Oh, and today is day 39 for me. I have decided I am only going to call on Wednesday and Friday evenings. I can't take the hearing the same depressing news EVERY day from the zombies at NVC. And it also seems that congressional inquiries mean NOTHING to them.

Is AP lasting only a few days for anyone these days, or is it always a month or longer? I have found no way to track data like on Igor's list for USCIS.

It is really unfair that some people get 75 days at USCIS, others with similar cases get 120 days at USCIS then 30+ days of AP.

It seems that AP now is running around 35+ days...just 1 month ago people were getting out at about 28-34 days.

Just received a call from my Congresswoman's office. They received a reply back from NVC. What the NVC had to say was AMAZING...and I felt all of you need to know what they had to say, it said...

We received the approved petition on Aust 24th, it is currently undergoing additional processing and will be forwarded to the Embassy upon completion.

WOW!

do you mind me asking what the dept of state said ?

Well, the person I spoke with was very nice and sympathetic about my situation. He told me that all he can see on the computer is that my petition is still at NVC in processing. He also told me that he can see on it also that there was an inquiry by my Congresswoman. I told him that I had contacted her twice about this and even faxed a letter to the Assistant Secretary of State For Consular Affairs. He told me "you are doing all the things that can be done". I think I have never felt as low as I have been feeling the past week, I am in a very very dark depression. I feel this is MUCH worse that the wait for USCIS to approve. Really dont know how much longer I can tolerate this.

I have been checking the DHL shipments out of NVC for two weeks now and this is the first I have seen to Panama. Not getting my hopes up too much, but I will call later this morning and see.

How do you guys check these shipments? Is there a link to find out?

Here is how I do it: first, go here: http://track.dhl-usa...?nav=TrackByRef
for reference type in : CORRESPONDENCE
For ship from and to dates you have to play with it, today I used the from date as Sept. 29th and the to date as today Sept 30
for origin postal zone: 03801

you also can put in the reference of EXP 29 SEP 2009A or apparently also 2009B...these can give other results.

And you guys call - ask for supervisor - have them do inquiry - and try to find out a bit more.

I found out though this whole process - one major thing - the people answering the phones are like robots - they may not even be aware they work where they work blink.gif

Maverick - call the dept of state - they will tell you if you are cleared - anyone over 10 days - call the dept of state - they will tell you exactly what is going on - they are the dept that does all the checks for the NVC and the people are really nice there.

@boghy about "b" - I might agree w you - BUT the dept of state said I was cleared on Sept 03, 2009 - so is why I suggested the backlog ??

could also mean - operator "b" or Bob or BS - Been in He** - Been threw it biggrin.gif

Well today is actually day 36 , not day 42 as I thought. When I called NVC Friday night I confirmed the receive date and it is August 24th. I am trying to be positive and believe that THIS WEEK IS THE WEEK I COME OUT OF AP. I am going to try and test my patience and not call till Wednesday...maybe. I just get so angry now when I call just to hear the same thing. I think if Wednesday there is no change then I will call my Congresswomans office again. Good luck to everyoine this week. Maybe being end of the month they have to get a certain number finished...just hoping.

I can't believe what has happened ... wondering if anyone else had a similar experience ... Sept 7 NVC sends us a letter saying our petition (K-1)is approved and is being forwarded to the consulate within 7 days. This letter contains our "A" number and our consulate case number (the one that begins with the 3 letter code of your consulate). 14 days later, I call the consulate and they haven't received it. I call back to NVC and they tell me our case was never sent to the consulate, and it's being held in AP status. They wouldn't tell me anything else. This is like going backward. The letter was not ambiguous... it was clear and definite, then they sent us backward. I feel so angry and frustrated.

I think everybody gets that letter. I got it too after they received our case from CSC..that was 37 days ago. Sorry

Now that I have the NOA2 I am starting on the I-134. I have read alot on here but I am still confused on several points:
1) I see many people on here state that it must be notarized. I see in the instructions it says " Signing Form I-134 is under penalty of perjury under US law, for this reason, it is not neceassry to sign Form I-134 before a notary, nor to have your signature notarized after you sign it."
2) Question 11....I see that most are putting N/A Application for K1 visa and I assune checking the NO box? I feel uncomfortable saying NO on a form that is all about swearing that I WILL support my fiancee.
3) I have seen some people say that if you are above the 125% poverty guideline NOT to list savings accounts, as it will give the CO more things to ask questions about. What questions might those be???????????
4)Has anybody found a bank that can actually give you a statement of how much money has been deposited ina year. (I got a funny look from the bank teller when I mentioned this)
5) If I pay child support are my children wholly dependant or partial?

