It sounds to me like things are really really taking longer than it should be.

A touch is what it means when you register online, and you see the date has changed for the last update. This means that someone has touched your file and scanned the barcode, although you don't always know what it means.

I'm not sure about the DCF, but I would definitely start calling people.

As for the G325A, you were supposed to send 1 copy for you (4 sheets) and one for your spouse (4 sheets). Sometimes they lose things though.

hey guys, very new here...what does touched mean and how can i tell if its happened (i feel like this is a sex ed question!!) ??

my husband is australian and in australia...i dont have my info with me for specific dates, but my i129f and i130 seem to be taking significantly more time than other peoples. i filed i130 at the end of march, havent heard a peep since the receipt notice early april. is that normal? it doesnt seem normal.

with the i129f filed immediately after i130 receipt, my first request for evidence was a paper that made me sign that my marriage wasnt arranged. did i miss something in the original application? are they allowed to just change legislation to make this a requirement halfway through a pending application? i received this in june and sent it out the next day. 3 weeks later i received a receipt, with another copy of this form! i called customer service and they said to send it in, just in case. i did. 2 weeks later i got a receipt.

then i didnt hear anything from them until october 22 when they sent another request for evidence for g325a..i had only sent one copy of each. does it say to send two on the instructions? i cant believe i could make such a big mistake. sent it out and got a receipt a couple days ago.

of course this whole time i have called incessantly and gotten zero information from customer service.

the third question is that after being lied to by the service center and them telling me that dcf and filing in the US takes the same amount of time, can i just say f this and go back to australia and try to file the dcf? it would probably be quicker at this point and im getting pretty desperate!

the last question is why do they have to be so torturous so randomly? ive read so many posts of people having theirs completed in a 1/4 of the time it has taken out. horrible sadists!!

also just filed a congressional inquiry with my local congressman to speak up on behalf of my case. well see what comes of that!

After sending the first package I-130, and recieving NOA1. Then I will send the I129F package. Now, in this package its needing us to include the same forms like the G28a forms. So does this mean me and my husband should fill out new forms and sign and date them again? Or do we just make a copy of the first G28a forms and send ??

Check the National Center for the K-3's. I'm assuming that shows what they think they are processing as far as when you are allowed to complain about being outside of processing time.

Anyway, the times don't show anything meaningful. The timelines on this site are much more relevant.

They have posted new processing time at USIS. This time California moves backwards with K-1 visas (from May 2 to April 18 !!!). They have not posted K-3 visa in California nor in Vermont!!!
What is going on??????????

K3 is NOT always the fastest - it was designed to be the fastest, but it doesn't always work out.

It is still possible though that the K3 will be completed first. The K3 was supposed to bring couples together faster, unfortunately it doesn't seem to be working very well :(

I'm sure more people will tell you that if you can afford it, the best option is to continue with both petitions and see which one will be approved first. The I130 stays at the NVC for a much longer time than the K3, so that is why it is possible that the K3 could beat it to the embassy.

I still don't fully understand how the K-3 is fastest now that our I-130 has been approved. If our I-130 is off to the NVC and there's no telling when the I-129F will be approved how could the K-3 be the way to go?

Is it abnormal for the I-130 to be approved before the I-129F? I was surprised that it was approved first because the K-3 was supposed to be put into existance as an alternative to the long waits that came with I-130. Am I mising something?

If your main concern is speed, you can continue to pursue both petitions and see what happens.

When the I130 gets to the consulate, it overrides the K3 so the decision would basically be made for you if they are both at the consulate at the same time.

If your wife has an interview and is granted an IR/CR-1 visa, she will enter the U.S. as a permanent resident and will not have to adjust status. She will be able to come as soon as the visa is issued (generally within a day or so of the interview if approved.)


A few things to consider, if you stay with the K-3 which lately is still a bit faster, you still will have to deal with the time waiting for Adjustment of Status in the states. If you wait the extra time invilved with the CR-1 visa, you will be doing the visa interview and green-card interview at same time and wont have to do AOS in the states.

One other thing the aproval of the I-130 just means it is moving on to NVC were several things need to be done before it moves to the consulate. The I-129F usually reaches the consulate before the I-130 petition.

So now the case is transferred to the NVC and then its sent to the consulate? If we stick with the I-130 path does that mean that she can come to the US after her interview etc or do we have to file her adjustment paperwork and wait for that before she can come back? Bottom line is... we dont care how long it takes for her to get her status adjusted and her green card issued... we just want her back in the States with me while we wait. That said... what is the fastest option for us to take?

I imagine that it wouldn't be too much of a problem, as long as the USCIS doesn't have any other reason to doubt the validity of their relationship. That's the only way I could see it affecting the petition.

I would use her current legal name, whatever that is, on the form.

Not necessarily. I guess it depends. Did she change the name on her passport? I filed everything with my maiden name because I still have my passport like that. I'll change the name on everything after I get my new passport with my married name. I've seen some people who filed everything with their married name and still have the passport with their maiden name. The consulate will give her the visa with the same name as she has on the passport though...that's the info they gave me.

It sounds like you fall into the exception of needing to give a written explanation of why you didn't file. I can't see why you would have trouble if you are able to show that you are currently earning enough.

