make you feel better you could have him submit it. Maybe someone else will have something to contribute :)

It's still possible your petition is on the way to the NVC - it averages 2 to 3 weeks, but it can take more than a month, I've seen it happen. Not to give false hope at all, just to let you know it's possible.

With regard to your question re the I824, I haven't seen one approved yet - you would think it wouldn't take very long!

For Q22 on my I130 I indicated that the beneficiary would be interviewing at the consular post abroad and gave the city and country (Cairo, Egypt) for the overseas consulate.

Both petitions were approved on Dec. 14th, 2006. I have been watching the touches & there hasn't been any action since Dec 21st, 2006.

OK, looks like I will just file an extension and wait until she gets here. By the time I send her the forms for the ITIN, I get them back, the IRS generates the ITIN, I send Kathlene a copy of the tax form for her to sign, she mails it back to me, it is looking a LOT like summertime!

Hey, maybe when she DOES get her and I file then, we can use the refund for a short honeymoon!

BTW, the IRS guy said I COULDN'T file for an ITIN since she was getting a SSN when she arrives here in the US, so he was wrong pretty much all the way around!

It sounds like the guy was right - the key is that you can't file for an ITIN once she's eligible for an SSN - which she isn't. So you can still file if you get the ITIN.

OK, so I guess it is true, you can't trust the IRS's own help line! I spent nearly 30 minutes on hold and waiting while they checked and researched forms and they told me I could file separately without her SSN.

Oh well, I guess I will still wait and send in copies of my 2006 w-2s and 1099s to show I gross over the 125% level.

I asked the guy three times if it mattered my wife did not have a SSN and he said he was sure I could file without it. He also said I could not file for a tax ID number since she is eligible for a SSN once she gets here.

I can always go back to my original plan and just file an extension until she gets her in the Summer. ( I just could use the refund to help pay her expenses!)

International Travel
A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

He can email the choice of agent and he can prepare the DS230 and mail it to you when you receive the IV Fee Bill, that way as soon as the NVC generates the DS230 you can send it out, or you can wait until you receive the mail from the NVC (which will be relatively fast) and then return it with the DS230 and any necessary documents that your husband has already sent you.

The pages are slightly different at the bottom - from my understanding this is an irrelevant difference now, but I would still do all four - especially b/c the computer makes it easy :)

The processing times on the USCIS website are pretty much useless except to show what the USCIS's goal is for the longest possible time they will take.

If you download the form from the James' shortcuts, it should only be one sheet, mostly blank with a payment slip at the bottom which has the barcode at the bottom.

After preparing the Affidavit of Support bill from NVC using James shortcuts, how is the single sheet with barcode utilized?
Is it folded and inserted with the bill and money order? Or should it be left flat and mailed in a large envelop?


You need to cut the Barcode (payment slip) at the dotted line. Use a paperclip and attach the check and the payment slip together into an envelope. I then put the envelope into a USPS overnight express envelope and sent it off.

I wrote on top of the envlope the NVC case number with my wife's Name and DOB as well as my own.

I'm preparing to submit the DS230 and I want to use the shortcut. I downloaded the Barcode Cover Sheet, and I'm just wondering if you changed the text where it says return with "completed DS-230 Part I" to indicate Part I and Part II.

I know it's a silly little thing, but I'm just trying to decide if I should change it.
