Name Typo On Beneficiary Birth Certificate

i had the same prob when i do my k1 visa
my last name in passport not the same in the birth certifacite ( one letter is diff )
did u think this can be a reason for them to print for me a visa in passport and over it they stamp it with cancled without prejudice ??? and send my case back for further review ????

the uscis respon to the sentor

we had our case sent back to usa , and we make an inqurey throw the sentor and the uscis said in the letter which they sent to the sentor that the fiancee cant prove a bonafide relation ship at the interview and thats why they sent the case back to uscis to adjuction !!!!
so what the next step did we have to forget about it , or we still wait for a hope they let us appel or what the next ?
according to our time line did somebody can tell me when i mayb hear about the final discion ?

Repetitioning

If it has been more then the 4 months the petition was approved for you can file now without waiting on them. Simply state in your coverletter that you filed for a K1 that was not granted at an interview on XXXXXX data and that you are filing a new petition under the assumption that the initial petition expired. I did it.

so can i refile again now according to my time line ???

Can We Refile K-1 ??

Yes they approved the refile and we got the visa on the second time through. The first denial was obvious, they demanded that he give them details of my classified work and of course he said he doesn't know, and they said no visa. Second time through I was outside the embassy with a large package of forms to justify their request access to this type of information ( for them to fill out and explain) , so they didn't push that path and we got the visa.
Do you know what areas your fiance had trouble with ? Was your initial package weak ?
You can file a freedom of information request but those can take some times. We front loaded the second petition ( over 7 pounds ) and had almost the same amount of added stuff to take to the embassy.

did the freedom of info is what we do by sentor inquirey , or something elese , and if it something elese did they give you a detiled answer or just like usall the fiancee cant prove a bonfida relationship

You can file a second K1 without waiting for the first to be expired . I did that and was successful in the filing

Yes, my fiancee is from the Philippines but she lives in Singapore and is not a singaporean permanent resident nor is she a singaporean citizen. She just lives there for work. She will be doing all of her interviews in singapore and will not have to go to the Philippines for any reason.

Except that "without prejudice" means only that they are not barred from applying for another visa, NOT that they can necessarily apply for a K-1 visa. I have worked with a case where a spouse's AOS was denied "without prejudice" because they had left the country after arriving on a K-1 and getting married here, but before receiving an AP. They were NOT able to just file another I-485, but there was no bar to the USC filing an I-130 for a CR-1, which is what they successfully did.

The OP needs to find the exact reason and then correct it. Getting married and filing for a CR-1 may not correct the problem.

In a legal case, the term "without prejudice" means different things, depending on whether it's used by a participant (litigant, petitioner, respondent, defendant, etc.) or an adjudicator (judge and/or jury).

When it's used by a participant it means they are not admitting any guilt or culpability, and are not giving up any rights. For example, when a respondent proposes a settlement of a lawsuit without admitting the basis of the suit actually has any merit, or that they are actually liable for the damages claimed, then they do so "without prejudice". If the settlement proposal is rejected then the petitioner can't use the proposed settlement as evidence against the respondent.

When it's used by an adjudicator it means that the decision is not based on the actual merits of the case. For example, if a judge tosses out a lawsuit because it wasn't properly filed then they do so "without prejudice". No decision was made on the merits of the case, so the petitioner may be able to refile.

In the case you mentioned, the AOS was denied because the applicant simply wasn't eligible to adjust status on the basis claimed. The IO never considered the merits of the case, so it was denied "without prejudice". The applicant was eligible to refile, this time using the proper basis of eligibility.

In the OP's case, he mentioned that the consulate's letter said they didn't believe his relationship was legitimate. This sounds like the reason for revoking the approval of the visa was based on considering the merits of his case, and that the decision was not "without prejudice". If they cite 212(a)(6)(C ) as the reason for returning the petition to USCIS then there is certainly "prejudice" in the decision, and it could affect the OP's eligibility to submit a future visa application.

And well bro i heard-from someone who work for USCIS- that USCIS is no longer reviewing k1 visa .Which means there is no NOID for k1 visa anymore .They just reviewing the married visa !!