This seems to be the most confusing form so far...please help!

6) I see nowhere on the form or in the instructions where it says tax returns or W-2's are needed unles SELF EMPLOYED. But I see that people are stating that it was needed at the interview. Would the past three years W-2's be ok?

US Embassy and Consulate DiscussionQuestions for packet 3 forms
I have a couple of questions as far as information on the DS-130, DS-156, DS-156K forms:
1) On Ds-230(question 37) and DS-156(question 9)it is asking for other first names used or aliases. My fiancee does not go by her given first name, instead she uses the name "Jenni", this is how 95% of all my correspondence (email, chat) addreses her. Is that what they are wanting?
2) I have just received the NOA2, but my fiancee is in the process of moving so she will have a different "house" address than what was listed in the I-129F petition. But her "mail" address is the same which do I use? her "mail" address or her new house address, and will this be a problem compared to the information in the I-129F?
Thanks in advance for replies.

US Embassy and Consulate DiscussionConsulate issues, need opinions
My petition for my K1 visa is now entering the NVC stage (NOA2 date- July 24- still no NVC receive sad.gif ). I have been trying to figure out exactly what forms and documents my fiancee will need for the interview, but the Panama consulate portal here on VJ has almost no information on it, nor does the Embassys website. My fiancee lives a 6-7 hour bus ride from Panama City, so it is just not feasable for her to just stop by. Also the mail system in Panama basically does not work, I fear she will never receive the packet 3 they send. In addition to this I have had many questions about other documents she will need and it is confusing on her end also. Therefore I decided to email the Embassy, after 2 weeks and no reply I sent another email...again no reply. I have now discovered that other people have experienced the same thing and also when you call, that they will hang up on you. I feel this is completely unacceptable.
Here is what I need opinions on. My congresswomans office is 2 miles from my place of employment and I actually stopped by and spoke with her before I started the K1 process. I am considering contacting her to see if she could send an email to the Embassy requesting the information. I dont know know if it would be a good thing for her to also state "that one of my constituents has received no replies back to his emails", or if this might cause a backlash when my fiancee has the interview. But, I also would like her to request that they keep her advised of the progress on this petition. I have seen this recommended here on VJ as a way of letting them know that a government official is watching the case. Thoughts?

Should the beneficiery fill out the part 2 of the Ds-230 (but not fill out the very last section of it) BEFORE it is sent back to the Embassy. Also are Ds-157 & Ds-158 required....I believe one is only for males? My understanding is most Embassy require just DS-230, 156 & 156K. Help please.
Also on these forms wherte it asks for other names used or aliases do they mean a first name that the person has used all their life istead of their given first name. All my email and chat correspondence with my fiancee shows this "nickname" , never her given name.

ummmm ok makes sense now. I have read a few posts regarding this subject and it appears that filling out the form on-line and then printing it out puts all the information into a barcode on the third page. US Embassy and Consulate DiscussionNeed help here....
My finacee went this past Monday to the Embassy to pick up her "packet 3", but she already had everything they needed as I visited her one month ago and brought with me the Ds-230, Ds-156 and Ds 156K forms that she filled out...and all the other things needed (long form birth Cert, police clearance, certificado de solteria and my completed I-134 with documentation). They looked at and took her documents and gave her an interview date of November 19th. She called me and told me the date of the interview and that the forms she filled out that I brought to her, they gave her, but in Spanish. So she filled them out and gave them back to the officer , but they gave her a piece of paper telling her she needs to bring with her something else. I could not understand what she was saying so she sent me an email and said this...

honey in the embassy they gave me a paper where says I have to look for a Nonimmigrant visa apllication, i know is the same that we filled together here, but the other pages that I filled in the embassy and the officer took with her, they were in spanish. I think I have to get this page DS-156 is spanish too, then I have to take with me on the date of my interview. She told me I have to take with me 2 page of each one. Then I only want to say that I going to print and write again. but i have some doubt, because in the paper it says, I have to answer the questions in English, because the system does not recognize some words in spanish as Ñ. and in the website, the instructions say this documents should filled in online and after printed, Then honey, tell me what I do?. I am confused.

