You can copy the example forms word for word (just replace the appropriate names) and sign and date it.  This is all that is needed.  All they want to see is your signed affirmation to marry...they don't care about details of your relationship.

 

The letter can be emailed to your fiance so it can be printed, but it MUST be mailed back to you with an original signature.

 

That's all we did, both times (letters are needed for the 129f petition and then again updated for the interview.).

 

You don't get extra credit for unneeded fluff.

hi everyone! I just want to ask some help about our status.... Im sorry i don't have a timeline but I'm going to have my interview nextweek.... the problem is we lack w2 and tax returns from petitioner and cosponsor. He lost our noa2. no paystubs sent to me..... lack of employment letter. we only have a list on how much he earned last 2013 from both of his job..... It's been months and I'm reminding him everyday about the papers but until now he haven't completed it yet.... we will just end up fighting at the end of the day.... He is really hard headed, he don't listen on what we need. he is lazy to complete the papers.... Im so frustrated right now and sad, but I think canceling the petition will be the best way so i can be stress free..... Cause i know if he is really willing to marry me, he will do everything but it seems that he is tired processing the papers.... What should i do?

 

Just don't go to the interview.  Sending the Embassy an email would also be wise. 
 

 

Many folks seem to think just because a person hates paperwork then that is an acceptable behavior for the petitioner.....it is not.

 

Paperwork is a whole part of the entire visa process and the petitioner should be the one who puts their selfish feelings aside and performs their part in the process....to burden the beneficiary with this is unacceptable, IMO.

 

Yes give the petitioner an ultimatum....but people don't change.  It's your decision; many prospective fiances want a man (or woman) who is organized....meaning good with peperwork and dealing with rules and regulations.  Sounds like this person doesn't fit your criteria for that.

 

Don't let "love" get in the way of planning for a future together which goes above and beyond your "love" for each other. Living life and everytihing that comes with it is best handled together; it is foolish to think you can "will" your relationship to be one.

I was just wondering if I needed a waiver to include in the I-129f package for a previous denial of travel under the ESTA Visa Waiver programme. 

 

The only reason for the denial of entry was that they deemed the ESTA inappropriate and believed I should instead apply for a K1 visa. I have my signed statement and already planned to include that within the package, along with a short explanation. 

 

Also does anyone have any experience of this being a "red-flag" in the process?

Not enough.  Have them send you the complete returns (or IRS tax transcripts which are free from the IRS) for the previous two years, PLUS copies of about three recent pay summaries and then a letter from the employer stating they earn what they claim.

You two will have to prove to a total stranger, the Embassy CO, that you have a legitimate relationship and intend to immigrate to the US to live permanently and do not intend to engage in visa fraud.

 

You SHOULD purposefully generate all different kinds of evidences......so keep talking but use other mediums and methods.

 

Send emails, send letters and cards and gifts, Skype and do screenshots of the video, all kinds of evidences.

See some of Gary and Alla's posting in the RUB regional forum on some of the content that was contained in the letter his wife had to obtain.

 

Basically it must state approval to permanently immigrate and live in the US AND approval to travel back to the home country to visit and then return to the US.

 

 

This should have been vetted out and obtained prior to filing the visa; it is a requirement to allow the child to leave. 

 

Money usually helps the process.

No complete copies of the last three years' income tax filings (which will include the W2s) or the free IRS tax transcripts.

Need the same for both 134 forms, both of yours and from your mother.

Plus about three of the most recent pay summaries.

for his son to leave Ireland, even if you have custody.  Otherwise, the son will not be issued the K2 visa. If he is amenable, the easiest is to go to a solicitor together and have him sign a piece of paper stating this, and have it notarised. If the bio dad is NOT willing to do that (not even with incentives, such as you waiving child support or something...), then the only other option is to go to court, but Irish courts are unlikely to effectively remove access from one parent.

 

What's the child's age?  If near 21, then the K-2 may not be available.

 

I's advised to get this letter taken care of before you file any petition; it is a deal breaker.

My fiance and I met in October of 2012 in Thailand while I was volunteering and he was attending school. However, he is from Myanmar, and was attending a mission school (not registered in Thailand) because he is part of an ethnic minority. Therefore, he has no Thai ID of any sort. We have been in a relationship since January 2013 and engaged since 2013 and were together almost everyday from January 2013-April 2013 and then again when I returned to visit in August-October 2013. Because he is from a very rural area in Myanmar, he does not have internet or cell access. We stay in contact through phone calls through his village phone, but have no way of showing proof of that. Because it is so expensive and difficult, when I want to send something to him, I send it with a friend who is going to the area, so I have no proof of letters or gifts that way either. I have read on here that some people have 50+ pages of proof of a continued relationship. I was just wondering what I could do in this unique situation? Praying that he can be here asap so we can be together always!

 

You need to purposefully generate evidence.  Think outside the box.

I completely get that. We messed that one up bigtime!!! But we were not trying to mislead or lie, we were just trying to make our chances at success a little higher.

But your man did mislead when he applied for the tourist visa !

In 2011 your man went to the consulate to apply for a tourist visa and never mentioned you, even though visiting you was the reason for applying for the tourist visa. Doesn't matter why he did that...he misrepresented his intention to visit you.

Now in 2013 you apply for the K-1 visa and tell the Consulate that you were romantically involved since 2010, well before the time that the tourist visa was applied for.....and on that 2011 tourist visa application there is no mention of you.

In effect your man told the Consulate in 2011 that he did not know you. But now, in 2013, you tell the Consulate that you two did know each other, and were romantically involved since well before the 2011 tourist visa application. So the Consulate sees that contradiction. In 2011 he did not know you, but now, in 2013, you have been a "couple" since 2010. Does not compute.

I do not know how to fix this. I see that other posters are suggesting going for CR-1 visa and certainly that is an option, but I would consult a good immigration attorney first to find out how a previous misrepresentation (on the 2011 tourist visa application) would effect the chances of a success.

One the one hand the OP said that she started this relationship in 2010, and supplied the USCIS with evidence of this. Then one year later the fiancé applies for a visitor's visa and during this application he does not reveal that he is wishes to visit her, and instead says he is to visit someone else (in this case the USC's mother). Sounds to me like misrepresentation on the application for the fiance's visitor visa in 2011 is the main cause for denial of the K-1.

If you send it Priority Mail with tracking number (no signature necessary), then the PO Box address is fine. If, however, you send it in a way that needs a signature (Express Mail), then you need to send it to the address listed for Express Mail, since someone will be able to sign for it. Sending mail that needs a signature to a PO Box means that the USPS will leave a notice, which will delay things.