Every consulate's Visa Section has a Fraud Prevention Unit, or FPU. The FPU at the consulate in Egypt has been know to make visits to the home of the beneficiary's parents and interview them about the relationship.

i never hear about the home visit before , i think they had no right to go to people home , they will not gonna waste time and money either they would deny it insted , thats my personal oppanion any way

my case got sent back since 7 mounths , afer they approve us at the interview and every thing went fine , but after that with 1 mounth i got my passport with a visa but there was astamp over my visa says cancled without prejudice !!! and aletter say they dont belive in our relation and our case got sent back !!!! , we contact the sentor and make inquirey we got the same answer .
the quiz is : i feel its becuse my stuibed mistake cuse when we sent the k1 application we was engaged but dont had cermony yet which is common here to have a cermony , and we explain this when we sent my medical and write for them the true which was : that my family wasnt approve our relation 100 % at the beginig but they was ok , and they make for us a cermony after we send our i-129 with 4 mounth and we provide the embassy with out egagment party pic with this letter , actualy we say the true which i know it was so stuibed of us , but the done is done

The best way to respond to any possible-fraud marker in your now dead I-129f petition would be to make sure that your CR-1 petition has a crazy amount of relationship evidence. You can't respond directly to anything relating to the fiance petition, since it is closed now. what you need to do is include substantial amounts of relationship evidence in the spousal visa petition. That is your response.

It will also help a lot if the USC petitioner is present at the interview.

she was with me at my k1 interview and the counselor tell us we are approved but they turn around and stap us at back !!!
any way we had alot of evidence and she will apper with me at interview , but we decide now to enjoy our time after alot of panic at the k1 before we file the cr1 (also we would like to file cr1 at our first year inversary did you think its good , at least to make them feel more comfortable as i see my self they care alot if the relation is long thats my personal oppanion maybe its wrong so correct me ,

Your I-129F petition is dead. This is far better than receiving an NOID or NOIR you can't respond to. Failing to respond to a NOID or NOIR would badly damage your case. But now, as they say, there is no more action to do with it. You literally can't screw up your case, because at the moment, you have no case, petition, appeal, or anything else pending with them.

They say specifically that the petition is closed "without prejudice to any future applications." That means that you have a clean slate with them. You can file a petition for a spousal visa with them and they will not hold this application against you in any way.

As And_Sam said above, this is a good thing. Even though you will be apart for more time, you are now free and clear to move on to the next step, which is the spousal visa. You can start making forward progress again.

And no, being married will not hurt your case for a CR-1. Not only do you have to be married to get a CR-1, but getting married and preparing to file for a CR-1 was exactly the right thing to do once you got "canceled without prejudice". You are on the right track, and this letter lets you start moving forward again.

i got a letter last night said that they find out that the case is expired and now they gonna close the case without prejudice and we are free to file again if we want to with the right fee and support document !!!!
we got an email say the same also i know our k1 petition is dead now but the quiz is we are married now so did you think this will hurt our case if we file cr1 ??
did it will be a red flag i mean ?
also i think its good thing they close it without denied or noir or noid i think even if this sad to us but as much i understand that mean they dont consider us as a fraud or nothing , or this still mean they but a fruad marker in our case even if they let expire ??

I double checked and I said K-1 Visa (I-129F) but I did revise it before making a second copy for my fiancee

I was a bit crazy with mine and paranoid they would send an RFE so I included evidence of relationship (call/sms records), engagement ring receipt, I-134, and copies of her birth certificate and passport. The packet I sent had two folders, the required stuff and extra stuff

Once our visa is approved and she is here I'm going to post samples of what I submitted for others to use

Our first petition ( K1 CSC) was sent back after the embassy sat on it for 4 months. At that time CSC would consistently wait 120 days and then tell you that they declared your petition expired and you were free to refile. That still seems the trend with K1 visas. You can actually take a preemptive strike and file a new , improved better K1 and self declare the first petition as expired ( a statement of presumption in your cover letter) and just push forward. This is what we did.
As to an IR/CR1 they are a different animal but you are most likely looking at 120+ days before they do much ( which is how long they will tell you you have to wait before filing a service request.

when the petiton can expire , did they use the the noa1 date ???? or noa2 date ??? or which date ???

what did you do after your k1 expired ?? what kind of process you choose to do and did it work ? , also did you know the reason they sent your case back or just the simple letter to your sentor which said : the fiancee dont show a bona fide relationship to his fiancee so we sent the case back to adijaction , or did you got another letter

I'd like to add here that a WEDDING and a LEGAL MARRIAGE are two very different things. So if someone is wanting to do a religious ceremony in their SO's country, they need to check the legalities of it. USCIS clearly tells us that a non-legal religious ceremony is ok, as long is it is not legal in the country in which it takes place.

