I am quite upset with my fiancé. He finally received his documents to come to the US on the K-1 visa. In his excitement, he accidentally ripped the envelope (the very important not to open one) on the side a little. I am attaching a photo (the plastic isn't important...just the tear on the envelope. Do you think he can enter with this envelope or do we need to get a new one....

 

He has a ticket for Feb 18th. I am hoping he can still come. I don't even know what the process is for getting the documents put into a new envelope but I have heard it costs something like 400$.

 

Any info or input on this would be greatly appreciated.

What i was wondering, is it not allowed to have a farewell party/traditional event back at your Foreign Fiances country just before coming to USA for wedding?

 

Some people are clearly misunderstanding the fact between a traditional wedding type events and a real legal registered wedding. I am pretty sure USICIS Co's aren't unreasonable or stupid and if you are able to explain to them that the reason behind this event was to give last bid to his family and friends in his Country.

 

What i'd like to know what is the distinction between having a farewell party to traditional wedding to a point where it can get you denied?

 

Me and My Fiance would like to have a farewell event in his Home Country, nothing official but i will be wearing a traditional dress just for the hell of it and i was wondering if it puts our status in any kind of Danger?

 

 

Please any response and expertise in this area would be deeply appreciated.

 

 

 

And many folks seem to not understand that any type of "official-looking" wedding celebration, regardless if it is legal or not, runs them the risk of a denial of the K-1 visa.  I'm amazed at the number that try this very risky behavior.  Having a celebration dinner or party is just fine, but they want to push it further than that.  I have no sympathy to those who do so and are denied.

Yes detail one meeting.  That's all they care about, that you met at least once.  You don't get extra credit for more than one meeting.

 

Save that evidence for your proof of relationship for the interview.

I understand what should be in it, etc in terms of primary and secondary evidence. 

 

My question is, what should that part of the visa application actually PHYSICALLY look like? 

Usually like a bunch of papers of copies of emails, photos, letter describing the evolution of your relationship, etc.  Nothing stapled but usually paper clipped and/or binder clipped together.

 

My fiance and I have met ~12 times in the last two years, and we have all sorts of airline/hotel ticket stubs, email confirmations, pictures, confirmation emails, ticket reciepts for events attended, etc. 

 

Those are great for proof of having met within the last two years....don't do much about proving your relationship, just that you met a lot.

 

Do I just put everything in order and staple it together? 

Yes to the former and no to the latter.  use paper clips and binder clips.

 

Should all the same types of evidence be grouped together? 

No, it should be in chronological order and should provide proof to a total stranger that your relationship evolved over time to one where you both want to be together, forever and become married and do not wish to circumvent immigration laws.

 

Do I highlight names/dates? 

Sure

OR should I use a file folder for each meeting time and put in the appripriate evidence? 

For proof of meeting, you one need highlight ONE meeting, not all of them. People have recieved RFEs for having too many meetings and sketchy proof overall.

 

Should pictures go in plastic ziplock bags and stapled to something?

All my photos were digital.  I printed them out, about four to a page on a color printer and then added a description beneath each.  Then to another sheet of paper I had the photos rprinted out as 4X6 size and wrote the names and dates on the back and placed these into a baggie and stapled that to the blank sheet.  Then I paper clipped this to the first printed sheet.

 

HELP (lol)!   We want to do this right the first time.

The idea of planning a full-on wedding inside of 3 months of her arrival is unfortunately out of the question. 

 

OK, the option is out.

 

We were hoping to get a civil union and plan a proper wedding after she gets her permanent residency, but I have read here that a civil union will not suffice for the I-30.

 

You NEED to be legally married.  A civil union or marriage by the county judge is all it takes.  We did only that.

 

 
 How do people usually handle this?  Do they just "sign the papers" and then have a real wedding sometime in the future even though they are already married?
 
We ONLY had the county judge marriage ceremony.  We had a dinner later for the relatives and friends, never a big shing-ding.

Our biggest worry is the income situation, at the moment my fiancee in Texas works at a bar and gets her hourly rate paid on cheque but she earns most of her income from gratuity/tips and this amounts to approx $350 a week. She will be looking for a second job in the new year so this will help.

My situation is that by the time my embassy interview comes around i will have $12000 to $15000 in a saving account.

Useless to her unless you transfer that money to her bank account.  You can't sponsor yourself, she has to be able to sponsor you.

 

 

No assets but have a car.

The car is useless also unless you sell it and convert it to cash.

 

So i was wondering about the sponsor/co sponsor/self sponsor options we have ??? I will be asking a friend in Texas if he can co sponsor if we need it but i havent asked just yet.

I'd start asking.  This should be all worked out before she petitions for you, because if she can not sponsor you or doesn't have a suitable cosponsor, you'r not going to be given a visa.

 

My fiancee's situation is that she lives with her mum, dad and 2 brothers so can i ask how the minimum poverty income works on her living situation ?

 

If she is legally responsible for the other family menbers, then they are added to the household size.  If she just lives there and doesn't have any legal obligation to them, then she's single on her own.

I have two questions on the I -134, First on the I 134 form question 10  I have submitted a visa petition to USCIS on behave of the following person. I am thinking that I have to put my fiancé name  there is that correct ? and for the date submitted do they want the day I sent the I-129 F or the day they received it . Also a question as to where to send the I 134 when completed I read the instructions and could not find this , do I send to my fiancé or to the consulate. If any one can help me I would be very appreciative. We are a few weeks away from my fiance's interview at the consulate and found a potential issue. She was reviewing the copy of the 1-129F i sent her for the interview and found that under Part 2 item 4, I listed the wrong city as her birth city. 