I'm pretty sure you can still file taxes for the years you were gone. As a citizen you are supposed to report your worldwide income if you are required to file a return. If you think it would be helpful I would look into filing for those years. If you didn't have any income, then I guess it wouldn't help :)

Other than that I'm not really familiar with the I864 yet, so I'm not much help sorry.

I beleive that most people in this circumstance either contact the NVC or the Embassy, rather than attempting to contact USCIS. It actually might be more likely that there would be an issue with not getting mail if you update at this point, since USCIS seems to have a hard time doing it. Maybe someone else will have specific instructions :)

If it says on your notice that you can follow up in 60 days, I don't see how it could harm your case if you call.

At this point there's probably a good chance, or a chance anyway, that the I130 will beat the K3 to the embassy or arrive there aroudn the same time and override it anyway :)

Oh well, I assume they want to get the extra $200 out of as many people as possible. Although it does make sense because a lot of people will AOS, but they need to change the form.

Sometimes it takes a long time for the NOA1 to come, I saw someone saying today that theirs took a month. They are transferring all the I130's to CSC or VSC now.

To know if they have received your I129F, you can watch to see if the check is cashed. The case number should be on the back. Do you know how to watch your cases online?

hi all again, I dont know why we got the NOA1 after 20 days that they received our I-130. And more we sent our I-130 for Nebraska and they moved to California without to contact us. Someone can explain it to me please. What can we do to know faster if they receive our I-129f?

I would definitely look into DCF. From what I hear, the best information regarding DCF is to call the individual embassy, as they all have different requirements. I'm guessing it would be the fastest best way if it is available to them :)

My cousin lives in Italy with her husband. They have been married since September, 2003 and they want to migrate back to the U.S. What will be the fastest way for her? Can she apply for I-130 (DCF) directly at the Rome Embassy? Or, does she have to take the K3 route?

Many people in this situation continue to pursue both the K3 and the IR/CR1. The IR/CR1 is a superior visa, and your wife will be a Permanent Resident upon entering the U.S. If the IR/CR1 arrives at the embassy first, the embassy will ignore the K3 if it arrives later. In addition, if the K3 arrives first, and the I130 afterward, the I130 usually will also override it.

I'm not sure about the fee difference, but you would have to pay basically the same fees for AOS as the I130, and the I130 is already approved, so it might make sense for you to puruse that. Many Canadians come down on a K3 and then go back to Canada for the IR/CR1 interview rather than filing AOS.

When the medical can be done depends on the phsyician, some require a letter showing the need for the physical. I'm not 100% sure if the physical can be done in the U.S., don't see why not though.

AOS is Adjustment of Status when a person is in the U.S. and files to adjust status to become a permanent resident. Some people also talk about AoS which is the Affidavit of Support.

People do it 2 different ways: they use two lines to put in the address, or they write in "see attached" and attach an addendum. I haven't heard of either way being a problem.

I am in the process of completing the G325A form for my wife and I have noticed that I do not have enough room in the blanks provided for residence and employment. When the address will not fit on the line provided is it OK to write on the line below and then draw a line through month and year boxes. ????? I thought the fillable forms would have skipped to the next line but they do not (the remaining information does not show up on the printed form when you type beyomd the space provided on the fillable form)
I know it may soumd like a silly question but I dont want to do anything that will cause my form to be sent back.

If you get married, then your fiancee returns to Canada, and you file immediately for a K3 or CR1, it will likely be 6-12 months before she is able to come move to the U.S.

She is definitely not allowed to enter with the intent of staying and adjusting status, otherwise that's what everyone would do and noone would be apart.

Yodrak, is that because the EAD that is granted is linked to the specific visa - thus the EAD a K1 applies for expires upon marriage, while a person with a K3 visa would get an EAD good for the remaining porition of the 2 years their K3 is valid for?

Once you come in on the K3 you can either (a) continue to pursue your I130, and return to your home country for the interview at the embassy, or ( b ) file for AOS. You will have to do one or the other eventually as the K3 is only good for two years.

I didn't check out your timeline, so I'm not sure where you stand, but if youre I130 hasn't been approved yet, at this point it would probably make the most sense to AOS because of the new requirement of requesting that the I130 be forwarded to the NVC, which carries a $200 fee. Sorry if I haven't explained it very clearly. :) Congrats on succesfully getting the K3!

The whole system is currently changing in favor of AOS, even some people who have already filed I130's are having to take further action to get their approved I130's sent to the NVC!

Regarding EAD, I always thought you could get it on K3. I'm feeling confused right now for some reason. I think I need to eat lunch :)

The only part I'm confused about in your post is about taking a receipt to the local office for a EAS? What's that?

And there is no such thing as uppercase numbers, if you use shift + number, you will get a symbol. The password and username for USCIS status do NOT require any symbols.

USCIS has a new policy in which they presume that people approved for K3 will come to the U.S. and do AOS. If you actually want to get the IR/CR1 in your home country, you must fill out the I824 (I believe this is the correct form) and pay $200 to request that the approved I130 be forwarded to the NVC.

But Question 7 clearly refers to "What Documents Do You Need to Prove That You Can Legally Marry".

My reading of the instructions is that if you are married, it is not necessary to submit the divorce papers at this point - it will be needed later though.
