Some consulates can be pretty far behind the times. Even if you're high-tech in your communications, make sure to have at least a few postal letters (birthday cards, etc.) sent to and from each of you.

not always possible...decided to snail mail my fiancee a romantic card with a picture we had taken at a circus in Panama City my last visit. 1 & 1/2 months later...she never received it. Talked with another VJ member who's SO lives in the same city in Panama...same for him. It will have to be all "electronic"

Just out of curiosity, if the K1 is denied what is the best route to take? Try and keep the case at the embassy and immediately get your senator involved or get a lawyer. If lawyer, an in-country lawyer or American. I am just curious. Also would it be of any help , if the petioner happened to know someone who was "high up" in politics (ie: former congressman, former presidential cabinet member, lawyer) to contact that person to see if they can do anything to let the Consulate know that the case is being watched? Sorry if I am being deliberately vague here. Please no flaming. Just some hypothetical questions.

We meet in Guilderland, NY during a bike ride on May 6th, 2009. Susana was living in Guilderland, NY and at the time she had a TD visa. I live nearby in Rensselaer, NY. We spent time together almost everyday in June 2009. In July she moved back to Mexico and since then we mostly have been communicating via emails, FaceBook chat, and FaceBook messages. On October 2nd, 2009 I traveled to Mexico to visit her.

Please see the inclosed pictures of us together, plane tickets(copy), my passport(copy), engagement ring receipt(copy) and some of our emails(copies).

Translation...yes, and other poster has mentioned it wuld be a good idea to provide other proof they are not still living together. All USCIS cares is that you are both free to marry at the time of the submission of the application. BUT...she must be prepared to answer questions about this at the interview by the consulate officer ,as they will very likely inquire as it is a red flag.

I called NVC this past Friday August 28th and was told that my case/petition was received on Monday August 24th and that I am in AP. Yesterday I received a letter from NVC stating: "this letter is to let you know that within a week the petition will be forwarded to the appropriate visa issuing post where your visa interview will take place". And it has the State dept. case #. Has anybody else who is stuck in AP at NVC also received a letter like this. I thought you only get a letter after they have sent your case to the Embassy.

FYI...my petition was approved on July 24th. I called NVC almost everyday for one month. They always said it can take 2-4 days, but the average is about 2-5 days. After one month I got fed up and contacted my congresswoman. She contacted the California Service Center and they shipped it out that day. Yup, it had been sitting for one month. Who knows how long it would still be there had I not had my Congresswoman call. FWIW
Oh, and the CSC sent me a NEW NOA2, with a new approval date of August 18th.

For utilizing your Congressman or Senator you will have to fill out a form authorizing them to make an inquiry on your behalf. Whether you go to their office or call doesn't matter. I personally went to my Congresswoman's office the first time I needed assistance, as the office is only 2 miles from my place of employment, they had me fill out the authorization form. Thereafter I just called her office and they used the same authorization form. My Congreswoman has been fantastic for me...your results may vary though.

Contact your Congressman? ABSOLUTELY...you should have done this 2 months ago! After 1 month of waiting for NVC to receive mine, I contacted my Congresswoman and she called that day USCIS and THAT DAY it was shipped. They misplace these files all the time. Good luck.

My congressional inquiry or my letter to the Assistant Secretary of State for Consular Affairs has produced an email I just received, thought I would share with everyone:

is in response to your letter concerning delays at the National Visa Center (NVC) in processing the I-129F petition, filed on behalf of I****** Ro*******.

Delays at NVC are generally caused when required documentation is missing from a file or when the receiving embassy or consulate has a backlog of pending cases. We reviewed the records at NVC and found that Ms. Ro******’ fiancée petition was recently forwarded to the U.S. Embassy in Panama City, Panama. Once the Embassy receives her file, an interview date can be scheduled. Ms. Ro****** will be contacted and provided with additional information and the date and time of her interview appointment

No letter from NVC at all yet... The letter from USCIS... I-797 NOA2..

No mention of NVC anywhere in the NOA2

Many people also receive a letter from the NVC, this what mine had to say:
The State Dept's NVC has recently received an approved I-129F petition filed on behalf of your fiance. This letter is to let you know that within a week the petition will be forwarded to the appropriate visa issuing post..yadda yadda yadda.....but for some ...not true!

This probably will be one of my ending posts here on this topic regarding the subject of being in AP. I say this because , as i knew it from last week, I'm officially out from AP.

Based on my experience with this unpleasant waiting period, i would like to make known for all those that are still in AP, that this topic is GREAT and my suggestion is "READ everything here".

Many posts that I've posted had a high accuracy, and i would recommend to learn from them. I put time and effort to make them easy to be understood, but also to benefit people that are still in AP by not wasting they time finding an answer.
With one thing i was wrong, I predicted that i will be out from AP tomorrow (Tuesday) but it happened today.

I would like also to thank you for all the people that give me they support, as i would not be able to get my self mentally prepared without them. I love them for they great mind and i wish them all the best!

yup.. have asked 4 times so far... only once did they finaly get a supervisor.. he answered..."may i help you" then the line went dead... the other 3 times there was none available... but the operator was kind enought to tell me each time that the sup. couldnt tell me any more that they could...


so i went to see my congressman thursday... wrote a nice letter before going.. the congressmans aid called mr back on friday...

so still waiting

I personally don't buy into the whole "AP at NVC is additional background checks" theory. First because why would it only be on K visas? And then why random? If it is so important that you have to do ADDITIONAL checks at NVC, then shouldnt it be all of the K visas? And why would issues not be caught at USCIS..after all THEY are a part of Homelanf Security. Sure would look bad for NVC to find something that USCIS couldn't. i dunno...and I guess noone will ever know the truth about AP. But we do know one thing....IT BLOWS

Good morning all.
Boghy, looks like today is day 40 for you. Really this week should be your week. Based on what happened this past Friday, I think they push to have alot of these done by Fridays. If this Friday comes and goes without your being released, you need to get on the horn to your Congressman. I can't say for certain it helped me, but it was definitely registered in their system as being received on Monday Sep 28th...and then I was out on Friday. But really I hope today or tomorrow is it for you.

My thoughts tonight....first I sincerely hope nobody here currently in AP has to wait 40 days like I did. When I called NVC today and asked "am I finally out of AP", and the lady said "you certainly are and your file is on it's way to the Embassy right now" I was so overcome with emotion that I really dont remember what I said to her, but I remember she started laughing. And I could tell she was tickled and happy for my happiness. They are just workers there and have nothing to do with our being there or getting us out, so please people be nice when you call.
I have to say I have enjoyed posting in this forum MORE than the K1 month forum for when I was waiting for NOA2 approval...it really is kinda like a family...bonded by despair, frustration and misery. To those still in AP ...you really will get there...it just SUX waiting to get there. Mav