 

Anyone have any experiences with amending information on a 1-129F at this stage? or is it even worth clarifying? Is this something she can take care of at the consulate? Will they even care about such a minor detail?

I am First timer k1 visa, my fiancé gave me the NOA2 when he got here in philippines last Nov. 10 then now i just check that our NOA 2 has validation date only until dec. 26, i am start to panic now coz i just find it out today... I went to the bank to pay my interview or visa fee they looking for the receipt number, i did not know where im going to get it? Anyone here could tell me where im going to get it? Is it the validation date could affect my interview next month (january)? What should i do?

 

The NOA2 date is meaningless in the K-1 process.  The 797 form is a used for other visa processes.  Once the NVC and then the Embassy has the case, they automatically keep the petition open without anything you need to do.

I'm in a tricky situation right now. I am currently studying for my Master's degree and had applied for the K-1 visa 3 months ago and to my fiance's and my surprise our visa processing has been progressing at a very rapid rate. My case is now with the embassy and will have my interview soon.

 

Now I know that if granted a visa I'll have to move to the US in less than 6 months.But doing this means I won't be able to finish my studies. Do you think I'll be able to extend/re-issue the visa based on this reason? If not, if I let the visa expire and then once I finish my degree I get married and apply for a spouse visa, will this cause any troubles (in the sense that I let my K-1 visa expire and based on this will I have any problems with the spouse visa?)

 

No need to let it expire.  Once issued, email the Embassy and ask them to extend it.  Most will do it for good reason, yours is one.

No you can attempt to visit but at any time you could be turned back if you don't have good ties to show that you will return to your country.

 

Shouldn't be an issue but it can be, especially once you guys file the petition, the border officers will see that in their system and have to make a decision.

 120 days after it has been returned for them to review. I am afraid they will not review it and just send me a letter that is will be revoked because our petition was approved in September of 2012 and finace visa's are only valid for 4 months.

 

That's totally false.  Once NVC or the Embassy or later USCIS has the case, they automatically extend that date, so not to worry about that.

 

I have contacted my congressman but, he was no help. What are my options should I hire an attorney and take them to court?

 

They won't be able to do much.  You need to determine why your case was returned.  Obviously considering the country, extra scrutiny is to be expected.

My fiancee and I are just starting this process. Looking at all of the information and compiling the pack has been our main focus. 
 
However, the use of an immigration lawyer has been suggested by a number of friends and family. 
 
We are both a little confused about exactly what a lawyer might be able to bring to the table. Does anyone have any experience of a lawyer helping or harming the process? Or did anyone feel it was not worth the expense?

Don't understand the reason for delaying the submittal since there is at least a 5 month wait once you do....but I'd say submit it.  You may want to obtain updated signed letters of intent and since she'll be sending you those might as well update any signatures she needs as well....then you can do the same on this end.

 

The proof of relationship is only for the interview, not the petition.

I have a NOA2 of July 26th and the Approval expires on November 25th 2013. It took one month for NVC to receive my approved petition, and It has been there for over two weeks, according to them under administrative processing...

Basically I have two months before this approval expires. If the consulate at Santo Domingo is scheduling interviews for December and January 2014 at this point, what should be done? I don't want to go there to the interview with my fiancé and voila!!! Your petition is no longer valid! 

 

Any ideas of what to expect or what could be done in case it expires before the interview date?

IN the K-1 proces, the NOA2 "experiation" date is meaningless.  As long as NVC or the Embassy has the case, it is automatically extended.  There is nothing for you to do and nothing to be worried about.

You don't get extra credit for unasked for fluff. It can slow down the process and there has been cases where it has caused confusion and led to delays.  Your adjucator will spend 15 minutes approving your petition (or creating an RFE...or denying it). Read up on how the process actually works.  Yes, after over 5 months of waiting the approval decision is made in 15 minutes.

Look....your intent to marry. This is a time for you to be heard. Your trying to sell this as a bonifide relationship, right?

Put some heart into it, put some detail into it. Dont be afraid to be a little "mushy".

There isn't the need for the beneficiary's intent to be so in-depth. "I so, and so intended to marry so, and so within 90 days of my stay in the US....blah, blah.

Petitioner...tell when/how you met. When you two fell in love. How you proposed. Got the idea?

Really...just trying to help. This advise was given to me. Our process has gone on smooth as can be.

But by all means....write it as you see fit.









 

Just follow the Example Forms.....no need to bore USCIS with your details....they really don't care about that.  Save it for the interview.

Our RFE said to provide evidence (statement) that the beneficiary intends to marry within 90 days.  Do they need one from the petitioner as well?

In our response, we submitted her statement of intent to marry within 90 days (along with other evidence) but I (petitioner) did not sign it or send my own declaration/statement of intent to marry within 90 days.  Do they need one from the petitioner as well?  The RFE just indicated they need one from the beneficiary so that's what we did.  Anyone have experience with this?

 

2nd question:  If I just take it upon myself to send one to them in the mail tomorrow, will it just be added to our packet with the packet remaining in the same place in line or will it be added to the packet and our packet will be sent to the back of the line again giving them 60 days to reply from receiving my document?

 

Anyone have experience with this?  We are at CSC.  Thank you in advance!

 

Yes letters of Intent are required per the129f instructions and are clearly itemized in the Guides.

Yep.  You erred in filing the petition without meeting in person.  You lost your fee and now just refile with a new fee enclosed.