To me it sounds like you truly have your ducks in a row concerning proofs, but if I am wrong someone will come along shortly and let us both know ! Also I wanted to suggest to you and your hubby to schedule his medical in Cairo and not Alexandria. Recently Ahmed and a dear friend of mine's husband had their medicals and whooooaaa nelly ....let me tell you both of their medicals were like day and night! Will PM about it.
Also Ahmed and I have decided he will not return with me in August to the States if he gets the visa right away . He has to stay and finish the year end closing with his company, really while I hurt to leave him again I have so much respect to his dedication and loyalty to his career as well as our family. So I too will be making that painful goodbye so soon, but at least I know when we say see ya soon... it really will be see ya soon! So I am looking on the bright side of things!

where to do the medical examination in Cairo ?

Yes, El Shrouk hospital is on the embassy's list

wait is there a new list? we got our medical in july and there were only 3-4 drs listed on the packet also you can check the embassy site.

You really need to put off doing it as long as you can but before 3 weeks of interview because your visa will expire 6 months from medical date from what i understand.

I'm having my interview next week at US embassy in Cairo, I'm so worried because of previous denials ( 2 times student visa JUL 2008 and 1 time tourist visa NOV 2010)

What exactly to prepare for the interview? what documents to prove ongoing relationship with my fiance?

Take everything you can think of and more because if you applied before they might look at you more closely. Phone records, travel receipts, pics(LOTS),especially ones that show family support for your relationship,chat logs, emails,did you have engagement party here? if so take them pics. Did you purchase rings? Anything you can think of that demonstrates your fiance and you have met in person in the last 2 yrs and that you have family support and if your fiance came with you that might help you a lot too!!

Don't be nervous be calm applying before for other things does not make you guilty of fraud and being turned down for student and tourist well honestly from what i've heard its very hard to overcome the assumption that you may not return. Most younger ones get refused because it's very hard to establish strong ties to your country when you are young and even older ones too.

ADMINISTRATIVE PROCESS DELAY FOR K1 VISA IN LONDON EMBASSY

HI,
I am a U.S citizen who applied for my Fiance Visa in summer of 2010, she did her medical, police report etc.. in spring of 2011. On June 16,2011 she had her interview where I wasn't there. We have been together for 10 years... very odd love story., so our file was thick. We provided all the proof of years. I did have a good lawyer based out in Atlanta. Now my questions is that its been 5 months til Administrative Process. I have emailed the embassy few times and get the same answer... How long should we wait for? Remember we both are orginally are from Pakistan. She has a indefinite visa here in U.K. Can you please let me know which angle should we approace now? Should we get married and change our Visa and re-apply again? Or should we just wait and wait... Humble request for some feed back., especially if anyone who is in the same boat as us(Administratvie process). Thanks a bunch!! Imagine being with someone for 10 years and now you are told to just wait... its very hard for both of us! God Bless!

AP wait times in pakistan tend to run a long time from what i have read on this forum. You could contact your congress and request them to make an inquiry. Some say that doesn't help but from experience i will say it helps "a little". You never know what is actually going on with your case when it's in AP because they are not giving you any information(i know thats hell) but i think it helps to have someone "higher up" look at your case and i think that is what happens when a contact is made through congressional email. Yes it does go to someone higher up in the embassy but if your case is still pending the checks they are going to tell your congressman "it's still pending" so don't expect a miracle or nothing. I think it helps because what if your case is just sitting on someones desk collecting dust, or got lost or misplaced...rare maybe but not impossible...so at least you know someone is looking into your case...

I have seen 2 people make the poverty amount or more and they asked for cosponsor. so maybe it is just egypt?

truth is that it depends on the consular in charge of your case...i barely made it by maybe hundreds(can't remember exact amount) and we passed. I have heard some are denied and told to get cosponsor like us so it depends i guess..doesn't seem fair but that is how it works...

yes i get denied in the us embassy in cairo and why i think all the interview was about age why u marry some one older than u why u didnt marry egyptian plah plah plah they just didnt show any respect they deal with me like i dont know my rights and law and they refused me for age diffrence after congress woman called them they said very fake answer THEY JUST LIE AND DONT SAY THE TRUTH AND THEY CANT SAY THEY REFUSED US FOR AGE CUZ THats illigal but no thing to do just wait AND PRAY CUZ WE LOVE EACH OTHER SO MUCH