It is useless for me to call the Embassy, as I have tried and they do not answer the phone and likewise they do not return emails. I believe they want her to fill out the DS156 on line in English and bring a copy of it. Is this what they are referring too? I dont understand why because I brought 2 copies of it to her that I printed off the State Dept. website and she filled them out in English, but then she also filled one out there that day but in Spanish...so why are they wanting her to fill it out online...she tried this but she could not save it to print at the internet cafe. Any help would be appreciated.

This is largely good, in concept, assuming that the consulate will accept such things in the interview. Optimally, folks should front-load their I-129F or I-130 petition with letters like this, and take "fresh" ones to the interview.

Incorrect. The embassies are part of the Department of State, not Homeland Security. Recommend keeping just the third line.

2. Both myself and xxxxx’s father (my fathers name)
Poor grammar lends a poor impression and distracts the reader from the message. Reword to "Xxxxx's father (father's name) and I..." Otherwise, good concept. Consider, though, that if every such letter has the same text "and only the names are changed," this could imply to the consul that the effort is contrived, with resultant reduced or negative effect. I personally believe that letters written in the individual's own words (such as the additional testimonials suggested by Maverick) will be more effective.

Which is exactly why I have done it like this... ( 1 sworn statement and the 2 others being personal testimonies), as I feel the same if they were all worded the same and/or sworn statements. I personally thought the written testimony of my mom was better. But the immigration attorney said a sworn statement carries more weight. So this way I have the best of both.

US Embassy and Consulate DiscussionGetting "Testimonial Letters" about Your Relationship
A terstimonial letter is an idea that I came up with several months ago. Based on advice from an immigration lawyer who replied here on VJ (Thank you so much for the advice!), I changed it to a sworn statement. Here is what it looks like:

U.S. DEPARTMENT OF HOMELAND SECURITY
UNITED STATES CITIZENSHIP AND IMMIGRATION SERVICES

CONSULAR OFFICER , US EMBASSY - PANAMA

Declaration Of (my mothers name) In Support Of
Form I-129f, Petition For Alien Fiancé Of (my name) On Behalf Of (my fiancees name)

Pursuant to 28 U.S.C. § 1746, I do hereby declare as follows:

1. My name is xxxxxxx, and I am the mother of xxxxx xxxxx . I am a US citizen currently residing at (address); my telephone number is 1-xxx-xxx-xxxx . I make this declaration in support of my son xxxxxx’s petition for alien fiancée on form I-129f on behalf of (fiancees name).

2. Both myself and xxxxx’s father (my fathers name) have been corresponding with xxxx through email and telephone beginning in December of 2008. Attached hereto as Exhibit A are copies of selected emails evidencing our communication with xxxxxx.

3. Through our correspondence we have found xxxxxx to be a wonderful, thoughtful and mature woman who sincerely desires to marry our son xxxxxx.

4. My husband and I have told xxxxxx that we have not seen our son this happy in many years. Likewise we told her, that we can see the love and happiness she also has for him. We are anxiously awaiting meeting our future daughter-in-law.

I declare under penalty of perjury that the foregoing is true and correct to the best of my knowledge, information, and belief. I also encourage the consular officer to contact me at the above telephone number should he or she have any questions.

Dated: (city, State)
August 27th 2009

Signed:_____________________
(mothers name)

In addition to this sworn statement, my father and sister who both regularly email my fiancee, have written persinal testimonials. I think this will work in addition to the sworn statement from my mother. A good piece of advice is to make sure your fiance(e) USES the evidence during questioning in the interview. As an example: what does your fiance's parents think about your relationship? Well, they seem very happy about our relationship...here look at this letter they wrote about our realtionship, and here are emails we have exchanged. As much as possible refer the to the evidence to help answer the questions. Mav
