Just a simple analysis, no offense meant to walls1010:

If walls1010 previous husband is a filipino and they got married in the philippines then her 1st marriage is still valid. In case her previous husband get hold of her present marriage certificate (2nd marriage), he could file a case of bigamy to her since she is still legally married to her husband in the phillipines. Though a divorce had been filed in hongkong, it is not recognized in our country.

Technically, she is committing bigamy under the philippines law.

I'm no lawyer and i could be wrong...




No, the filipino husband can't file a bigamy case against her because she got married to the USC here in the US. Criminal cases are territorial, if the act is not committed in the Philippines, our criminal courts have no jurisdiction over it.

Article 26 of the Family Code provides, to wit,

All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35(1), (4), (5) and (6), 36, 37 and 38.

Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.

Remedy ng friend mo in order for her to obtain her capacity to remarry, ay pa-annul nya yong kasal nya IF sya ang nag-initiate ng divorce.

Better yet, speak to a lawyer na lang in order for you to get a legitimate and sound legal advise.

Gosh... forget about that and move on. There are so many things on earth to be sad about not just by that purse left by your husband's ex... Or if you do really wanna get rid of her items, ask him to buy you a new house, new utensils, new bed, new car, etc... In that way, you wont be taunted by his ex memorabilia's.

Mind you, my hubby's ex live-in-partner turns out to be my hubby's best friend now. So the communication is still open. She used to call and send email from time to time, but we haven't seen her for 3-4 years already as she moved out of state. With her permission, I sold her items on ebay and some ended up in Salvation Army, and the townhouse where they (hubby & ex) lived for 9 years is now a rental property as we moved to a single detached house. happy.gif I respect my hubby's past and I feel so secured with my marriage. I am not even threatened if her ex is brunette...lol

You'll be fine. Be considerate with his feelings too.

In addition to all the suggestions posted above:

1. Tabulate all your Daily/Monthly expenses vs Income (household; meaning Wife's/Hubby Income & Expenses)

2. Go back to the basics (eliminate some perks: cable, phone, gas & electricity, unnecessary trips, movie, spa, clothing, dining-out, vacation) - EXCEPT: Child education (let him handle that). Never nag your hubby about that. You should have an adult discussion on how to address the situation.

3. Find a second or third employer. If you are working 8 hours a day to your current job, and lets say you're paid $10/hour so you have a gross of $80 a day. Retails are a good target for a part-time job, where you would be able to work from 6-10PM (4hrs @ $10/hr = $40 x 5days = $200 + 8hrs on Saturday (take a day off on Sunday) your part time job would round-up to a gross of $280/week which is $1,120 for one month. See, where are you going to get that money if you will just continue on whining and stressing out yourself? There are a LOT of jobs around.

with that, i do believe your husband will follow, and hoping that he will also find a second job.

Your situation is not even comparable to a stage 3 cancer where death is the only way out. You are both young, find a way to fix your lives. This will entail major life changes but both of you will definitely benefit.

And yeah, I guess its a good idea not to get pregnant for now.

WRONG! Kahit saan Universe ka pa ikinasal IF FILIPINO citizen ka pa, valid ang kasal mo sa batas ng Pilipinas... Under Phil Law hindi ka pwedeng mag-asawa unless otherwise na-dissolve ne yong first marriage. And, let the foreign spouse initiate the filing of divorce para sa mata ng batas sa Pilipinas, maka-pag-asawa ulit sya.

Bago maging complicated ang lahat dear OP, check mo na muna documents mo and makipag-usap ka na muna sa abogado kung anong consequences ba ang kahaharapin mo KUNG ikaw ang magpa-file ng divorce...

As long as you are not a carrier of a communicable disease that will pose threat to US, then your safe. That wouldn't be a ground for VISA denial.

Now if you want your teeth fixed, then you can have it done in the Philippines. I had braces, and 3 dental implants here (US) and it cost us not less than $18,000.00 Dental Insurance doesn't cover a penny as according to them, dental braces and implants are not medically necessary.

I suggest, if there's no way for you to get home and see her real quick before August 25, then just submit a detailed explanation why you can't. I have high hopes that the immigration will not deny your application basing on this technicalities. Grab this chance to defend your claim why you failed to see her during the 2 years time, and why still you couldn't see her now. More evidence to suffice a genuine relationship I guess would be of great help. And if and only if, your letter would not work and your application be denied, you can always appeal it (i believe so), but prior of doing that, you have to do all means possible see and be with her in person. If there's no appeal, then re-file.

For my dental braces = $8,000
Implants @ $2,500 each = $7,500
CT Scan = $350
Bone Grafting = $750
Retainer = $350

It's already a fortune.... I can have this fix in my home country for less than $2,000 for everything. But, I don't trust my country's medical system so it is what it is.

N400, page 1, item D: "Name Change (optional)" - - - - I just wanna know if this gave us an option to change our names without filing the petition to a regular court and obtain a declaration of a new name???

I read the instructions on N400 and it says "a court can allow a change in your name when you are being naturalized. A name does not become final until a court naturalizes you. For more information regarding name change, see the Guide (QUESTION: Where I could find this Guide per se?).

If you want a court to change your name AT A NATURALIZATION OATH CEREMONY, check "YES" and complete this section. If you do not want to change your name, check "no" ..."

Obviously I do really want to change my name to the name that I am well known by the public. In my native country, parents tends to give their children 2 first name, and the most common is Maria and is followed by the 2nd first name. Now that am here at the US, Maria became my first name and the 2nd first name been construed as my middle name. I had an argument with the DMV and Social Security before and I'm already tired of dealing this. I wanna dropped 'Maria.'

Can I take this opportunity to have changed my name legally without going through the regular court?
